RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to
execute for and on 'behalf of the City of Lubbock, Amendment No. 1 to that certain
Professional Services Agreement by and between the City of Lubbock and Pavetex
Engineering & Testing, Inc., and related documents. Said Amendment is attached hereto
and incorporated in this resolution as if fully set forth herein and shall be included in the
minutes of the City Council.

AMENDMENT NO.1
TO PROFESSIONAL SERVICES AGREEMENT
CITY OF LUBBOCK, TEXAS
AND
PAVETEX ENGINEERING & TESTING, INC.
FOR SANITARY SEWER TRENCH EVALUATION AND REMEDIATION PROJECT
98TH STREET -ALBANY AVENUE TO HURON AVENUE.
PROFESSIONAL SERVICES FOR: 98" Street sanitary sewer trench evaluation form Albany Avenue to
Huron Avenue.
THIS IS AN AMENDMENT TO THE AGREEMENT dated April 19, 2010 and entered into by and between
the CITY OF LUBBOCK, TEXAS, hereinafter called "Client," and PAVETEX ENGINEERING & TESTING, INC,
hereinafter called "Consultant," of 12804 County Road 2500, Lubbock, Texas. The original Agreement
was approved by the City Council action on April 19, 2010, Resolution No. 2010-R0188.
The purpose of this amendment to the agreement is to extend the scope of work to include: additional
geotechnical investigation from Albany Avenue to Huron Avenue; extend the project limits to include
geotechnical investigation along 981h street from Huron Avenue to Justice Avenue; additional surveying,
and extend scope to include landscape design. The original scope of the project required the Consultant
to determine the extent of the subsidence concerns occurring between Albany Avenue and Huron
Avenue along 98th street. Additional geotechnical investigations will include:
Provide geotechnical reports to determine the stability of the first tier homes along the south side of
98th Street between Huron Avenue and Justice Avenue. A total of 4 borings per house will be drilled to
verify if the first tier houses were affected by the construction of the sanitary sewer line.
Provide geotechnical reports to determine the stability of the second tier homes along the south side of
98th Street between Albany Avenue and Huron Avenue. A total of 4 borings per house will be drilled to
verify if the Second tier houses were affected by the construction of the sanitary sewer line.
Provide video of approximately 1000' linear feet of the sanitary sewer line to ensure the sanitary sewer
line has not been damaged by the consolidating soil surrounding the line.
Provide metes and bounds description of 3 parcels and additional horizontal surveying that was not
included in the original agreement.
The Client has requested the Consultant include design of landscaping a "green -way" for the lots that
will have the homes removed.
The additional scope of work and associated additional contract cost is addressed further in the
attached Attachment A to this Amendment No. 1.
This amendment No. 1 will add $293,305.00 to the not to exceed amount payable for this project, thus
increasing the not to exceed amount payable from $769,945.00, and establishing a new not to exceed
amount payable for this contract at $1,063,250.00. The added cost is necessary to compensate the
Consultant for the additional scope of work requested by the Client in order to verify the construction of
the sanitary sewer line has not affected any homes along the south side of 98`h street between Albany
Avenue and Justice Ave.
All other portions of the original Agreement shall remain in place and are not altered by this
amendment.

W' Street Sanitary Sewer Trench Remediation
Additional studies have been requested by the Client, and will be used to determine if
construction of the sanitary sewer line has impacted the stability of the residences.
Geotechnical Reports — First Tier Lots
First tier home sites along 98t' Street, including first tier houses between Huron Avenue and
Justice Avenue, need to be explored for possible concerns related to the construction of the
sanitary sewer line. A letter report will be provided to the Client stating the soil conditions
encountered and whether those conditions are related to the construction of the sanitary sewer
line or they are in-situ soil conditions. The additional testing to verify these first tier homes
include:

Concerns from residences located in the second row of homes south of 981h Street have
occurred; additional testing will verify that the homes have not been affected by the excavation
of the sanitary sewer line. Verification will comprise four borings to a depth of 30 feet. Two
borings will be conducted approximately 20 feet north of the home and two borings 70 feet north
of the home. Standard Penetration Tests (SPTs) will be conducted to determine relative
consistency of soil conditions. A letter report will be provided to the Client stating the soil
conditions encountered and whether those conditions are related to the construction of the
sanitary sewer line or they are in-situ soil conditions. The additional testing to verify the second
tier homes between Albany Avenue and Huron Avenue include:

Determine Limits of Excavation
Additional testing to determine if the full depth remediation of the sanitary sewer line does not
need to continue west of Huron Avenue includes:
• 98th and Iola Avenue - 2 borings from 20 to 30 feet (one on sewer line and one close to
the ROW line south of 98th Street.)
• 981h and Juneau Avenue ----2 borings from 20 to 30 feet (one on sewer line and one
close to the ROW line south of 98th Street.)
• 98th and Justice Avenue ----2 borings from 20 to 30 feet (one on sewer line and one close
to the ROW line south of 98" street.)
• 98th and Ironton Avenue ----2 borings from 20 to 30 feet (one on sewer line and one close
to the ROW line south of 98th street.)
Additional Testing to confirm full depth remediation between Frankford Avenue and Genoa
Avenue has been remediated includes:
• 4 borings to 20 feet (two borings on sewer line and two close to the ROW line south of
98th Street)
Additional testing in 9$`h Street and Frankford Avenue intersection to verify original limits of jack
and bore includes:
• Seven borings to 20 feet throughout the intersection.
The borings are drilled with a truck mounted drill rig and support vehicle. The borings extend to
depths varying from 20 to 30 feet below ground surface (bgs). The relative density/consistency
of the soil was determined in general accordance with the use of the Standard Penetration Test
(SPT) (ASTM D 1586).
Groundwater observations will be made in each boring and samples recovered during the field
exploration program are visually logged in the field. Samples are sealed in plastic to reduce
moisture loss and delivered to the laboratory for testing. Laboratory tests included moisture
content, the percent passing the #200 sieve and Atterberg limits. These tests are used to
classify the soils in accordance with the Unified Soil Classification System (ASTM D 2487).
Provide Video Footage
Video footage of the sanitary sewer line has been requested by the city to ensure that the
pipeline has not been damaged by the consolidating soil surrounding the pipe. The camera will
record footage from inside the pipe for approximately 500 feet east to 500 feet west of the
manhole at 98th and Elkhart.
Provide Additional Surveying
Acquire meets and bounds on three parcels of land along the south side of 98th street and
Frankford Avenue.
Provide Landscape Design
The landscape plan will include such elements as turf, irrigation, plants, trees and a screening
fence. The additional scope will include several meetings with the Park Department personnel
to determine the design details.
The following tables detail the additional contract cost for geotechnical investigation, field survey
and landscape design that will be done outside the original scope of work.
