( 5.) Briefing on Covenant Health System Y2K readiness efforts by
Charley Trimble, President and CEO, and Susan Kelly, Assistant
Vice President Y2K Compliance Projects.
The City of Lubbock is in the midst of informing citizens and other
municipalities about possible Y2K disruptions. City staff has addressed
various Y2K concerns through local radio shows, publications, a
newsletter, the Internet, mass mailings, speaking engagements, and
community meetings.
Staff has made every effort to be Y2K ready through a variety of staff
initiatives. One such initiative was to determine the readiness of
industries and businesses in our community that impact the public
significantly on a daily basis. Covenant Health System is one of the two
largest providers of major medical attention to our citizens and the
surrounding region. Charley Trimble of Covenant Health System was
asked to make this presentation to the City Council regarding their state
of Y2K readiness.
The City of Lubbock has been preparing a Y2K Business Continuation
Plan for almost two years. One component is a disaster response plan to
keep the organization functioning in the event of unforeseen emergency
circumstances. This backup plan provides logical alternatives to
potential failures of mission -critical systems. Staff is constantly making
revisions to the Business Continuation Plan as new issues surface due to
continued testing and as new information becomes available. The City
of Lubbock's Emergency Operations Center (EOC) will go into full
operation on the evening of December 31, 1999. By asking Mr. Trimble
to make this presentation to the Mayor and City Council, staff is
continuing our efforts to inform the public and further develop our

(25.) Ordinance No. 10206 amending Chapter 5 of the Code of Ordinances
of the City of Lubbock by amending the language of subsection 5-11
so as to permit the performance of aerobatics over the City of
Lubbock, subject to restrictions (first reading).
ORDINANCE NO. 10206
AN ORDINANCE AMENDING CHAPTER 5 OF THE CODE OF
ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY AMENDING THE
LANGUAGE OF SUBSECTION 5-11 SO AS TO PERMIT THE PERFORMANCE
OF AEROBATICS OVER THE CITY OF LUBBOCK SUBJECT TO
RESTRICTIONS, PROVIDING A PENALTY CLAUSE, PROVIDING A SAVINGS
CLAUSE AND PROVIDING FOR PUBLICATION OF THIS ORDINANCE AND
AN EFFECTIVE DATE HEREOF.
The Federal Aviation Administration (FAA) and the City of Lubbock
have regulations that restrict aerobatic flight operations over the City.
The FAA's restrictions can be found in Federal Aviation Regulation
91.303, "Aerobatic Flight", while the City of Lubbock's restrictions can
be found in Section 5.11, "Aerobatics," of the City Code. In the event
that someone would desire to perform aerobatic flight for an air show or
a fly -in, a waiver can be requested from the FAA, however, the City of
Lubbock has no provision for such a waiver.
Aerobatic activity can be conducted safely over open land in certain
areas of the city and at Lubbock International Airport under the
supervision of the Air Traffic Control Tower. To allow for such events,
staff proposed a revision to the ordinance that would provide City
Council with the authority to allow aerobatic flights over the city subject
to certain restrictions. The City Council would have to approve the
event, a waiver for the event would have to be obtained from the FAA,
and the event would have to be conducted solely within airspace for
which the waiver was sought.
The Airport Board has reviewed the proposed amendment to the
ordinance and recommended approval. Staff also recommended
approval.

When lots 540 and 541 were platted, a five-foot LP&L underground
utility easement was dedicated along the east five feet of each lot. These
two lots were replatted into Lot 540-A, and a new five-foot easement
was dedicated along the west side of Lot 540-A. This ordinance closes
the two original five-foot underground utility easements along the east
side of lots 540 and 541.
The Right -of -Way Department recommended the approval of the first
reading of this ordinance.
(27.) Ordinance No. 10208 amending Chapter 6 of the Code of Ordinances
of the City of Lubbock, Texas, with regard to establishing a cross -
connection control program utilizing backflow prevention devices
(first reading).
ORDINANCE NO. 10208
AN ORDINANCE AMENDING CHAPTER 6 OF THE CODE OF
ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, BY ADDING NEW
SECTIONS 6-85.8, 6-85.8.1, 6-85.8.2, AND 6-85.8.3 WITH REGARD TO
AMENDMENT OF THE 1997 INTERNATIONAL PLUMBING CODE IN ORDER
TO MEET LOCAL CONDITIONS RELATING TO BACKFLOW PREVENTION;
PROVIDING A PENALTY CLAUSE; A SAVINGS CLAUSE AND PROVIDING
FOR PUBLICATION
(28.)
The protection of the public water system is essential to ensuring
delivery of safe drinking water. The Texas Natural Resources
Conservation Commission's Rules and Regulations for Public Water
Systems, Section 290.44(h) addresses the need for an effective cross -
connection control program and specifically names the water purveyor as
having the responsibility for administering an effective program.
This ordinance amendment is intended to establish a cross -connection
control program that will systematically and effectively prevent the
contamination of the public water supply by requiring the installation and
periodic testing of backflow prevention devices. Backflow prevention
devices are used to protect the potable water supply by isolating the
sources of potential pollution and contamination within a customer's
internal plumbing system and promoting the elimination or control of
existing cross -connections.
Adopting this ordinance will allow enforcement of the provisions of this
ordinance; designate and authorize City employees to effectively monitor
the installation of backflow prevention devices; require that said devices
be tested periodically in accordance with industry standards; and require
that documentation related to the status of said devices be filed with the
City.
Staff recommended the passage of this ordinance.

This agenda item authorized the Department of Aviation to contract with
CNN Airport Network for installation of its system at LIA at a cost of
$67,850. The project will be funded initially from operating reserves,
then reimbursed in the next few months from money approved in the
agreement with Coca Cola. An itemized list of equipment was included
in agenda backup. If for any reason the agreement between CNN and
the City is terminated, the City will retain ownership of the equipment.
Programming will be provided by CNN Airport Network at no charge to
the City. CNN will derive revenue through proceeds from the sale of
commercials that are placed on the system for nationwide viewing. The
City will be allowed to place two thirty-second local commercials on the
system per half-hour, and will keep all revenues that it derives from the
sale of the local commercials. In addition, the City will be given one
three -and -one-half minute "info-mercial" per half hour for non-
commercial advertising such as a spot promoting local tourism or
economic development.
The installation of CNN Airport Network is a means of providing high
quality news, weather and sports programming to our customers. The
proceeds from local commercial sales will go toward increasing net
revenues of the Airport.
The Airport Board has reviewed this item and recommended approval.
Staff also recommended approval.

HB 3072 mandates that the TNRCC return a portion of all tipping fees
collected in the state to local governments. The funds are apportioned
back to each Council of Government based on a formula which includes
(but is not limited to) population, need, and number of counties in the
Council area. The Councils then conduct a competitive grants programs
request to address the needs of their specific region. This year, SPAG
has approximately $174,000 available for pass -through implementation
projects. The SPAG Solid Waste Advisory Committee has chosen to
limit each single -jurisdiction award to 25 % ($58,000) of the total
available funding. The Solid Waste Department's grant application is for
the purchase of equipment to enhance the City of Lubbock Recycling
Program.
Budget Impact - This grant is for a twelve-month period and will have
minimal impact on the Solid Waste budget. If the SPAG Solid Waste
Advisory approves the glass pulverizer purchase, the Solid Waste budget
will be impacted by $16,000. This reflects the total cost of the glass

pulverizer minus the $58,000 single jurisdiction award. At the end of
the grant period, the program will be evaluated to determine whether it
will receive continued funding from City resources.

application.

In conjunction with opening of the City Holding Facility, six
temporary/substitute judges were appointed in September of 1997 for the
principal purpose of providing night-time magistration for prisoners
brought to the holding facility on outstanding warrants or instanter
tickets. The initial term of service of those six judges has expired as of
September 11, 1999. While they continue to serve officially (as "de
facto" judges, absent a specific act of reappointment), it would be more
appropriate to take specific Council action to reappoint them, to
eliminate any potential question of the legality of their actions. They
will also continue to provide potential emergency relief for the presiding
judge when he is absent from the City, ill, on vacation, etc. Each of the
six judges has agreed to continue service and accept reappointment.
The individuals will continue to act under the direction of the presiding
judge. Compensation for the positions is recommended to continue at
$30 per hour for time spent during regular business hours (8 a. in. -
5 p. m.) and $50 per hour for time outside of normal business hours.

The "learning center" room at the Patterson Branch Library was
activated in February 1996, with grant funds provided for special
hardware and software. From that time until now, 677 individuals
enrolled in basic literacy, how to use the computer, help with reading,
math, writing skills, and GED test preparation.
"Active users" in any given week are 15 to 20 percent of enrollment. In
the case of GED preparation, there are 60 enrollees current, with
approximately 12 "active users". Given the historic percentages of
educational attainment, school dropout, etc., the program at T. J.
Patterson Branch Library has been relatively successful.
This agreement with Region 17 Adult Education, however, is intended to
strengthen both the "learning center" program and the library services
program:
❖ Region 17 staff is trained specifically in "adult education"
technique and teaching methods. Region 17 will provide staff,
materials, etc. at no cost to the Library.
❖ The Library will:
♦ Save $2500 annually in software maintenance costs.
♦ Save $22,000 in FY 1999-2000 hardware and software
upgrading costs
♦ Gain the use of one Library Assistant to young adult and
outreach work
Because this agreement sustains the existing Learning Center program,
saves funds to budget, and improves the use of library staffing for
programming in the branch service area, staff brought this proposal and
recommended the Mayor be authorized to execute the necessary
interlocal agreement as provided in the resolution document.

A copy of the Subcontract Agreement is filed with Resolution No. 6534.
South Plains Emergency Medical Services/RAC (SPEMS) is the lead
agency in the Injury Prevention Coalition of the South Plains. The City
of Lubbock is one of the founding members of that coalition, and Jere
Hart, the City Traffic Engineer, is the vice -chair for that group. SPEMS
has received a $72,000 grant from the Texas Department of
Transportation (TxDOT) for injury prevention programs. The City of
Lubbock has been approved for up to $16,000 of those funds for a Safe
Communities Program at Safety City.
This is the second consecutive year that the City will have received
$16,000 for Safety City through SPEMS. This subcontract agreement
will cover the period from October 1, 1999 through September 30, 2000.
The agreement will provide for reimbursement of expenses including up
to $10,000 for part-time staff for instruction as well as the purchase of
two additional miniature vehicles and repairs to the 17 existing miniature
cars. This agreement will enhance the service to approximately 5,000
local and area second and fourth grade students.
Second grade students will participate in Safety City programs as
pedestrians and bicyclists, while their fourth grade counterparts are
allowed to also participate as motorists in the miniature cars. During the
field trip to Safety City, the students are exposed to a simulated traffic
environment that features many of the hazards that children encounter
daily. The instructors and trained volunteers practice the safety
precautions with the children.
The Parks and Recreation Department and the Traffic Engineering
Department recommended that Council authorize the Mayor to execute a
subcontract agreement with South Plains Emergency Medical
Services/RAC (SPEMS) as part of their contract with Texas Department
of Transportation for the Injury Prevention Coalition of the South Plains.

When bonds are issued, a paying agent/registrar is identified to pay
bondholders semi-annual payments. Recently the current service
provider raised rates. In addition, the current service provider has not
performed satisfactorily. Working with the City's financial advisor,
First Southwest, the City obtained quotes from other paying
agent/registrars for the payment of outstanding debt service. The
successful bidder was Bank One Investment Management Group. Their
quote to perform the paying agent services is $9,400 less annually. Over

The City of Slaton, having a surplus of water, and the City of New Deal,
desiring to supplement its water supply, have developed an interlocal
agreement for the purchase and sale of water between them that is
contingent on this agreement to process and deliver the water. Since all
the water provided to the City of Slaton by the Canadian River
Municipal Water Authority (CRMWA) is treated by and passes through
the City of Lubbock water treatment plant, the simplest and most
economical way to deliver the water from Slaton to New Deal is via the
City of Lubbock water system. This agreement provides the terms and
conditions necessary to do this. In this agreement Lubbock would
deliver up to 50 million gallons of water from Slaton to New Deal

annually. New Deal would pay to Lubbock the sum of Lubbock's
budgeted cost, per thousand gallons, for delivery of the water to New
Deal, as calculated annually by Lubbock. The budgeted cost for the
1999-2000 fiscal year is $0.42 per thousand gallons.
The point of delivery for the Lubbock water system would be the nearest
practicable point to the extreme northwest corner of the property owned
by the City of Lubbock just north of the Lubbock International Airport.
This agreement is contingent upon Lubbock obtaining sufficient grant
funding from the United States of America, or the State of Texas to
construct a pipeline system planned for the airport industrial park. This
pipeline system would be used to transport the water to New Deal.
The water processing and delivering agreement, as proposed, would
serve to provide the most reasonable, cost effective and practical method
to allow water to be transferred from the City of Slaton to the City of
New Deal. The City of Lubbock will be fully reimbursed for all costs
associated with processing and delivering the water. In view of these
considerations, staff recommended approval of this item.
(42.) Approve Science Spectrum 1999-2000 Budget for Omnimax Theater.
Each year, the Science Spectrum budget for the Omnimax Theater is
presented to the Council as a matter of information. The City of
Lubbock has a vested interest in the continued successful operation of the
Science Spectrum. Article 5, Section 14 of the Land Acquisition and
Management Agreement between the City of Lubbock and the Science
Spectrum requires the Science Spectrum to present its annual budget for
its Exhibition Hall/Auditorium for approval.
The Science Spectrum has met its quarterly payment schedule to the City
Of Lubbock.
The budget information for the Omnimax Theatre is included in the

was present to answer any questions from Council.
The Science Spectrum budget for the Omnimax Theatre was accepted by

Senate Bill 7 enacted into law by the 76th Session of the Texas
Legislature and signed by the Governor on June 18, 1999 promotes
competition among electric utilities within Texas. A portion of this Bill
allows public utilities such as Lubbock Power & Light to limit the type
of information they must disclose to the public. This portion was
included to give public utilities the same rights and privileges currently
enjoyed by investor -owned utilities. This action levels the competitive
playing field among all utilities in Texas.
The resolution includes a specific list of items considered to be
competitive matters.
The staff recommended approval of the requested resolution to enable
LP&L the same rights concerning competitive matters as are currently
enjoyed by its competitors.
