Williams Communications has submitted an application for a street -use license for their fiber optics interconnect cable. This company connects their cable with other communications cable companies to improve cable communications. The route Williams plans to use is to begin in TxDOT right-of-way at 50' Street and Avenue A, westward to Avenue P, northward to 19'h Street and Avenue N, then northward to Main Street and Avenue N, then eastward to Avenue E and Main Street, then southward to Broadway, then eastward to Avenue A. The total length of the route is 19,796 feet for a one -foot wide license. The charge for this is calculated as follows: 4,550 feet at $0.50 per square foot (50' St. rate) = $2,275. 4,686 feet at $3 per square foot (downtown average) = $14,058. 10,560 feet at $0.30 per square foot (residential rate) = $3,168, Total = $19,501. Using the street -use license formula for an underground street use, the value is $19,501 x 10 % x 60 % = $1,170.06 per year or $5,850.30 for five years. Therefore, Williams Communications will pay the City $5,850.30 for the first five year term of this 20-year license. The Right -of -Way Department recommended the approval of this street - use license with Williams Communications. (43.) The next item considered was Item No. 59. REGULAR AGENDA (58.) ORDINANCE #2000-00025—Assessments for paving improvements on the 82°d Street Assessment Paving Program (second of three readings). ORDINANCE NO.2000-00025 AN ORDINANCE CLOSING A HEARING AND LEVYING ASSESSMENTS FOR PART OF THE COST OF IMPROVING THE FOLLOWING STREET: 82nd STREET FROM AVENUE U EAST TO US HIGHWAY 87 SUCH PORTIONS BEING MORE PARTICULARLY DESCRIBED IN THE PAVING ASSESSMENTS OF THE CITY OF LUBBOCK ATTACHED HERETO AND MADE A PART HEREOF, AND PORTIONS OF OTHER SUNDRY STREETS, HIGHWAYS, AVENUES AND/OR ALLEYS IN THE CITY OF LUBBOCK, TEXAS, AND/OR ALONG THE BOUNDARIES OF SAID CITY, AND PROVIDING FOR THE COLLECTION OF SUCH ASSESSMENTS AND FOR THE ISSUANCE OF ASSIGNABLE CERTIFICATIONS ON EVIDENCE HEREOF, ALLOCATING FUNDS. On April 27, 2000 the City Council conducted a public hearing to consider a paving assessment for a portion of 82nd Street, and conducted the first of three readings required for the paving assessment ordinance. 282 Regular City Council Meeting October 12, 2000 Page 283 After the public hearing, the Council made the following decisions relative to the street. Unit 2386-001, 82nd Street from Avenue U East to US 87 — Pave this unit as indicated on the plans and assess abutting property owners at the rates shown on the proposed assessment rolls with the exception of three vacant, unplatted tracts currently zoned R-1. After discussion, the Council voted to reduce the rates on these three parcels to $0.00 but requested additional information prior to the second reading At the City's request, the appraiser reviewed his enhancement study with respect to properties zoned R-1 and R-2. After review he determined it would be appropriate to reduce the proposed assessment to $0.00 for properties which are zoned R-1 and R-2 and are not currently in commercial use. On that basis staff has reduced the proposed assessments for parcels 1, 28 and 29 to $0.00. The abutting footage to be considered for assessment on parcels 28 and 29 has been reduced to reflect portions of those properties affected by an adjacent playa lake. This public hearing is being reopened on October 12, 2000 to allow public comment on these proposed changes to the ordinance. The 82nd Street project was designed, bid and is being constructed by the Texas Department of Transportation (TxDOT). The appraisal rates to be assessed against the abutting properties are less than the City's participation in the costs of the project. Consideration of the second reading of this ordinance will follow the public hearing reopened for this paving assessment. For the second reading, staff recommended the ordinance be considered for approval with the assessment rates being the same as the appraised rates listed in the assessment rolls in the public hearing, with the exception of the three vacant, unplatted tracts zoned residential. These three parcels will not be assessed. At a future meeting the Council will consider the third and final reading of the ordinance. Motion was made by Councilmember McDougal, seconded by Councilmember Morrison to pass on second reading Ordinance No. 2000-00025 as recommended by staff. Motion carried: 7 Yeas, 0 Nays. S. Highway 87 82nd Street is a thoroughfare and is being paved as a capital improvement project with federal participation. On April 27, 2000 the City Council conducted a public hearing to consider a paving assessment for a portion of 82nd Street, and conducted the first of three readings required for the paving assessment ordinance. After the public hearing, the Council made the following decisions relative to the street. The 82nd Street project was designed, bid and is being constructed by the Texas Department of Transportation (TxDOT). The appraisal rates to be assessed against the abutting properties are less than the City's participation in the costs of the project. Staff recommended that the assessment rate be established at the revised appraised rate. Following the public hearing, the Council took action on the second of three readings of Ordinance #2000-00025. The next item considered was Item No. 58. HEALTH AND COMMUNITY SERVICES (60.)
