RESOLUTION
WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in
Lubbock County, Texas, has determined and does hereby determine that the public
needs, safety and welfare demand and create a public necessity for the acquisition of
additional land for municipal public use and purposes, to -wit: for realignment of
Avenue O and Avenue P at 3'd Street in conjunction with the Marsha Sharp
Freeway and the City Council of said City finds it in the public interest and for public
purposes and municipal purposes to proceed with the acquisition of lands as needed for
such purposes as aforesaid; NOW THEREFORE:
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the fee simple title to the tracts of land further described in
Exhibit "A", Exhibit "B", Exhibit "C", and Exhibit "D" attached hereto, be
acquired for public purposes and municipal purposes as set forth in the preamble
hereof.
SECTION 2. THAT the owner of said tracts, being Falcon Steel Company,
BE offered through the Right -of -Way Department of the City of Lubbock the amount of
$123,700.00 which is the amount appraised as the value and total damages for the fee
simple title and acquisition of said real estate purposes herein stated, and unless
accepted forthwith, the City Attorney of said City of Lubbock is hereby authorized and
instructed to institute condemnation (eminent domain) proceedings to acquire the fee
simple title.

Richmond Second Addition to the City of Lubbock, Lubbock County, Texas as conveyed to
Falcon Steel Co. and recorded in Volume 1037, Page 596 of the Deed Records of Lubbock
County, Texas, which said 0.04 acres (1,739 square feet) of land is more particularly described as
follows;
BEGINNING at a 1-1/2" iron rod, found for the Southwest corner of said Lot Eight (8), Block
Nine (9), Richmond Second Addition and in the existing East right-of-way line of Avenue "P" and
in the existing North right-of-way line of Third Street, for the Southwest and beginning corner of
this parcel;
(1) THENCE North 02°21'26" East, along -the West line of said Block Nine (9), Richmond
Second Addition and the existing East right-of-way line of Avenue '7% 113.05 feet to a 1/2" iron
rod with cap, set for the Northwest corner of this' parcel;
(2) THENCE South 87°36'37" East, along the proposed East right-of-way line of Avenue
"P", 3.36 feet to a'/z" iron rod with cap, set for the Northeast corner of this parcel;
(3) THENCE Southeasterly along the arc of a curve to the left and along the proposed East
right-of-way line of Avenue "P", an arc distance of 121.21 feet to a '/2" iron rod with cap, set in
the South line of said Lot Eight .(8), Block Nine (9), Richmond Second Addition and in the
existing North right-of-way line of said Third. Street for the Southeast cornier of this parcel, said
curve has a radius of 187.50 feet, a central angle of 37°02'18", and a chord that bears South
16"07147" East with a distance of 119.11 feet;
(4) THENCE North 87°45'41" West, along the South line of said Lot Eight (8), Block Nine
(9), Richmond Second Addition and in the existing North right-of-way line of said Third Street,
41.13 feet to the P.O.B., -of which contains an area of 0.04 acres (1,739 square feet).

feet of land is more particularly described as follows:
