STATE OF TEXAS
COUNTY OF LUBBOCK
THIS AGREEMENT, made and entered into this day of , 2026, by and between the City
of Lubbock, County of Lubbock, State of Texas, acting by and through its duly authorized representative, hereinafter referred
to as OWNER, and New Mezico Tan Master, of the City of Albuquerque, County of Bernalillo, State of New Mexico,
hereinafter referred to as CONTRACTOR.
WITNESSETH: That for and in consideration of the payments and agreements hereinafter set forth, and under the
conditions expressed in any required bonds bearing even date herewith, the CONTRACTOR hereby agrees with the OWNER
to furnish all labor, materials, equipment, tools, supervision, insurance, and services necessary to perform emergency repair
work described as follows:
�� PROJECT DESCRIPI'ION: Emergency repair of City of Lubbock public works infrastructure located at Reaair
66"' & MLK Streets (Rl), including all necessary excavation, isolation, repair, replacement, testing, and restoration work
� required to stabilize the site and return the affected system to safe operation.
This emergency procurement is authorized under Texas Local Government Code §252.022(a)(2), which permits
contracts for emergency repairs to public property without competitive bidding when necessary to preserve or protect the
public health or safety.
The CONTRACTOR agrees to commence work immediately upon receipt of written or verbal notice to proceed
and to diligently prosecute the work to completion within the timeframe determined necessary by the OWNER due to
emergency conditions.
The OWNER agrees to pay the CONTRACTOR in current funds for the performance of the work, in accordance with
the approved emergency cost proposal, subject to additions and deductions as provided in the contract documents.
IN WITNESS WHEREOF, the parties hereto have executed this Agreement in Lubbock, Lubbock County, Texas, on the day
and year first above written.
