NC4J, THEREFORE, be it resolved by the City Council of the City of Lubbock in regular session this 26th day of June # 19'5 , that the Highway Department is hereby requested to widen and improve Highway U S. 84 th St.), as set out above. Ol— The City of Lubbock will provide all necessary right-of-way clear of ob- struction and free of property damage and will, provide for the immediate construc- tion of continuous curb and gutter, utility adjustments, storm sewers# etc., all as may be necessary for a complete project with the exception of pavement widening, and wil1 assume responsibility for the construction of driveways and sidewalks should they be deemed necessary now or in the future. The Texas Highway Department, after the City had fulfilled its responsibilities, will provide for pavement widening and its support within these limits. It is understood that the responsibility of the Texas Highway Department is con- fined to the pavement and its support and all other features necessary now or in the future to provide an adequate travel facility shall be the responsibility of the City of Lubbock .. It is further agreed that the City of Lubbock will maintain that por- tion of the work which is its construction responsibility and will pass such resol- utions and ordinances in accordance with standard forms of the Highway Department to indemnify the State during and after. construction against any and all liability or damages growing out of such construction, to regulate traffic, to provide for parallel parking and to prevent encroachment on the right-of-way. The City also agrees to pass an ordinance prohibiting the use of the area between the curb and the property line for the servicing of cars or trucks parked on the right-of-ways and will make provision for the rearrangement of the driveways and location of Filling Station Pumps or other obstructions to enable enforcement of this ordin- ance. 110TION made by Commissioner Maxey seconded by Maner AND upon vote same was unanimously carried.
