Don Caldwell, Co -Chair of the Entertainment Lubbock Task Force will present the Committee's recommendations for an enhanced Buddy Holly Symposium and Music Festival for September 2004. On April 10, 2003, the City Council passed Resolution No. 2003-RO143 creating the Entertainment Lubbock Task Force. Consisting of eight members, the Task Force has the primary objective to develop recommendations for the City Council with regard to the development, organization, coordination and funding of events that would take 324 Regular City Council Meeting October 9, 2003 Page 325 advantage of the various talent and venues associated with the City of Lubbock's entertainment industry, while working collectively with entertainment entities throughout the region, and that would have a positive impact on tourism within the City. Over the past six months, the Task Force has researched many entertainment issues. The Task Force collectively agreed that the top priority that needs to be addressed is a continuous stream of funding for an expanded Buddy Holly Symposium and Music Festival. The Festival had its beginning in 1996, with the celebration of the 60t' anniversary of Buddy Holly's birth. Since its inception, the event has had several variations. From 1996 through 1998, the event was known as the Buddy Holly Music Festival; the first two years Broadway Festivals Inc. planned the event. In 1998, the Convention and Visitors Bureau, with the assistance of Broadway Festivals, Inc., planned the event. In 1999, the event's name was changed to reflect Lubbock's designation as the Music Crossroads of Texas. This was in response to the inability to negotiate the use of Buddy Holly's name for the event. In 2001, an agreement was reached with Maria Elena Holly and the event is now known as the Buddy Holly Symposium and Music Festival. For the past three years, the event has received annual funding of $50,000 from Market Lubbock, Inc. Event expenses over that amount have been privately raised. Each variation of the Festival has had several positive components. The early years of the Festival included sock -hops and a 50's car display. The event has also featured Chuck Berry, a legendary entertainer from the 1950's, in a headliner concert. The symposium that was added three years ago has brought Texas Tech University into the fold as an event partner. Furthermore, the music related exhibits at the Buddy Holly Center have continued to compliment the Festival activities. The Task Force is recommending that the City Council establish an annual stream of funding of $225,000, beginning with the 2004 event, to fund the successful components that are needed to build the Buddy Holly Symposium and Music Festival into a successful national and international event. The Entertainment Lubbock Task Force will present other entertainment -related recommendations to the City Council on a quarterly basis. Don Caldwell, Co -Chair of the Entertainment Lubbock Task Force presented the Committee's recommendations for an enhanced Buddy Holly Symposium and Music Festival for September 2004. Council Member Martin suggested that "Symposium" be removed from the name and it be called a festival only. (9.) This is hosted by the American Association for People with Disabilities in partnership with the U.S. Dept. of Labor, Office of Disability Employment Policy. Cindy Finley and her guide dog, Twig accepted the Special Recognition. (15.) Presentation of a Proclamation to declare October 2003 as National Disability Employment Awareness Month in Lubbock. October is National Disability Employment Awareness Month. Polls indicate that almost three of every four individuals with disabilities are not employed. Many of these individuals are eager and able to work. The focus of National Disability Employment Awareness Month is the Department of Labor's efforts to integrate Americans with disabilities into the mainstream of our economy and to highlight the many talents that people with disabilities bring to our workforce. Bonner Bennett accepted the proclamation. (16.) Presentation of a Special Recognition to the City of Lubbock's graffiti removal program administrators for their outstanding job in keeping Lubbock free of graffiti. The City of Lubbock's graffiti removal program has been recognized in many cities and used in many seminars for its approaches to graffiti removal. Being one of the first cities in the State to use baking soda as a medium to remove graffiti, Lubbock is on the cutting edge of graffiti removal. The program has one employee, who removes graffiti from an average of 1600 sites per year. The City also utilizes volunteers for approximately 1,700 hours of graffiti removal. The graffiti removal program is housed in the Business and Neighborhood Development Department (BAND). Mayor Pro Tern Hernandez requested that this be placed on the agenda. He indicated that after visiting many cities around the state and nation, Lubbock is very clean of graffiti as compared to most places of comparable size. Manuel Placencia, Graffiti Program Administrator, and Peter Kern, BAND manager, accepted the Special Recognition. (17.) Eric Golle and William Rizzo, Jr. representing the SoHo Grille (located at the south intersection of Toledo and the Marsha Sharp Freeway) appeared to discuss issues related to the closing of Toledo Avenue at the Marsha Sharp Freeway. This item was considered following Item 72. This past July, Council upheld the Citizens Traffic Commission's recommendation to close Toledo at the Marsha Sharp Freeway. The City Engineer was directed to close Toledo at the north side of the old railroad right-of-way immediately by temporary measures. Eric Golle and William Rizzo, Jr. addressed the severe impact the closure of Toledo is having on the SoHo Grille and the Cactus Alley tenants. Since the closure, they are claiming a 10% monthly decrease in sales. They do not understand why the City chose to close Toledo, when construction will not start in that area for many years. They would like Toledo reopened until construction begins in that area. Staff recommended that Council consider holding a public hearing before taking action on this item. Craig Farmer, Managing Director of Planning & Transportation, stated that because they did not feel the closure would affect property owners to the south, notification of the prior public hearing had not been sent to them. Mayor McDougal asked if it would hurt to leave Toledo open until construction begins. 327 Regular City Council Meeting October 9, 2003 Page 328 Mr. Farmer stated if this temporarily opened, there would be no reason to have a public hearing to reclose it at a later date. He added this fact would need to be made clear. City Council consensus was to uphold the closing of Toledo. The next item considered was Item 73. The first item considered was Item 81, followed by Item 82. CONSENT AGENDA (Items No. 18-59, 60A-62, 64) These items were considered following Item 82. Motion was made by Council Member Morrison, seconded by Council Member Patterson to approve Items 18-59, 60A-62, 64 on consent agenda as recommended by staff. Motion carried: 7 Yeas, 0 Nays. (18.) Ordinance No. 2003-00111 abandoning and closing a 20-foot wide and a 16-foot wide alley located in Block 1, Westwood Drive Addition to the City of Lubbock (3610 215' Street)( first reading). ORDINANCE NO. 2003-00111 AN ORDINANCE ABANDONING AND CLOSING A 20 FOOT WIDE AND A 16 FOOT WIDE ALLEY LOCATED IN BLOCK 1, WESTWOOD DRIVE ADDITION TO THE CITY OF LUBBOCK, LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. This ordinance abandons and closes a 20-foot wide and a 16-foot wide alley just west of Knoxville Avenue, between 21S` Street and 22"d Street in Block 1 of the Westwood Addition for replat purposes. The requestor of this closure is NS Development LTD and Covenant Health Systems and there will be a charge for this 7,734 square feet alley area being closed. NS Development Company LTD owns the property abutting the east portion of this alley. The alley area being closed adjacent to their property totals 2,544 square feet. A value of $7 per square foot is placed on this property for a total value of $17,808. This area will be dedicated back as a utility easement and a credit will be given for an additional 184 square feet of utility easement area to be dedicated in the plat for an amount due of $8,260. Covenant Health Systems owns the property abutting the west portion of the alley area being closed that amounts to 5,190 square feet and is valued at $7 per square foot for a total of $36,330. This area will remain as a utility easement. A 50% credit will be given for an amount due of $18,165. Covenant was the original dedicator of the north -south portion of this alley area being closed and they will be given a credit for that. They originally dedicated 2,714 square feet of alley area. The 2,714 square feet X $7 = $18,998. Pursuant to Chapter 372 of the Texas Local Government Code, this resolution illustrates the following findings: 1. The advisability of the improvement; 2. The nature of the improvement; 3. The estimated cost of the improvement; 4. The boundaries of the public improvement district; 5. The method of assessment; and 6. The apportionment of costs between the district and the municipality as a whole. The City Council will need to make these findings in order to create the PID. FISCAL IMPACT: Staff time is required to facilitate the PID process. The intent of this PID is to provide additional services at no increased cost to the City. Staff recommended approval of this resolution. Motion was made by Council Member Martin, seconded by Council Member Gilbreath adopting the resolution as presented with one addition, which is to make a finding that the City Council will be the governing body for this PID in making and levying assessments and serving as the governing body and to pass Resolution No. 2003-RO468 as recommended by staff. This action is being taken to deed the former Fire Administration Facility, 511 Avenue K, to the Lubbock Regional Arts Center, Inc. in response to the City Of Lubbock Council direction to either lease City Of Lubbock owned facilities at fair market value or to transfer ownership of the facility. The current Lubbock Regional Arts Center, Inc. lease for the Avenue K facility initially started in December 2000, extending for a period of 20 years ending on the last day of August 2020. The deed without warranty conveys the Property by Grantor (City Of Lubbock) to the Grantee (Lubbock Regional Arts Center) as long as the Grantee utilizes the Property solely in a manner that promotes a public purpose of the Grantor. For the purpose hereof, "public purpose" of the Grantor shall mean Lubbock Regional Arts Center, Inc. "to provide a central home for the arts to foster the arts through education, exhibition, and performance." If the Property ceases to be so used, all rights, title, and interest conveyed by this instrument shall automatically revert to, and vest in, Grantor. In Resolution No. 2003-R0366, dated September 4, 2003, Council directed the Mayor to execute a letter from the City of Lubbock to the Lubbock Housing Authority (LHA). The letter specifically provided that the City would convey one tract of land to LHA in the event LHA is awarded a grant by the Texas Department of Housing and Community Affairs to construct multi -family affordable housing units. It has been communicated to the City by LHA that the subject of the application is a bond transaction rather than a grant application. It has also been communicated to the City by LHA that it desires to purchase two separate tracts of land from the City, in the event it is awarded two separate bond reservations. LHA has partnered with Landmark Development in Austin, Texas to apply for bond funds from the Texas Department of Housing and Community Affairs through a lottery process to finance the gated community in East Lubbock. LHA is submitting two applications in hopes that one application will be selected from the lottery and receive a higher number than competing applications from smaller communities. LHA has requested that the City reserve two 25-acres tracts of land for the application process. The intent is for the City to sell the land to LHA for $1,750 per acre in the event that LHA is awarded the grant. FISCAL IMPACT: $43,750 profit to the City of Lubbock -- (25 acres X $1,750 per acre) Approval of a resolution authorizing the Mayor to send a letter to the Lubbock Housing Authority committing the City to sell the LHA a 25 acre tract of land for development of affordable multi -family housing units. Knight John M. Knight, Assistant City Attorney A copy of the Contract is filed with Resolution No. 2003-R0408. The developers of North Pointe Addition have requested that the City participate in the cost of paving Slide Road from Erskine Street north, approximately 1,500 feet. Slide Road is a designated thoroughfare street in the City's Master Thoroughfare Plan. In accordance with the City of Lubbock Paving Policy, the City does participate in extra width paving on thoroughfare streets. The extra width participation requested by the developer is in the amount specified in the Paving Policy. Typically the full -width paving of a thoroughfare is initiated by the City. In this case the developer is initiating the thoroughfare paving with the development of his subdivision. The developer owns, and is platting property on both sides of Slide Road. The developer feels the paving of Slide Road is critical to the success of the development. The developer's request also complies with the minimum length of 1,000 feet for thoroughfare paving allowed by the Paving Policy. FISCAL IMPACT: The City's participation in the cost of paving Slide Road is $109,833.30. At the September 18, 2003 City Council meeting, an amendment to the 2003-2004 Capital Projects Budget was approved transferring $110,000 to the Subdivision and Assessment Paving capital project to fund the City's participation for this portion of Slide Road. The total estimated cost to pave this length of Slide Road is $392,956. The developer's total contract to pave all streets within this subdivision (including the City's portion of Slide Road) is $1,611,600.50. Staff recommended approval of this resolution. Consider a request for islands in Slide Road from Erskine Street north, approximately one half mile in the proposed North Pointe Addition. This item was considered following Item 81. David Miller, representing the developers of the proposed North Pointe Addition, submitted a request that islands be allowed in Slide Road from Erskine Street north approximately one half mile. The Subdivision Regulations require City Council approval of any islands in public streets. The developers are requesting approval of islands for the entire length of -- Slide Road in their ownership. However, this first phase of the development of North Pointe Addition will only extend from Erskine Street north, approximately 1,500 feet. In the letter requesting the islands, the developers have acknowledged they will be responsible for the construction and the maintenance of these islands. They are currently evaluating funding alternatives for the continued private maintenance of these islands. The islands will be platted as privately owned tracts. FISCAL IMPACT: There is no City cost associated with the construction or maintenance of these requested islands. Staff recommended approval of this request.
