Said Amendment is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. December 20, 2010 Resolution No. 2011-R0013 AMENDMENT No. 1 TO PROFESSIONAL SERVICES AGREEMENT This Amendment No. 1 to Professional Services Agreement ("Amendment") is entered into this 13th day of January, 2011, by and between the City of Lubbock (the "City"), a Texas home rule municipal corporation, and HDR Engineering, Inc. (the "Engineer"), a Nebraska corporation. WITNESSETH WHEREAS, the City and Engineer entered into a certain Professional Services Agreement, dated June 23, 2009, Resolution No. 2009-RO238 (the "Original Agreement"), wherein the City contracted with Engineer to perform activities related to the planning, evaluating, permitting, designing, constructing, and inspection of reservoirs and dams; WHEREAS, it has come to the attention of City and Engineer that Phase 2 activities in the scope of services of the Original Agreement are no longer desired by the parties; and WHEREAS, the City and Engineer now desire to amend the Original Agreement to substitute a revised scope of services that contemplates related, but originally unanticipated, work. NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the City and Engineer agree as follows: 1. The attached "Amended Phase 2 Scope of Services, Task List, Proposed Schedule, and Fee Estimate" is substituted for all Phase 2 Tasks, Summary of Deliverables, and Project Schedule items listed and otherwise contained in Exhibit "A" to the Original Agreement, in relevant and corresponding part. 2. The attached "Amended Phase 2 Scope of Services, Task list, Proposed Schedule, and Fee Estimate" is substituted for all Fees and Compensation items specific to Amendment No. 1 to Professional Services Agreement City of Lubbock and HDR Engineering, Inc. Pagel of3 Phase 2 that are scheduled and otherwise contained in Exhibit `B" to the Original Agreement, in relevant and corresponding part. 3. The Hourly Rate Schedule contained in the Original Agreement remains the same for the attached "Amended Phase 2 Scope of Services, Task List, Proposed Schedule, and Fee Estimate" to the extent a fee schedule shall be required to calculate fees in connection with the revised Phase 2 activities. 4. All summaries, tasks, schedules, fees, deliverables, and other information specific as to "Phase 2, Physical Inspections of McMillan & Ransom Canyon Dams" listed or otherwise contained in Exhibits "A" and `B" of the Original Agreement are deleted and of no further force and effect; provided, however, that provisions contained in Exhibit "A" of the Original Agreement as to "Additional Services and Detailed Investigations" are retained inasmuch as said services and tasks may reasonably be applied to the substituted dams and projects set forth in the "Amended Phase 2 Scope of Services, Task list, Proposed Schedule, and Fee Estimate." 5. Except as amended hereby, all terms and conditions of the Original Agreement shall remain valid and subsisting as originally provided. Page 3 of 3 Resolution No. 2011—R0013 Amended Phase 2 Scope & Fees Page 1 Amended Phase 2 Scope of Services, Task List, Schedule, Fees and Compensation City of Lubbock, Texas John T. Montford Dam and Existing Small Dams Breach Analyses and Inundation mapping Introduction According to Title 30 of the Texas Administrative Code (TAC), Chapter 299, Dams and Reservoirs, 299.61(b), all owners of significant and high hazard dams are required to submit an Emergency Action Plan (EAP) to the Texas Commission on Environmental Quality (TCEQ) by January 1, 2011. Accordingly, the City of Lubbock (City) had requested from TCEQ information on dams owned by the City that are listed in the TCEQ database. Based on the dam information provided, three City of Lubbock dams are classified as either significant or high hazard and require an EAP. These dams are listed in the table below with Texas Dam ID numbers. Each EAP will require a breach analysis and inundation mapping. Per TCEQ rules and guidelines, the "simplified" dam breach analysis may be used for existing small or intermediate dams, and the "full" dam breach analysis is required for all large dams. The City of Lubbock will be preparing an EAP for each dam. The City has requested that HDR prepare a proposal to perform the dam breach analyses and inundation mapping that is required for each EAP and coordinate with the City the information from the breach analyses for each dam EAP document. In addition, the City has requested a physical inspection of John T. Montford Dam (Lake Alan Henry). The City has requested that HDR prepare a proposal to perform the dam breach analyses and inundation mapping that is required for each EAP and coordinate with the City the information from the breach analyses for each dam EAP document. In addition, the City has requested a physical inspection of John T. Montford Dam (Lake Alan Henry). The Scope of Services and Fees are as follows: Amended Phase 2 Scope & Fees Page 2 Task 1 Dam Breach Analysis and Inundation Mapping HDR will perform dam breach analyses and inundation mapping in accordance with TCEQ Dam Safety Guidelines for the dams listed above. Task 1.1 John T. Montford Dam 1.1.1 Review previous hydrologic and hydraulic (H&H) analyses performed, if available at TCEQ Central Records. 1.1.2 Perform site visit to verify hydrologic and hydraulic parameters, dam and spillway configuration and geometry, and downstream development and damage points. 1.1.3 Develop Hydrologic and Hydraulic (H&H) model of the watersheds for the dam, and perform a probable maximum precipitation/flood (PMP/PMF) analysis. The U.S. Army Corps of Engineers HEC -HMS or HEC -1 computer model will be utilized to determine peak inflows to the reservoir and outflow from the dam for the PMF event. A previous PMF analysis was performed in the late 1990's for Lake Alan Henry. Hydrologic model information from that previous analysis will be adopted and used for this analysis. The standards utilized at the time of the previous analysis were somewhat more stringent than the current standards promulgated in the January 2007 TCEQ "Hydrologic & Hydraulic Guidelines for Dams in Texas" document. Therefore, the results from an analysis incorporating the previous work will be more conservative and will be acceptable to TCEQ for use in an EAP. If the model data from the previous PMF analysis cannot be obtained in a useable form or are inappropriate for use in this analysis, HDR will notify the City that a new model needs to be developed. Development of a new PMF model will constitute additional services and is not part of this scope. Hydraulic modeling for the spillway discharge rating curve will be developed using data from the existing PMF model, and elevation and dimension information obtained from record drawings or survey data, if available, will be used to confirm the previous analysis. The stage -storage relationship for the conservation pool of the reservoir (up to elevation 2,220 feet) will be determined from the volumetric survey of the reservoir completed by the TWD13 in 2005. The stage -storage relationship for the flood pool above 2,220 feet will be computed using the best available data, which may be from reservoir record drawings, the existing PMF analysis, or USGS 1:24,000 scale topographic maps. If spillway data are not available, a field survey will be required to determine the total spillway capacity. Field surveys will be considered additional services and are not part of this scope. 1.1.4 Evaluate the hydraulic adequacy of the dam with respect to current TCEQ hydrologic criteria for existing dams to determine if modifications will be necessary to safely pass the design flood. Amended Phase 2 Scope & Fees Page 3 1.1.5 Perform breach analyses of the dam in accordance with the January 2007 TCEQ "Hydrologic & Hydraulic Guidelines for Dams in Texas" document. The breach analysis will be performed using the TCEQ full breach method in conjunction with the computed design flood hydrology from Task 1.1.3. The dam breach and unsteady -state flow capabilities within HEC -RAS will be used for dam breach and hydraulic modeling and inundation mapping. Two dam failure scenarios will be evaluated as required by TCEQ guidance; 1) sunny -day, and 2) design flood or barely overtopping breaches. The hydrologic model developed under Task 1.3 will be used to provide the PMF inflow hydrographs. Topographic data for the breach hydraulic modeling will be obtained from USGS 1:24,000 scale topographic maps, unless more accurate mapping is available. Flood profile water surface elevations will be computed with HEC -RAS. Roughness coefficients for the HEC -RAS model will be developed from aerial photography and field reconnaissance. The HEC-GeoRAS software for ArcGIS® will be used to map inundation extents based on the water surface elevations computed. 1.1.6 Prepare a draft and final report for the flood hydrology and hydraulic modeling and breach analyses. This report will detail the various methodologies used for computing rainfall distribution, initial losses and infiltration, unit hydrograph development, and flow routings. The stage - storage relationship for the lake, as well as the stage -discharge ratings for the spillways, will be presented in tabular and graphical format. Inflow and outflow hydrographs will be prepared for the design flood event. Breach methodology and parameters and maps of inundated areas downstream of each dam will also be included. The inundation maps will be provided to the City for inclusion as an appendix to the EAP. 1.1.7 Coordinate dam breach results and inundation mapping information with the City for use in the EAP for the dam. 1.1.8 Review the draft EAP developed by the City and provide review comments to the City. Task 1.2 Existing Small Dams Except as noted otherwise below, the following dam breach analyses and EAP preparation tasks will be performed for the two existing small dams: 1.2.1 Perform site visit to verify parameters, dam and spillway configuration and geometry, and downstream development and damage points. 1.2.2 Perform breach analyses of each dam in accordance with the January 2007 TCEQ "Hydrologic & Hydraulic Guidelines for Dams in Texas" document. Amended Phase 2 Scope & Fees Page 4 Breach analyses will be performed using the TCEQ simplified breach method. The simplified TCEQ discharge equations will be used along with steady-state HEC -RAS hydraulic modeling for the simplified breach analyses and inundation mapping. Topographic data for the breach hydraulic modeling will be obtained from USGS 1:24,000 scale topographic maps, unless more accurate mapping is available. Water surface elevations will be computed with HEC -RAS. Roughness coefficients for the HEC -RAS model will be developed from aerial photography and field reconnaissance. 1.2.3 Prepare a draft and final report for the breach analyses. This report will describe the breach methodology and parameters and maps of inundated areas downstream of each dam. The inundation maps will be provided to the City for inclusion as an appendix to the EAP. 1.2.4 Coordinate dam breach results and inundation mapping information with the City for use in the EAP for each dam. 1.2.5 Review the draft EAP developed by the City for each dam and provide review comments to the City. I Task 2 Inspection of John T. Montford Dam HDR performed an inspection of John T. Montford Dam on June 21-22, 2005, prior to transfer of ownership of the project from the Brazos River Authority to the City. The purpose of the inspection was to determine if there were any pre-existing conditions that could threaten the safety of the dam or lead to major capital expenditures or increased operations and maintenance costs. HDR's report on this inspection is dated August 9, 2005. The City has requested that HDR perform a 5 -year follow-up inspection and prepare a report documenting findings of the inspection. HDR proposes the following Scope of Services to accomplish this objective: 2.1. Review existing project information including plans and specifications, as - built drawings, photographs, previous inspection reports, instrumentation data and reports, operation and maintenance (O&M) records, and emergency action plan. The City shall make these items available to HDR for review at the Project office the day prior to the inspection. 2.2. Prepare inspection plan and checklist; 2.3. Perform detailed, on-site visual inspection of dam and appurtenant structures; 2.4. Obtain photographic documentation of the inspection using a digital camera having a resolution of 5 mega -pixels or higher. Amended Phase 2 Scope & Fees Page 5 2.5. Prepare site plan drawing to serve as key map showing the location and orientation of inspection photographs; 2.6. Review and make recommendations for updating the existing O&M manual for the dam and appurtenant structures; 2.7. Develop recommendations for instrumentation monitoring and data collection frequency; 2.8. Prepare a prioritized list of action items with recommended timeframes for addressing each item; 2.9. Prepare Draft Inspection Report for City review. Provide two (2) copies of Draft Report in black & white. 2.10. Finalize Inspection Report after receiving City's review comments. Provide three (5) copies of Final Report in color. Provide electronic `PDF' file of report and all inspection photographs on a CD. 2.11. A professional engineer registered in the state of Texas shall seal the Draft and Final Inspection Reports. Specific tasks that are not a part of this Scope of Services include, but are not necessarily limited to, the following: A. Geotechnical investigations and analyses; B. Surveying; C. Underwater inspections; D. Inspection of confined spaces, such as intake towers, deep manholes and outlet conduits; E. Obtaining current readings of instrumentation devices; F. Failure mode analyses and risk assessment; G. Preparation of Emergency Action Plans; and H. Design of dam or spillway improvements. Montford Dam 60 FEES AND COMPENSATION Fees (including per diem) for the Proposed Scope of Services are provided below. These estimates are based on HDR's current understanding of current data availability and of each dam without site visits or meetings with TCEQ Dam Safety Program staff. Task 1— Dam Breach Analysis and Inundation Mapping Task 1.1 — John T.
