State's Director of Public Transportation and shall terminate on
August 31, 1997. By acceptance of this amendment, the City of
Lubbock is not obligated to allocate further funding during this

A copy of the Interlocal Agreement is filed with Resolution 5522.
Council will recall that on April 10, 1997 a tornado struck the
community of Liberty. In an attempt to be of assistance to the
residents of that community and to Lubbock County, staff allowed
the tornado debris to be deposited in the City landfill without
paying the customary tipping fee. Lacking an interlocal
agreement, however, staff does need to enact this particular
document in order to recoup those costs from Lubbock County.
The "repayment" will be paid by road work done on various City
streets by County forces.
Staff recommended approval.

(21.) ZONE CASE NO. 2794 (5023 34th Street): Hold a public
hearing to consider request of Margie Annetta Mackey (for
The Branch Office) for zoning change from C-3 to C-4 Specific
Use limited to a cocktail lounge and all permitted C-3 uses on
the west 86 feet of Lot 6, Block 3, Hillcrest Re -Sub Addition,
and to consider ordinance.
Mayor Sitton opened the public hearing at 5:15 p.m. George
Miller appeared on behalf of Margie Annetta Mackey to present
the zone change from C-3 to C-4 Specific Use. No one appeared in
opposition. Mayor Sitton closed the hearing at 5:20 p.m.
Bill Boon presented staff comments.
This request is for a zone change from C-3 to C-4 Specific Use for
a 1,530 square foot lounge and to maintain the current permitted C-
3 uses.
This establishment is and has been licensed as a restaurant with
mixed alcoholic beverages as an incidental use since 1975. By
definition a restaurant that sells alcohol must first be a place where
the primary business is the preparation and sale of food to the
general public, with kitchen facilities separate and apart from the
area of the premises devoted to public dining. The kitchen
facilities must meet all requirements of other applicable City
Codes, contain a stove and oven in working order, provide pots,
pans and utensils necessary for the preparation of menu items, and
provide refrigerated storage for food. The kitchen facility must be
staffed by a full-time cook or chef who must be on duty for the
preparation of food during the hours that the restaurant is open
until the hour of 11:00 p.m., provide a full service menu with a
variety of entrees to be available until 11:00 p.m. each day, and
maintain a food inventory and condiments for use by the cook or
chef in the preparation of food. The proponent indicates that it is
not economically feasible to operate this establishment as a
restaurant anymore and they desire to operate this business strictly
as a lounge. Food will continue to be available but not at the level
meeting the definition of "restaurant".
A restaurant with the incidental sale of alcohol is permitted in the
C-3 zoning district. However, to run a nightclub, bar or lounge C-
4 zoning is required.
Adjacent land use relationships include:
North - commercial
South - residential
East - commercial
West - commercial
This request is for only one C-4 use (a lounge) and not "open" C-4.
The request does constitute a minor deviation from the
Comprehensive Land Use Plan.
The Comprehensive Land Use Plan calls for C-4 zoning to be
located on state/regional highways or expressways.
357
City Council Minutes
June 26, 1997
Page 358
The zoning code establishes a set of standards for a lounge and a
different set of standards for a restaurant with the sale of alcoholic
beverages as an incidental use. This request is styled Specific Use
because the property cannot meet two of the standards for a
lounge:
Any bar, cocktail lounge, private club, nightclub or dance hall is
required to be located a minimum of 200 feet from any
residentially zoned property.
This establishment is immediately across the alley from residential
property. Restaurants are not required to meet this separation.
A nightclub, bar, lounge or dance -hall is required one parking
space for each 50 square feet of gross floor area. A 1,530 square
foot bar is required 31 parking spaces.
According to the zoning certificate for this property, there are 21
parking spaces at this property which meets the 1:75 parking ratio
for a restaurant with a beverage permit. Thus, for the 1:50 normal
requirement for a lounge, the parcel is ten spaces short.
This development should have no effect on traffic volumes in the
area.
Each time a limited C-4 request that is not on a state, U.S. or
regional highway is considered, the decision making process is
confronted with a policy from the Comprehensive Land Use Plan
that C-4 uses should be located adjacent to regional or state
highways. However, since this request is for only one use from C-
4, the most important aspect of this discussion is how the proposed
development interacts with and/or affects the surrounding
development. Discussion by the Planning Commission included
comments that, from all appearances, the business was wanting to
operate in the same manner that they had for a long period of time.
No members of the public spoke at the hearing.
NOTE: The staff requested that the Planning and Zoning
Commission consider discussion, at a future date, to provide some
direction as to whether a number of existing C-4 uses (including
small lounges, and perhaps used car lots) should become a
conditional use in the C-3 zoning district. A number of other
establishments in Lubbock are being investigated relative to their
status as "restaurants" or whether they have, by definition,
defaulted to being "bars or lounges". The ability or commitment to
serve food at a level required to meet the definition of "restaurant"
has become an issue at a number of locations. By making these a
conditional use there would still be a public hearing by the Zoning
Board of Adjustment but the discussion would center on the
compatibility of the project with the surrounding area and not
whether the project meets the guidelines for C-4 zoning.
The request was approved by the Planning and Zoning
Commission
The staff supports the recommendation of the Planning and
Zoning Commission.

(22.) ZONE CASE NO. 1266-G (5205 13th Street): Hold a public
hearing to consider request of Gary J. Schwede for zoning
change from C-2A to C-2A Specific Use for a veterinary clinic
and all permitted C-2A uses on Lots 411, 412 and 413, Alford
Terrace Addition.
ORDINANCE NO.9997
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING
CHANGES: ZONE CASE NO. 1266-G; A ZONING CHANGE FROM C-2A TO C-2A
SPECIFIC USE ZONING FOR A VETERINARY CLINIC ON LOTS 411, 412 AND
413, ALFORD TERRACE ADDITION, LUBBOCK, TEXAS; SUBJECT TO
CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE
AND PROVIDING FOR PUBLICATION.
Mayor Sitton opened the public hearing at 5:28 p.m. Gary J.
Schwede appeared on behalf of the zone change from C-2A to C-
2A Specific Use for a veterinary clinic and all permitted C-2A
uses. No one appeared in opposition. Mayor Sitton closed the
hearing at 5:31 p.m.
Bill Boon presented staff comments.
This request is to recycle a vacant building that was a drug store
- into a veterinary hospital or clinic. The proponent operates an
existing veterinary clinic next door and proposes to relocate to this
much larger building as an expansion.
Adjacent land use relationships include:
North - commercial
South - residential
East - commercial
West - commercial
This request is consistent with the Comprehensive Land Use Plan.
The zoning code establishes a set of standards for a veterinary
hospital or clinic in the C-2A specific use zoning district and also
establishes a set of development standards for the C-2A zoning
district in general:
Any treatment rooms, cages, pens, or kennels shall be maintained
within a completely enclosed, soundproof building.
_ The floor plan indicates that all of the kennels (dog runs) are
located inside the building. The outside use at the current clinic
adjacent to the residential property will be eliminated. The only
outside use indicated on the proposed site plan is an outside
exercise area on the north side of the building, away from the
residential property. Dogs will not be kept in that area, but the area
will be used for exercising animals kept at the clinic and by
customers whose pets are being treated at the clinic.

City Council Minutes
June 26, 1997
Page 360
When proposed development in this district is adjacent to
residential zoned property, a six-foot solid screening fence of wood
or masonry construction shall be installed and permanently
maintained. Typically, gates are excluded for access to the alley.
The adjacent residents would prefer no access to the alley from the
proposed business. A solid wall of a building can constitute
adequate screening.
The building currently sits approximately five feet from the
property line. The floor plan indicates a door opening onto the
alley that is adjacent to the residential property. According to the
Building Inspections Department this door is not required for
emergency ingress or egress. The proponent could seal this door
and not have to build part of the required fence. By maintaining
this door, a screening fence between the building and the alley will
be required.
This property currently has a cyclone fence with plastic inserts to
screen the parking lot from the residential property. One of the
neighbors has indicated that a solid wood fence was originally
installed but was later replaced with the current fence when the
wood fence fell into disrepair.
Another issue that needs to be addressed deals with solid waste
disposal. The same neighbor indicated that on several occasions
the existing veterinary clinic has used the adjacent neighbors'
dumpsters to dispose of their trash when their dumpster became
full.
This is not a zoning issue. However, the proponent has already
asked the Solid Waste Department to set a second dumpster for the
existing clinic. If this request is approved, lie has agreed to ask the
Solid Waste Department to locate commercial dumpsters in the
parking lot and the business will not use alley dumpsters for solid
waste disposal.
One owner of an adjacent home (a rental unit) did appear and
assert that numerous incidents related to noise, animal waste, and
trash disposal had occurred. In discussion by the Commission, the
general feeling seemed to be that the proposed conditions would
correct the problems.
This request was approved by the Planning and Zoning
Commission with the following conditions:
That a six-foot solid screening fence of wood or masonry
construction (with no gates) be constructed along the alley
property line. If the rear wall has no openings, then the
fence shall be required to only screen the parking lot, with
no gates to the alley;
Solid waste dumpsters shall be picked up from the
development lot and not from the alley; and
All unconditionally permitted C-2A uses be permitted.
The staff supports the recommendation of the Planning and
Zoning Commission.

This request is to construct a 150 foot monopole communication
tower. The proponent would like the flexibility to increase the
height of the tower to 180 feet to facilitate a second user if the
opportunity presents itself.
The adjacent land use relationships include:
North - commercial, (IHC)
South - commercial, (IHC)
East - residential, (R-1)
West - commercial, (IHC)
This request is consistent with the comprehensive land use plan.
The zoning code establishes several goals for the siting of towers
and antennas. Several of these goals need to be addressed for this
tower.
"encourage the location of towers in non-residential areas and
minimize the total number of towers throughout the community."
This tower, while located in a commercial zoning district, backs up
to residentially zoned property. The proponent provided written
documentation signed by 40 neighbors indicating their support for
this project.
"encourage strongly the joint use of new and existing tower sites."
The proponent has provided information regarding their inability to

The proponent has indicated that 150 feet is the very minimum for
the PCS technology. However, at this location the tower needs to
be at 180 feet to provide adequate service. By locating at 180 feet
there will definitely be room for cellular technology, which in this

The Texas Constitution provides as outlined in Article 3, Section
52-(a) including Section 380.002 of the Local Government Code,
provisions for municipal governing bodies to establish and provide
for the administration of one or more economic development
programs including programs for grants of public money to

funds totaling $500,000 for a period of one year for Market
Lubbock, Inc. to advertise and assist with the Image Texas
Campaign. This campaign will bring Convention and Tourism
dollars to the region as well as bring local, state and national
exposure for business opportunities. Four additional years of
funding will be considered by the City of Lubbock annually.

A copy of the Minute Order is filed with Resolution 5525.
After hearing the presentation from the Lubbock delegation
consisting of representatives of the Lubbock Metropolitan Planning
Organization, the City of Lubbock, Lubbock County, Wolfforth
and Frenship Independent School District on May 29, 1997, the
Texas Transportation Commission approved funding assistance for
this project. The limits of construction are from Frankford Avenue
to U.S. 62/82 (3 miles). However, the funding source from the
state requires this roadway to be on the state system. In order for
the roadway to terminate at existing state roadways on each end,
82nd Street will be placed on the state system as Spur 313 from
Slide Road (FM 1730) to U.S. 62/82.
The City and County will be responsible for:
100 per cent of all required right-of-way;
All necessary utility relocations and adjustments;
$994,098 for construction (not to exceed amount); and
Maintenance of the completed roadway.
The state will provide $5.1 million toward construction.
The City and County share of the cost is based on the following:
Total Project Cost $6,365,491
20 per cent (City & County Match) 1,273,098
Less Amount Spent for Plans, Specs 279,000
Minute Order Match Due $ 994,098
With one mile of the construction limits inside the city limits and
two miles in Lubbock County, the proposed funding split is one-
third City and two-thirds County. This funding split is further
described in the next agenda item for the Interlocal Agreement
between the City and County.

A copy of Agreement Amendment No. 2 is fled with Resolution 5527.
This amendment allows for additional engineering services for this
project in a "not to exceed" amount of $97,383. The engineer will
bill on the actual amount of hours worked with the City paying that
amount should the actual work be less than that estimated.
The majority of the expense for these additional services
(approximately $68,000) is for surveying. Detailed surveying is
required for all four miles (Slide Road to U.S. 62/82) in the
preparation of a right-of-way map required by the Texas
Department of Transportation. Surveying services will also be
needed to assist utilities requiring relocation for this project. In
addition, plan sheets previously prepared require revisions to
indicate new right-of-way acquired, the new locations of relocated
utilities, and revisions of some drainage details. Preparation of a
utility relocation plan and coordination with the affected utility
companies is also part of this amendment.
The original agreement for engineering services on this project was
$276,768. This amendment will increase the amount of the
agreement by $97,383 for a new total amount of $374,151.
The original agreement was for preparation of plans, specifications
and estimates, as well as environmental documentation and
approvals necessary to construct the project. These additional
services are required in order for the state to accept this roadway
onto their system.

Page 374
The City and County have agreed to share the cost of these
additional services with each agency paying 50 per cent as
described by the Interlocal Agreement on the previous agenda
item. The right-of-way map, surveying and utility locations are
required for all four miles (from Slide Road to U.S. 62/82) that will
be placed on the state system. With two miles inside the City and
two miles in Lubbock County, the 50-50 shared cost appears to be
the most equitable split in costs.

informed the City of Lubbock that the city was eligible to receive a
Fiscal Year 1997 consolidated formula allocation of $4,381,000, an
$80,000 decrease from last year. With additional monies from
program income and carry-over contingency funds, the city has
$5,696,952 to allocate this year. The following shows a breakout
of these resources and the amount requested, through applications,
for the use of these resources:

This year the city received 59 applications for CDBG, ESG, and
HOME funds with the requested amounts totaling $10,096,399.
As discussed in the June 12, 1997, work session, Lubbock citizens
have participated in this year's process through neighborhood
associations, community and business organizations, direct
participation, and the Community Development & Services Board
(CDSB). The CDSB met on May 14, 1997, to discuss, evaluate,
and vote on the proposals submitted for funding. The board kept in
mind the goals of the City Council, the consolidated plan, the
identified needs of the neighborhoods, the recommendations of the
provider groups, and the recommendations of staff in making their
decisions. After much deliberation, the board finalized a
recommendation for the use of the 1997-98 federal funds, which
was detailed to Council at the June 12 work session.
The plan for spending federal dollars has been published for open
comment since May 25, 1997, and will continue until June 25. On
June 26, 1997, a public hearing will allow citizens to directly
participate by addressing the City Council with comments.
Since the June 12 meeting, staff was asked to clarify several points
in the overall recommendation:
If Council chooses to fund the Facade Improvement Program for
North University, staff recommended that it be implemented as a
grant program rather than a loan program for this first year of
funding. In subsequent years, if re -funded, it could then be
implemented as a loan program.
The Community Development & Services Board recommended
$250,000 for the Appletree Apartments project despite the staffs
recommendation that the project not be funded. Since this time,
staff have received an amended application for the project in the
amount of $320,000. The staff has not changed its original view
that the Appletree Apartments project should not be included in the
1997-98 proposal to HUD. Therefore, adding $70,000 to the
original request does not change the staff s position and accepting
the proposed amendment will require that another project or
projects be reduced by this amount. While staff appreciate the
intent behind this initiative, staff recommended against funding
since the additional amount ($70,000) requested would require that
another project in this category be similarly reduced.
Staff recommended that the $250,000 be allocated to CHRB for
their Elderly Housing Project.

Staff recommended that the City Council accept the Community
Development and Services Board's funding allocation plan, with

for their Elderly Housing Project.

The Lubbock Police Department has lost its lease on the facility
currently used for storage of seized vehicles and surveillance
vehicles. They had an offer to utilize a building at Reese without
cost, however, there are environmental and liability implications
which our Legal Department determined made that impractical.
A facility was located at 1407 Avenue F which meets all the
requirements of the Police Department for size, security and
accessibility. The rental rate is 21.5 cents per square foot per
month, for a total of $1,400 for a period of one year. A rental rate
of 20 cents per square foot, or $1,300, could have been secured on
a three year lease, however, the department would like to keep the
term of the lease short in anticipation of a City facility becoming
available.

promotion, and improvement of all forms of art in the community.
424
City Council Minutes
June 26, 1997
Page 425
The 1997/98 agreement provides for a total sum of $118,720.23
which is .400 cent of the hotel/motel tax collected during the fiscal
year ended September 30, 1996. The agreement provides that a
joint review committee of the Lubbock Arts Alliance, Inc. and the
Lubbock City Council will receive and evaluate applications for
the arts grants from community organizations and make
recommendations to the City Council for awarding of the grants.
Approved grants are then paid by the Lubbock Arts Alliance, Inc.
out of the funds received from the City. The Lubbock Arts
Alliance is responsible for monitoring and administering all
aspects of the grants program.
As a result of a request by City Council to the Lubbock Arts
Alliance, guidelines for the grants program have been revised. The
objectives of the revisions are: 1) to make the application process
more accessible and encourage agencies to seek staff assistance
throughout the entire grant process; 2) to establish a mechanism for
accountability from agencies receiving and using grants funds; and
3) to establish a clear mechanism for oversight of the grant funds
by the Arts Alliance. Changes in the guidelines were presented to
the Council at its March 13 work session and they were approved
by Council April 24, 1997.
Because of the need to work more closely with arts agencies in the
community and to more closely monitor the grants program, the
Arts Alliance is requesting that the percentage allowed for
administration of the program be revised. The current agreement
allows for $5,936.01 which represents 5 per cent of the
$118,720.23 paid to the Arts Alliance to disburse to application
grantees. The Arts Alliance is requesting that the percentage
designated for administration of the funds be revised to $11,872.02
which represents 10 per cent of the funds. A budget, detailing the
administrative cost for oversight of the funds is included in
Council's back-up.
