BE IT RESOLVED BY THE CITY COMISSION OF LUBBOCKt TEXAS, THAT: I. Public necessity exists that the following portions of streets, highways, avenues and/or alleys in the City of Lubbock and along the boundaries thereof be Improved as herein provided, to -wit: 43rd Street WPL Knoxville Avenue 43rd Street WPI, Louisville Avenue 43rd Street WPL Memphis Avenue Nashville Avenue SPL 42nd Street Nashville Avenue SPL Ord Street Nashville Avenue SPL 44th'Street 48th .Street EPL Avenue Q Baylor Street EPL Waco,Avenue 39th Street WGL.Avenue A 39th Street WPL Avenue B 39th Street b;Quaker :Avenue 26th Street WPL Memphis Avenue Akron Avenue SPL'34th Street 2nd Place WPL Avenue H Avenue N SGL -Broadway East one-half AveOQ SPL 6th Street II. to WPL Louisville Avenue to WPL Memphis Avenue to WPL Nashville Avenue to NPL 43rd Street to NPL 44th Street to NPL alley North of 47th Street to EGL Avenue P to SW Fay. L Clovis Road to 'WPL Avenue B to 'WPL Avenue D to EPL Salem Avenue to 293.75 feet West of Nashville to NPL 35th Street to WPL Texas Avenue to NGL 13th Street to alley between 6th and 7th Said portions of streetst highwayst avenues and/or alleys shah be improved by raisings grading and filling same, by installing concrete curb, and gutters, by installing storm severs and drains where necessar79 by installing 'a compacted caliche base and by. surfacing ;w'ith quadruple asphaltic surface, treatment (Pene- tration types except on Avenue N from 13th to Broadway which shell be improved and widened by removing the existing.pevements,by raising,,grading,and filling* by installing new concrete curb and gutters at new widths',by reconstructing existing storm sewer leads and inlets in new locations and by constructing a new pavement of increased width of caliche base and quadruple asphalt surface treatment and except on the East one-half of.Ave. Q: from 6th to alley between 6th and 7th which shall be improved on this project by only installing concrete curb and"gutter. III. The City Engineer is hereby directed to prepare plans and specifications ` i for such Improvements. lv. Such improvements in each unit shall be paid for in the following manners (8) Railways and street railva7a usings occupying or crossing amy portion of. said streets, highways, avenues a uVoor alleys to be improved shall be assessed for and shall pay for aof the cost of the work in the area between their rails and ill tracks., double tracks# turnouts and switches and two feet on each side thereof. (b) The abutting property and owners thereof shall pay and shall be assessed for all the cost of constructing curbs in front of such respective property and a part of the remaining cost of the other improvements,'after deducting the sums to be paid by the railways under sub -paragraph (a) above., provided that such part of the costs assessed to the abutting property or owners thereof shall not exceed 90% of the cost of the improvements plus the cost of the cvrbj, and further provided that if it shall appear at the hearing to be had before final assessment is made that the special benefits to such property by way of enhancement value thereof by means of such improvements will not aggregate such "proportion of the cost as specified abovep then there shall be assessed and be paid by sudh'abutting property and the owners thereof, a lesser amount not to exceed the benef'itis. (c) The remaining cost of said improvements,9.after deducting the suns finally assessed against railways and street railways under sub -paragraph (a) hereof, and against abutting property and the owneirs thereof under sub -paragraph (b) above, shall be paid by the City of Lubbock. The amounts assessedainst and to be 88 ,paid by railways and street railways for work ,between rails and tracks and 2 feet on each side thereof shall be paid on estimates or statements on or before ten days after acceptance of the improve- ments in,the unit in which the railway lies, by the City Commission and shall bear interest from date due and until paid at the rate of 6% per annum, The amounts assessed against and to be paid by the abutting property and the 'owners thereof shall be payable in three equal installmentat the first of which shall become due Non or before 10 days 'after completion and acceptance of the improvements in the unit on which the property abuts by the City Commission; the second and third one and two years respectively after comapletion and acceptance -of the improvements in t unit upon which the property abuts, by the City Oommission, and shall bear interest from the date of completion and acceptance until paid, at the rate of six percent per annum, payable annually, withprovisions that if default be made in the payment of any installment promptly as the same maturesa'then at the option of the holder of such assessment or certificate issued in evidence''thereof, such default shall mature the entire assessment upon which same is made. 4I. Assessments shall be made and levied„ and shall be a first and prior lien and personal liability for principal, interest, reasonable attorney's fees and costs of collection, if incurred, all under and in accordance with the.Charter, and amendmen thereto, now in force in this City, and in accordance with the provisions of Article 1105 B Revised Civil Statutes of Texas as amended by Chapter 281 Acts of the 52nd Legislature. VII. This Resolution shall take effect and be in force from and after its passage.
