EMERGENCY REPAIR CONTRACT
This Agreement between the City of Lubbock and
hereinafter referred to as CONTRACTOR:
WITNESSETH
1. This agreement between the City and the Contractor is entered into for
the purpose of repairing a building or buildings owned by the City of Lubbock
which sustained damage in the tornado of May 11, 1970. The details covering
such damage and the repairs to be made shall be furnished to the Contractor by
the Architect/Engineer and are made a part hereof and the specific building or
buildings to be repaired are as follows:
2. Contractor agrees to perform the repairs agreed upon and further agrees
to perform such work according to the standards set forth and will not engage in
any repair work where the effectiveness of such repairs are questionable in the
opinion of the Contractor or of the architect or engineer.
3. Contractor agrees that the type of construction or material used may be
different from that used in the original construction of such building or buildings
when in the determination of the Architect/Engineer such alternative method of
construction or material is better suited for such repair work.
4. The basis for payment to the Contractor shall be the Contractor's cost
plus 576 overhead, plus 1076 profit but the cost shall not exceed the amount set
forth below unless such increase is agreed to in writing by both parties. It is
agreed between the City and the Contractor that the estimated figure for the cost
of repairing such structure is $
5. Contractor agrees that while in the performance of such repair work, the
Contractor will notify the City of any savings in repairs or any repairs he feels
are unnecessary in order that the City may be aware of any possible savings in
repair cost.
6. It is understood and agreed that the Contractor will carry Workmans
Compensation Insurance in the amount set by law and insurance on his motor veh-
icles and equipment and Public Liability Insurance and Contractors Comprehensive
Insurance in the amounts required by the City. In addition to the above, the Con-
tractor shall provide an Owners Protective Policy, Builder's Risk and Perform-
ance and Payment Bonds.
