HomeMy WebLinkAboutResolution - 011214B - Assessing Cost Of Street Improvements By Construction Of Sidewalks - 01/12/1914 Best Available Scan s On motion by Mr. McWhorter, seconded by Mr. Dickinson, the following resolution was unanimously adopted: RESOLUTION DETERHINING THE NECESSITY OF ASSESSING THE COST OF IMPROVING A PHRTION OF CEDAR STREET IN THE CITY OF LUBBOCK BY CONSTRUCT ING AND PUTTING IN FOURTEEN FOOT CONCRETE SIDEWALKS IN FRONT OF LOTS NO. 11 and 13 IN BLOCK NO. 133 AND FIVE FOOT CONCRETE SIZE— WALKS IN FRONT OF LOTS NO. 15, 17 AND 19 IN BLOCK NO. 149 AGAINST THE OWNERS OF SAID PROPERTY AND TFEIR PROPERTY, AND NOTICE TRER7,OF AND FIXING IRE TIMF AND PLACE FOR SUCH HEARING:-- Be it resolved by the City Council of the City of Lubbock, Texas: -- Whereas, the City Council has heretofore, by resolution directed the improvement of a portion of Cedar Street by the construction of fourteen foot concrete sidewalks in front of and abutting Lots Numbered Eleven (11) and thirteen (13) in Block Numbered 133 . and lots Numbered Sixteen (16) , Seventeen (17) , and eighteen (18) in Block Numbered 148 on Cedar Street, and whereas, thereafter plans and specifications were prepared by L.A.Hiteheock, City jngineer, for the City of Lubbock, and advertisements were made f� bids therefor, and thereafter bids were received therefor, and opened and considered by the City Council and .th•er�3after the bid of J.B.Pryor for the said work of improvement was a-d6pted by the Council; and, Whereas, and thereafter, said Engineer prepared and filed with the Council his report, stating the total cost of such improvement and the proportion of such costs payable by each owner of said abutting property and the costs of such improvement per front foot of abutting property, and the names of the persons, firms, corporations and estates owning he property abutting on the proposed improvement, with a description ,of their property, and the toatl casts of such improvement to each parcel of property; and, Whereas, said report was approved by the City Council by resolution; and. Whereas, the City Council has finally determined to assess the cost of said improvement against the owners of the said abutting property and their property:- 1. That it is finally determined hereby to assess the cost of said improvement against the owners of the property abutting upon said streets Page �2. and their property, as herein provided. That a hearing shall be given be- fore the City Council to the owners of said abutting property, their ��- torneys or agents, which hearing shall be held in the Council Chamber in the City of Lubbock, Texas, on the 13th., day of April, A. D.1914, at 8 o'clock p.m., and shall continue from time to time and day to dav, until all persons interested in said property shall be fully heard, at which time the owners of said property or any person inter, sted therein shall be entitled to a hearing as to the benefits of slid improvements to Chair property or as to any invalidity or irregularity with reference to said proce�dinC) or as to any other matter of objection connected with the said pvoceedings, :end at which hearing said owners or any other person inter,sted in said property may produce evidence in su-Oort of any objections. ?. That, after said hearing, said Council will, by Ordinance, as- sess against the owneratkxxxx of said property and their property, such sums as shall be determined tc be just and equitable, and that said as- sesanent willbe made in accordance with the front foot plan and rule, as the frontage to each owner is to the whole fronting to be improved, provided if the said rule or plan shall be deteririned in any case to be unjust or inequitable,then that the Council will adopt such rule of ap-cIortionment as shall be just and equitable, having in view the bene- fits to each owner and burdens imposed u?non them, provided that no as - se ssm,ent shall be made against any owner or bis property in exc-� ss of the benefits to said property in the enhanced value thereof by reason of said improvement. 3.fVhat the total estimated costs of sa..d improvements is the sum of T�q Hundred Thirty Nine and 43/100 dollars 0239.43) and that the amount per front foot, which it it is nropo sed to assess against eitch parcel of property and its owner is One and 92/100 dollars. That the City Secretary of the City of Lu' -,bock is hereby directed to give notice hereof by publication of this Resolution, signed by him, which publication shall be by advertisement inserted three times in the Lubbock Avalanche, a newspaper published in said City of Lubbock, the first publication o' which shall be at least ten days before the date of the aforesaid hearing, and such notice will be further given by the City Secretary mailing a copy h?reof, signed by him, by registered mail to each of said owners at their addresses, if known, or if unknown then to their agent or attorney, if known, which said notice shall be de- posited in the Post Office of kL,C-x the City of Lubbock at leabt ten days before the date set for said hearing aforesaid. 5.
