the South Lubbock Storm Sewer Feasibility Study. The consultant team
completed the study and presented the results of that study to the City
Council.
There were four alternatives presented to the City Council ranging in
estimated cost from $30,100,000 to $51,800,000. Staff presented these

The shortage of skilled workers to replace the baby boom generation is
one of the major Human Resources issues of the present and future. The
City organization must stay competitive in the market place to maintain
an effective workforce. The Human Resources Department examined
several trends to assist the City Manager in determining compensation,
benefits, and other work place issues to attract and maintain a viable
workforce.
This is not an action item and was intended to provide background
information as staff begin the budgeting process.

CITIZEN APPEARANCES
(12.) Presentation of a certificate of appreciation to Walter "Andy"
Anderson, Area Manager/Meteorologist in Charge, Weather Service
Forecast Office, National Weather Service, for his service to the City
of Lubbock's Emergency Operations Program.
Andy Anderson has been the Chief Meteorologist in Charge of the
Lubbock Forecast Office of the National Weather Service for the past
eighteen years. During this time Andy has implemented programs to
ensure the City of Lubbock has received early notification of impending
severe weather. He also implemented a policy for early notification of
severe weather watches and warnings directly to the Communications
Center and/or the Emergency Operations Center. In addition, the local
Forecast Office of the National Weather Service provides annual
Weather Spotter Training classes for the Fire Marshal's staff and the
Communication's Center staff.
Much of Andy's work during his career with the National Weather
Service has been dedicated to the areas of individual response to severe
weather and the effectiveness of warnings in emergency situations. He
has worked in post disaster surveys following hurricanes, flash floods,
and tornadoes to determine public response to National Weather Service
warnings.
Andy has truly made a significant contribution to the City of Lubbock
and the surrounding area during his eighteen -year tenure with the
Lubbock Forecast Office of the National Weather Service.
A certificate of appreciation was presented to Walter "Andy" Anderson
in honor of his years of dedicated service to the Lubbock Community.
(13.) Presentation of the Legendary Service Star Award for June.
The Legendary Service Star Award recognizes an employee or team
which has exhibited exemplary customer service. There were nine
nominations for the June Star Award.
The recipient of the June Legendary Service Star Award is Connie
Gibbons, Cultural Arts Services Manager. The nomination came via
email from Sue and Mike Barnes of Cheshire, England. The Barnes
were in Lubbock on a Monday, when the Buddy Holly Center was
officially closed. Connie saw the visitors try the door and came to see if
she could help. When the Barnes explained that they were from England
and in Lubbock only for the day, Connie opened the Center and allowed
them to visit the Buddy Holly exhibit. The Barnes thanked Connie for
"a kindness we shall never forget" and commented "what a thrill it was
seeing `the guitar and glasses' and as for the film, it left us both
emotionally drained." The Barnes added "You are a long way from
Cheshire, England, but it was worth the trip!"
City Manager, Bob Cass, presented the award.
TOP TEN LIST
Councilmember David Nelson gave his Top Ten List of Positive Things
About Lubbock.
No. 10 is LP&L. Lubbock is one of 75 cities within the State of Texas
that owns and operates its own electric utility. Every resident of
•,
City Council Meeting
June 20, 2000
Page 385
Lubbock is an owner of LP&L and has an investment in the success and
well-being of our electric company. On May 24 of this year, LP&L set
a record consumption by its customers of 303 megawatts of electricity.
This was delivered in a reliable, safe and low cost manner - all without
we consumers even noticing. LP&L is preparing for a deregulated
environment. It now has three interties with SPS, which allow up to
another 140 megawatts of electricity to be transmitted on top of the 282
megawatts that LP&L can generate on its own. The new Robert
Massengale Plant is up and running, running the most efficient gas
fueled generator of electricity in west Texas. LP&L partners with the
West Texas Municipal Power Authority and SPS in assuring the
residents of Lubbock that they will always have reliable electric power
when needed. LP&L is one of our city's most valuable assets. Our hats
are off to all of those hard-working folks at LP&L for providing our
electric service. One additional note - the new Alex "Ty" Cooke station
will be dedicated in July, and we look forward to that event.
No. 9 is Understanding disabilities. Lubbock was recently named the
Outstanding Committee on Disabilities at the May meeting of the Texas
Association of Mayors' Committees on Disabilities. Lubbock's
Handicapped Guide establishes criteria for recognizing, inspecting and
enforcing building codes for accessibility by persons with disabilities.
Lubbock's video report of the accomplishments of the Community
Relations Commission reflected the many efforts that our city is
undertaking to make Lubbock as barrier -free as possible. Our Citibus
program for the handicapped is outstanding. Handicap -accessible houses
were built and sold in the Dream Tour 2000 of the Lubbock Housing
Consortium. The members of the State Association were so impressed
by Bonner Bennett's presentation - Bonner is our representative to that
association - that Lubbock will house the June, 2001 meeting of the
Texas Association of Mayors' Committees on Disabilities, and Bonner
was elected Vice -Chairperson of the Association.
No. 8 is Broadway Festivals, Inc. It is time once again for the largest,
most attended and most spectacular citywide holiday celebration - 4'' on
Broadway. Beginning the evening of July 3, numerous events, from a
barbecue and musical entertainment at the courthouse, to a July 4''
parade, street fair, and a spectacular musical and fireworks show in
McKenzie Park will be featured in this year's 4' on Broadway
celebration. This is a "can't miss" event for the whole family put on by
the hundreds of volunteers and spearheaded by the Broadway Festivals
organization.
No. 7 is Better every year. Not only is our July 4'' celebration better
this year, but so are many other aspects of our community. As
mentioned earlier, LP&L is more reliable now than it ever has been.
Lubbock lead the nation in Y2K preparedness, and this new year was
ushered in with little more than an infrastructure yawn. The almost 12
inches of rain that we have received ahead of schedule this year have
been accommodated with only minimal inconvenience and no flooding to
speak of - all because our city engineers and Water Department have
implemented an interim pipeline and pumping plan to increase the
storage capacity of our playa lakes in between our storm events.
Lubbock is rated the 40'' best city in the United States in which to
relocate or expand your business - this was up from No. 92 the year
before. Lubbock's bond rating was increased to a AA+ rate this year.
Our City Manager received a national award for being the best municipal
leader in America. It is obvious that the quality of life in Lubbock gets
better every year.
385
City Council Meeting
June 20, 2000
Page 386
No. 6 is Out of our way. Sure, things are getting better every year in
Lubbock, but one thing remains the same. That is the hospitality and
friendliness of the people in Lubbock. We will go out of our way to
welcome a visitor, lend a helping hand and do what we need to get
Lubbock on the move, and keep Lubbock on the move. I have one thing
to say to those other 39 cities that are rated ahead of us from the
standpoint of economic development. "You better move out of our way,
because the friendly folks of Lubbock will see to it that Lubbock is the
best city in the United States in which to live and work."
No. 5 is Courtyard - BHC. Every Thursday evening beginning at 6:00
p.m. the Buddy Holly Center hosts "Jazz and More in the Courtyard."
The Board of Civic Lubbock, Inc., spearheaded by board member Gertie
Jeter, provides quality live music and entertainment free of charge within
the confines of the beautifully remodeled and shaded courtyard of the
Buddy Holly Center. I see Connie Gibbons here, and she can attest to
this, too. Yes, the Depot Beergarden has been revived every Thursday
and Friday night through September.
No. 4 is Katastrophic weather preparedness. I just want to, again,
highlight Andy Anderson's contributions to making Lubbock the most
prepared city in west Texas, especially this time of year when we're
dealing with difficult and challenging weather. Also, hats off to our
Emergency Operations Center, headed by Ken Olsen.
No. 3 is Yardline. Lubbock has never been shy about setting lofty goals
and doing whatever is necessary to achieve them. We do it by
establishing a carefully, well thought-out plan in setting realistic phased -
in steps to accomplish the goal. We reach our objectives by eclipsing
yardline by yardline until we reach the goal line. An example of this is
the two stormwater drainage projects that are currently under design and
consideration, which could take from seven to nine years to complete
both, but from which we have already seen positive interim results.
No. 2 is Establishing safe hands. The Lubbock Police Department has
recently begun reaching out to an isolated part of our population - those
who suffer from Alzheimer's Disease. The program LPD has
established is called "In Safe Hands." It provides for those persons free
ID bracelets and cards that will help police keep track of them if they
become lost or confused in public. Once identified, police can safely
return Alzheimer's patients to their homes. This program is being
commended for helping those precious people in our city who cannot
help themselves.
No. 1 is Strategic plan. One of the reasons why Lubbock is so
successful in achieving its goals is because everybody that works for the
City establishes and implements a strategic plan. On March 23 of this
year we met in a retreat at Reese center where the City Council
established both short and long-term goals. Pursuant thereto, the City
staff develops methodology to carry out this established policy. Our
Council adopts the directions set forth in this methodology and
communicates this to our shareholders - the citizens of Lubbock. This
City Council and staff has made plans for projects that will evolve over
the next 20 years, with attendant commitments thereto; the greatest
commitment of which is to the citizens of our fair city, and the quality of
life that they enjoy and will continue to enjoy in both the short and long
term.

TxDOT is beginning a widening project to widen Frankford Avenue
from North Loop 289 to its intersection with U.S. 84, the Clovis
Highway. The existing right-of-way is sufficient for this project.
However, TxDOT, due to a September construction letting date, has
asked the City and County to help with right-of-way acquisition of
drainage easements for this project. TxDOT will pay 90 percent of this
cost that will include the appraisal and the purchase price of the easement

area. The total estimated cost for this drainage easement is $9,000. The
City's share would be 10 percent of that amount. Funding will come
from the recent bond sale in which $233,113 was allocated for match
funds with TxDOT.
The relocation of a major gas line will also be included in this project.
The "Contractual Agreement for Right -of -Way Procurement" to be
signed today states all of these provisions and the "Supplemental
Contractual Agreement for Right -of -Way Procurement" states that the
City will not be responsible for any utility relocation or right-of-way
acquisition except for these two parcels of the one drainage easement.
TxDOT will be responsible for the relocation of the major gas line, but
the City will pay 10 percent of its estimate relocation cost that according
to TxDOT is $37,500 (our 10 percent). This amount is in addition to the
drainage easement cost of $900, for a total of $38,400.
The Right -of -Way Department recommended the approval of this
agreement.

The Federal Aviation Administration owns and operates two Instrument
Landing Systems (ILS) at Lubbock International Airport. The systems
provide guidance for pilots landing at the airport during times of limited
visibility. One of the components of the ILS is the Outer Marker. This
facility emits a signal that tells a pilot when the aircraft is passing a
certain point during its approach to the airport. This agenda item
involves approval of a land lease between the City of Lubbock and the
Federal Aviation Administration for the Outer Marker on the ILS
approach to RWY 8/26.
The Rwy 8/26 Outer Marker site is a 0.412 acre tract located 1/ mile
north of the intersection off US 62/82 and FM 1729 adjacent to the
F.W.& D. rail spur. The current lease will expire on September 30,
2000. The FAA has requested a new lease with a one-year term
beginning October 1, 2000. Thereafter, it can be renewed annually
through September 30, 2010. The FAA retains the right to cancel the
agreement on 30 days' notice to the City.
In accordance with FAA grant assurances, the City provides leases for
navigational equipment at no cost to the federal government. In
exchange, the FAA accepts full responsibility for maintenance and
operation of the facility.
The Airport Board has reviewed this agreement and recommended
approval. Staff also recommended approval.

A copy of the Grant Application is filed with Resolution No. 2000-R0178.
The Governor's Criminal Justice Division is preparing to award Juvenile
Accountability Incentive Block Grant (JAIBG) funding to the City of
Lubbock in the amount of $94,186 for fiscal year 2001. The City is
eligible for this allocation provided a 10 percent cash match is made
available, making the total project budget $104,651. Lubbock County is
eligible for $41,100, requiring a 10 percent match of $4,567. The
County's total funding is $45,667. Should the allocations be combined,
the total amount of project funding would be $150,318.
On May 25, 2000, a JAIBG Juvenile Crime Enforcement Coalition met
to conduct a needs assessment to determine priority areas for the
investment of the JAIBG funds. The coalition, consisting of police,
educators, juvenile justice agency officials, youth service providers, and
community leaders, developed a coordinated enforcement plan that
provides the basis for distribution and expenditure of these JAIBG funds.
After much consideration, the coalition proposed that it would be most
beneficial to Lubbock County citizens for the City of Lubbock to waive
its funding to Lubbock County, specifically to the Lubbock County
Juvenile Justice Center, whereby the funds would be used to provide
probation rehabilitation services to juvenile offenders who contribute to
and reside in concentrated crime areas of the City.
JAIBG JUVENILE CRIME ENFORCEMENT COALITION PLAN:
In cooperation with the City of Lubbock, Lubbock County, and local
federal agencies, the Lubbock County Juvenile Justice Center (LCJJC)
will occupy five existing neighborhood service centers strategically
located within five concentrated crime areas. From these service
centers, probation officers will conduct supervision conferences, broker
services, and participate in community service restitution projects along
with these juvenile offenders in an effort to deter crime. Contracted
counseling services, educational classes and job skills training will be
some of the services provided at these centers on a daily basis.

It is believed that by combining the personnel efforts of neighborhood
developmental programs, community police, localized faith -based
agencies and probation, the community as a whole will share in the
responsibility of supervising, teaching, and supporting the positive
development of these youth while holding the juveniles accountable for
their wrongdoings.
Further, in keeping with Senator Robert Duncan's Achieving the Goal
initiative to "move Lubbock to the lowest crime rate per capita of Texas
cities of 100,000 or more," it is believed that by combining the efforts of
city and county law enforcement, city and county officials and others, a
significant decrease in crime will be realized.
Staff recommended approval of this resolution.
(26.) Consider a resolution and directing the Mayor to execute for an on
behalf of the City of Lubbock an interlocal agreement and all related

(27.) Consider the price and condition of sale of Parcel Number 33500-8-

This is a routine sale of property by the Urban Renewal Agency to
Guadalupe Economic Services Corporation (GESC), a non-profit
organization, for $4,000 for a parking lot, landscaping and beautification
for its adjacent office at 1416 1" Street. On May 18, 2000, the Zoning
Board of Adjustment approved the parking lot development.
The Urban Renewal Board of Commissioners approved the proposed sale
on November 16, 1999 subject to approval by the Zoning Board of
Adjustment. In accordance with Zoning Board of Adjustment approval
on May 18, 2000, Guadalupe Economic Services Corporation has
complied with the Zoning Board of Adjustment requirements. The

Page 409
Mayor Sitton closed the hearing at 6:40 p.m.
Nancy Haney, Community Development Manager, presented staff
comments.
The U.S. Department of Housing and Urban Development informed the
City of Lubbock that the city was eligible to receive a Fiscal year 2000
consolidated formula allocation of $4,436,000. With additional monies
from Revolving Funds, the city has $4,847,000 to allocate this year.
This year the city received 57 applications for CDBG, HOME and ESG
funds with requested amounts totaling $6,467,422. The following shows
a breakout of these resources and the amounts requested, through
applications, for the use of these resources:
Community Development $3,158,000 $4,930,817 ($1,772,817)
Block Grant (CDBG)
HOME Investment $1,165,000 $1,402,710 ($237,710)
Partnership Program
Emergency Shelter Grant $113,000 $133,895 ($20,895)
(ESG)
Revolving fund revenue $411,000 1 $411,000
Total $4,847,000 1 $6,467,422 1 ($1,620,422)
Lubbock citizens participated in this year's funding process through
neighborhood associations, community and business organizations, direct
participation and the Community Development and Services Board
(CDSB). After breaking into subcommittees to review the applications
and formulate recommendations in April, the CDSB met on May 10,
2000, to formulate their recommendation for the FY 2000-2001 funding
cycle. In making their decision, the board kept in mind the goals of the
City Council, the consolidated plan, the identified needs of the
neighborhoods, staff priorities, and the recommendations of the provider
groups.
The recommendation for spending federal dollars has been published
since June 5, 2000. This public hearing will allow citizens to directly
participate by addressing the City Council with comments.
The Consolidated Plan was developed starting in the spring of 1999 by
soliciting neighborhood input, non-profit and public agency input, and
needs assessments. Several public hearings were scheduled by the
CDSB to obtain citizen comments on the plan as it developed. The
Board approved the final draft on June 7, 2000 to be presented to the
City Council. This public hearing will allow final comments to the City
Council by citizens on the Consolidated Plan.
No action is required other than holding the public hearing.

City Council Meeting
June 20, 2000
Page 450
At the inception of the East/West Freeway project, it was determined
that the railroad must be relocated for the concept adopted and it would
require two agreements: (1) an agreement between the City of Lubbock
and the Seagraves, Whiteface and Lubbock Railroad, and (2) an
agreement between the City of Lubbock and TxDOT; both of which set
forth the respective responsibilities of each party. In these agreements it
was stipulated that TxDOT would bear 90 percent of all relocation costs
and the City of Lubbock would bear 10 percent of these costs. Within
these agreements, the total cost of the railroad relocation (right-of-way
and construction) was determined to be "right-of-way costs".
In the initial agreement between the City of Lubbock and the Seagraves,
Whiteface and Lubbock Railroad, there were numerous stipulations
relating to the definition of the "old" and "new" rights -of -way, and a
further stipulation that the final exchange of rights -of -way between the
State and the railroad would not occur until the new relocated railroad
had been built and the old right-of-way for the railroad was no longer
needed. At that time, there would be "mutually agreed upon" values
established for both the old and new rights -of -way, which might include
detailed appraisals of both. This process left a great deal of uncertainty
as to the final cost of the right-of-way.
The portion of the railway to be acquired and relocated was originally
under the ownership of the Seagraves, Whiteface and Lubbock Railroad,
and has gone through a sale to the current ownership of the West Texas
and Lubbock Railroad. The West Texas and Lubbock Railroad is
currently in the process of executing a sale to yet another railroad and
they are anxious to receive compensation for their old right-of-way in
settlement for the difference between the old and new rights -of -way.
Execution of this agreement with the West Texas and Lubbock Railroad
and the Texas Department of Transportation will accomplish the
following:
It will clarify the current parties to the agreement.
1. It will clarify the definition of the old right-of-way.
2. It will clarify what improvements are involved in the sale and will
enumerate these.
3. It will set a mutually agreed upon consideration for the exchange
of the old and new rights -of -way at $9,265,000. Although the
State is liable for 90 percent of this cost, the City will be required
to front the State's portion through the time of closing of this sale
and be reimbursed by the State in a timely manner. In order to
accomplish this, the City must withdraw invested funds and will
incur the loss of earned interest to some degree, which the State
has indicated that they cannot reimburse. Hopefully, the State
can request and receive a reimbursement as an "emergency" and
reimburse the City at or shortly after closing by June 29. At this
point, there is no guarantee that they can do that; however, they
are obligated to reimburse 90 percent of the $9,265,000.
4. The agreement requires the release of certain liens on the old
right-of-way.
5. The agreement certifies that the City and State will file on or
before June 20, 2000 a verified notice of exemption with the
Service Transportation Board.
450
City Council Meeting
June 20, 2000
Page 451
6. The agreement stipulates that the railroad will place a sum of
money in escrow to be paid to Burlington North Santa Fe to
obtain release of the fiber optics easement.
7. The agreement sets a closing date of no later than June 29, 2000.
8. The agreement stipulates that the current railroad will retain
operating rights on the old line until the new relocated line is
completed. At the time of these comments, TxDOT is resisting
this stipulation, but may agree to it if the railroad will accept any
and all liability for operating on land owned by TxDOT in the
interim.
It appears mutually beneficial to all parties to amend the original
agreement with the railroad in order to expedite this sale for the
aforementioned consideration. This agreement has been reviewed in
detail by the railroad, by TxDOT and the City and all parties are in
agreement. Staff recommended approval of this resolution.
Motion was made by Councilmember Cooke, seconded by
Councilmember Nelson to pass Resolution No. 2000-RO187 as
recommended by staff. Motion carried: 7 Yeas, 0 Nays.
The next item to be considered was Item 86.

Lubbock to execute an agreement with the West Texas and Lubbock
Railroad and the Texas Department of Transportation, conveying a
portion of the railroad right-of-way to the State of Texas for highway

This item was considered following Item 34.

Councilmember McDougal to take Item 85 out of order. Motion carried:
7 Yeas, 0 Nays.
Execution of this agreement will authorize payment in conveyance of the
exchange of the old railroad right-of-way and the new railroad right-of-
way for the East/West Freeway for the sum of $9,265,000, in keeping
with the revised agreement between the railroad and TxDOT as set forth
in agenda item #84.
Approval of this agreement will accomplish the following:
1. Establish that the railroad will convey to the State of Texas the
old right-of-way in a quit claim deed.
2. Defines the old right-of-way that is being purchased as Exhibit A.
3. Defines improvements and authorizes the railroad to salvage
enumerated improvements on the old right-of-way.
4. Establish consideration to be paid, as settlement, between the old
and new rights -of -way as $9,265,000. The City will pay this
amount up front but will be reimbursed 90 percent by the State of
Texas, either after the day of closing, or within a reasonable
specified time.
5. Specifies the release of certain liens in the old railroad right-of-
way.
6. Specifies that the City and State shall file a verified notice of
exemption with the Service Transportation Board.
7. Establishes that the railroad will create an escrow account out of
the proceeds paid to them to obtain an agreement for the release
of fiber optic easements retained by Burlington North Santa Fe.
8. Closing is established to occur on this conveyance between June
23 and June 29, 2000.
9. Establishes the closing expenses and the sharing of expenses
between the City and the State.
10. Establishes that all taxes and past due assessments shall be paid
by the railroad.

11. Allows the railroad to continue to operate railroad activities on
the old right-of-way until the new right-of-way is complete.
12. Establishes the eligibility of relocation expenses for the railroad.
13. Establishes responsibility and timing of the relocation of utilities
in the old right-of-way.
14. Establishes the representation and warranties authorizations to
allow the railroad, the City and the State to enter into this
agreement.
15. Establishes agreement as the entire understanding between the
parties for this conveyance, and defines the resolution of
conflicting terms between this and prior agreements.
Execution of this conveyance agreement will shortcut the very complex
and tedious conveyance process established in the original agreement
between the City and the railroad, as concurred in by the State of Texas.
This agreement has been reviewed and agreed upon by representatives of
the City, the railroad, and TxDOT. Staff recommended approval of this
resolution and execution of the agreement.

On May 11, 2000 the Lubbock City Council approved an agreement to
pay the Lubbock Arts Alliance, Inc. $122,308. The agreement stipulates
that the funds are to be used in making grant awards to cultural arts
organizations for the encouragement, promotion, improvement, and
application of the arts. The funds represent seven percent of the
hotel/motel tax collected during the fiscal year ended September 30,
1999. In reviewing requests and developing funding recommendations
for each application, the Grants Review Committee follows guidelines
that were approved as part of the May 11, 2000, agreement. The grants
review committee, composed of appointments by City Council and
representatives of the Lubbock Arts Alliance, evaluates applications and
submits their recommendations to the City Council for approval.
The Lubbock City Council is now asked to approve $56,100 in grant
awards for the first grant period for 2000/01. Twenty applications were
