Coy Harris, Executive Director of the American Wind Power Center, appeared to present a proposal to allocate $49,000 of Hotel/Motel Tax Funds for the restoration and addition of twenty rare and historically important windmills to the museum grounds. This item was considered following Item 15. In 1993, the City of Lubbock approved a grant of $65,000 from the hotel/motel fund for the American Wind Power Center (AWPC). The funds were used to purchase and transport 50 historic windmills from Mitchell, Nebraska. The purchase of these windmills assisted in the creation of the American Wind Power Center. Certain obligations were outlined in the contract between the City and the AWPC and in a subsequent contract in 1997. Community Development monitors these obligations, and to date the AWPC has met its obligations and is in compliance with the contracts. Additionally, the AWPC used the $65,000 to leverage $3,907,311 in funds for operating capital and established an endowment fund. The endowment fund has been used to purchase and erect 105 windmills. The Center also used these funds to build the new interpretive windmill facility. The AWPC claims to be the largest collection of windmills exhibited in the world. Since the new building was opened in 2000, the number of guests visiting AWPC has continued to rise; this year there have already been 6,776 visitors. Approximately 50% of the visitors to the Center are from out-of- town. The Wind Power Center has developed an educational program that provides an on -site learning experience for school children from Lubbock and surrounding communities. The AWPC has an additional 100 windmills in storage that are in need of restoration. The total cost to restore twenty of these windmills is $98,000. If these windmills are restored, the number of windmills on the grounds outside the museum would total fifty. These windmills will be visible from the highway and will greatly enhance the appearance of the grounds and building. The AWPC is asking for half of the needed amount ($49,000) from the City's portion of the Hotel/Motel Tax, and will acquire the remaining $49,000 from other sources. As of 9/30/02 the Visitor Information Center Fund (Fund 118) of the Hotel Motel Tax Fund has a balance of $167,284. That fund is projected to have a balance of $265,637 at the end of the fiscal year (9/30/03). For details of this fund, see Attachment I. Other entities have expressed an interest in spending money from this fund to enhance tourism in Lubbock. The Chamber of Commerce has expressed an interest in establishing a Visitor's Center. There has also been some interest in purchasing 6 additional visitor information kiosks (Attachment II), similar to the one displayed during the Vatican Exhibit, and placing them at major tourist sites around the City. These sites could include the Airport, the Buddy Holly Center, the Windpower Center, etc., and would be used to direct visitors to other destinations within the City limits. Staff recognized the value of the American Wind Power Center and applauded its efforts to attract visitors to Lubbock. Staff recommendation is that Council hold on this item until such time as Council has considered all possible requests for this funding. Staff requested direction as to the manner in which Council would like to have this analysis conducted. 272 Regular City Council Meeting October 10, 2002 Page 273 Coy Harris, Executive Director of the American Wind Power Center, appeared to make the presentation. City Manager Bob Cass suggested that Council consider the possibility of holding this until the revised budget process, if not the formal budget process, recognizing they will do whatever Council directs them to do. Mayor McDougal suggested referring Mr. Harris to Convention and Tourism and Council can relook at this during budget allocation time if necessary. Council Member Hernandez stated that if we required that of this -- particular group, then we need to require that of all groups because that has not been the practice in the past. Council consensus was that if anyone comes in wanting part of the hotel/motel tax it must be considered in revised budget. Next item to be considered was Item 17. (11.) Ordinance No. 2002-00106 amending Article III of Chapter 6 of the Code of Ordinances of the City of Lubbock, Texas, with regard to adopting the 2000 Edition of the International Plumbing Code (first reading). ORDINANCE NO. 2002-00106 AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ADOPTING THE 2000 EDITION OF THE INTERNATIONAL PLUMBING CODE AND PROVIDING FOR CERTAIN AMENDMENTS TO SUCH CODE IN ORDER TO MEET LOCAL CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. The State of Texas requires that municipalities adopt a recognized plumbing code as the authority for enforcement of plumbing concerns. The current plumbing code is the 1997 International Plumbing Code. Prior to 1997, the plumbing code was the Uniform Plumbing Code. The proposal to the City Council is the adoption of the 2000 International Plumbing Code, along with local amendments as the plumbing authority for the City of Lubbock. For several years different code groups developed codes that were primarily used in different areas of the country. Lubbock has traditionally adopted the Uniform Codes published by the International Conference of Building Officials. The three model code groups are Building Officials and Code Administrators International, Inc. (BOCA), International Conference of Building Officials (ICBO), and Southern Building Code Congress International, Inc. (SBCCI). These joined forces to establish the International Code Council (ICC) and to publish the international codes. The staff notified the professional organizations affected and an ad hoc committee was formed to review this code. Those with an interest attended meetings once a week for several months. The committee was comprised of mostly plumbers, mechanical contractors, staff, and engineers. After several months the group presented their final recommendations to the Building Board of Appeals. The amendments were presented to the Board for approval to be adopted by the City Council. The Building Board of Appeals has recognized the hard work of the ad hoc committee headed by Cyril Reasoner to compile the proposed amendments. The Board has voted and approved the 2000 International Plumbing Code with amendments for City Council approval and adoption. Staff recommended approval of this ordinance. (24.) Ordinance No. 2002-00107 amending Article III of Chapter 6 of the Code of Ordinances of the City of Lubbock, Texas, with regard to adopting the 2000 Edition of the International Mechanical Code (first reading). ORDINANCE NO.2002-00107 AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ADOPTING THE 2000 EDITION OF THE INTERNATIONAL MECHANICAL CODE AND PROVIDING FOR CERTAIN AMENDMENTS TO SUCH CODE IN ORDER TO MEET LOCAL CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. The State of Texas requires licensing for those persons engaged in mechanical contract work. The Building Inspection Department has been granted authority, through the adoption of the mechanical code, to enforce this code through permits and inspections. The current code is the 1996 International Mechanical Code, which was the first edition of the International Code Council. It was adopted by the City of Lubbock. 277 Regular City Council Meeting October 10, 2002 Page 278 It is hereby submitted to the City Council that the 2000 International Mechanical Code be adopted, along with the attached amendments, as the mechanical code for the City of Lubbock. This mechanical code falls into the same group of international codes as discussed in the memo describing the 2000 International Plumbing Code. The mechanical code amendments were presented in a group of three codes to the Building Board of Appeals and approved. The Building Board of Appeals has approved the ad hoc committee's recommendation of amendments to the 2000 International Mechanical Code and recommended to the City Council the adoption of the code and attached amendments. Staff recommended approval of this Ordinance. (25.) Ordinance No. 2002-00108 amending Article III of Chapter 6 of the Code of Ordinances of the City of Lubbock, Texas, with regard to adopting the 2000 Edition International Fuel Gas Code (first reading). ORDINANCE NO.2002-00108 AN ORDINANCE AMENDING ARTICLE III OF CHAPTER 6 OF THE CODE OF ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO ADOPTING THE 2000 EDITION OF THE INTERNATIONAL FUEL GAS CODE AND PROVIDING FOR CERTAIN AMENDMENTS TO SUCH CODE IN ORDER TO MEET LOCAL CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION. The fuel gas code is a separate code from plumbing and mechanical codes. This is the third of the three codes that were presented to the Building Board of Appeals for approval by the ad hoc committee. The present mechanical code references NFPA 54 for testing, inspection and purging of gas piping systems. The 2000 International Fuel Gas Code is founded on broad based principles that make possible the use of new materials and new fuel gas system and appliance designs. The Building Inspection Department will be given authority, through the adoption of the fuel gas code, to enforce this code through permits and inspections. It is hereby submitted to the City Council that the 2000 International Fuel Gas Code be adopted, along with the attached amendments, as the fuel gas code for the City of Lubbock. This code falls into the same group of international codes as discussed in the memo describing the 2000 International Plumbing Code and 2000 International Mechanical Code. Amendments for the fuel gas code were presented in the group of three codes that were approved by the Building Board of Appeals. The Building Board of Appeals has approved the ad hoc committee's recommendation for amendments to the 2000 International Fuel Gas Code to send to the City Council for adoption of the code and attached amendments. Staff recommended approval of this ordinance. (26.) This lease agreement is for Bryan Dayne O'Reily and Felenia Dawn Burge, owners of Conference Cafe, Inc., DBA Whiskey River, at 1720 Buddy Holly Avenue to lease approximately 31 spaces of the City's Health Department parking lot at the southwest corner of 191h Street and Texas Avenue. Additional parking per zoning requirements is needed for customers of the Cafe during the evening and nighttime hours. This lease is for two years and the City will receive $116.25 per month for this lease. This has been calculated as follows: $15 per space (typical monthly downtown parking lot space rental rate) x 31 spaces = $465. (32•) Consider approval of a median in Quincy Avenue from 82°d Street south to 87th Street. The Code of Ordinances requires City Council approval of medians in streets. This particular Street, Quincy Avenue, is on the half section line, which is the normal location of collector streets. There is a large power line that extends along the half section line. The subdivision to the west of Quincy Avenue, Westwood Addition, was platted in 1993. Sixty feet of right-of-way was dedicated from that subdivision for Quincy Avenue, but much of that width contains the power line. Betenbough Homes is preparing to plat land, Monterey Addition, on the east side of Quincy Avenue from 82nd Street to 98th Street. With that plat, an additional 60 feet of right-of-way will be dedicated for Quincy Avenue. Two one-way streets, on either side of the power line, are proposed for Quincy Avenue. This will result in a boulevard for Quincy Avenue with a median area for the existing power line. The developer of Monterey Addition, Betenbough Homes, has indicated an interest in paving not only their required paving improvements along the east side of the power lines, but also the one-way street along the west side of the power lines. The roadway along the west side is currently strip paved. The City will participate in the extra width paving cost of a typical collector street. The developer has also indicated a preliminary interest in providing some up -front improvements for this median area, with the intention of the City continuing maintenance once installed. This will be discussed further with Parks Department. 283 Regular City Council Meeting October 10, 2002 Page 284 Staff recommended approval of this median for Quincy Avenue. (33.) Consider approval for special handling of garbage collection for Lots A-1-A-I through A-1-A-8, Park Lorraine Addition. The developer of this tract is replatting into residential lots. With the tract size, and the tract being adjacent to a thoroughfare (341h Street), it is difficult to plan a normal alley configuration for residential development. The developer is proposing to have residents of these eight residential lots access their garbage collection from the north -south alley east of this development tract. This documented approval of special garbage collection will place future owners of these residential lots on notice of the change from normal collection. Staff recommended approval of this request for special handling of garbage collection. (34.) Primary issues include continuous requests for additional office spaces by many functions, wide variety of office standards being applied and complications arising as visitors and employees try to efficiently exit the building during emergencies. A capital project was approved in FY2000/01 to begin renovations of the Municipal Building. The initial step will be to analyze the building relating to space used and space available. Negotiations took place to aggressively seek the best fee for this project. -- PSC agreed to a fee of $39,872 for the professional services to perform the space analysis of the Municipal Building and the fee is within the Capital Outlay -Municipal Building/First Floor Renovations budget. Based on past and current work experiences with PSC, the Selection Committee recommended awarding this contract to the local firm of Parkhill Smith & Cooper. (36.) BID #158-02/BM—Construction of High Speed Taxiway (Aviation) and reject all bids. This item was moved from Consent Agenda to Regular Agenda and considered following Item 16. On August 22, 2002 staff received and opened two bids for the Taxiway "V" project. After reviewing the bid tabulations with our engineers for this project, staff have concluded that bids are high and recommended that they be rejected. It is our intent to place the project out for bids again at the earliest opportunity. Through discussions with the companies that bid on the project, staff have identified areas of uncertainty that staff believe staff can eliminate by modifying the bid specifications. This should bring the cost of the project within the existing budget. However, in the event that bids still come in higher than expected, staff are restructuring the package to include deductive alternates that will allow us to go forward with the project in stages over a period of two to three years. The low bid is $2,259,495 from Duininck Brothers, Inc. of Roanoke, Texas and is not within the Construct High Speed Taxiway B-1 budget of $1,714,850. Mark Earle, Director of Aviation, stated that the bids came in over $500,000 over the estimated amount. Staff recommended that City Council reject all bids. Motion was made by Council Member Patterson, seconded by Council Member Boren to reject all bids as recommended by staff. Motion carried: 7 Yeas, 0 Nays. Next item to be considered was Item 80. (37.) The older relays are not supported any longer and are starting to fail. These relays are used to protect substation expensive breakers and lines costing over $150,000 each. A sustained outage could occur by not replacing these relays. The review committee evaluated high-tech proposals based on technical specifications (50%), warranty (20%), quality of bidder services (20%), and cost (10%). The criteria used in the evaluation process included technical specifications (50%) to make sure that the relays would be able to serve the purpose for which they are intended and would replace the old electro- mechanical relays. Emphasis was also placed on the warranty (20%) to ensure that LP&L would not incur additional cost for repair or replacement of these costly relays in the event of an early failure. In determining best value, staff considered the eight criteria pursuant to Local Government Code §252.043(b). Hester's/McGlaun discount applies to on-line orders and walk-in orders at their local retail store. Boise Cascade does not have a local retail store and the discount only applies to on-line orders. §252.043(b)(4) Hester's/McGlaun's on-line ordering system will suggest alternate items when additional savings can be realized. This feature could more than offset the 1.8% price difference (43,800) between the two low bids. §252.043(b)(7) Hester's/McGlaun's accepts orders on-line and at their local retail store providing the City with next -day and same -day delivery. Boise Cascade does not have a local retail store and offers only next -day delivery. §252.043(b)(8) The bid from Hester's/McGlaun offers the City of Lubbock the best combination of contract price and best value for the City created by contract award. Ordinance No. 2002-00109 - ZONE CASE NO. 2945 (south of Erskine Street and east of North Dover Avenue): Hold a public hearing to continue request of Hugo Reed and Associates, Inc. (for Erdon Corporation) for a zoning change from R-1 to R-2 Specific Use for 20-foot front setbacks for duplexes and reduced setbacks at cul-de- sacs on an unplatted 19-acre tract of land out of Section 1, Block J-S. ORDINANCE NO.2002-00109 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2945; A ZONING CHANGE FROM R-1 TO R-1 SPECIFIC USE AND R-2 SPECIFIC USE ZONING ON AN UNPLATTED 19-ACRE TRACT OF LAND OUT OF SECTION 1, BLOCK J-S, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. Mayor McDougal opened the public hearing at 11:48 a. m. Bernie Gradel appeared on behalf of Hugo Reed/Erdon Corporation. Don Cummings, Steve and Joyce Tomlinson, David Laney and Terry Dodd appeared in opposition. Mayor McDougal closed the hearing at 12:15 p. m. The original request would rezone an area south of Erskine and east of Dover as duplex zoning with a condition for a 20-foot front setback on regular lots and five feet on cul-de-sac lots. During the Planning Commission meeting, the proponent amended the request to R-1 Specific Use for town homes on the lots facing Dover south of the proposed Emory Street. Adjacent land use: North — vacant, zoned residential South — zoned for a church East — vacant, zoned residential West — duplex units from Erskine to Emory, single family residential to the south. Subsequent to the Planning Commission meeting, the proponent met with neighbors and agreed to amend the request to single family zoning with a twenty foot front setback on the lots facing Dover, with the exception of the first six south of Erskine. Those lots would be R-2 across from existing R-2 zoning. In addition, the development would have no connection to Dover between Erskine and Colgate, eliminating or dramatically reducing traffic from the new area toward the west to Frankford. During the Commission meeting and at the Council hearing, a number of the Horizon West residents west of Dover expressed concern about duplex zoning. Even after learning of the amended proposal, several continued to express concern. A petition was presented to the Council opposing the change, although the petition did not specify if the opinions of the persons signing the document would remain unchanged with the amendment proposed by the proponent. The signatures on the petition that are landowners in the Notice Area do not constitute 20 percent opposition. The petition contains 190 signatures, and at least one is a duplicate (as many as 19 appear to be duplicate). Of the 189 households represented, twenty are signed by two residents of the same home, which reduces the number of households to 169. By matching the last name of the resident and the name of the person who gets the tax bill, approximately 127 (75%) of the households represented by the signatures are owner -occupants and 42 (25%) appear to be renters. The residents expressed fear that the units would be rented to students. At the Planning Commission meeting the staff reviewed for their understanding that the proposed zoning will contain the prohibition of 293 Regular City Council Meeting October 10, 2002 Page 294 more than two unrelated persons in each unit. In addition, a review of LCAD homestead exemptions in the area indicate that approximately 102 of the 261 existing homes (39%) in the single family area of the Horizon West neighborhood have not filed for an exemption and are presumed to be rental. The 2000 Census reports that renters occupy 44.2% of the housing units in Lubbock, and four square mile Tract 4.02 including Horizon West is 41.4%. These percentages include apartment units so the numbers for single family are not as high when considered alone. However, more single-family homes are rental units than generally understood by the public. Some neighbors expressed concern for devaluation of their property. With current construction costs, the minimum proposed square footage and a 75% brick or masonry requirement would suggest a valuation in excess of $100,000 for the new homes along Dover. Most of the homes on the 264 single family zoned lots in Horizon West are at least fifteen years old. Twelve are valued above $80,000 by LOAD. Eighty-six are valued $70,000 to $80,000 and 163 are valued $60,000 to $70,000. Three lots are vacant in the area. The request, as amended, is consistent with the Comprehensive Land Use Plan. Single family faces single family and the R-2 is to the east on the next street and no street connections exist between Erskine and Colgate. Colgate does not connect to Frankford to the west because of a playa. During the Council hearing mention was made about consistency with the Comprehensive Land Use Plan. R-2 is a district that, properly located, meets both the definition of low -density housing and buffer zoning. In this instance, the developer is buffering (with continued single family) and limiting access to the adjacent existing single family. Many areas in Lubbock are developed in a manner as this area is proposed, having pockets of R-2 adjacent to single family. The project should have no greater effect than anticipated on the thoroughfare system. The Planning Commission recommended approval of the request subject to two conditions: 1. A minimum square footage of the town homes. 2. A twenty -foot front setback for the R-2 non -cul-de-sac lots and a five-foot minimum setback (excluding any garage portion of the structure) for lots facing a cul-de-sac. With subsequent discussion at Council and between the neighborhood and proponent, the staff recommended the amended request with the following conditions: 1. The proposed Lots 1-6 will be zoned R-2 Specific Use related to setback. 2. The proposed Lots 7-30 will be zoned R-1 Specific Use related to setback. 3. For both the R-1 Specific Use and R-2 Specific Use lots, a minimum twenty -foot front setback shall be required for the non- cul-de-sac lots and a five foot minimum setback (excluding any garage portion of the structure) for lots facing a cul-de-sac. 4. For both the R-1 Specific Use and R-2 Specific Use corner lots, the minimum side setback for both the structure and the rear/side yard fence shall be five feet. 5. Eliminate Emory and Dartmouth between North Clinton and North Dover. Staff recommended approval of this ordinance. Motion was made by Council Member Martin to uphold Planning and Zoning with the following conditions: K:Z! Regular City Council Meeting October 10, 2002 Page 295 1) Lots 1-6 be R2 with conditions expressed 2) Lots 7-27 be R1 with conditions expressed, and 3) Add north/south alley on the east side of Lots 1-27 be a paved alley and that 1-27 all have rear entry garages and if needed, two additional alley outlets would be in the area between Lot 47 and Lot 28 coming out to the east along North Clinton. Motion failed for lack of a second. Motion was made by Council Member Hernandez, seconded by Council Member Boren to deny Zone Case 2945. Motion failed: 2 Yeas, 5 Nays. Motion was made by Council Member Martin, seconded by Council Member Boren to amend the above motion to pave the alley one block east of Dover, rear entry garages on both the residential and the duplexes and with one additional alley to be worked out with staff from north/south paved alley to come out on North Clinton. Council Member accepted the amendment. Motion carried: 6 Yeas, 1 Nays. Council Members Hernandez voted Nay. 11:15 A.M. SPECIAL PUBLIC HEARING (45.) Hold a public hearing to receive input concerning the adoption of an ordinance to designate a reinvestment zone within the City of Lubbock. Mayor Pro Tern Hernandez opened the public hearing at 12:40 p. in. David Sharp, Market Lubbock, Inc. presented a slide show and made brief comments. Mike Iannuzzelli, Technical Manager, Frito Lay also appeared on behalf of the reinvestment zone. No one appeared in opposition. Mayor Pro Tern Hernandez closed the hearing at 12:43 p. m. Motion was made by Council Member Boren, seconded by Council Member Patterson that the improvements sought are feasible and practical and would be a benefit to the land to be included in the zone and that the zone will contribute to the retention or expansion of primary employment and would contribute to the economic development of the City of Lubbock. Motion carried: 4 Yeas, 0 Nays. Council Members, Cooke, Hernandez and Martin had left the dais. (46.) Ordinance No. 2002-00110 of the City Council of the City of Lubbock, Texas designating a reinvestment zone within the City of Lubbock as authorized by Chapter 312, Tax Code; describing the boundaries of said Zone; describing the eligibility of said Zone for commercial -industrial tax abatement; providing a saving clause and providing for publication (first reading). ORDINANCE NO. 2002-00110 AN ORDINANCE DESIGNATING A REINVESTMENT ZONE WITHIN THE CITY OF LUBBOCK AS AUTHORIZED BY CHAPTER 312, TAX CODE; DESCRIBING THE BOUNDARIES OF SAID ZONE; DESCRIBING THE ELIGIBILITY OF SAID ZONE FOR COMMERCIAL -INDUSTRIAL TAX ABATEMENT; PROVIDING A SAVING CLAUSE AND PROVIDING FOR PUBLICATION. The City of Lubbock has been approached by Frito Lay to assist them in solving some issues that are hindering the Lubbock Plant's competitiveness. The Lubbock Frito Lay plant is 40 years old and will need some upgrades in order to be competitive with other plants inside the Frito Lay system. Frito Lay has asked for assistance from the City of Lubbock, Lubbock County and Market Lubbock, Inc. in order to resolve these issues. 295 Regular City Council Meeting October 10, 2002 Page 296 Frito Lay employs approximately 307 people in Lubbock with a $9.7 million annual payroll. The average annual salary at the Lubbock Frito Lay plant is approximately $32,000. Frito Lay plans to invest approximately $6.5 million in upgrading the plant over the next couple of years. Part of this investment is for a pretreatment system, at a cost of $2.5 million. The new pretreatment system would reduce TSS by 90% and BOD by 55%, which would reduce the surcharges that Frito Lay pays by 2/3. Prior to completion of the new pretreatment facilities, Frito Lay has requested that the City of Lubbock provide some degree of financial relief regarding their current wastewater surcharge fees. The funds saved by Frito Lay would be allocated toward construction costs of the new pretreatment facilities. The specifics of the requested relief are still pending, but it is anticipated that the surcharge adjustment recommendation will require Council action to effect. In order to make this large investment in a small plant in their system, Frito Lay has to have a certain return on investment for the upgrades to be approved by PepsiCo. One of the ways that has been proposed to assist Frito Lay is the creation of a reinvestment zone where the Frito Lay plant is located. This would allow the City and County of Lubbock to consider a tax abatement for the new improvements. Frito Lay is already building onto their warehouse at the present time and this improvement would not be included in an abatement considered by the City and County. A reinvestment zone will be necessary since the area where Frito Lay is located was omitted from the South Enterprise Zone due to the very low unemployment rate of the tract. In order for the City of Lubbock to nominate the area in Exhibit "A" as a reinvestment zone, there must first be a public hearing held for citizen input. Once the public hearing is concluded, the City of Lubbock must pass an ordinance designating the reinvestment zone. Designation of the area attached as Exhibit "A" as a reinvestment zone will be reasonably likely to contribute to the retention or expansion of primary employment and will contribute to the economic development of the City of Lubbock. This public hearing and ordinance will fulfill the requirements of the law on designating the reinvestment zone. Staff recommended approval of this ordinance. Motion was made by Council Member Morrison, seconded by Council Member Hernandez to pass on first reading Ordinance No. 2002-00110 as recommended by staff. Motion carried: 5 Yeas, 0 Nays. Council Members Cooke and Martin had left the dais. (47.) The proposed paving improvements consist of the following alleys and streets: Unit Number Description A-462-42 East-West alley between 10th Street and 11 th Street from Salem Avenue east to Quaker Avenue A-462-43 East-West alley between 56th Street and 571h Street from Memphis Avenue west to Nashville Avenue A-462-44 U-shaped alley between 85th Street and 86th Street/Oxford Avenue from 85th Street to Oxford Avenue A-462-45 U-shaped alley between 77th Street/York Avenue and 78th Street/Zoar Avenue from Slide Road to 79th Street A-462-46 East-West alley between 8th Street and 9th Street from Salisbury Avenue east to Salem Avenue 2336-001 251h Street from Milwaukee Avenue east to La Salle Avenue 2336-002 261h Street from Milwaukee Avenue east to Kewanee Avenue All of the included streets and alleys were requested by petition to be paved. The petition for the alley between 1 oth Street and 11 th Street was signed by 86% of the assessable abutting property owners. The petition for the alley between 56th Street and 57th Street was signed by 81 % of the assessable abutting property owners. The petition for the alley between 85th Street and 86thStreet/ Oxford Avenue was signed by 80% of the assessable abutting property owners. The petition for the alley between 77th Street/York Avenue and 78th Street/Zoar Avenue was signed by 64% of the assessable abutting property owners. The petition for the alley between 8th Street and 9th Street was signed by 85% of the assessable abutting property owners. The petition for 25th Street from Milwaukee Avenue to LaSalle Ave was signed by 63% of the assessable abutting property owners. The petition for 26th Street from Milwaukee Avenue to Kewanee Avenue was signed by 64% of the assessable abutting property owners. The purpose of this hearing is to provide the affected property owners on the alleys and streets an opportunity to express their feelings in regard to proposed paving and subsequent assessment of the cost of such improvements. After public comment the City Council will determine whether or not the City will pave the petitioned alleys and streets and the portion of the costs that will be assessed to the abutting property owners for the paving improvements for all units. Under Texas Law a municipality may not assess an amount exceeding the special benefits, or enhancement value, of the paving improvements to the abutting properties. The enhancement must be established by a qualified person, and the municipality must participate in at least 10% of the cost of street and/or alley paving, exclusive of curb and gutter costs. 297 Regular City Council Meeting October 10, 2002 Page 298 The "Calculated Rate" shown on the assessment rolls is the maximum assessment rate that may be levied consistent with state law and the City of Lubbock Policy, exclusive of the enhancement value issue. This rate is calculated on the basis of the property owners paying 100% of the curb and gutter cost and 90% of the paving cost. The "enhancement rate" shown on the rolls is the estimated amount that the value of the abutting property will be increased by the proposed paving improvements. A qualified appraiser was engaged by the City of Lubbock to determine the enhancement value of the paving improvements for each of the abutting properties included in this project. His report indicates that the enhancement value for the paving of the five petitioned alleys and the two petitioned streets is significantly less than the estimated construction cost. These determinations are consistent with historical enhancement studies. A copy of the appraiser's report is available for inspection. The City Council may set the rate for each street or alley at any amount from zero up to the calculated rate. When assessing amount greater than the enhancement value past Councils have required that an agreement be signed by at least 50% of the abutting property owners stating that they agree to pay the rate set by council. This approach is in effect paving by contract between the signing property owners and the City. The signed agreement may be considered as testimony that the benefits to the property equal the amount being assessed. The validity of this testimony could be challenged, and the City could possibly be required to reduce the assessment rate to the enhancement value for owners not signing the agreement. The alternatives available to the City Council are as follows for each unit: A. Units A-462-42 through 46 (Alleys) 1. Delete the alley from the program. 2. Authorize paving of the alley, and assess the abutting property owners the amount specified by the appraiser as the enhancement value. Property owners would pay 24%- 28% of the cost. This would require the City to pay 72%- 76% of the cost of the alley. 3. Authorize paving of the alley, and assess the abutting property owners an amount up to the calculated rate. The property owners would pay up to 90% of the paving cost. B. Units 2336-001 and 002 (25th Street from Milwaukee to LaSalle and 26th Street from Milwaukee to Kewanee) 1. Delete the street from the program. 2. Authorize paving of the street and assess the abutting property owners the amount specified by the appraiser as the enhancement value. On 25th Street the property owners would pay 42% and the City would pay 58% of the cost. On 26th Street the property owners would pay 52% and the City would pay 48% of the cost. 3. Authorize paving of the street and assess the abutting property owners an amount up to the calculated rate. The property owners would pay up to 90% of the paving cost and up to 100% of the curb and gutter cost. Regular City Council Meeting October 10, 2002 Page 299 The public hearing will serve as the first of three readings of the assessment ordinance. The first part of this ordinance is included in the Council's back-up materials. The ordinance will be completed following testimony given at the public hearing. Upon completion of the paving construction, the amounts determined by the City Council will be assessed to the abutting property owners. The assessments may be paid all at once or in five annual payments at 8% interest. A. Unit A-462-42 Alley between 1 Oth and 1 Ith from Salem to Quaker. Staff recommends that the Council elect to construct the paving improvements, assess at the calculated rate, and require the majority of the abutting property owners to sign an agreement stating their property will be enhanced to an amount equal to the calculated rate.
