Said Amendment is attached hereto and incorporated in this Resolution as if fully set forth herein and shall be included in the minutes of the Council. WHEREAS, the City of Lubbock and LECD entered into an Interlocal Cooperative Agreement for use of the 4`h Street Tower, which was approved on May 13, 2010 by the Lubbock City Council. WHEREAS, Article VIII of the Interlocal Cooperative Agreement provides that the agreement may be amended or modified by the mutual agreement of both parties in writing. WHEREAS, LECD requires a fourth antenna to the 120 foot level of the tower to complete the radio path going north to Plainview that will enable the LECD to bypass the Lubbock Fire Training Center as a radio site and lessen any concerns regarding interference with airport operations. WHEREAS, an FAA Form 7460-2 has been electronically filed to assure that the FAA does not have concerns with the radio paths from the 41h Street Tower or the Lubbock Fire Administration Building Communication Tower. WHEREAS, the radio path going north toward Plainview and the radio path going toward the Lubbock Fire Administration Building Tower have been determined to be no hazard to air navigation by the FAA. NOW THEREFORE, the parties agree to the following Amendment: I. Additional Obligations of LECD 1. LECD shall install an additional 4.9 GHz PT600 Integrated Radio/Antenna (for a new total of four antennas). 2. LECD shall install an additional NEMA outdoor cabinet and "H" frame (for a new total of two cabinets). 3. LECD shall install an additional Motorola PTP600 GPS unit (for a new total of three units). 4. LECD shall install an additional PTP600 IDU Power Unit (for a new total of four power units). II. Incorporation Pursuant to Article VIII of the original Interlocal Cooperative Agreement between the City of Lubbock and LECD, this Amendment is incorporated into the original Agreement. III. Attachment An updated equipment list reflecting the additional equipment to be located and installed on the 4'h Street North Tower is attached to this Amendment. Mounting per best practices recommended by Tower Crew. Locations on tower will be: 120 Foot facing West, 75 Foot facing Southeast, 100 Foot facing Northeast, 120 Foot facing North. Four (4) PTP600 IDU (Power Units) mounted in exterior NEMA Cabinet. These units measure 9.75"x1.5"x3.0" . One (1) UPS Battery backup within six (6) feet of above listed IDUs. This unit will be placed in the exterior cabinet One (1) Cisco Router mounted next to above listed IDUs. This unit measures approximately 18"x16"x4" and would be mounted in the exterior cabinet. IOW Heights: 30 feet above ground level (AGL) 3271 feet above mean sea level (AMSL) This aeronautical study revealed that the structure does not exceed obstruction standards and would not be a hazard to air navigation provided the following condition(s), if any, is(are) met: Based on this evaluation, marking and lighting are not necessary for aviation safety. However, if marking and/or lighting are accomplished on a voluntary basis, we recommend it be installed and maintained in accordance with FAA Advisory circular 70/7460-1 K Change 2. This determination is based, in part, on the foregoing description which includes specific coordinates , heights, frequency(ies) and power. Any changes in coordinates , heights, and frequencies or use of greater power will void this determination. Any future construction or alteration , including increase to heights, power, or the addition of other transnutters, requires separate notice to the FAA. This determination does include temporary construction equipment such as cranes, derricks, etc., which may be used during actual construction of the structure. However, this equipment shall not exceed the overall heights as indicated above. Equipment which has a height greater than the studied structure requires separate notice to the FAA. This determination concerns the effect of this structure on the safe and efficient use of navigable airspace by aircraft and does not relieve the sponsor of compliance responsibilities relating to any law, ordinance, or regulation of any Federal, State, or local government body. This aeronautical study included evaluation of a structure that exists at this time. Action will be taken to ensure aeronautical charts are updated to reflect the most current coordinates, elevation and height as indicated in the case description.
