HomeMy WebLinkAboutResolution - 2023-R0370 - Grant Amendment, Texas Parks And Wildlife - 07/25/2023Resolution No. 2023-R0370 Item No. 5.26 July 25, 2023 RESOLUTION BE TT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock, a grant amendment between the City of Lubbock and the Texas Parks and Wildlife Department, to remove a grant encumbrance regarding certain property as described in Exhibit "A" attached hereto, by and between the City of Lubbock and the Texas Department of Transportation, and related documents. Said Agreement is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. The political subdivision (sponsor) and the State of Texas, in mutual consideration of the promises made herein and in the fund agreement of which this is an amendment, do promise as follows: To remove the grant encumbrance from the identified portion of the Youth Sports Complex as the first part of a Conversion with Delayed Replacement, as referenced in the 01/25/08 Texas Local Park Grants Programs Manual Chapter 675.9 Section 3.C. The portion of land being converted is 39.440 acres, as identified in the TPWD-approved appraisal and survey and is located on the southernmost border of the park, adjacent to Hwy 1585/CR 7400/130th Street. The land will be impacted by Texas Department of Transportation road widening as well as the City of Lubbock's desire to create state highway frontage commercial development. This Amendment and subsequent Conversion apply to grant projects 20-000099, 20-000135, 50-000303, as they all have funded the original park, Bill McAlister Park. The City of Lubbock commits to finish the Conversion process in one year, from the signed date below, by finding and dedicating an appropriate replacement parcel according to the TPWD Local Park Grants Conversion Flow Chart. Another Amendment to this grant (and applicable to the other related grants) will be signed by both parties to finalize the Conversion once the replacement land is identified, approved by TPWD, and dedicated. The City of Lubbock commits to developing the replacement land as usable parkland, as approved by TPWD, or adding land on to an already developed park within three years of dedication. In all other respects the fund agreement of which this is an amendment, and the plans and specifications relevant thereto, shall remain in full force and effect. This amendment is effective upon execution by the Department.
