RESOLUTION
BE IT RESOLVED BY THE CITY CO[JNCIL OF THE CITY OF LUBBOCK:
THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute
for and on behalf of the City of Lubbock, Change Order No. 5 to that certain Contract No.
17341, by and between the City of Lubbock and ACME Electric Company, and related
documents. Said Change Order No 5 is attached hereto and incorporated in this resolution as if
fully set forth herein and shall be included in the minutes of the City Council.

"Change Order" means a HTitten order to a Contractor, executed by the Owner, in accordance with the Contract authorizing an addition to, deletion
from, or adjustment or revision of the requirements of the Contract documents, or an adjustment to the compensation payable to the Contractor, or to
the time for perforrr►ance of the Contract and completion of the project, or a combination thereof, which does not alter the nature of project and is an
integral part of the project objective. Adjustments to "Estimated Quantities" to a line time in a Unit Price Contract do not require a Change Order. All
work that alters the nature of the construction or that is not an integral part of the project objective must be let out for public bid.

1. PCO # 008 - An existing panel serving the Southwest Airlines gate services was unknown and not identified to be refed in
the bid documents. This item refed the existing panel from the new main switchboard to maintain power to the area.
2. PCO #009 - Additional panels were requested by the airport to be included as part of the project scope to replace existing
agedloutdated panels and motor control centers that were at the end of their useful service life. This item provides new
panels to be able to extend the life of the existing systems. This item will also add 276 calendar days to the construction
duration to procure and install new panel equipment. New Substantial completion date will be March 16, 2026.
3. PCO #O10 - An existing panel RU-3 was unknown and needed to be reconnected to the new switchgear panel USA-1 to
maintain power to the systems fed from RU-3.
Where the Change Order is negotiated, the Change Order must be fully documented and itemized as to costs, including material quantities, material
costs, taxes, insurance, employee benefits, other related costs, profit and overhead. Where certain unit prices are contained in the initial Contract, no
deviations are allowed in computing negotiated change order costs.
ITEMIZED COSTS MUST BE FULLY DOCUMENTED AND ATTACHED TO THIS FORM.

Engineer's Response
The SWA 400A panel should be integrated into the new main switchboard
MSB-1. See sketch below. The existing 400A panelboard shall be fed from
the spare 400A circuit breaker, and new 400A feeders. Existing feeders
may be reused provided they do not need to be spliced and extended.
Existing Feeders could not be reused. Attached PCO reflects the new feeder required for the
panel.
Architect / Enqineer's Response:
New feeders proposed cost will be incorporated into next change order, Change
Order #5.

Acme Electric would like to request an additio al 276 d s to be added to the contract time.
Shut Down Delay: 21 days
1. 4/10/2025 — Key player for airport could not be on hand. Shutdown had to be pushed
to the next week. Acme's Superintendent indicated that even though the shutdown was
only pushed for a week, the impact was really 3 weeks. This was due to the prep work
going into a major shutdown being a week's worth of work and losing a week working
on other non-shutdown related tasks.
Pricing Request #2 — Additional MCCs and Panels:
1. Approval — 21 days? This can go along with the shutdown time extension
2. Submittals — 30 days
Equipment Lead Times. 26 weeks was indicated by supplier, but I've seen orders being
pushed back weeks, even months. I would like to cover ourselves and request 30
weeks. — 210 days
4. Complete shutdowns — 45 days

Contract Document Clarification/Suqplement Description:
As shown in the attached drawings, provide proposal to replace eight existing panel boards and motor
control centers. Provide individual pricing for each panel board replacement as well as combined price
to replace all eight panel boards as one lump sum amount.
