In October 1997, City Council passed a resolution creating a Citizens
Advisory Committee and establishing Citizen subcommittees on Finance,
Transportation, and Community and Municipal Facilities. Jim Gilbreath
was asked to serve as the overall CAC Chair, Steve Krier chaired the
Finance Subcommittee, Clayton Yeager chaired the Transportation
Subcommittee, and Jim Brunjes chaired the Community and Municipal

numerous times and have held public meetings to receive citizen input.

1:40 P. M. WORK SESSION RECESSED
1:53 P.M. WORK SESSION RECONVENED
( 6.) Presentation on the architectural and engineering improvements as
recommended by the Canyon Lakes Master Plan Feasibility Study by T
Phillip Neely, Project Manager for design team of Carter & Burgess,
Inc. and Parkhill, Smith & Cooper, Inc.
In September 1998, the design team of Carter & Burgess, Inc. and
Parkhill, Smith and Cooper were commissioned by the City of Lubbock
to create a new, visionary plan for the continued development of the
Canyon Lakes System. The design team prepared conceptual
alternatives that address the feasibility of completing the series of lakes
in the canyon. During the 1970s, the original plan for the system called
for eight lakes, with two placed outside the city limits. Lakes One,
Two, Three, and Six were constructed, however Lakes Four, Five,
Seven, and Eight were omitted from the original development due to
funding constraints.
The feasibility study envisions the creation of a continuous, navigable
body of water and the design and location of bridges to allow boat,
vehicular and pedestrian circulation throughout the canyon. Additionally
the plan addresses future commercial sites, parks and recreational
facilities, water recreation areas, potential private development venues,
architectural theming of bridges and park amenities, and a network of
trail systems.
Included are improvements to the existing Lake One, Lake Two, Lake
Three, and Lake Six. Also provided are recommendations for
development of Lake Four and Lake Five. Lakes Seven and Eight, both
outside the city limits, were not considered as part of the feasibility
study. A phasing schedule is also provided that balances new
development with improvements to the existing infrastructure. For
384

example, the first phase consists of development of Lake Four and a new
dam and bridge crossing, an outdoor theater in Mackenzie Park, and a
new festival area in the Buddy Holly Recreation Area at Lake Two.
The vision for the feasibility study is to establish the system as a
timeless, enduring, multi -purpose recreational resource for the City of
Lubbock. It will represent stewardship of the natural resources through
continued focus upon water reclamation and the naturally diverse
ecosystems throughout the canyon. The continued implementation of the
Canyon Lakes system will make it a popular destination point for park
users from West Texas, the United States and international visitors to
Lubbock.
Phillip Neely, the project manager for the design team of Carter &
Burgess, Inc. and Parkhill, Smith & Cooper, Inc., made a presentation
on the architectural and engineering improvements as recommended by
the Canyon Lakes Feasibility Study.

the Texas Tech University Police Department.
A representative from the Police Patrol Division discussed vehicle and

Section 175.1 Certain streets in the newly annexed area do not have

studied this area and proposes the following speed limits on Upland
Avenue, 114th Street and 66th Street. The Texas Department of
Transportation plans to widen Frankford Avenue from West Loop 289 to
north of the City Limits and following a detailed speed study, they have

Section 175.2 North Ridge Elementary School, F.I.S.D. (6302 llth
Place) has requested a school zone for several years at this location but
did not meet the criteria due to only one-half street width constructed on
I Ith Place. Recently this street has been constructed to full width and a
large number of new homes have been constructed to the south of this
street. This location now meets the criteria for a reduced speed school
zone, and Traffic Engineering Department plans on installing the new
flashers and signs this summer. The new school zone is in front of the
school.
New construction costs for this school zone are available in the Traffic
Signal Capital Projects Fund. Operations costs can be absorbed in the
existing Traffic Operations Fund.
At its March 23 and April 20 meetings the Citizens Traffic Commission
recommended approval of these speed limit changes and additional
schoolzone.
The Traffic Engineering Department and the Citizens Traffic
Commission recommended approval of the first reading of this
ordinance.

A copy of the Amendment to Agreement is filed with Resolution No. 6331.
With the addition of hockey in the Municipal Coliseum, there will be
new revenue generated through additional beverage sales. The contract
terms negotiated for hockey included rent credits so that the franchise
could recoup their capital investments in retrofitting the Coliseum for
hockey. The City will receive revenues through ticketing fees, shared
advertising and parking revenues from the hockey franchise, and
concession commissions from Civic Lubbock, Inc.
This amendment to the agreement between Civic Lubbock, Inc. and the
City of Lubbock increases the commission paid to the City by Civic
Lubbock, Inc. from 20 % to 30 % on the beer sales generated from the
hockey games. Since this is a new revenue stream for Civic Lubbock,
Inc., it should not adversely affect their ability to handle their financial
commitments. It will, however, allow the City to generate additional
revenue to offset the rent credits given to the hockey franchise for the
Coliseum improvements. Revenue generated for the City is expected to
be approximately $86,000, using an average attendance of 3,000 per
game. Civic Lubbock, Inc. approved this amendment at their board
meeting on May 20, 1999.
This amendment to the agreement between the City of Lubbock and
Civic Lubbock, Inc. will increase the commission paid to the City from
20 % to 30 % on all beer sales sold for the upcoming hockey games. This

additional revenue will assist the City in offsetting the rent credits given
to the hockey franchise for the capital investment they are making in the
facility. City staff recommended approval of the amendment to the
agreement.

Five concessionaire contracts will provide on -airport, automobile rental
concession services at Lubbock International Airport. Automobile rental
services are to provide the highest standard of quality at competitive
pricing with an adequate number of vehicles. Successful incumbent rent
car concessionaires will remain in their present locations. Each contract
is for a three-year term with 30-day extensions. The selection committee
used the basic evaluation methods in the Evaluation Procedures for
Competitive Negotiation for Professional and Non -Professional Services
as written in the City's Purchasing Manual. Evaluation criteria included:
• Management and Operational Plans including management plans
and experience profile; customer service programs, philosophies,
and training; operational inventory and cash controls. (10%)
• Operational background and experience in providing automobile
services on airports; demonstrated knowledge of car rental
business and understanding of market conditions; professional
references. (10 %)
• Reservations systems and/or national franchise proposed or
availability of reservations directly with national companies or
through travel agencies. (5 %)
• Amount of the proposed minimum annual guarantee, including
financial strength of proposers as described in the qualification
and business information questionnaire. (75 %)
First each committee member independently reviewed and scored the
proposals. After committee discussion of individual scores and reference
checks, aggregate total scores for each proposer were recommended to
the Airport Board for its approval. Proposals were ranked and scored as

The Airport Board met on May 19, 1999 to deliberate the
recommendation of the selection committee. By unanimous vote of those
members attending (one member was absent) the Board accepted the
selection committee's recommendation and forwarded the item to the
City Council for final action.
During their deliberation, the Board members acknowledged the impact
that the contracts will have on the revenue stream at the airport. Under
the new contracts (sample contract included in Council backup), each
concessionaire will be required to pay either an annual minimum
guarantee or ten percent of their annual gross revenue, whichever is
greater. The contracts will generate an aggregate minimum annual
guarantee of $1.9 million compared with the current aggregate minimum
annual guarantee of $480,000. The increase in revenue will provide
additional financial security to the airport in the event of a sudden
reduction in passenger traffic. However, in most cases the
concessionaires actually pay the percentage of gross revenue (percentage
rent) rather than the minimum annual guarantee. Therefore, since we
are adding one new rental car concessionaire that will bring their market
onto the airport, we anticipate the overall yield of percentage rents to
increase by as much as ten percent.

This project involves the replacement of roofs at the Garden and Arts
Center, the City Warehouse, and the Radio Shop, and repair of the Fleet
Maintenance Facility roof. The Building Capital Outlay -Facilities
Reroof budget amount is $225,000.
The low bid is $174,684 from A/P Resources of Odessa, Texas. Many
of the references provided by A/P Resources had not heard of the firm,
and some reported areas of concern. Based on the lack of adequate and
acceptable references, staff did not recommend awarding a project of this
scope to A/P Resources.
The lowest responsible bidder is Lydick -Hooks Roofing Company of
Lubbock, Texas with a bid amount of $176,636.
(22.) Bid #99129--Generator Rotor Repair (Electric Production)
403
Regular City Council Meeting
June 10, 1999
Page 404
During early May, the No. 4 generator at J. Robert Massengale
Generating Station could not be brought on line because of open field
windings in the rotor. The rotor was removed and sent to National
Electric Coil's facility in Ohio for evaluation. Besides locating two
breaks in the windings, National Electric Coil found the winding
insulation to be in poor condition, and they recommended rewinding the
rotor with new insulation using the existing copper windings.
In view of the need for this unit during the summer months, requests for
quotation for emergency repair were faxed to National Electric Coil
(NEC), Siemens -Westinghouse Power Corporation, GE Energy Services,
Electric Machinery Manufacturing, and Dresser -Rand Machinery.
Repair work by the low bidder started in mid -May and is scheduled for
completion in early July.
The low bid was $143,000 from National Electric Coil of Columbus,
Ohio.
Staff recommended award of each bid to the bidder as indicated on the
tabsheets and award of each contract as shown on the resolutions.
REGULAR AGENDA
PUBLIC HEARINGS, PLANNING AND ZONING
(23.) Ordinance No. 10164/Zone Case No. 2844 (4424 35th Street):
Reconsider the request of Dan Wood for zoning change from R-2 to
C-4 limited to an automotive repair shop on Lot 16 and the east 92.5
feet of Lot 15, Block 1, College Heights Addition (first reading).
(Public hearing has been conducted and closed.)
ORDINANCE NO. 10164
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND
THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING
CHANGES: ZONE CASE NO. 2844; A ZONING CHANGE FROM R-2 TO C-4
ZONING LIMITED TO AN AUTOMOTIVE REPAIR SHOP ON LOT 16 AND THE
EAST 92.5 FEET OF LOT 15, BLOCK 1, COLLEGE HEIGHTS ADDITION,
LUBBOCK, TEXAS; PROVIDING A PENALTY; SUBJECT TO CONDITIONS,
PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
The proponent operates a non -conforming auto repair business on 34th
and owns these two vacant lots south of the business on 35th. Adjacent
land uses:
North - commercial;
South - residential and a church;
East - residential; and
West - church.
The proposal does not conform to the policies of the Comprehensive
Land Use Plan. As submitted, the proposal had no element of buffering
from the adjacent residential and would encourage commercial traffic on
a residential street.
Prior to and during the meeting, the proponent made several requests for
conditions that satisfied the adjacent property owners. Two of the
adjacent owners were present, Mr. Hueckel and Mr. Garrett. A written
reversal of opposition from the adjacent church was submitted.
404
Regular City Council Meeting
June 10, 1999
Page 405
The Planning and Zoning Commission recommended approval of the
request subject to the following conditions:
1. The property shall have a six-foot solid wood screening fence
along the full southern length and both sides. The fence along
35th Street shall have a 15-foot front setback.
2. There shall be no driveway from 35th Street. Access shall be
from the north across the alley.
3. No commercial structure on these lots may have a vehicular
opening facing south, east or west. Vehicular access shall be on
the north building face. Glass brick windows and pedestrian
doors are acceptable on the south, east or west walls.
4. Any change of business other than auto repair shall require a zone
change request.
Initially, staff did not support the request. While the two lots would
most likely not be developed as residential in the near term, commercial
encroachment is seldom an asset. Because the adjacent owners agreed to
the use with the conditions, staff supported the recommendation of the
Planning and Zoning Commission.
Motion was made by Councilmember Cooke, seconded by
Councilmember Ince to pass on first reading Ordinance No. 10164 as
recommended by staff. Motion carried: 5 Yeas, 2 Nays. Mayor Sitton
and Councilmember Nelson voted Nay.
(24.) Zone Case No. 2709-A (1701 Buddy Holly Avenue): Hold a public
hearing to consider the appeal of Ron Mercer (for Worklink, Inc.)
for zoning change from IHC Specific Use (for Depot District
standards) to IHC Specific Use (for a homeless shelter) on Lots 1 and
2, Block 215, Original Town Addition, and to consider ordinance.
Mayor Sitton opened the public hearing at 4:15 p. in. Ron Mercer
appeared on behalf of Worklink, Inc. Kurt McMillan, President of the
Depot District Association, and Tess Trost spoke in opposition. Mayor
Sitton closed the hearing at 4:42 p. in. One more person came forward
who wished to speak, so Mayor Sitton re -opened the public hearing at
4:43 p. in. Jim Shearer spoke in opposition. Mayor Sitton closed the
public hearing at 4:48 p. in.
The current Code contains an entry in the Specific Use Section, which
requires a zone change request in every instance, for "Rescue missions
and shelters for the homeless". Adjacent land uses:
North - commercial;
South - commercial;
East - commercial; and
West - commercial.
As Specific Use, the primary objective of the hearing process is to
determine compatibility of the proposal with adjacent land uses. While
the objectives of the proponent are above reproach, the recognition of
Mr. Mercer in his letter that concern for the effects of the activity are
unfounded is obviously up for debate. A number of citizens provided
comments during the hearing. Those in favor generally expanded on the

humanitarian issues of homelessness, while those in opposition were
adamant that the proposed location did not mesh with the objectives
established for the Depot District.
Contrasting vision statements from the City of Lubbock, The Depot
Association, and from Work Link exist in this request. The most recent
goals program for the City of Lubbock, "A Vision into the 215L
Century," established a goal under the Recreation Parks Entertainment
Cultural Affairs Committee to "Revitalize downtown Lubbock as a focal
point for entertainment, arts and business". The Land Use and Urban
Design Committee adopted a companion goal to "Establish a positive
identity for downtown Lubbock, including the Central Business District,
Broadway Corridor and the Depot District, as the civic, cultural,
entertainment, governmental, and financial center of the City."
In addition, the property owners association of the Depot District
adopted a vision statement in 1998 articulating sentiments about the
direction desired for the Depot District (included in Council backup). A
vision statement for Worklink was read during the meeting.
In addition to significant private investment in the area, the City of
Lubbock has recently become an integral part of the District through
purchase and restoration of the Depot Building, recent LP&L
infrastructure renovation grants, and an ongoing streetscape project.
General consensus from the Planning Commission and adjacent owners
seemed to be that the project is a critical need, but in the wrong location.
The Planning and Zoning Commission recommended denial of the
request.
With sincere appreciation for the social objectives of the proponent, staff
supported the recommendation of the Planning and Zoning Commission.
Motion was made by Councilmember Cooke, seconded by
Councilmember McDougal to deny the appeal of Worklink, Inc. Motion
carried: 7 Yeas, 0 Nays.
The next item considered was Item No. 26.

Lubbock citizens participated in this year's process through
neighborhood associations, community and business organizations, direct
participation, and the Community Development and Services Board
(CDSB). After breaking into subcommittees to review the applications
and formulate recommendations in April, the CDSB met on
May 12, 1999 to formulate their recommendation for the FY 1999-2000
funding cycle. In making their decision, the board kept in mind the
goals of the City Council, the consolidated plan, the identified needs of
the neighborhoods, staff priorities, and the recommendations of the
provider groups.
The recommendation for spending federal dollars has been published
since May 19, 1999. This public hearing was held to allow citizens to
directly participate by addressing the City Council with comments.
Staff recommended that the City Council accept the Community
Development and Services Board's funding recommendation.
TRANSPORTATION SERVICES
(26.) Consider request of James Ruthardt and George McMahan to
continue the use of strip paved streets for completion of Papalote
South Subdivision, and take appropriate action.
This item was considered following Item No. 24.
The developers of Papalote South (letter included in Council backup)
have requested the style of paving (strip paving) in the subdivision prior
to annexation. Paving items usually are submitted by Streets
Engineering. In this instance, the Planning Department processed the
request through the Planning Commission.
The request is for an area containing Lots 79-121. The portion
containing Lots 1-79 was developed prior to being inside the City and
met County strip paving standards. The developers are working with
Streets Engineering to place a concrete curb along the edge of the strip
paving to reduce deterioration of the street yet keep the "feel" of the
rural subdivision.
The Planning and Zoning Commission recommended approval of the
request.

neighborhood associations, community and business organizations, direct
participation, and the Community Development and Services Board

The Convention and Visitors Bureau (CVB) is requesting $30,000 for the
Music Crossroads of Texas - West Texas Style Rock-n-Roll Festival.
The Lubbock CVB is coordinating a top -rated 1950's-era rock-n-roll
entertainment act for the residents and visitors in the Lubbock
Community during the festival to promote this event in conjunction with
the grand opening of the Buddy Holly Center.

Regular City Council Meeting

Page 461
The CVB believes that by promoting this type of event, they will
generate out of town visitors and create a strong economic impact for the
City of Lubbock. By providing an entertainment act of this magnitude,
the CVB will ensure future participation by citizens and visitors in years
to come.
From a legal standpoint, Section 351.101(a)(5) of the Tax Code provides
that revenue for the Municipal Hotel Occupancy Tax may be expended
toward projects located in a municipality that will be frequented by
tourists, convention delegates or other visitors to a municipality. With
this in mind, the Lubbock CVB is requesting funding to cover the cost of
the Everly Brothers.
Additionally, the Lubbock CVB believes that the rock-n-roll festival will
attract visitors from all walks of life, many of whom may be involved in
organizations and associations, generating an interest in hosting events
and conventions in Lubbock. The Lubbock CVB feels this is an
opportunity to reach out to the travel trade. Many participants of motor
coach tours grew up in the 1950's era, and this type of event would be
key to draw tour operators to put together overnight programs for the
City. The CVB plans to promote this event worldwide.
Upon approval, the Lubbock CVB will be responsible for executing the
contract with any performers for this event and providing appropriate
payments to them in a timely manner. They will also handle any other
arrangements, i.e. travel, lodging, transportation, etc., for the
performers for the festival. The Lubbock CVB agrees that the sole
purpose of this funding is for the Rock-n-Roll Music Festival.
Funding is available in the Tourism Reserve portion of the hotel/motel
occupancy tax. Council may authorize the Mayor to execute the
agreement between the City of Lubbock and Market Lubbock, Inc. for
the Convention and Visitors Bureau for the Rock-n-Roll Music Festival.
Motion was made by Councilmember Patterson, seconded by
Councilmember McDougal to pass Resolution No. 6341 as recommended

A copy of Amendment No. 1 to Agreement is filed with Resolution No. 6342.
The City of Lubbock and the Canadian River Municipal Water Authority
entered into an agreement in 1996 for the purchase and acquisition of
Conjunctive Use Ground Water supply. The total project cost was
projected to be $92,500,000 and the Phase II cost was projected to be
$62,000,000. City of Lubbock share is approximately $23.1 million.
Since then, additional items have been added to the scope of the project
that are expected to enhance operations resulting in lower long-term
operating costs that are passed on to the City. Due to the passage of
time since estimates were prepared and the additional items added to the
project, CRMWA and the City of Lubbock agreed to reschedule the
issuance of the certificates to allow sufficient time for a bid process to
more precisely identify the true cost of the project.
This resolution amends the original contract with the original cost
estimates and allows the increase in project costs, subject to the
demonstration of the need for the increase, as evidenced by the bid
process. The theory supporting this allows a smaller issuance size, thus
lower costs passed onto citizens. However, if the bid process results in
higher than expected costs, the proposed 15 % rate increase may have to
be adjusted up to achieve the amount necessary to support the required
debt service but would reduce additional debt issuance costs.
This resolution also gives CRMWA the authority to replace their current
reserve requirements with a surety bond election. This action must be
approved by all member cities. Staff concurred that this method saves
considerable funds for all member cities.
Betsy Bucy, Director of Finance, presented staff comments.
Staff recommended approval of the resolution and recognized the efforts
of CRMWA Board members Jim Collins and Bobby Rodgers for their
efforts in this cost containment effort.
Motion was made by Councilmember Cooke, seconded by
Councilmember Patterson to pass Resolution No. 6342 as recommended
by staff. Motion carried: 7 Yeas, 0 Nays.

Copies of Exhibits "A" and "B" are filed with Resolution No. 6343.
These certificates are necessary to fund the final phase of the North
Panhandle Project and are expected to be issued September 20, 1999.
In 1996, total project costs were projected to be $92,500,000. Phase II
project costs were projected to be $62,000,000. City of Lubbock share
is approximately $23.1 million. Since then, additional items have been
added to the scope of the project that have been identified to enhance
operations resulting in lower long-term operating costs that are passed on
to the City. Due to the passage of time since estimates were prepared
and the additional items added to the project, CRMWA and the City of
Lubbock agreed to delay the issuance of the certificates to allow
sufficient time for a bid process to more precisely identify the true cost
of the project.
The theory supporting this allows a smaller issuance size, thus lower
costs passed onto citizens. However, if the bid process results in higher
than expected costs, the proposed 15 % rate increase may have to be
adjusted up to achieve the amount necessary to support the required debt
service but would reduce additional debt issuance costs.
This Phase is a continuation of the project that began in 1996 with the
purchase of right-of-way along the project path. This item replaces
necessary legal requirements reversed by City Council on May 27, 1999.
