HomeMy WebLinkAboutResolution - 2024-R0261 - Canvassing May 4, 2024 Special Election, Pertaining To A Citizen-Led Proposition - 05/14/2024Resolution No. 2024-RO261 Item No. 7.4 May 14, 2024 RESOLUTION A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE RESULTS OF THE SPECIAL CITY ELECTION HELD MAY 4, 2024. WHEREAS, an election was held in the City of Lubbock on the 4ch day of May, 2024, for the purpose of submitting a proposition pertaining to the adoption or rejection of a proposed city ordinance pursuant to the initiative provisions of the Lubbock City Charter; and WHEREAS, it is hereby found and determined that notice of the election was duly given in the form, manner and time required by law, and said election was in all res:)ects lc> ill} held and conducted in accordance with the Lubbock City Charter and applicable lav,-� o f ;:1C State of Texas governing the calling and governing of such election; and WHEREAS. the returns of said election have been duly and legally made and s.ibmitted to the City Council for canvassing, and a tabulation of the returns for each polling place and for early voting, as canvassed and tabulated by this governing body and shown in Exhibit A attached hereto, reflect that the sum of precinct vote totals "FOR" and "AGAINST" such adoption of such ordinance are as follows: PROPOSITION THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK SHALL BE AMENDED BY ENACTING AN INITIATIVE ORDINANCE CREATING "FREEDOM ACT LUBBOCK" INCLUDING MEASURES TO REDUCE ENFORCEMENT OF LOW-LEVEL MARIJUANA OFFENSES. VOTES FOR: 11,262 VOTES AGAINST: 20.563 TOTAL VOTES CAST IN ELECTION: 31,825 NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK, TEXAS: SECTION 1. THAT all of the recitals contained in the preamble of this Resolution are found to be true and are adopted as findings of fact by this governing body as part of its decision. SECTION 2. THAT it is further found and determined that the results of the election are as canvassed and tabulated in the preamble hereof and in Exhibit A attached hereto, and, a majority of the electors voting at said election having voted against the proposition, the City Council hcruby �:cclares the result of the Special City Election to be that said ordinance is not adopted.
