Public oecesjity exists that the following portions of streets, avenues and alleys in the , ity of Lubbock, Texas. be improved, as herein provided, to-wit: To Pave Avenue Z from its Intersection with 16th Street to its Intersection with 19th Street, same width as paving from 13th St. to 16th Street, Brick on concrete foundation. Paving Avenue 3 from its Intersection with 19th Street to its Intersection with 34th Street, not less than 36 feet wide. brick on natural base. Paving on Avenue T from its Intersection with Broadway to its Intersection with 19th 4treet, 36 feet wide. brick on natural base. raving 14th 3treet frcm its Intersection with Avenue 3 to its Intersection with Avenue H. 55 Feet wide. brick on concrete base. Paving 14th Street from its Intersection with Texas -venue to its Intersection with avenue U, 55 feet wide, brick on concrete base. To pave 14th Street fr m its Intersection with Avenue Z to its " intersection with College Avenue. 36 feet wide, brick on concrete base. Pave 19th rest from its Intersection from avenue 8 to its Intersection with avenuetN. 36 feet wide, brick on concrdte base. II. Said portions of streets, ave ues and alleys shall be improved by raising, grading and filling same, and by installing concrete curbs and gutters, and storm sewers and drains where necessary, and by paving with one of the following types of material on proper foundation, to-wit: (a) Vertical Fibre Brick. (b) Bock Asphalt, (o) Yarrentie Bitulithie, (d) Concrete, (e) Asphaltic Concrete, (f) Patented Types of Paving. the exact type of pavement to be determined by the Commission of the City of Lutbook after receipt of bids. I II. The City 3ngineer is hereby directed to prepare plans and specifications for such improvements embracing specifications for each of the said ,Vpes of paving. IV. i Such improvements in each Unit or District shall be paid for in the following manner: (a) Railways and street railways using, occupying, or crossing any portion of said streets, or avenues to be improved, shall pay for and be assessed for all the cost of work in the area between their ra_ Is and tracks, double tracks, turn-outs, and switches. and two feet on each side thereof. (b) The abutting property and owners thereof shall pay and shall be assessed for all the cost of a°:.nstrueting curbs in front of such respective pro:erties. and 90% of the remaining cost of such improVe- ments, a�'ter deducting the sums to be paid by railways and street railways under sub-paragraph (A) above, provided that if it shall appear at the hearing to be had before final assessment that the special benefits to such property in the enhanced value thereof by means o-' such improvements will not aagree-te such proportion of coats. then there shall be assessed hnd be paid b such abutting property, and the owners thereof, the amount of such benefits. 269 wl (a) The remaining cost of said improvements after deducting the sums finally assessed against railways and street railways under sub- paragraph (a) hereof, and against abutting property and the owners thereof under sub-paragraph (b) above, shall be paid by the Cityof Lubbock, Y. The amounts to be paid by and assessed against railways and street railways for work between rails and irtessasand two ofeet on each side thereof, shall be payable rk progresses, as may be provided in such specifichtions, and shall bear interest from date due and until paid at the rate of 7% per annum. The amounts to be assessed against and paid by abutting property and the owners thereof in each Unit shall be payable in six equal Install- ments, due respectively on or before 10 days, 1,2.3,4 and 5 years after the completion and acceptance by the City of the improvements in the Unit upon which the property abuts, and shall bear interest from date of such completion and acceptance and until paid at the rate of 7% per annum, payable annually, with provision that if default be made in the payment of any installment promptly as the same matures, then at the option of the holder of any such assessment or certificate issued in evidence thereof, such default shall mature the entire assessment upon which save is made. YI. Assessments shall be made and levied and shall be a first and prior lien and personal liability for principal, interest, reasonable attorney's fees and costs of collection, if incurred, all under and in accordance with the Charter, and ammendments thereto, now in force in this City. Rodgers, was authorized to izsue Warrants in favor of the ranhandle Construction ComFany in the amount of S40,702.07 In payment of Estimate Number 3 for construction of subway on East Broadway. Do further business coming up for consideration upon motion by Mr. Jeaver, seconded by Mr. Leaverton, carried unanimously, the City Commission recessed to me-it May 17th, 1929, at 8 P.M.
