Ordinance No. 10107 abandoning and closing two portions of 98th Street just west of Orlando Avenue in Sections 14 and 17, Block E-2, Lubbock County, Texas (9802 Orlando Avenue) (first reading). IL.. Regular City Council Meeting October 8, 1998 Page 195 ORDINANCE NO. 10107 AN ORDINANCE ABANDONING AND CLOSING TWO PORTIONS OF 98TH STREET IN SECTION 14, BLOCK E-2 AND SECTION 17, BLOCK E-2; LUBBOCK COUNTY, TEXAS, AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO REFLECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. This ordinance abandons and closes two portions of 98th Street just west of Orlando Avenue and north of the new 98th Street route. Originally, 98th Street was situated on the section line until 1985, when the 98th Street and Quaker Avenue project shifted this intersection southward and eastward to miss a playa lake area. Right-of-way was acquired at this time from H. A. Sessions, the proponent of this closure, for this intersection project. In 1994, the City and the Texas Department of Transportation widened 98th Street from Slide Road eastward to Indiana Avenue. The State required the City to purchase additional right-of-way on 98th Street to lengthen the curve radiuses. This moved 98th Street further southward and left the 1985 route of 98th Street vacant. The City owns these old parcels of 98th Street right-of-way, and Mr. Sessions desires to acquire the two parcels of 98th Street just west of Orlando Avenue and south of Lot 297, Kingsgate Addition. Mr. Sessions will have to pay for the north portion of 98th Street being closed since he was not the original dedicator. This 5,976.72-square- foot portion of 98th Street right-of-way is valued at 94C per square foot for a total of $5,609.66. It will be dedicated back in the plat as a utility easement due to the location of existing utilities, so a deduction of 50 % will be applied to this $5,609.66 for a total due the City of $2,804.83. Mr. Sessions was the original dedicator of the south portion of 98th Street so he will not be charged for it. The Right -of -Way Department recommended the approval of the first reading of this ordinance. (22.) Ordinance No. 10108 abandoning and closing a 20-foot alley in Section 7, Block B, and a 37.5 foot power line easement located in Section 7, Block B, Lubbock County, Texas (3202 Avenue B) (first reading). ORDINANCE NO. 10108 AN ORDINANCE ABANDONING AND CLOSING A 20 FOOT ALLEY LOCATED IN SECTION 7, BLOCK B, LUBBOCK COUNTY, TEXAS, AND A 37.5 FOOT POWER LINE EASEMENT LOCATED IN SECTION 7, BLOCK B, LUBBOCK COUNTY, TEXAS, EACH OF WHICH IS MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS ORDINANCE; DIRECTING THE CITY ENGINEER TO MARK THE OFFICIAL MAPS OF THE CITY TO RELECT SAID ABANDONMENT AND CLOSING; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. This ordinance abandons an alley area and an easement in an area west of Avenue B, east of Avenue D, and north of 34th Street for Frito-Lay for replat purposes. This 20-foot alley area being closed contains 13,460.04 square feet and is located just west of Avenue B. It will remain as a utility easement. The 37.5-foot power line easement is located north of 34th Street in the area that will be dedicated for 195 Regular City Council Meeting October 8, 1998 Page 196 Avenue D and contains 20,037.6 square feet. There will be no charge for these closures since more area is being dedicated than closed. All utilities are in agreement with these closures. The Right -of -Way Department recommended the approval of the first reading of this ordinance. (23.) Resolution No. 6020 authorizing the Mayor to execute a contract of sale with Mary Lou Scott and Helen Sue Hoskins for the purchase of Lots 1-10, Block 56, Original Town Addition to the City of Lubbock for a Citibus parking lot (701 Texas Avenue). RESOLUTION NO. 6020 WHEREAS, the City of Lubbock, Texas, a Home Rule Municipality located in Lubbock County, Texas, has determined and does hereby determine that the public needs, safety and welfare demand and create a public necessity for the acquisition of additional land for municipal purposes and public purposes, to -wit: for construction of a Citibus Parking Lot, and the City Council of said City finds it in the public interest and for public purposes and municipal purposes to proceed with the acquisition of such lands as needed for such purposes as aforesaid; NOW THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: SECTION 1. SECTION 2. Passed by City Council this 8th day of October, 1998. /s/ WINDY SITTON WINDY SITTON, MAYOR ATTEST: /s/ Kaythie Darnell Kaythie Darnell, City Secretary APPROVED AS TO CONTENT: /s/ Ed Bucy Ed Bucy, Right -of -Way Agent APPROVED AS TO FORM: /s/ Richard K. Casner Richard K. Casner, Natural Resources Attorney A copy of the Contract of Sale is filed with Resolution No. 6020. 196 Regular City Council Meeting October 8, 1998 Page 197 Citibus desires to purchase the one-half block of land north of their existing facility. This one-half block of land fronts onto Texas Avenue and is located between 6th Street and 7th Street and contains a 23,374- square-foot building. This building will be demolished, and Citibus will build a parking lot for their busses at this location. The legal description of this land to be purchased is Lots 1-10, Block 56, Original Town Addition, and this property is owned by Mary Lou Scott and Helen Sue Hoskins. The property has been appraised by Gary Phillips at $230,000, which they have accepted. It was listed with Lynn Zickefoose, realtor, for $300,000. This contract calls for a closing date on or before October 30, 1998. Citibus has done an environmental assessment study of this property, and the only possible problem seen is a hydraulic car lift that could have leaked. CSG, the environmental research company, did background research on this, and a pressure test showed the oil tank for the lift held pressure and has probably never leaked into the subsurface. Nevertheless, Citibus has set aside a maximum of $50,000 to cure this problem, but a more reasonable figure would be around $15,000 to $17,000. This would also include the removal of this lift that is required for demolition anyway. The Federal government is paying for 80% of this acquisition and the City is paying 20%, which has already been budgeted. Two tenants will be relocated from this building. The Right -of -Way Department recommended the approval of this contract. (24.) Passed by City Council this 8th day of October, 1998. /s/ WINDY SITTON WINDY SITTON, MAYOR ATTEST: /s/ Kaythie Darnell Kaythie Darnell, City Secretary APPROVED AS TO CONTENT: /s/ Doug Goodman Doug Goodman, Managing Director of Health and Community Services APPROVED AS TO FORM: /s/ Amy L. Sims Amy L. Sims, Assistant City Attorney After discussion with the Police Department and Lubbock County, the City of Lubbock will waive its eligibility to apply for the Juvenile Accountability Incentive Block Grant awarded from the Criminal Justice Division of the Governor's Office. Lubbock County submitted an application for this funding on September 30, 1998. The County will expend 95 % of these funds for the expansion of the Lubbock County Youth Center (LCYC) and 5 % will be utilized for administrative expenditures. Because a number of issues involving juveniles in Lubbock are coordinated under the authority of County government, the City of Lubbock will support the County's application and any efforts the County undertakes in acquiring these block grant funds. Therefore, the City wished to designate Lubbock County as the recipient of its allocated amount of $121,339. In making this designation, the City of Lubbock will appoint a representative to serve on the Juvenile Crime Enforcement Coalition. Staff recommended City Council approval of the resolution. (28.) By: /s/ Jerry Smith PRINTED NAME: Jerry Smith TITLE: President COMPLETE ADDRESS: Lubbock Building Services, Inc. P.O. Box 65600-194 Lubbock TX 79464 This project consists of renovations and additions to the former Fort Worth and Denver South Plains Depot building to allow for the opening of the new Buddy Holly Center on September 1, 1999. The plans and specifications for this project were prepared by McKinney Architects of Austin and Driskill Hill Architects of Lubbock. The work consists of new concrete foundations and slab, new brick veneer, CMU bearing walls, new clay tile, metal and membrane roofing, new interior finishes and partitions, structural steel, mechanical, electrical and plumbing systems. 1:1 Regular City Council Meeting October 8, 1998 Page 209 Because of the complexity of this project and the necessity to allow other consultants and staff to complete the programming and installation phase of the project in time for the grand opening, completion of galleries and public spaces have been staggered. In order to allow adequate time for the installation and a thorough walk through of all electronic components of the Buddy Holly permanent exhibition, Gallery One must be completed by June 1. Other galleries and the gift shop must be completed by July 1 so that installation of changing exhibitions and merchandise can be completed. We are beginning to promote internationally the events that will occur around the grand opening and will be raising about $65,000 to cover the costs of staging a premiere reception on September 2, a ribbon cutting on September 3, and lectures, performances, and gallery talks throughout the weekend. In addition, discussion is underway on activities that will be presented as part of the Buddy Holly festival in conjunction with the grand opening. Failure to meet any of the deadlines during construction will delay installation of exhibitions and programs and will jeopardize having programs ready for the grand opening. In addition to the loss of any funds invested in staging the grand opening and events for that weekend, we would risk creating a huge credibility gap. Many of the people we are inviting to Lubbock for that weekend are the same ones we need to establish a relationship with for future donations of cash and artifacts. The lowest submitted bid is in the amount of $1,314,525. However, based on reference checks and previous work experience with this contractor, staff recommended that City Council reject this bid and award the contract to the lowest responsible bidder as required by Texas Local Government Code §252.043(a). The Buildings Capital Outlay -Depot Renovations budget amount is $1,390,000. The recommended low bid is $1,351,000 from Lubbock Building Services of Lubbock, Texas. (33.) Passed by City Council this 8th day of October, 1998. /s/ WINDY SITTON WINDY SITTON, MAYOR ATTEST: /s/ Kaythie Darnell Kaythie Darnell, City Secretary APPROVED AS TO CONTENT: /s/ Tommy Gonzalez Tommy Gonzalez, Managing Director of Civic Services APPROVED AS TO FORM: /s/ William de Haas William de Haas, Competition and Contracts Manager/Attorney A copy of the Contract is filed with Resolution No. 6061. The Canyon Lakes Project had its beginning in 1966 whereby the Yellowhouse Canyon began to be converted from a dumping ground into a regional park. The City of Lubbock Planning Department prepared a feasibility study in March 1968 which included the following objectives: water conservation, outdoor and water based recreation facilities, elimination of pollution sources and blighted areas, preservation of a significant amount of open space, and strengthening Lubbock's economic base. In October 1968, Freese, Nichols, and Endress Consulting Engineers prepared a feasibility report with the charge to evaluate the basic feasibility and probable cost of the Canyon Lakes project. On August 8, 1970 the citizens of Lubbock approved a $2.8 million bond package for development of the project, and these funds were utilized along with various grants to initiate development of the project. 255 Regular City Council Meeting October 8, 1998 Page 256 The Yellowhouse Canyon is the most unique physical feature in Lubbock and is one of the largest urban parks in the United States. Initial planning proposed a series of eight lakes, six within the City limits and two downstream, however, I-27 routing and funding constraints only allowed for the construction of four lakes. This "gap" in the lakes system did not allow the continuous, navigable stream concept envisioned in the original plan. Recently approved "Goals for Lubbock" and the Parks, Recreation and Open Space master plan encourage completion of the Canyon Lakes System. With the advent of recent plans for equestrian trails, a campground, the National Windmill Museum and discussion of relocating Prairie Dog Town, it is an opportune time to consider the next phase of development for the Yellowhouse Canyon Lakes System. A Request for Proposals was sent out to solicit architectural and engineering services for the Canyon Lakes Feasibility Study. Two responses were received: one from Carter and Burgess, Inc. and one from Freese and Nichols, Inc. The review committee unanimously selected Carter and Burgess, Inc. Carter and Burgess, Inc. will provide professional landscape architectural, planning, engineering and architectural design services for preparing the Canyon Lakes Feasibility Study for the City of Lubbock. The scope of work will include developing concepts which address the overall feasibility of the following design issues: future park and commercial sites; recreational facilities; potential private development venues; continuous navigable water courses; bridge locations and architectural theming; lakes and dams; and opportunities for trail development. For additional expertise of the design team, Carter and Burgess, Inc. will retain the services of Parkhill, Smith and Cooper, Inc. as a subconsultant. The study is scheduled to be completed within sixteen weeks after authorization to proceed. Carter and Burgess, Inc.'s fee, including reimbursable expenses, is not to exceed $114,480. Jim Bertram, Director of Strategic Planning, presented staff comments. Staff recommended that the Mayor be authorized to execute the necessary contract documents provided in the resolution. Motion was made by Councilmember Cooke, seconded by Councilmember Patterson to pass Resolution No. 6061 as recommended by staff. Motion carried: 6 Yeas, 0 Nays. MISCELLANEOUS (70.) Sims Amy L. Sims, Assistant City Attorney A copy of the Assignment is filed with Resolution No. 6065. Market Lubbock, Inc. and the Marketing, Entertainment, Travel, Tourism and Sports (METTS) boards were formed to address the economic development and tourism needs of the Lubbock community. When these boards were formed the thinking was that at some point they would merge in order to maximize their effectiveness. With this in mind, and since economic development and tourism are a natural partnership, during the METTS board meeting in September 1998, the Lubbock METTS board voted to dissolve as a governing body of the Convention and Tourism Bureau of Lubbock and the Lubbock Sports Authority. In dissolving the METTS board, the Convention and Tourism Bureau of Lubbock and the Lubbock Sports Authority will fall under the direction of Market Lubbock, Inc. The goal of this merger is to unite Lubbock's economic development forces to fully take advantage of opportunities for both economic and tourism growth. The consolidation will take advantage of efficiencies and is a natural tie to Lubbock City Council efforts to maximize effectiveness in economic development and tourism efforts. 260 Regular City Council Meeting October 8, 1998 Page 261 METTS, Inc. has been involved in attracting visitors to Lubbock through conventions and sporting events as well as a multitude of special events and concerts. These duties will not change as the Convention and Tourism Bureau and the Lubbock Sports Authority work under the direction of Market Lubbock, Inc. With the consolidation some administrative functions will be streamlined, which should allow the Convention and Tourism Bureau and the Lubbock Sports Authority to spend more time on promoting Lubbock for conventions, tourism, and sporting events. Regarding the logistics that will make this consolidation a reality, several steps need to take place to affect the changes that must occur to transfer the METTS functions to Market Lubbock, Inc. Since METTS is a corporation with assets, liabilities and fixed assets, there are several issues that need to be addressed before the transfer of responsibility and funds takes place. First, Market Lubbock, Inc. must amend their articles of incorporation and/or corporate laws to reflect the new functions they are assuming. Second, the city must accept and resolve all METTS contracts, assets and liabilities before conveying these documents to Market Lubbock, Inc. Third, the City of Lubbock must execute an amendment to the agreement between Market Lubbock, Inc. and the City of Lubbock reflecting their additional functions. Lastly, the City of Lubbock will assign all contracts, assets and liabilities previously held by METTS, Inc. to Market Lubbock, Inc. These changes represent a positive step in uniting Lubbock toward a common vision of growth and development that encompasses economic development, tourism, and sports. Anita Burgess, City Attorney, presented staff comments. Staff recommended that Council authorize the Mayor to execute the resolutions and all related documents that will affect the transfer of METTS functions to Market Lubbock, Inc. Motion was made by Councilmember Cooke, seconded by Councilmember Nelson to pass Resolution No. 6065 as recommended by staff. Motion carried: 5 Yeas, 1 Nay. Councilmember Hernandez voted Nay.
