LUBBOCK, TEXAS, WITH REGARD TO TELECOMMUNICATIONS
FRANCHISING BY PROVIDING AN AMENDED DEFINITION OF
"TELECOMMUNICATIONS SERVICE"; PROVIDING A SAVINGS CLAUSE;
AND PROVIDING FOR PUBLICATION.
In the course of fine-tuning our telecommunications regulatory
ordinance, our consultant (Mark Smith, Brown-McCarroll) has
recommended that staff slightly broaden our definition of
"telecommunications service" as a result of industry representative
testimony before the Senate Interim Committee on Telecommunications
Franchising that was held in Lubbock last week. This change is very
minimal and will not affect any of the current providers of
telecommunications services within the City of Lubbock. As the
industry continues to expand and proliferate, however, it could be of
future importance with regard to keeping our franchise revenues
proportional to the use of our right-of-way by new types of providers.
Staff has prepared an ordinance making this change at the request of Mr.
Smith and the City.
The staff recommended that the City Council pass this ordinance
amending the definition of "telecommunications service" contained in the
City's telecommunications regulatory ordinance.

One of the 1999 City of Lubbock street widening projects is the
widening of Indiana Avenue from 95th Street to 114th Street. From 95th
Street to 98th Street, Indiana Avenue will be paved, curbed, and guttered
to a full six -lane thoroughfare with a center turn lane. From 98th Street
to 114th Street, three lanes will be constructed which will include a
center turn lane. The Right -of -Way Department is acquiring the full 110
feet of right-of-way or 55 feet on each side of the center line. In some
locations along Indiana Avenue there are some existing dedications, but
the majority must be acquired. There are a total of 15 property owners
and 13 parcels of right-of-way to acquire. These parcels were appraised
by Jimmy Goddard, MAI, whose values are quoted in the resolution with
the parcel number. None of the parcels contain improvements, and the
majority are in future residential areas of development.
This resolution authorizes the Right -of -Way Department to offer the
property owners this appraised amount and if refused, institute
condemnation proceedings to acquire the property.
The Right -of -Way Department recommended the approval of our offer to
all 15 property owners.

A copy of the Change Order is filed with Resolution No. 5880.
The City of Lubbock executed ITB #97300 construction contract with
D. E. Rice Construction Company, Inc. in April, 1998, for Phase I of
the West Texas Region Disposal Facility at a price of $5,264,398.66 for
alternate A, which did not include enough earthwork excavation for cell
1B. Since beginning construction, Rice has offered the City of Lubbock
a more attractive excavation price that both the Solid Waste Management
Department and our engineers, HDR and PSC, agree would be beneficial
to the city to accept. This will save the city $35,497.40 on the
excavation of cell 1A. This is a total savings of $62,532 over the full
excavation of lA and 1B in the original base bid. The cost to excavate
cell 1B will be $1,216,557. Additionally, Rice has offered an alternative
liner that has now been approved by TNRCC to use at this site that will
save the city an additional $174,456.46. This change order will save the
city approximately six months on the final construction of cell 1B, which
will be needed in approximately two -three years. It is estimated that it
will save between $300,000 and $480,000 to excavate cell 1B now rather
than later under a separate contract.
A minor increase in the building foundation cost of $9,000 has occurred
due to encountering clay at the building location that did not show up on
the site borings. This clay is several feet thick, but the seam of it falls
between the original samples collected at the site. Due to the later start
of construction than originally planned, the contractor will not be able to
plant the trees on the site this summer, and a separate contract for this
landscaping will need to be finished early next year. This change _
resulted in a reduction of $10,000. These other two changes result in a
net decrease of $1,000.
All these changes increase the construction contract amount from
$5,264,398.66 by $1,005,603.14 to a new total of $6,270,001.80. This
is an increase of 19.1 %, within the legal contract change order maximum
of 25 % .

Page 337
There are sufficient funds authorized within the Solid Waste
Management Fund to cover these costs.
The City Attorney's Office and The Solid Waste Management
Department recommended approval of this resolution to authorize this
change order.
(21.) Consider the price and condition of sale of Parcels No. 33500-20-20
and No. 33500-20-30 at 1007-1009 2nd Place in the Guadalupe Area.
This is a routine sale of property by the Urban Renewal Agency to John
F. Gildersleeve for $800 ($400 per lot). The property is to be
redeveloped with a new 1,442-square-foot, single-family residence
valued at $85,000. The land is properly zoned.
The proposed development was approved by the Urban Renewal Board
of Commissioners on May 19, 1998. The Community Development
Department recommended approval.
(22.) Consider the price and condition of sale of Parcel No. 15760-48-10 at

property is to be redeveloped with a new 2,000 square foot, single-
family residence valued at $97,000. The land is properly zoned.
The proposed development was approved by the Urban Renewal Board
of Commissioners on May 19, 1998. The Community Development

The U.S. Department of Housing and Urban Development informed the
City of Lubbock that the city was eligible to receive a fiscal year 1998
consolidated formula allocation of $4,371,000, a $10,000 decrease from
last year. With additional monies from program income and carry-over
contingency funds, the city has $4,872,000 to allocate this year. This
year the city received 69 applications for CDBG, HOME and ESG funds
with requested amounts totaling $7,241,984. The following shows a
breakout of these resources and the amounts requested, through
applications, for the use of these funds:

Lubbock citizens participated in this year's process through
neighborhood associations, community and business organizations, direct
participation and the Community Development and Services Board
(CDSB). After breaking into subcommittees to review the applications
and formulate recommendations in April, the CDSB met on May 9, 1998
to formulate their recommendation for the FY 1998-99 funding cycle. In
making their decision, the board kept in mind the goals of the City
Council, the consolidated plan, the identified needs of the
neighborhoods, staff priorities, and the recommendations of the provider
groups.
The recommendation for spending federal dollars has been published for
open comment since May 26, 1998 and continued until June 10, 1998.
On June 11, 1998, the public hearing allowed citizens to directly
participate by addressing the City Council with comments.
There are some areas that the Council needs to be aware of. These
include:
i:l
Regular City Council Meeting
June 11, 1998
Page 381
The request by the Lubbock Housing Authority for demolition funding
will require a one -for -one replacement plan for each unit demolished
within the next five years. Staff has been working with the LHA and
HUD to facilitate this. However, if HUD were to disapprove the plan,
the funding would need to be reallocated to another project.
The request by the YWCA for funding to renovate a facility they are
purchasing was considered by the committee. Much debate occurred,
and it was decided that funding should be spread around since the
YWCA had received funding in this year's reallocation. It was not put
on a high priority; however, the committee felt that should any money
come available, at this time, or at reallocation, the YWCA should be a
top priority. It should also be noted that the building has not been
purchased. The contract for CDBG funds from the reallocation was
approved at the City Council meeting on May 28, 1998, and staff is
waiting on final approval from HUD for the project. This project will
also involve a relocation of a tenant currently in the facility.
CONTACT Lubbock's request for funding was considered by the
committee. The committee and staff feel this is a good organization but
due to some concern over the Information and Referral Hotline, the
committee chose to fund the Youth and Senior Lines.
LUNA had three requests; the committee funded the same project as last
year following the public service reduced level funding policy. The two
other requests were good projects, but due to funding limits, and an
evaluation of the numbers served, they were not funded.
Arnett Benson Omnibudsman project was considered by the committee.
It was felt that there were a number of other agencies that served in this
capacity including LUNA, Neighborhood Coordinator, and CD staff. It
was also felt that if the door to funding neighborhood association
personnel is opened, all eligible neighborhoods would begin requesting
funding.
The City Housing programs, including the Reconstruction,
Rehabilitation, Barrier Free, and Emergency Repair, were all full funded
by the committee; however, it is at a lower level than last year's funding.
After evaluating the requests, staff reduced their requests for this year.
The board did not leave any funds for contingency. They felt that with
the program income being generated and reallocation at mid year, they
could obligate all funds at this time.
Staff recommended that the City Council accept the Community
Development and Services Board's funding recommendation and
recommended the approval of these resolutions authorizing the Mayor to
execute this Agreement.
Items No. 79 - 87 were considered immediately following the Consent
Agenda items.

with Texas Tech to place this fire station on campus property.
This lease agreement would provide a 50-year lease to locate a fire

lease agreement.

A copy of the Medical Services Agreement is filed with Resolution No. 5885.
The City of Lubbock began operating a temporary holding facility on
September 30, 1997 for prisoners arrested by the Lubbock Police
Department (LPD). Since the inception the Physicians Network
Association (PNA) has provided medical services for the holding facility.
Staff is required to hold prisoners until they are arraigned by City of
Lubbock magistrates. Once prisoners are arraigned, they are transported
to the Lubbock County Jail. Using the same medical services provider,
PNA, has resulted in minimized prisoner transfer refusals by the
Lubbock County Jail staff on medical grounds.
PNA was selected because of their experience in providing medical
services for five years to the Lubbock County Jail. PNA has additional
experience providing medical services to the Lubbock County Youth
Center, the Lubbock County Correctional Facility, and a privately
managed prison facility in Brownfield.

The agreement with PNA provides training for LPD Detention and
Police Officers that are charged with the operation of the holding
facility. Training includes first aid assessment, suicide assessment, and
the use of intake screening and evaluation forms. New officers will be
trained at the time of employment.
PNA provides liability insurance that reduces the City of Lubbock's
exposure in the case of any legal action.
The Medical Services Agreement addresses the necessary training and
assessment programs for LPD Detention and Police officers along with
the medical needs of those individuals held in the holding facility.
Approval of the agreement will provide continuous services to the
holding facility.

Staff recommended approval of this agreement.
