RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to
execute for and on behalf of the City of Lubbock an Amendment to the Agreement between the
City of Lubbock and Asplundh Tree Expert Company to perform tree trimming services. Said
Amendment is attached hereto and incorporated in this Resolution as if fully set forth herein and
shall be included in the minutes of the City Council.

AMENDMENT
This Amendment to the Agreement is entered into by and between the City of
Lubbock, a Texas home rule municipal corporation (hereinafter referred to as the "City")
and Asplundh Tree Expert Company (hereinafter referred to as "Contractor").
WITNESSETH:
WHEREAS, the City desired to obtain tree trimming services;
WHEREAS, the Contractor has the expertise, manpower and equipment to
perform tree trimming services;
WHEREAS, the City and the Contractor have entered into an agreement executed
March 11, 1999 (Resolution No. 6224) (the "Agreement"); and
WHEREAS, it is the desire of the City and the Contractor to amend the terms of
the Agreement by amending and/or adding certain sections of the Agreement;
NOW THEREFORE:
BE IT RESOLVED BY THE CITY AND THE CONTRACTOR AS FOLLOWS:
The parties hereto desire to amend certain portions of the Agreement entered into
by and between the City and the Contractor on the 11th day of March, 1999, (Resolution
No. 6224) as is set out in detail hereafter.
1. Article IV. Scope of Work, Section 2 (b) shall be deleted and replaced in
it's entirety with the following:
"b. (i). The CONTRACTOR agrees to furnish written notice to each
property owner and public authority having ownership or control over
each tree to be trimmed or removed and/or all property to be cleared or
sprayed. Such notice shall be given at least ten (10) business days before
work is to commence and at the minimum, provide the following
information:
A. The date in which the notice was issued;
B. A summary of the work to be conducted by the Contractor;
C. A contact number and address for the benefit of the property
owner and/or public authority; and
D. The utility on whose behalf the Contractor is performing the
work.
A guideline for such written notice is attached hereto and incorporated
herein as though set forth fully herein as "Exhibit 1."

(ii). The Contractor shall obtain written permission from the property
owner and/or public authority having control over the property for all
trimming greater than the 10 ft. minimum specified in Article IV (3) of
this Agreement. The Contractor shall obtain written permission from the
property owner and/or public authority having control over the property
for all tree removals located on private property but whose growth is
interfering with the City's power lines, right-of-ways or substation areas."
