HomeMy WebLinkAboutResolution - 1248 - Accept Whisperwood Circle As Public Street With Stated Conditions - 11_11_1982JWF:da RESOLUTION RESOLUTION 1248 - 11/11/82 WHEREAS, Tara Land Company (as owner) and First National Bank at Lubbock (as lienholder) have submitted a replat of Lots 140 thru 154., Whisperwood Addition (revised date Oct. 18, 1982) indicating the street known as Whisper - wood Circle, shown on said replat, be dedicated forpublic use; and WHEREAS, said street, known as Tract K, Whisperwood Addition, was desig- nated on the original plat as a private street as was recorded in the Deed Records of Lubbock County, Texas in 'Volume 1736, Page 724; and WHEREAS, Tara Land Company (as owner) and First National Bank at Lubbock (as lienholder) have requested that said street, currently known as Tract K, Whisperwood Addition, be accepted by the City of Lubbock; and This City.Council of said City finds it would be in the best interest of the public health, safety and welfare to accept such street; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the dedication to the public of the street currently known as Tract K, Whisperwood Addition, and shown as Whisperwood Circle on the said replat, is hereby accepted for the use and benefit of the public by the City of Lubbock, said dedication of the street to be accomplished by the recording of said replat in the Deed Records of Lubbock County, Texas, at such time as all platting requirements have been met in accordance with the Subdivision Regula- tions of the City of Lubbock, Texas, such dedication affecting property all of which is within the corporate limits of the City of Lubbock, Lubbock County, Texas, said acceptance of dedication being subject to compliance by the deve- lopers with the following conditions, to -wit: 1. That the roll type curb would remain. 2. That the sidewalks be placed at the property line as required by the Lubbock City Code of Ordinances. 3. That the Islands would remain privately owned and that irrigation systems be installed in each island to maintain landscaping. 4. That the flare would remain. 5. That the street name be "Whisperwood Circle". 6. That Certification be provided certifying that the street construc- tion was in accordance with City standards and specifications with proper test results presented. 7. That street lights be installed at the developer's expense. (5 $475.00 A $2,375.00) 8. That street name signs be installed at the developer's expense. r 9. That the dedication deed be furnished by the developer.
