Casner First Assistant City Attorney Mayor Miller asked First Assistant City Attorney Richard Casner to explain the justification of this emergency meeting. Casner explained that, ordinarily, an open meeting requires 72 hours posted notice; however, in the event of an emergency or an urgent public necessity, a meeting of the City Council may be held with two hours' notice. "Urgent public necessity and emergency" is defined by statute as an eminent threat to public health or safety, or a reasonably unforeseeable situation. Police Chief Claude Jones explained that his office was notified by the State of Texas Emergency Operations Coordinator that United States citizens could be received as evacuees out of the Middle East Region. Chief Jones said funds needed for this could very well go over and above the limits of the City Manager's authority and would take an action from the Council to approve funds outside of the bounds of the current approved budget to be able to meet the needs of the citizens that could possibly be coming to our community. Chief Jones stated that preparation is being made to receive evacuees. He also answered questions from Council. There were concerns about how the City of Lubbock would be reimbursed for monies used for this emergency. Council Member Leonard voiced concern that the City was taking premature action, and suggested waiting for further information from the State at a 4:00 p.m. meeting. After further discussion, Mayor Pro Tern Gilbreath called for the question. Vote was taken, which carried: 6 Ayes, 0 Nays. Motion was made by Mayor Pro Tern Gilbreath, seconded by Council Member Price to pass Resolution No. 2006-RO358 as recommended by staff. Motion carried: 5 Ayes, 1 Nay. Council Member Leonard voted Nay. Emergency City Council Meeting July 19, 2006 Page 61 2:28 P.M.
