HomeMy WebLinkAboutResolution - 2022-R0386 - Interlocal Agreement with Lubbock County for Library ServicesResolution No. 2022-R0386 Item No. 5.24 September 13, 2022 RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT pursuant to the authority and in compliance with the Texas Government Code, Chapter 791, the Interlocal Cooperation Act, the Mayor of the City of Lubbock is hereby authorized and directed to execute for and on behalf of the City of Lubbock an Interlocal Agreement for Library Services by and between the City of Lubbock and Lubbock County, regarding providing county -wide library services for all of Lubbock County, and all related documents. Said Agreement is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. Passed by the City Council on ATTEST: tu Z-0�� A7 - Rebec a Garza, City Secre APPROVED AS TO CONTENT: A� 1 Brooke Witcher, Assistant City Manager APPROVED AS TO FORM: RES.Interlocal Agreement for Library Services -Lubbock County 8.25.22 September 13, 2022 Resolution No. 2022-R0386 STATE OF TEXAS § COUNTY OF LUBBOCK § INTERLOCAL AGREEMENT FOR LIBRARY SERVICES WHEREAS the Commissioners Court of Lubbock County, Texas, hereinafter referred to as "THE COUNTY", has determined that a need exists for the provision of county -wide library services; and WHEREAS, the City Council of the City of Lubbock hereinafter referred to as "THE CITY", has agreed to participate with "THE COUNTY" in order to provide library services for the citizens of Lubbock County; and WHEREAS, this agreement is made pursuant to Chapter 791 of the Texas Government Code; THIS AGREEMENT is made and entered into by and between THE COUNTY and THE CITY in consideration of the mutual benefits to each party to provide library services as specified below: PURPOSE: THE CITY shall use the funds provided to it by THE COUNTY strictly for providing Lubbock County citizens with library services, including, but not limited to, personnel, library materials and resources, maintenance and administrative costs. TERM OF AGREEMENT: This Agreement shall be effective from October 1, 2022 through September 30, 2025 "INITIAL TERM", and shall be automatically renewed each subsequent October 1 thereafter, upon written request of THE CITY to THE COUNTY to continue this agreement. If this Agreement is extended beyond the INITIAL TERM, the Parties shall also amend the FUNDS ALLOCATION section of this Agreement by written agreement, with the approval of the governing bodies of each Party, to provide THE CITY additional consideration for the Services provided herein. PAYMENTS: Payments to THE CITY shall be made in full not later than December 31 of the Agreement year. Each party paying for the performance of a governmental function or service must make those payments from current revenues available to the paying party. TERMINATION: THE CITY shall have the right to terminate this Agreement upon thirty (30) days written notice to THE COUNTY. A report of library services for the period from the beginning of the Agreement period through the effective date of the termination shall be submitted to THE COUNTY within 30 days of the effective termination date. Any unspent funds remaining on the effective termination date shall be immediately refunded to THE COUNTY within 30 days of the effective termination date. TERMINATION BY THE COUNTY: Although it is the express intention of THE COUNTY that funding of library services be an ongoing program, THE COUNTY, in circumstances dictated by any future budgetary constraints or change in existing circumstances, reserves the right to terminate this Agreement at the end of any COUNTY fiscal year. FUNDS ALLOCATION: THE COUNTY shall pay a total sum of $205,000.00, annually for each of the first three (3) years of the INITIAL TERM of this Agreement, which shall be paid as set forth above. Fund allocations for subsequent Agreement periods will be provided by THE COUNTY on or before each December 31, subject to receipt by THE COUNTY of the written request by THE CITY to continue this Agreement. AUTHORIZATION: The Commissioners Court of THE COUNTY has authorized the County Judge to execute all documents in its behalf. The City Council of THE CITY has authorized the mayor to execute all documents in its behalf. This document constitutes the whole and complete Agreement by and between the parties and may not be modified in any way except upon the prior written consent of the parties hereto.
