Bob Schmidt, President, Lubbock Memorial Arboretum Foundation, announced the kick off of the Tree-Mendous Tree program to stimulate interest in the importance of trees in West Texas. Memorial pens, made from the lumber of the Winchester Mulberry tree formerly growing at 50th and Indiana, were presented to Councilmembers in appreciation of their work for the City. The volunteer board of the Lubbock Memorial Arboretum is kicking off its Tree-Mendous Tree program in an attempt to establish Lubbock as a leading home of Texas Champion Big Trees. The Foundation's president, Bob Schmidt, discussed the program's purpose of stimulating interest in the importance of trees in West Texas and the opportunity of citizens to nominate big trees for competition for the largest tree of each species within the boundaries of Lubbock County. The Lubbock County winners would then be eligible for nomination for state or national champions. Lubbock is already home to one State Champion Tree, a Chickasaw Plum located at 4820 38th Street. With enthusiastic citizen involvement in identifying other candidates, there can be yet another reason to consider Lubbock the "Home of Champions." G•1 Regular City Council Meeting November 19, 1998 Page 361 The Winchester Mulberry tree that formerly grew at the intersection of 50th and Indiana is no longer a candidate due to its death and removal a few years ago. However, its history is preserved in memorial pens made from its limbs. The Arboretum Board presented the memorial pens to the Council in appreciation of their work for the City. The Lubbock Memorial Arboretum Foundation, established in 1963, is a non-profit organization responsible for the planning, maintenance, and improvement of the Arboretum and Botanical Gardens. Administered by an all -volunteer board of fifteen members, the foundation provides educational programs and promotes research and development in gardening and growing experiences for the public. The Lubbock Memorial Arboretum fulfills its purpose by showcasing an extensive selection of plant specimens and an experimental growing area as well as by providing educational programs. The Tree-Mendous Tree program is intended to highlight the quality of life in Lubbock and to establish the city as a leading home in Texas Champion Big Trees. The Council was presented with memorial pens made from one of the most famous trees in Lubbock; the Winchester Mulberry formerly located at 50th and Indiana. ( 9A.) Presentation of Special Recognition to the Lubbock County Bar Association for "Keep Justice Alive" Week. The Rule of Law and the integrity of the legal system are the cornerstones upon which our democracy is built. The Constitution sets out the inalienable rights of all people; it is incumbent that the public has a stake and a responsibility for the continued strength of our democracy. The public's perception and understanding of the legal system and the legal profession has eroded over the past several decades. The State Bar of Texas has developed an educational plan whereby it will partner with lawyers, local and specialty bar associations, and members of the judiciary to restore public trust and confidence in the legal profession. Part of that plan includes an initiative to educate the public and especially young people about the rule of law and familiarize them with courthouses in their area of the state. The Lubbock County Bar Association has planned events throughout the week to be a part of this unified educational program designed to ensure Texas citizens understand the importance of the rule of law and their part in the legal system. This special recognition commemorates Keep Justice Alive week. Bill Matea, Fred Bowers, and Gordon Treadaway accepted this recognition on behalf of the Lubbock Bar Association. ( 9B.) Presentation of a Special Recognition to Crestview Elementary School by Acting Mayor Jeremy Wilkins. 10-year-old Jeremy Wilkins was honored as "Mayor for a Day" through the Make -A -Wish Foundation. As acting mayor, he presented a special recognition to Crestview Elementary School in recognition of the students' activism in the community. Mayor Sitton then invited Jeremy to sit on the dais and assist her in presiding over the remainder of the Council meeting. 361 Regular City Council Meeting November 19, 1998 Page 362 CONSENT AGENDA (Items No. 10 - 23, 25 - 27) Motion was made by Councilmember Patterson, seconded by Councilmember McDougal to approve all items on consent agenda as recommended by staff. Wade Matthew L. Wade Assistant City Attorney At the September 10, 1998 City Council meeting, an offer was made to the above owners for this tract of right-of-way needed for the railroad relocation project. When the City's appraiser, Jim Bowman, MAI, visited with the owners, they refused to let him on the property. His first appraisal indicated a value of $107,300 for this tract of land. They refused this offer, but after negotiations, allowed the appraiser on the property, discussed with him additional land sales in the area, and additional information about their property. After reviewing this 366 Regular City Council Meeting November 19, 1998 Page 367 information and visiting with the owners, the appraiser entered this new information into his appraisal and came up with a new value of $152,500 for the property. Of this amount, $9,500 is for the 10.51 acres and $143,000 is for the damages the majority of which result from the owner's irrigation system being altered. This resolution authorizes the Right -of -Way Department to offer the property owners this appraised amount and if refused, institute condemnation proceedings to acquire the property. This is a probable condemnation case. The Right -of -Way Department recommended the approval of our offer to these property owners. (17.)
