Vandiver Donald G. Vandiver, First Assistant City Attorney A copy of the Collateral Agreement is filed with Resolution 2002-R0288. The current bank depository services contract with American State Bank is a three-year contract with the provision for a two-year extension. The two-year extension was exercised in 2000; therefore the current contract will expire on July 31, 2002. For the best interests of the citizens of Lubbock, the City Council rejected all bids for RFP #066-02/DC. This RFP was for the selection of the official City depository. The application process for depository services will begin within the next thirty days. Therefore, the City needs to enter into a contract to ensure collateral coverage on all City funds deposited at American State Bank for this interim time -period. RESOLUTION 2002-RO289 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LUBBOCK: THAT the Mayor of the City of Lubbock BE and is hereby authorized and directed to execute for and on behalf of the City of Lubbock, a Purchase Order for 28,000 pound GVWR cab & chassis with shuttle loading system, by and between the City of Lubbock and Philpott Ford of Port Neches, Texas, and related documents. Said Purchase Order is attached hereto and incorporated in this resolution as if fully set forth herein and shall be included in the minutes of the City Council. 43 Regular City Council Meeting July 23, 2002 Page 44 Passed by the City Council this 23rd day of July, 2002. /S/ MARC MCDOUGAL MARC MCDOUGAL, MAYOR ATTEST: /s/ Rebecca Garza Rebecca Garza, City Secretary APPROVED AS TO CONTENT: /s/ Victor Kilman Victor Kilman, Purchasing Manager APPROVED AS TO FORM: /s/ William de Haas William de Haas A copy of the Purchase Order is filed with Resolution No. 2002-R0289. This bid is for the purchase of a 28,000 Pound GVWR Cab & Chassis with a shuttle loading system for the Parks Department. A shuttle loading system is a hydraulic system that allows interchange of various truck bodies (i.e. water tank, dump bed, etc.). Our bid documents require bidders to submit a New Equipment Service Questionnaire (NESQ) with their bid to assure the City that warranty work and service work are available locally. However, the bid documents also state that the City reserves the right to waive immaterial formalities and to accept the offer most advantageous to the City in its sole discretion. Staff waived the formality of requiring a NESQ with Philpott Ford's bid because the intent of the NESQ requirement was met due to the fact that 1) the Purchasing Department already has a NESQ on file from Philpott Ford, and 2) the Fleet Services Department has experienced excellent service from our local Ford dealers on vehicles purchased in the past from Philpott Ford and on this particular class of truck. In making a recommendation for award of this bid, staff carefully considered the availability of local service in addition to other factors in Philpott's bid: Lowest Cost by $3,550 (5.8%) Exceeded GVWR (Gross Vehicle Weight Requirement) by 17.8 % Exceeded Front Axle Requirement by 33.3 % Exceeded Rear Axle Requirement by 9.5 % Exceeded Engine Horsepower Requirement by 6.5 % Exceeded Fuel Tank capacity Requirement by 42.9 % Exceeded Alternator Requirement by 30 % The City will deliver the truck to one of the local Ford dealers to have service work done. The City will not have to take the engine to one place, the transmission to another, and the vehicle to another to get all the warranty work done. The City has a letter on file from Philpott Ford stating that Gene Messer or Pollard will do the warranty work and service work on this truck. Staff has received written and verbal assurance from Gene Messer and Pollard service representatives that Gene Messer and Pollard will perform warranty work and service work on this truck. Regular City Council Meeting July 23, 2002 Page 45 The second low bid from Lubbock Truck Sales did not indicate any exceptions to the specifications and was $3,550 (or 5.8 %) higher than the low bid. The low bid is $61,719 from Philpott Ford of Port Neches, Texas and is within the Equipment Capital Outlay -Heavy Movable Equipment budget. Staff recommended award of this bid to Philpott Ford as the most truck at the lowest price.
