A CORRECTIVE ORDINANCE ABANDONING AND CLOSING A STREET ��
LOCATED IN SECTION 42, BLOCK AK, ROLLING PLAINS ADDITION, LUBBOCK r�'
COUNTY, TEXAS, ALONG YUMA AVENUE BETWEEN 32N° STREET AND 34T" �; o
STREET, WHICH PROPERTY IS MORE PARTICULARLY DESCRIBED 1N THE BODY ��
OF THIS ORDINANCE; DIR�CTING THE CITY ENGINEER TO MARK THE �
OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND
CLOSING; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; �
AND REPEALING ORDINANCE 2025-O0097, THAT IN ERROR DESCRIBED THE �
ABONDONMENT AND CLOSING INTENDED THEREBY, AND DIRECTING THE
CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ■�
REPEAL. �

WHEREAS, the City Council finds that the RIGHT-OF-WAY hereinafter described �
in the body of this Ordinance is no longer needed for public use; and it would be in the public =
interest to close, vacate and abandon the same for public use; and —
WHEREAS, the City Council previously enacted Ordinance No. 2025-O0097 that
incorrectly described and depicted the street property intended to have been abandoned and
closed thereby; and
WHEREAS, the City Council now desires to take further corrective action to abandon
and close the intended real property, and repeal the ordinance previously enacted in error;
NOW THEREFOIZE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK:
SECTION 1. THAT the streets as hereinafter described shall B� and the same is
hereby closed, vacated and abandoned for public use, such area being more particularly
described in the attached Exhibit "A".
SECTION 2. THAT the City Engineer is hereby authorized and directed to mark the
official maps of the City of Lubbock to reflect said abandonment and closing, showing the
number of this Ordinance and the date of its final passage.
S�CTION 3. THAT' should any section, paragraph, sentence, phrase, clause or word
of this Ordinance be declared unconstitutional or invalid for any reason, the remainder of this
Ordinance shall not be affected thereby.
SECTION 4. THAT the City Secretary of the City of Lubbock is hereby authorized
and directed to cause publication of the descriptive caption of this Ordinance as an alternativc
method provided by law.
S�CTION 5. THAT Ordinance 2025-O0097, September 9, 2025, a copy of which is
attached hereto as Exhibit "B", is hereby repealed, and the City Engineer is hereby
authorized and directed to take all actions necessary, including making the off cial maps of
the City of Lubbock to reflect said repeal, showing the number of this Ordinance, and the
