HomeMy WebLinkAboutResolution - 010870 - Land Acquisition - Marvin Mclarty - Mclarty's Circle View Addition No. 2 - 01_08_1970RESOLUTION WHEREAS, the City Council of the City of Lubbock, has heretofore determined the necessity of establishing building lines on property abutting the Traffic Circle located in Survey 2, Block E, Lubbock County, Texas, and so enacted Ordinance No. 3087; and, WHEREAS, it has now been determined that the increased vehicular traffic on U. S. Highway 87, U. S. Highway 84, U. S. Highway 87 (Avenue A South Drive), Avenue H, and U. S. Highway 84 (Avenue Q South Drive) at their point of convergence at such Traffic Circle, necessitates the construction of an improved traffic interchange; and, WHEREAS, it is necessary to acquire for street and highway right of way purposes the fee simple title to the land hereinafter described, owned by Marvin McLarty, Sr; and, WHEREAS, the City Council has caused an appraisal to be made of said land and the value and total damages, if any, to the owner, and all others, whose interest may appear, for fee simple title to said land have been appraised in the amount of $82, 000. 00, and the Council finds such amount to be fair and equitable; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the City of Lubbock acquire for the purpose of improving the traffic interchange at the convergence of U. S. Highway 87, U. S. Highway 84, U. S. Highway 87 (Avenue A South Drive), Avenue H, and U. S. Highway 84 (Avenue Q South Drive), the fee simple title to the land lying and being situated in Lubbock County, Texas, and more particularly described as follows, to -wit: TRACT I 1. 174 acres of land being out of and a part of McLarty's Circle View Addition Number 2 to the City of Lubbock in the Southwest one -quarter of Section 2, Block E, Lubbock County, Texas, which 1. 174 acres of land is more par- ticularly described by metes and bounds as follows: BEGINNING at a point in the East property line of McLarty's Circle View Addition Number 2, sai d point being S 0 ° 021 W, 151. 5 feet from the Northeast corner of said addition as recorded in Volume 432, Page 551, Deed Records of Lubbock County, Texas, and being also 1, 650 feet North and 2, 572. 7 feet East of the Southwest corner of Section 2, Block E; THENCE S 00 02' W, 186. 80 feet along said East property line to a point; THENCE along a curve to the right, the center of the curve being N 89 ° 58' W, 80. 00 feet from the beginning of the curve, a distance of 193. 52 feet along the existing property line of said Addition to a point in the Southwest property line from which the center of the curve bears N 48 ° 38' E; said point being in. the Northeast Right of Way line of U. S. Highway 84; THENCE N 41° 22' W, 308.41 feet along said Southwest property line to a point which bears S 41 ° 22' E, 21. 2 feet from the West corner of the recorded Plat and being along the Northeast Right of Way line of U. S. Highway 84; THENCE N 680 08' E, 52.45 feet along a line parallel to and 20. 0 feet Southerly from the Northerly property line of the recorded Plat to a point; THENCE in a Southeasterly direction along a curve to the left, the center of the curve being N 23 ° 01' E, 1, 206. 57 feet from the beginning of the curve, a distance of 232. 0 feet to a point; THENCE S 78 ° 00' E, 2. 00 feet along a line to a point; THENCE in a Northeasterly direction along a curve to the left, the center of the curve being N 12' 00' E, 60. 00 feet from the beginning of the curve, a distance of 106. 78 feet to the PLACE OF BEGINNING. TRACT II: 0. 033 of one acreL, of land being out of and a part of the Southwest one -quarter of Section 2, Block E, Lubbock County, Texas, which Southwest one -quarter section was conveyed to Marvin McLarty by Deed dated 22 May 1951 and .recorded in Volume 307, Page 247, Deed Records of Lubbock County, Texas, which 0. 033 of one acre of land is more particularly described by metes and bounds as follows: BEGINNING at a point in the Northeasterly Right of Way line of U. S. Highway 84, said poing being the most Westerly point of the Plat of McLarty's Circle View Addi- tion INumber 2, as recorded in Volume 432, Page 551, Deed Records of Lubbock County, Texas, and being 1, 657. 8 feet North and 2, 214. 7 feet East of the Southwest corner of Section 2, Block E; THENCE N 41 ° 22' W, 80. 25 feet along said Highway Right of Way line to a point; -2- THENCE S 61 ° 13' E, 7.44 feet along a line to a point; THENCE in a Southeasterly direction along a -curve to the left, the center of the curve being N 28 ° 47' E, 1, 206. 57 feet from the beginning of the curve, a distance of 93. 44 feet to a point in the Northerly property line of the recorded Plat; THENCE S 68 ° 08' W, 39. 92 feet along said Northerly property line to the PLACE OF BEGINNING. THAT owner, Marvin McLarty, Sr., and all others, if any, whose interest may appear, be offered through the Right of Way Department the amount appraised as the value and total damages, if any, for the fee simple title and acquisition of said land for the purposes herein stated, for the use and benefit of the City of Lubbock, and unless accepted forthwith, the City Attorney is hereby authorized and instructed to institute condemnation pro- ceedings for and on behalf of the City of Lubbock to acquire the fee simple title to said land as hereinabove described for street purposes.
