RESOLUTION
WHEREAS, the City of Lubbock affirms a strong commitment to open
government and good governance based on the essential tenants of accountability,
transparency, accessibility, and responsiveness in government; and
WHEREAS, the City of Lubbock, by and through the City Council, enters into
contractual relationships with various individuals, entities, vendors, and other service
providers on a routine basis for the public good; and
WHEREAS, in the course of formulating and negotiating the contracts and other
agreements and instruments underlying these relationships, the City of Lubbock to the
fullest extent possible should strive to maintain a bargaining position that maintains the
best possible outcome for price, value, terms, and conditions that are to be contained in
said documents; and
WHEREAS, the City of Lubbock and its residents are served most responsibly
and most transparently when the City Council and the public are fully informed as to the
express terms and conditions of any agreement or other instrument under consideration
by the City Council, with the City Council and the public having had ample opportunity
to review in advance all associated documents, thereby ensuring that the City Council has
adequate time to perform its proper due diligence and to maintain its fiduciary
responsibility; and
WHEREAS, except in emergency and other extraordinary instances, the City
Council of the City of Lubbock deems it in the best interest of open government, and
essential to the integrity of the contracting process to require that contracts and associated
documents to be considered by the City Council to be presented for inspection in final
form for a set minimum period of time not less than seventy-two hours; NOW
THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT unless waived by the Mayor for urgent necessity, or where there is an
urgent public necessity where a meeting of the Lubbock City Council has been called
pursuant to applicable state law, City Council shall consider no contract, agreement, or
other such instrument unless it shall be presented in completed form, subject to
amendment by City Council consistent with City Council policy and procedure, not later
than seventy-two hours prior to the meeting at which the item is posted for consideration.
