Citi bus has applied for a Section 5307 Block Grant to fund FY 1999-2000 capital projects, and to finance the planning, improvement, and operating costs of equipment, facilities, and associated capital maintenance items for use in mass transportation. The total grant amount equals $4,847,359, sixty-five percent ($3,157, 887) of which is the share from the Federal Transit Administration, and thirty-five percent ($1,689,472) of which is the local share. The remaining local match comes from TxDOT in the form of State Operating Assistance ($800,000) and other sources such as Texas Tech, Route Guarantee and Advertising revenues. TxDOT did not allow final approval of this grant until November 9, 1999, hence the delay in coming before the City Council. On November 23, 1999, the Lubbock Public Transit Advisory Board approved the revised budget, as the original amount requested was reduced to $3,157,887. The capital allocation of this grant, which equals $2,367,359 (80% or $1,893,887 of which is federally funded and 20% or $473,472 of which is locally funded by the City of Lubbock) will be used to purchase the following rolling stock: ♦ 3 vans to expand the demand response service, ♦ 2 trolley buses (due to their popularity for charters and the trolleys generate revenue), ♦ 1 supervisor van, ♦ 1 van for a vanpool, and ♦ 1 sedan to replace a demand response (ADA) sedan. 11 City Council Meeting January 13, 2000 Page 12 Citibus will also use the capital allocation of this grant to pay for parts and labor to maintain the fleet (engines, transmissions, tires and other main components), to purchase equipment (including tools and computers); to provide passenger amenities such as pull-outs, signs, and benches; and to provide the demand response paratransit service required under the Americans with Disabilities Act (ADA). The planning allocation of this grant equals $80,000 (80 % or $64,000 of which is federally funded and 20 % or $16,000 of which is locally funded by the City of Lubbock). Citibus will use the planning allocation for training, to fund planning studies and activities, and to perform activities necessary to maintain eligibility in order to receive capital and operating assistance. The operating assistance portion of this grant equals $2,400,000 (50% or $1,200,000 of which is federally funded and 50% or $1,200,000 of which is locally funded). Of the local match, the City of Lubbock's share is $389,728; $800,000 is from TxDOT; and $10,272 is from non-farebox revenues. Sims, Assistant City Attorney A copy of the Grant Application is filed with Resolution No. 2000-R0009. In September 1997, the State of Texas' Telecommunications Infrastructure Fund Board initiated non-competitive Internet grants for Texas Public Libraries. The purpose of the grants is to increase public access to the Internet. In the first round, Lubbock secured $99,775 to provide the first connection of its public libraries with a basic package of Internet elements. In this next round, the Library is applying for $125,400 to expand and enhance its Internet access and capabilities. In the Library's application, the following elements will be sought: ♦ 15 Internet workstations ♦ "Wireless" telecommunications hardware/software ♦ Web pages workstation, software, and peripheral equipment ♦ Added software enhancements to the Library's automation system ♦ Computer/video training technology for library meeting rooms 19 City Council Meeting January 13, 2000 Page 20 ONGOING COSTS IMPACT: Information Technology estimates that the introduction of "wireless" technology will result in line speeds at the library branches equivalent to "T-1", without increased telecommunications cost. The additional computer workstations will increase operating costs to budget by approximately $5,000. However, public access will be doubled, and in some cases tripled, at each respective library facility. The $5,000 cost estimate is based on what the library currently pays in technology operational costs to Information Technology. Deadline for submitting this grant application to TIF is January 14, 2000. Award packets will be mailed in April and implementation would begin in calendar year 2000. Staff recommended that Council authorize the Mayor to execute the necessary application and related documents. (25.) It is implementing a 2000- 2001 Mortgage Program to assist moderate and low-income people within the South Plains Association of Government's 15 county area. Under the act, which governs housing finance corporations, the mortgage program cannot apply to property located within a municipality having more than 20,000 population unless the governing body of that municipality approves. The total bond issuance amount for SPHFC is not to exceed $20 million. LHFC will contribute $200,000 to provide cost of issuance and other related program costs, as well as serve as manager for the program in exchange for a set fee. Council approval of the proposed resolution is required for the SPHFC program funds to apply to single-family homes within the City of Lubbock for eligible residents. Said contract is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. Passed by City Council this 13th day of January, 2000. /s/ WINDY SITTON WINDY SITTON, MAYOR ATTEST: /s/ Kaythie Darnell by B. Garza Kaythie Darnell, City Secretary APPROVED AS TO CONTENT: /s/ Jim Bertram Jim Bertram, Director of Strategic Planning APPROVED AS TO FORM: /s/ William de Haas William de Haas, Competition and Contracts Manager/Attorney A copy of the Contract is on file with Resolution No. 2000-R0018. This project involves digital orthophotography and contour mapping services for the City of Lubbock, surrounding areas, and for Water Utilities facilities in Bailey, Lubbock, and Lynn Counties. The software products, photographs and maps created in this project will align the elements of different departments mapping efforts into a single, accurate coordinate system and provide a standardized input criteria for all users of the Geographic Information System. In addition, the maps and other data collected are used by citizens and professionals, including neighborhood organizations, realtors, appraisers, engineers, and developers. The hard copy maps and photographs will be housed in the Map Room in the Planning Department at the Municipal Building for easy access by employees and citizens. Eventually the digital photographic files will be part of the city's GIS web site for citizen use. The primary impact of this project will be enhanced service levels and abilities by departments that use the digital data, photographs, and survey information that will be created. The digital products will be used by departments including Planning, Storm Water Management, Streets/Drainage Engineering, Water Utilities Engineering, Parks, Solid Waste, Lubbock Power and Light, and Traffic Engineering. No impact is projected for future staffing, maintenance, or supply costs. 33 City Council Meeting January 13, 2000 Page 34 The project is to be a two-year project, with aerial photography completed in February and March of 2000 and delivery of digital orthophotos, hard copy maps, and contour maps in phases throughout 2000 and early 2001. The project is to be completed by September 1, 2001. On November 29, 1999, six firms submitted proposals to the City of Lubbock for these services. All of the firms are professional aerial photography and photogrammetry firms. They are as follows: Analytical Surveys, Inc. of Indianapolis, Indiana Landata Geo Services, Inc. of San Antonio, Texas Dallas Aerial Surveys, Inc. of Dallas, Texas (3D)I of Easton, Maryland Williams-Stackhouse, Inc. of San Antonio, Texas MARKHURD of Dallas, Texas A selection committee with representatives from Planning, Information Technology, Streets/Drainage Engineering, Water Utilities Engineering, and Stormwater Management reviewed and rated the proposals submitted by the firms listed above. The evaluation criteria contained in the RFP included: Technical Expertise 35 percent Vendor Qualifications 30 percent Similar Project Experience 25 percent Delivery Schedule 10 percent The selection committee discussed their independent evaluation and ratings derived from the proposals. The committee's average ranking score was as follows: Dallas Aerial Surveys, Inc. 90.75 percent Williams-Stackhouse, Inc. 89.85 percent Landata Geo Services, Inc. 88.80 percent MARKHURD 85.62 percent (3D)1 83.50 percent Analytical Surveys Inc. 82.82 percent. The selection committee heard oral presentations from the three top - ranked firms and their subcontractors, which were: ♦ Dallas Aerial Surveys, with subcontractors Carter & Burgess (ground control) and ATS (training and conversion) ♦ Williams-Stackhouse, Inc., with subcontractors Wilson Surveying (ground control) and G Squared (training and conversion) ♦ Landata Geo Services, with subcontractor George Moery (ground control) After the interviews, the committee again ranked Dallas Aerial Surveys, Inc. number 1. Williams-Stackhouse, Inc., ranked number 2, and Landata Geo Services, Inc., ranked number 3 following the presentations. Because of their high initial rating and outstanding interview, as well as excellent reference reports, the committee recommended Dallas Aerial Surveys, Inc. for contract negotiations. 34 City Council Meeting January 13, 2000 Page 35 The amount budgeted for the base project (digital orthophotography and contour mapping services for the City of Lubbock and surrounding areas) was $586,000. This included 1 foot pixel resolution digital orthophotography and 1 foot contour mapping for 195 square miles. The funding was budgeted from the General Fund ($235,000) and the Storm Water Utility Fund ($351,000). The "Needs Assessment for Joint GIS Sharing" report for the City Of Lubbock, Lubbock Central Appraisal District, and Lubbock Emergency Communication District, which was completed after the project was initially approved, recommended that the digital orthophotography be more accurate than that originally proposed. Further research by city staff corroborated the consultant's recommendation. Therefore, the Request for Proposals asked for 6 inch pixel resolution digital orthophotography rather than 1 foot (double accuracy). Additional land area was also included in the RFP, as areas to the west and south were added in response to the recent annexation and drainage concerns. The initial price proposed by Dallas Aerial Survey for the base project (digital orthophotography and contour mapping services for the City of Lubbock and surrounding areas) was $820,300. Through negotiation, staff were able to lower the price by $149,500 (18 %). This negotiated price includes more accuracy and more areas of the City Of Lubbock and Lubbock County. The negotiated contract price for the base project is now $670,800, which is $84,800 over the Digital Orthophotography and Contour Mapping budget amount. The additional funding needed is available and will be contributed equitably by other utilities expected to benefit from these expanded capabilities (Water, Sewer and Solid Waste funds and Lubbock Power and Light). (35.) Bid #99275 - Distribution Transformers —Annual Pricing (Electric Distribution) . This bid is for the purchase of pole type and pad mounted distribution transformers for the year 2000. These transformers are electrical devices that transform electricity from one voltage level down to another (i.e., from 12,700 Volts to 120 Volts). They are of different capacities, from lOkVA to 1500kVA and different types and secondary voltages to suit customer requirements. These units will be installed in our overhead and underground distribution systems to maintain existing electrical service or serve new and additional customers The tabsheet lists the bidders for each item in order of increasing evaluated cost of buying and operating the transformer for a twenty-year period. However, for bids that are within 3 % of the lowest evaluated cost, the evaluated bids are considered equal and the bidders are listed in order of unit price. The evaluated cost was calculated by multiplying the quoted core loss by $5.60, multiplying the quoted winding loss by $1.70, and adding the two resulting numbers to the price for each transformer. The ranking for Frank Gorman Company of Albuquerque, New Mexico was established by applying the State of Texas reciprocity statute that requires us to apply the same local preference used in the non-resident bidder's state. New Mexico has a preference of 5 % to resident businesses 35 City Council Meeting January 13, 2000 Page 36 in purchases up to $5,000,000. Therefore, 5 % was added to the prices from Frank Gorman Company to evaluate their ranking. The low bids are from the following companies: Priester Supply Co., Inc. of Lubbock, Texas $101,467 Frank Gorman Company of Albuquerque, New Mexico $ 41,963 Wesco Distribution, Inc. of Haltom City, Texas $ 44,394 Techline, Inc. of Amarillo, Texas $129,379 Preferred Sales Agency, Inc. of Carthage, Texas $ 83,285 Delta-Y Electric Company of Jackson, Missouri $ 49,515 The low bids are within the System Capital Outlay -Distribution Transformers budget amount. Mayor Sitton closed the hearing at 11:07 a.m. (44.) Ordinance No. 2000-00001 of the City Council of the City of Lubbock, Texas adopting new guidelines and criteria with regard to tax and other incentives applicable to business enterprises in Lubbock's Enterprise Zones which are not applicable throughout the city; providing for a public hearing and providing an effective date (first reading). ORDINANCE NO. 2000-00001 AN ORDINANCE ADOPTING NEW GUIDELINES AND CRITERIA WITH REGARD TO TAX AND OTHER INCENTIVES APPLICABLE TO BUSINESS ENTERPRISES IN LUBBOCK'S ENTERPRISE ZONES WHICH ARE NOT APPLICABLE THROUGHOUT THE CITY; PROVIDING FOR A PUBLIC HEARING AND PROVIDING AN EFFECTIVE DATE. Motion was made by Councilmember Cooke, seconded by Councilmember McDougal to pass on first reading Ordinance No. 2000-00001 as recommended by staff. Motion carried: 6 Yeas, 0 Nays. In designating the North and South Enterprise Zones, City Council was required to create three local incentives available to businesses locating in the enterprise zones. These three incentives are a Qualified Job Creation Sales Tax Refund, Sales Tax Refund on Local Purchases, and Refund of Building Permit Fees and were adopted in September 1993. After careful review and discussions, staff recommended revising these guidelines to update some out-of-date provisions, clear up some vague language, and change some of the qualifying criteria. Qualified Job Creation Sales Tax Refund The current guidelines do not state whether the refund is from sales tax paid by the business or is based on the number of qualified employees, regardless of the amount of sales tax paid by the business. A qualified business could obtain sales tax refunds of up $250 per qualified employee, with a maximum of $2,500, regardless of whether they had actually paid that much sales tax. Staff have clarified the guidelines by adding, "...at no time shall the amount of the refund exceed the amount of local sales tax paid." Staff also revised the annual minimum hours worked to qualify as a full-time position from 1,040 (20 hours/week) to 1,820 (35 hours/week) to match the State. M City Council Meeting January 13, 2000 Page 47 Sales Tax Refund on Local Purchases Staff proposes some major changes to qualifying criteria for this incentive. The State incentives for enterprise zones have two different ways to receive sales tax rebates; a one-time refund, like our local one above, that only requires the company to be a qualified business. The other requires the company to be a state -designated enterprise project to be eligible for the five-year rebate. Our guidelines have been changed to reflect the same requirement for our local 3-year sales tax rebate. This will allow smaller companies to access the one-time rebate and will limit the number of companies that can access the 3-year rebate to 3 in a two-year period, per State guidelines. Staff also revised the annual minimum hours worked to qualify as a full-time position from 1,040 (20 hours/week) to 1,820 (35 hours/week) to match the State. Building Permit Fee Refunds Staff proposes that this incentive be changed to qualifying on jobs or qualifying on investment. The way the criteria were structured made it impossible for some large capital -intensive projects to qualify for the incentive. With the proposed changes, companies building new facilities for a third party can qualify for the incentive even if they are not the company actually creating the jobs. Changing the above incentives will require a public hearing and an ordinance change for the North and South Enterprise Zones and LIA Enterprise Zone. All of the above mentioned changes can be done through one public hearing and one ordinance. Revising the guidelines for the financial incentives in the Enterprise Zones will help in addressing the changes that have become obvious in the past few years in the way companies now conduct business and build facilities. This public hearing and ordinance will fulfill the requirements of the law on making changes to the incentives offered in the enterprise zones. Staff concurred with Market Lubbock's recommendation of approval of the ordinance changing the guidelines for the financial incentives in the North Enterprise Zone, South Enterprise Zone and Lubbock International Airport Enterprise Zone.
