J:sw RESOLUTION WHEREAS, the City Council finds that increased vehicular traffic on Avenue Q (U. S. Highway 84) and 196 Street (U. S. Highway 62) necessitates the improv- ing of the street and highway at this intersection; and, WHEREAS, it is necessary to acquire for street and highway right-of-way 11 purposes the fee simple title to the land hereinafter described, owned by Mrs. Beulah Rogers, °fo Warlick Carr, Attorney, Lubbock National Bank Building; and, WHEREAS, the City Council has caused an appraisal to be made of said land and the value and total damages, if any, to the owner, and all others, whose in- terest may appear, for the fee simple title to said land has been appraised in the amount of $7, 550.00, and the City Council finds such amount to be fair and equi- able; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City of Lubbock acquire for street and highway right-of-way pur- poses, the fee simple title to the land lying and situated in the City of Lubbock, Lubbock County, Texas, and more particularly described as follows, to -wit: A tract of land out of Lots 7 and 8, Overton Addition to the City of Lubbock, Lubbock County, Texas, to -wit: BEGINNING at the Northeast corner of said tract extending South along the East property line to the Southeast corner of said tract; THENCE West a distance of 16 feet plus the arc of a curve (R = 5.001, T = 4.6'7' ); THENCE Northeast along said curve and North- east to the North property line of said tract; THENCE East a distance of 11. 76 feet to the point of beginning. THAT owner, Mrs. Beulah Rogers, % Warlick Carr, Attorney, Lubbock National Bank Building, and all others, if any, whose interest may appear, be offered through the Right -of -Way Department the amount appraised as the value and total damage, if any, for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith, the City Attorney is h6reby authorized and instructed to institute condemnation proceedings for and on behalf of the City of Lubbock to acquire the fee simple title to said land as hereinabove described for street purposes.
