Home My WebLink AboutResolution - 072458C - Modification Of Contractual Agreement For ROW Procurement - Quirt Ave. - 07/24/1958RESOLUTION WHEREAS, the City of Lubbock has heretofore entered into an agree- ment with the Texas Highway Department and Lubbock County, Texas, for procurement of right of way on (1) Loop 289, Project No. RW 783-1-1, the limits being from U. S. Highway 62, Southwest of Lubbock to Quirt Avenue, Southeast of Lubbock, agreement dated July 31, 1957; (2) Loop Z89, Project No. RW 783-1-2, the limits being from U. S. Highway 62, Northeast of Lubbock to Quirt Avenue, Southeast of Lubbock, agreement dated July 31, 1957; (3) Loop 289, Project No. RW 783-2-1, the limits being from U. S. Highway 62, Southwest of Lubbock to U. S. Highway 84, Northwest of Lubbock, agreement dated July 31, 1957; and (4) Loop 289, Project No. RW 783-2-2, the limits being from U. S. Highway 84, Northwest of Lubbock to U. S. Highway 62, Northeast of Lubbock, agreement dated July 31, 1957; and WHEREAS, the Texas Highway Department and Lubbock County, Texas and the City of Lubbock mutually desire the:_modification of agreement referred to, substantially providing for 50 per cent reimbursement to the City and County of court costs and the cost of State appraisers when used by the City in condemns tion proceedings; NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LUBBOCK: SECTION 1. THAT the Mayor of the City of Lubbock BE and he is hereby authorized and directed to execute the attached"Modification of Contractua: Agreement for Right of Way Procurement". SECTION 2. City Secretary is directed to attach a true copy of this Resolution to each copy of the modification agreement submitted by the Highway Department and cause the same to be transmitted to the Highway Department through the City Right -of -Way Department as requested by the Texas Highway Department dated July 16, 1958, and attached to said copy.
