HomeMy WebLinkAboutResolution - 2024-R0055 - Final Report, Amortization And Strategic Downzoning Study Committee (ASDSC) - 01/23/2024Resolution No. 2024-R0055 Item No. 7.2 January 23, 2024 RESOLUTYON WHEREAS, the City Council of the City of Lubbock (the "Council") created a committee on October 24, 2023 through Resolution No. 2023-R0532, later named the Amortization and Strategic Downzoning Study Committee (the "Committee"), for the purpose of considering several zoning matters within the City of Lubbock; WHEREAS, the Committee was tasked to deliver a final recommendation of its findings to the Council no later than the second regular council meeting in March of 2024; WHEREAS, at the Committee meeting on January 3, 2024 the Committee discussed and voted to make final recommendations to Council regarding zoning matters under the Committees review, said recommendations are attached as Exhibit "A" and incorporated herein; and NOW, THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the final recommendations of the Committee are hereby received by the City Council. Said recommendations are attached hereto and incorporated within this Resolution as if fully set forth herein and shall be included in the minutes of the City Council. Rece�pt of ASDSC final report 1.524 bbo'c k TEXAS DATE: January 23, 2024 TO: The Honorable Mayor and City Council of the City of Lubbock FROM: Thomas Parker, Chairman, Amortization and Strategic Downzoning Study Committee SUBJECT: Final Recommendations On October 24, 2023, the City Council approved the creation of a seven -member citizen committee with three general charges: to study the concept of amortization as a tool for possible incorporation in the C`.ty of Lubbock Unified Development Code, to assess the extent and negative effect, if any, of abandoned :r, l istr�al blight or underutilized properties on nearby residents, and whether to use strategic downzoning as a stratc<'� or tool. On November 7, 2023, the Mayor and Councilmembers each appointed one citizen to the Committee. The Amortization and Strategic Downzoning Study Committee (ASDSC) convened four '.lines in public forum. These meetings occurred on November 17, 2023, December 4, 2023, December 18, 2023, and January 3, 2024. The Committee's recommendations are as follows: 1. Recommend the City Council take no action on the item of amortization • Approved by a vote of 3-2-0 Texas Senate Bill 929 (SB 929), currently allows the City to use amortization. Since SB 929 already allows amortization, there is no reason to add language to the Unified Development Code regarding amortization, which could potentially conflict with state law. The Committee's charge was to recommend whether or not City Council should use amortization. Their recornmendation is the City take no action on the topic of amortization. 2. Recommend that City staff move forward with the CEP to conduct a Zoning Map Analysis • Approved by a vote of 5-0-0 There are properties that may have 'tiappropriate zoning, or zoning that is of a higher intensity than the existing use, where it may be appropriate to rezone to a more restrictive zoning district. If a business that is legally operating within its current zoning district is re7.oned to a more restrictive district, making the existing use non- conforming, the business will be aI],jvr�xi to continue in perpetuity, provided it does not cease operating for a continuous period of more than i I munths.
