( 7.) Presentation concerning the construction of a barrier free
playground at Maxey Park. Stephanie Massengale, representing the
Lubbock AMBUCS (American Business Clubs) (15 minutes)
Stephanie Massengale, representing the Lubbock AMBUCS, presented
information concerning the construction of a barrier free playground at
Maxey Park. The purpose of the playground is to provide a playground
that is usable for those with special needs. This playground will have
equipment designed specifically for children and adults in wheelchairs
and with other physical limitations. It is estimated that there are over
one thousand children in Lubbock with special needs. Many disabled
adults would like the opportunity to "play" with their children. This
playground will serve families with full consideration of each
individual's unique needs. The planned amenities include accessible
picnic tables, complete access to all playground equipment, wheelchair
swings, wheelchair basketball court, slides, sandpits and other accessible
amenities. The playground's design will provide activities for all ages
and abilities. The estimated construction cost for the playground is
$500,000. The playground has been titled the "H.U.B. City
Playground". The acronym H.U.B. represents the phrase "Helping
Undo Barriers."
The planning for the H.U.B. City Playground began with a committee
comprised of local individuals who felt strongly about the rights of those
with physical challenges. The committee includes occupational, physical
and speech therapists, social workers, parents of children with special
needs, persons with physical disabilities, business men and women,
special education teachers, representatives from the Parks and Recreation
Department and many more. The Caprock, Monterey and Downtown
AMBUCS have agreed to assist with fund raising. In fiscal year
2002/03, it is anticipated the committee will request $125,000 from the
City of Lubbock for this project. This request will be made as per the
matching funds policy approved by Resolution Number 6408, approved
on June 24, 1999.
In an effort to gain support for the playground, the committee has
received written endorsements from Covenant Health Systems, Lubbock
Regional MHMR, Citibus, Lubbock Parks and Recreation Department
and American Business Club (AMBUCS).

Maxey Park is the requested site for the H.U.B. Playground. During the
May 10, 2001 City Council meeting, the City Council approved the
amended Parks and Recreation priorities. The number one priority for
the Northwest Planning Zone is a playground, followed by a group
pavilion, demonstration garden and multi -purpose trail. The existing
playground is in need of renovation and updating. Many of the
playground amenities have been removed due to safety concerns. The
City of Lubbock's Parks and Recreation Department will maintain the
playground. Maxey Park is also considered an excellent site for this
playground, due to the location of the nearby medical facilities.
During the June 27, 2000 meeting of the Parks and Recreation Advisory
Board, the Board recommended the construction of the H.U.B. City
Playground at Maxey Park.
Randy Truesdell, Director of Parks and Recreations spoke for the staff .
( 8.) Presentation on ice hockey. Mark Adams, Owner and General
Manager of the Lubbock Cotton Kings (25 minutes)
This presentation gave an overview of the second season of ice hockey in
Lubbock, Texas. Highlights included a recap of last season, information
on the merger between the WPHL (Western Professional Hockey
League) and the CHL (Central Hockey League) and its impact on the
Cotton Kings, the importance of local corporate partnerships,
recreational skating programs that focus on youth, and the Cotton Kings'
involvement in the community. The presentation also covered marketing
strategies for the upcoming 2001/2002 season.

(11.) Wesley H. Ellis of Ellis Motor Escort Service, Cleburne, Texas,
appeared to speak on the issue of allowance of funeral motor escorts
by private companies.

Regular City Council Meeting
October 11, 2001
Page 212
Remarks by Bob Cass, Citv Manager
Council is aware of the fact that the Police Department, with my
concurrence, recently suspended motorcycle escorts for funeral services.
While this service has been provided free of charge to Lubbock residents
for many years, staff has become increasingly concerned about safety for
both the officers and the public. It requires our officers to run at high
rates of speed while darting in and out of traffic. When they reach a
heavily traveled intersection, they are then required to enter that space,
which often puts both them and motorists at risk.
Since suspension of the service was initiated, City staff has received
some complaints from both funeral home operators and members of the
general public. I would not necessarily characterize the comments staff
has had as overwhelming in terms of the number, but they are heartfelt
expressions from individuals genuinely concerned about a process which
has, in their opinion, provided a well deserved token of respect for
members of our community.
While still harboring reservations about the safety of such a program, the
City staff is prepared to recommend that staff look at a couple of options
that would enable us to re -institute the service:
1. Provide a Police Department managed service which would utilize
police sedans rather than motorcycle units. This particular
approach is less effective when it comes to moving in and out of
traffic, but probably provides a greater degree of safety for officers
when they enter an intersection. As staff transition to this
approach, staff would likely continue to use motorcycle officers for
a period of time. In addition, staff would provide the officers
conducting these services with access to the Opticom system
currently used by the Fire Department. As you know, this
particular system enables Fire Department personnel to control
signalized intersections at key points throughout the community.
2. As an alternative, it would be possible to enact an ordinance which
would allow private individuals to provide this service to the
public. While staff understand that this has been provided in other
communities, staff feel compelled to point out that staff do have
some concerns relative to the legal authority for non -certified police
officers to stop traffic in intersections. In the event that off -duty
police officers were hired by such a company, staff also have
concerns that they would immediately "revert" to City status (thus
subjecting the City to liability) in the event that they were injured
while performing these duties. The City Attorney's office will be
prepared to more fully discuss this at the Council meeting. Having
said all of that, this would be an alternative should Council care to
pursue it.
At this point in time, the staff recommendation is that staff try, on a one-
year pilot program, option number one. Staff was prepared to fully
discuss this matter.
Mr. Ellis spoke on the issue of allowance of funeral motor escorts by
private companies. He stated his business works in many cities and
counties in Texas. He described the formulas for how his company
handles each area.
212

Page 213
Bob Cass, City Manager, also spoke concerning his alternatives as stated
above.
Councilmember Morrison asked Mr. Ellis to provide the staff a list of
the cities or areas or jurisdictions that he works with so that they may do
some research in those areas to see what type of relationship they have.
After discussion, since this is not an action item, it was suggested that it
be put on the agenda for work session in the near future.
(12.) Presentation of incentive awards -the August and September
Legendary Service Star Awards and one Cost Savings Suggestion
award.
The Legendary Service Star Award recognizes an employee or team
which has exhibited exemplary customer service. The August Legendary
Service Star was awarded to a team from Accounting. According to
Chief Accountant Perry Stout, this team's involvement in processing
unaddressed purchase orders was unsolicited and beyond the scope of
their responsibilities as accounts payable staff. The project took over a
year to gather information on purchase orders dating back to 1994.
Tammy Swack, Christie Lord, and Tracey Sadiq have unreceived and
canceled approximately 3,000 purchase orders and increased fund
balance of over a million dollars.
The September Legendary Service Star Award was awarded to Crystal
Zant in Parks and Recreation. Crystal went "above and beyond" in
assisting a lady with a disability that inadvertently entered the Parks
offices while in search of Citibus. Crystal not only provided a cold
drink, but also took the woman's application for Demand Response to
Citibus offices while she waited.
The Cost Savings Suggestion program awards employees who find
innovative ways to save the City money, avoid costs or improve
productivity. Ten percent of verified, first -year savings or a cash award
for productivity improvement without verified savings is paid to
employees. Jack Veazey, electrician at Water Reclamation, suggested
that the new warehouse could be wired in-house at lower cost than a
vendor. The team of Jack Veazey, Terry McCreary and Scott Wright
completed the wiring at about one-third of the contractor's estimate and
will share 10% of the savings--$11,376.90.
City Manager Bob Cass presented the awards. Christie Lord was unable
to attend for her recognition of the August Legendary Star Award and
Terry McCreary and Scott Wright were unable to attend for their
recognition of the Cost Savings Suggestion program award.

The Texas Department of Transportation (TxDOT) is in the process of
buying right-of-way for the Marsha Sharp Freeway along 4`' Street and
the Brownfield Highway. The City owns the property adjacent to the
Texas Tech University campus where the Coliseum and Auditorium are.
TxDOT wants to purchase two tracts of land for the freeway project, one
being 50.0 square feet, which is at the northeast corner of 6`h Street and
Brownfield Highway and the other one being 755.6 square feet, which is
just northeast of the coliseum along the south side of Brownfield
Highway. Woody Nelson appraised these two tracts of land for TxDOT
for a total offer to the City of $11,205. The Right -of -Way Department
has reviewed the appraisal of this property and finds it acceptable.
This resolution authorizes the Mayor to execute a deed conveying the
property, a Memorandum of Agreement with TxDOT regarding the

price, condition, occupancy date, and closing instructions. Along with
these items to be signed is a Modification of Reverter Clause Agreement
with Texas Tech University for TxDOT. When the City acquired the
property from Tech in 1953, the deed contained a reverter clause that
stated if the property is no longer used for coliseum -auditorium purposes
then it would revert back to Tech. This Modification of Reverter Clause
Agreement states that only these two tracts being sold to TxDOT will
revert to Tech and not the entire property.

The H.U.B. (Helping Undo Barriers) City Playground is planned to be a
barrier free playground located at Maxey Park. The purpose of the
playground is to provide play amenities that are usable for those with
special needs. The playground will have equipment designed specifically
for children and adults in wheelchairs and with other physical
limitations. It is estimated that there are over one thousand children in
Lubbock with special needs. Many disabled adults would like the
opportunity to "play" with their children. This playground will serve
families with full consideration of each individual's unique needs. The
planned amenities include accessible picnic tables, complete access to all
playground equipment, wheelchair swings, wheelchair basketball court,

slides, sandpits and other accessible amenities. The playground's design
will provide activities for all ages and abilities. The estimated
construction cost for the playground is $500,000.
The
City of Lubbock Parks and Recreation Department will maintain the
playground. Maxey Park is also considered an excellent site for this —
playground, due to the location of the nearby medical facilities.
During the June 27, 2000 meeting of the Parks and Recreation Advisory
Board, the Board recommended the construction of the H.U.B. City
Playground at Maxey Park.

usable for hockey as well as provide goals and nets for the court. The
City will provide the appropriate fence surrounding the roller hockey
court. Mr. Baker will charge a fee for roller hockey lessons and league
play. Mr. Baker will hire and pay the instructors and will provide

A copy of the Amendment is filed with Resolution No. 2001-R0396.
On February 24, 2000, the City Council passed Resolution No.
2000-R0069 thereby entering into an agreement with the Lubbock
Regional Arts Center Corporation (LRAC) for the lease and management
of the Fire Administration Building located at 511 Avenue K. This
agreement stipulates that LRAC initiate $1 million worth of
improvements to the facility by December 31, 2002. Furthermore, the
agreement stipulates that the renovations will be accomplished by LRAC
within one year of the City's notice to proceed. However, according to
the agreement, the City will not issue the notice to proceed until the $1
million has been received by LRAC.
Since February 2000, LRAC has made significant progress in meeting
the terms of the agreement. Notably, LRAC purchased the adjacent
Borden's Dairy property for $46,407 to provide additional parking and
they have improved the main office area of the Fire Administration
building at a cost of $21,663. LRAC has also secured the following four
resident arts associations: El Ballet Folklorico Nuestra Herencia,
Lubbock Art Association, Lubbock Community Theater and West Texas
Watercolor Society. In addition, $964,090 has been raised for the
renovation of the Fire Administration building. While over $400,000 of
that has already been realized, the remainder will be received in the next
eighteen to twenty-four months. While the funds have been raised for
the project, the current terms of the contract will not allow LRAC to
receive the notice to proceed by December 31, 2002.
224
Regular City Council Meeting
October 11, 2001
Page 225
To provide the LRAC the appropriate flexibility to begin the project, a
contract amendment is necessary to allow for a phased approach. With
that in mind, LRAC will be permitted to complete the renovation of the
Fire Administration building in four phases. Funds for each phase will
be on hand prior to the notice to proceed for each subsequent phase.
Phase I included an environmental assessment of the facility and minor
renovations to the main office. These improvements are completed.
This work was allowed in order for the LRAC to begin their operations
at the facility. Attached are three letters regarding the Phase I
environmental site analysis of the Fire Department Administration
Building. The first, dated September 18, 2001, informs the City that
the environmental study has been completed. The second and third
letters, dated September 20, 2001 and September 21, 2001 respectively,
acknowledge that the City received the environmental study.
Phase II will include restroom renovations to meet the immediate
demand of the four resident arts groups. The second phase will be
completed by December 31, 2002 for a total cost of $165,000. By this
date, 18.7 percent of the required funds will have been spent.
Phase III, renovation of the north garage area into a multi -purpose visual
art space, will be completed by December 31, 2003 for a total cost of
$86,419. By this date, a minimum of 27.3 percent of the budget will
have been spent.
Phase IV renovations will be completed by December 31, 2004 for a
total cost of $1,122,618. This will include the following items: a black
box theater with not less than 150 seats, back stage dressing areas,
support room, a second multi -purpose visual arts and working gallery
classroom as well as a lobby gallery. The original contract stipulates a
proscenium stage, which is fixed. The amendment allows for a black
box stage, which is a shell to accommodate various staging needs as
required for different types of performances. The total cost of the
project, including A/E fees, is estimated to be $1,395,700.
This amendment will ensure that the renovations are done purposefully
and using prudent financial planning to attain a first-rate regional arts
center. All other terms of the original agreement will remain in effect.

Most of the Urban Renewal land inventory in the Guadalupe Area has
been sold. Only six parcels in this area remain in Urban Renewal
ownership from the 365 parcels acquired and replatted into 242 parcels
in the early 1970's. There have been several inquiries and interested
prospective purchasers interested in building single family residences on
these parcels.
The properties are identified as Parcel 33500-20-9 at 1109 2°d Place
legally described as Lot 9, Block 20, Guadalupe Addition and Parcel
49800-6-10 & 20 at 221-223 North Avenue P legally described as all of
Lot 1 and the north 40 feet of Lot 2, Block 63 of the Kise Subdivision of
the Roberts & McWhorter Addition, both to the City of Lubbock,
Lubbock County, Texas.
The proposed amendment was approved by the Urban Renewal Board of
Commissioners on September 18, 2001 for the proposed change to be
submitted to the City Council for a public hearing. The City's current
zoning is already single-family residential (R-1).

A copy of the Application is filed with Resolution No. 2001-R0398.
The Federal Home Loan Bank of Dallas has $8.5 million available for
grant applications of eligible housing projects. The applications are due
on October 15, 2001. The C.D. Department would like to apply for
these funds to coordinate with the other rehab loan programs offered by
the department or to be used as a stand alone grant program. There is a
need for the additional housing funds as there are always more qualified
applicants than available funds. Also, the C.D. Department already has
the staff and program guidelines in place to administer these funds.
If received, the grant funds will be to assist low-income homeowners,
(50 % and below median income) on a city-wide basis with handicap
accessibility items, emergency repairs, and energy efficiency items with
20 % of the funds set aside for low income homebuyers assistance. A
forgivable lien will be placed on the property as required by the grant.
To apply for these funds, a member bank of the Federal Home Loan
Bank must be a partner in the application and be the fiduciary bank set
up to receive the grant funds. Staff would like to apply for this grant,
and if approved, have the program be in memory of two of our late
Urban Renewal Agency Board Members, Melba Richards and Mike
Fowler.
This item was approved by the Urban Renewal Agency Board on

Lubbock Power & Light will implement a new billing system which will
be used to bill for all City utility services. In order to minimize
development costs of the new system, it was necessary to modify the
structure of the existing electric rates while keeping internal controls.
The modified rates were designed such that they would produce
approximately the same revenue within each rate class as do the existing
rates. This creates new rates which are as close as possible to being
revenue neutral as compared to the existing rates. The revised rates
actually slightly reduce the overall charges across all rate classes.
The proposed new rates adopt a more conventional electric rate structure
and are consistent with the electric utility industry. The revised structure
will be more understandable to our customers.
These rates will go into effect when the new billing system is made
operational on October 8, 2001. This date coincides with one of the
slower times of the month from a customer service and billing standpoint
that will help the transition to the new system.

Bond -funded capital projects for the City's Water System were approved
in the 2001-2002 Capital Projects Budget.
City Council considered a budgeted amount of construction projects to be
financed with bond proceeds. The bond proceeds are not expected to be
delivered until early spring 2002. For authorized construction projects
there may be design and engineering costs incurred prior to delivery of
the bond proceeds in order that the projects may be completed within
prescribed timeframes. The City must declare its intent to reimburse
bond -funded construction costs that are incurred prior to the bond
issuance for the costs to be eligible for reimbursement with bond
proceeds.
This resolution allows reimbursement of authorized costs incurred in
advance of the bond issuance in order that projects may be completed
within prescribed timeframes.
Staff recommended approval of this resolution to reimburse no more than
$6,980,000.

A copy of Proposition 2 is filed with Resolution No. 2001-R0446.
Proposition 2 of the November 6, 2001, ballot would allow the issuance
of bonds for the building of roads in border colonias. These roads would
provide access for emergency medical service, school buses, mail, and
other basic and necessary access. This would be built through the
issuance of bonds, requiring no increase in taxes.
Since the rate of inflation for road building cost is higher than the current
interest rate on bonds, building the roads with funds from bonds will cost
less than waiting to build the roads using the "pay as you go" method,
such that the Proposition 2 constitutional amendment would allow roads
to be built in the most fiscally conservative manner. The City of
Lubbock supports TEX-21's position in this endeavor.
Tony Privett spoke for the staff. Staff recommended approval of this
resolution.

A copy of Proposition 15 is filed with Resolution No. 2001-R0447.
The voters of Texas will have the opportunity to create the Texas
Mobility Fund at the general election on November 6, 2001 by voting in
favor of Proposition 15.
Seventy percent of all NAFTA trade traffic travels through Texas, and
this trade is conveyed by many modes including roadway, rail, maritime
and aviation, all of which require adequate and appropriate surface
transportation infrastructure to ensure the safe and efficient movement of
people and goods.
The Legislature and the Governor have seized the moment and have
furthered our war on congestion by creating necessary and appropriate
funding methods to make much needed resources available to mitigate
congestion and enhance mobility.
It is necessary for all Texas Cities and Counties and indeed all regions of
Texas to strongly support the Governor and the Legislature in the
historic passage of Proposition 15. The City of Lubbock supports TEX-
21's position in this endeavor, as well as the cities' major initiative on
Ports to Plains.
