Ery an Miller and Fire Chief '.±.E. Twitty as a committee to inves- tigate and report back to the Gity Commission. The matter regarding opening road on the East side of the nir?ort section was discussed at length by the entire Commission and approved. I:otion by 1:r. Eenson, seconded by lir. Bacon, the following Resolution carried unanimously. RESOLUTION GRANTING PER'= TO SOUTh.1 STERN BELL TELEPHONE COMPANY AND THE LUBBOCK COUNTRY CLUB TO ?RECT, MAINTAIN AND OPERATE TELEPHONE LII%'E OR 1INM ON CITY•S ELECTRIC LIGHT POLES RUNNING FROM THE CITY OF LUBBOCK TO THE COUNTRY CLUB. It was moved by Benson, seconded by Bacon, and carried by a unanimous vote of the "ity Commission that the Southwestern Bell Telephone Company and the Lubbock Country Club, both private corporations, be, and they are hereby given ermit to erect, maintain and operate telephone line or lines iP serve Lubbock Country Club and J.D. Slaughter on the poles of the City's electric light lire running from the City to the Lubbock Country Club, all without expense or damage to the City of Lubbock, and with the understanding that grantees of said permit shall be directly and solely responsible for all damages that may be caused by grantees in the erection, main- tenance or operation of said telephone line. It is further understood that this permit shall expire when the Southwestern Bell Telephone Company shall hereafter erect its ocsm telephone line to serve said J.D. The matter of roofing alley between Lots 10 and 11, Block 117, of the Original Town of Lubbock, Texas, was discussed and the following resolution passed unanimously. RESOLUTION REGARD TO ROOFII'G ALLEY BET77M LOTS 10 I -ND 11 1111 BLOCK 117 OF THE ORIGINAL TOC.T: OF LUBBOCK, TEXAS. It was moved by Benson, seconded by Bacon, and carried by unani:--ous vote of the pity Commission, that hermit be hereby granted to the Hotel Lubbock Operating o. of Lubbock, Texas, to erect, maintain and operate a roof over all or any part of the alley between Lots Ten (10) and Eleven (11) in Block One Hundred seventeen (117) of the Original Town of Lubbock in Lubbock County, Texas. It appearing that the abutting pronerty owners were present at a public hearing and consented. Said roof shall be not less than fourteen feet above the sur- face of the ground or paving„ shall comply with the city ordinances regarding construction: of fireproof materials, and be installed under plans and specifications which must be first approved by the City engineer and the City Building Inspector. This permit shall expire December 1, 1935. The grantee shall equip the under part of said roof with adequate lighting fixtures and keep said alley reasonably well lighted and in a reasonably safe condition all the time, without expense to the city. Y It is understood that this permit is granted primarily for the benefit and convenience of the traveling public, and that the city reserves all rights over said alley the same as it has over any other public highway under the law; and that if for any reason the city should at any time desire said roof to be removed or altered in whole or in part it shall have the right to cause the same to be done at any time after giving the grantee sixty days written notice. r 460 Before this perm1t shall become effective the grantee shall deliver to and file with the City of Lubboca good and sufficient surety company bond in the sum of Five Thom and (15,000.00) Dollars, payable to the City"of Lubbock, at Lubbock, Texas, conditioned that the grantee will save the City of Lubbock harmless from all damages that may be caused by such roof, and defend without expense to the City all law- suits or claims that may be made account of damages caused thereby. The City commission of the pity of Lubbock, Texas, met at 7:30 P.M. in Recessed Regular Session, recessed from Regular I:"_eeting of October 9, 1930, at the Regular I'eeting Place in the City Hall, the following members thereof being present, to -wit: Mayor J.J. Clements, Commissioners Jno. E. Roach, J.F. Bacon, D.N. Leaverton, Geo. E. Benson, City Attorney E.L. Klett, City Manager J. Br, an Miller and City Secretary W.H. Rodgers. Absent: None. The :,:mutes of Xccounts allowed from Warrant No. 4293 to -.arrant No. 4488, both inc., were read and upon motion by P::r. Leaverton, seconded by I -r. Benson, they were unanimously approved and ordered signed by the Mayor and City Secretary. Motion by Lr. Leaverton, seconded by Mr. Roach, carried unanimous- ly, Ordinance No. 472 passed second and final rer:ding. ORDINANCE NO. 472. AN ORDINANCE GRANTING THE PECOS AND NORTHZRN TEXAS RAILWAY COMPANY, A CORPORATION, AND ITS LESSEE, PANHANDLE AND SANTA FE RAILWAY COIJTANY, A CORPORATION, AND ITS SUCCESSORS AND ASSIGNS PERI,ZSSICE TO USE CERTAIET STREETS MTD ALLEYS IA: TFC' CI TY OF LUBBOCK, f'J\TD AUTHORIZING THEM TO CLOSE CERTAIN STREETS AND ALLEYS IN SAID CITY. Motion by Lir. Benson, seconded by Air. Leaverton, carried by unanimous vote of the City Commission, E.P. Norwood be paid the sum of b.3500.00 in full and final settlement for property taken and damage done to Lot 11, in block 40, in the Original town of Lubbock, Texas, on account of the construction, main- tenance and operation of Railroad Underpass in front of said property and upon the said E.P. Norwood executing and delivering duly acknowledged written receipt and release. J
