Doug Goodman Doug Goodman, Managing Director of Health & Community Services APPROVED AS TO FORM: /s/ Amy L. Whitt Amy L. Whitt, Assistant City Attorney According to staff memo, in 1993 the City Council set goals regarding the targeting of neighborhoods to accomplish a focused renovation of blighted areas of the community (particularly those eligible under entitlement funding). Targeting includes utilizing the Community Development Block Grant (CDBG), Emergency Shelter Grant (ESG), and the HOME Investment Partnership Program (HOME) as much as possible. In FY1994-1995, the City Council selected Arnett Benson and Chatman Hill as the areas for targeting entitlement dollars. In FY1995-96, the City Council selected Arnett Benson, Chatman Hill, and Chris Harwell neighborhoods for substantial funding. The Community Development Advisory Committee (CDAC) met on March 4 and April 1, 1996, to discuss, evaluate, and vote on the 1996-97 recommendations for funding. Their discussions included: The accomplishments in Chatman Hill and Arnett Benson The possibility of adding another target area this year 239 City Council Minutes April 18, 1996 Page 240 Items which remain to be done in the Chatman Hill and Arnett Benson areas The dollars needed to complete the priority needs of the neighborhoods The idea of funding only capital projects in Chatman Hill in 1996-97 The CDAC recommendations to the City Council are as follows: The same fifteen neighborhoods be able to participate in federal funding between 1996-2000 The same seven neighborhoods be prioritized between 1996- 2000 The Harwell, Arnett Benson, Chatman Hill, and Jackson/Mahon neighborhoods be recommended for substantial funding in 1996-97 In keeping with the City Council goals set in 1993, the Community Development & Neighborhood Initiatives (CDNI) staff continues to further the selection of areas to prioritize funding. The staff also continues to meet with other City departments, neighborhood associations, non-profit organizations, and private groups in furthering investment in these neighborhoods. The CDNI staff agrees with the CDAC recommendation and would also like to limit funding in the Chatman Hill neighborhood to capital projects since private investments are present in the neighborhood. Motion was made by Councilmember Patterson, seconded by Councilmember Hernandez to authorize Resolution #5162 as recommended by staff. Motion carried: 6 Yeas; 0 Nays. ( 9.) Vandiver, First Assistant City Attorney A copy of the Professional Services Agreement by and between the City of Lubbock and Southwest Museum Services is filed with Resolution No. 5163. According to staff memo, in December 1995 a request for proposals was sent out for professional consulting services to assist with the development of a master plan for the permanent exhibition of the Buddy Holly collection. The completion of the master plan will provide recommendations consistent with professional museum standards on such areas as security, climate control and conservation management. The plan will provide City staff with additional information on fundraising and grant opportunities for the capital campaign as well as operations and maintenance once the facility is opened. Recommendations on the research and story line development for the permanent exhibit will identify opportunities to acquire additional items, establish a mechanism for the donation of additional items, and to fully tell the Buddy Holly story. This information will be essential before the comprehensive design of the exhibition can be completed. Cost for Phase I is $18,000. Funds for this phase of the project are budgeted for in Cultural Arts Services from hotel/motel occupancy tax monies. Phase II of planning will include development of exhibit design for the Buddy Holly exhibition, complete with research, preparation of the story line, and comprehensive drawings showing every facet of the exhibit including location of objects, graphics, photographs, text and audio -visualize. The drawings and designs will include specifications adequate for fabrication. Cost for Phase II is $39,700. Fundraising for Phase II of the planning is currently underway. 241 City Council Minutes April 18, 1996 Page 242 Six firms submitted proposals for professional services for the Master Plan for the permanent exhibition of the Buddy Holly collection. A selection committee reviewed and rated the proposals submitted by the firms. Southwest Museum Services (SMS) received the highest ranking of 94.7. References given by Southwest Museum Services were contacted by the committee. All references gave excellent reports on SMS. In addition, site visits were made to two museums for which SMS had completed exhibit designs and fabrications to better determine the scope of their vision and ability. The selection committee recommended that Southwest Museum Services be engaged to perform the master plan for the Buddy Holly exhibition. Staff recommended approval of this resolution. Mayor Langston asked that the City Secretary ensure that Mayor Pro Tern Neugebauer file with the City Secretary the appropriate disclosure statement regarding this item, even though Mr. Neugebauer was not present at the City Council meeting. Mayor Langston opened the public hearing at 10:45 a.m. Bernie Gradel appeared on behalf of Lubbock Land Company to present this request for zone change from A-1 to R-1 and R-1 Specific Use. No one appeared in opposition. Mayor Langston closed the hearing at 10:47 a.m. Randy Henson, Senior Planner, presented staff comments. The developer of Remington Park is processing one final zone change to eliminate existing apartment zoning in favor of single-family to protect the existing and future home owners. The rezoning will prevent individual lots from being developed with duplex structures. Mr. Henson gave the adjacent land use relationships as follows: North - apartments South - residential East - apartment/commercial West - single-family The request is consistent with the Comprehensive Land Use Plan. The proposal is a minor change to the Plan which anticipated high density (apartment) residential at this location. The request is also consistent with zoning policy. The request will have no adverse impact on traffic. Staff supported the request as approved by the Planning and Zoning Commission. 251 City Council Minutes April 18, 1996 Page 252 Motion was made by Councilmember Sitton, seconded by Councilmember Patterson to pass on first reading Ordinance #9893 as recommended by P&Z and City staff. ORDINANCE #9894 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2718-B; A ZONING CHANGE FROM R-2 TO AM SPECIFIC USE ZONING FOR A PERSONAL CARE FACILITY, MEDICAL OR GENERAL OFFICE ON LOTS 208-211 TERRA ESTATES NORTH, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. Mayor Langston opened the public hearing at 10:49 a.m. Don Osborne appeared on behalf of Kurion Development to present this request for zone change from R-2 to AM Specific Use. No one appeared in opposition. Mayor Langston closed the hearing at 10:55 a.m. Randy Henson, Senior Planner, presented staff comments. The request is filed as AM with a Specific Use Permit to cover three options: A personal care facility (as permitted in two zone change requests to the east) Professional/medical offices The existing R-2 which allows duplex or town/garden home construction. Mr. Henson gave the adjacent land use relationships as follows: North - single-family, outside city limits South - 4th Street, vacant single-family East - zoned for personal care facilities West- vacant, zoned R-2 The request is consistent with the Comprehensive Land Use Plan. When this area was annexed in 1984, the block face from Milwaukee to Oak Ridge was designated as commercial policy by the Plan. The standard policy for ten acres of commercial at major intersections is precluded by the existing subdivision. Discussion during the annexation hearings was that the deed restrictions of Terra Estates North allowed commercial development on the lots fronting 4th Street. The request is consistent with zoning policy. The request should create very little additional traffic on 4th Street. 252 City Council Minutes April 18, 1996 Page 253 Planning and Zoning approved subject to the following condition: Limited to a personal care facility, medical or general offices and all unconditionally permitted R-2 uses. Staff supported the request as approved by the Planning and Zoning Commission. Mayor Langston opened the public hearing at 10:57 a.m. Don Baldridge appeared on behalf of Lubbock Christian University (LCU) to present this request for zone change from R-1, A-1, A-2 and C-3 to R-1 Specific Use. No one appeared in opposition. Mayor Langston closed the hearing at 11:00 a.m. Randy Henson, Senior Planner, presented staff comments and gave the adjacent land use relationships as follows: North - commercial and church South - residential across 34th Street East - LCU West - apartments and commercial The existing Comprehensive Land Use Plan indicates the land owned by LCU as public use. The proposal fits very well into the Plan. The site plan is more generic than normal for Specific Use, but a condition related to review at a later date can alleviate any concerns. The adjacent traffic system will be affected very little. The staff supports the request subject to one condition: That a site plan, including building elevations showing materials, color, texture, a detailed landscape plan and an irrigation plan, shall be submitted to the Planning and Zoning Commission for approval prior to the issuance of a building permit. 253 City Council Minutes April 18, 1996 Page 254 Staff supported the request as approved by the Planning and Zoning Commission. Mayor Langston opened the public hearing at 11:01 a.m. David Buskirk appeared on behalf of Lubbock SMSA/Southwestern Bell Mobile Systems to present this request for zone change from C-4 to C-4 Specific Use. No one appeared in opposition. Mayor Langston closed the hearing at 11:05 a.m. Randy Henson, Senior Planner, presented staff comments and gave the adjacent land use relationships as follows: North - apartments South - commercial East - commercial West - commercial The existing zoning is C-4. The request is consistent with Comprehensive Land Use Plan and Zoning Policy. The owner of Paul's Parts objected because he stated an intent to use the alley from Peoria Avenue as access to his commercial center after the cross town freeway blocks his access to 19th Street. However, the tower is not on his property. Staff also indicated that the final details of the freeway are not available and that, normally, the business use of the alley as primary access to a business development is not acceptable. The details on how the right-of- way takings will occur will not be clear for some time. Staff supported the request as approved by the Planning and Zoning Commission. 254 City Council Minutes April 18, 1996 Page 255 Motion was made by Councilmember Cooke, seconded by Councilmember Patterson to pass on first reading Ordinance #9896 as recommended by P&Z and City staff. Motion carried: 6 Yeas; 0 Nays. Councilmember Cooke asked that City staff prepare a preliminary feasibility study regarding the sharing of towers by different providers. (23.) (for Lubbock SMSA/Southwestern Bell Mobile Systems) for a zoning change from C-3 to C-3 Specific Use (radio transmission facility) on a portion of Tract U-2-A-1, Greenlawn Addition, and to consider ordinance. No one appeared in opposition. Mayor Langston closed the hearing at 11:19 a.m. Randy Henson, Senior Planner, presented staff comments. The proponent is expanding coverage for cellular in Lubbock. Mr. Henson gave the adjacent land use relationships as follows: North - commercial South - LCU property (future golf course) East - commercial West - commercial The request is compatible with both Comprehensive Land Use Plan and Zoning Policy. The tower will be located behind commercial development that faces 19th Street. The project will have no effect on traffic. Staff supported the request as approved by the Planning and Zoning Commission. Motion was made by Councilmember Patterson, seconded by Councilmember Sitton to pass on first reading Ordinance #9897 as recommended by P&Z and City staff. Zone Case No. 1615-H (south of 58th Street and east of Loop 289)--Hold a public hearing to consider request of South Plains Mall Association (for Home Depot USA) for a zoning change from C-3 Specific Use to C-4 Specific Use (home improvement store with enclosed garden center) on a tract out of Section 28, Block E-2, and to consider ordinance. ORDINANCE 49898 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1615-H; A ZONING CHANGE FROM C-3 SPECIFIC USE TO C-4 SPECIFIC USE ZONING FOR A HOME IMPROVEMENT STORE WITH ENCLOSED GARDEN CENTER ON A TRACT OUT OF SECTION 28, BLOCK E-2, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. Mayor Langston opened the public hearing at 11:21 a.m. Michael Clark appeared on behalf of Home Depot USA to present this request for zone change from C-3 Specific Use to C-4 Specific Use. No one appeared in opposition. Mayor Langston closed the hearing at 11:24 a.m. Randy Henson, Senior Planner, presented staff comments. The proponent is developing a home products facility west of South Plains Mall. Mr. Henson gave the adjacent land use relationships as follows: North - commercial and apartments South - Loop 289 East - South Plains Mall West - Loop 289 The request is compatible with the Comprehensive Land Use Plan. The request is filed as C-4 Specific Use for several items: The area north that is commercial is not required to be screened by the Zoning Code, while the area zoned and developed as apartments has a screening requirement. The proposal by the staff was to screen the rear of the building along 58th Street and not to screen the parking lot area west of the building. The proponent has responded to that suggestion on the site plan. The west 350 feet unfenced will allow a good visual access to the service road of Loop 289 from 58th Street. During the hearing on the Lowe's request, the staff proposed and the Planning Commission supported a condition limiting outdoor display of permitted products to the area under the front canopy. The City Council, after considerable discussion that the Lowe's tract was already C-4 and located next to M-1, disallowed that proposed condition. Since this property is C-3 by current ordinance, the staff proposes the same condition in this case, even though the stores are basically the same. 256 City Council Minutes April 18, 1996 Page 257 The site plan has a garden center on the west end that proposes a green, plastic dipped chain link fence exterior. Again, using Lowe's as an example, the staff did not oppose the use of chain link because of the size and height of the garden center. In terms of equity, the Senior Planner related to Home Depot that the proposed garden center use of chain link would not be opposed, but that a proposal would be made that limits stacking higher than the top of the chain link fence. The proposed use is going to share some parking with a lot that the Mall will retain. A cross access and parking easement will be filed. As a result, the facility has a great parking ratio. Otherwise, the request is a routine request. The Planning and Zoning approved the request with three conditions: Outdoor display of portable buildings, plant material and garden and yard equipment shall be limited to the front sidewalk in a manner as to not affect pedestrian access or safety. 150 adjacent parking spaces to the south shall be used in conjunction with Home Depot. No product shall be stacked above exterior garden center chain link walls. Staff supported the request as approved by the Planning and Zoning Commission. Motion was made by Councilmember Patterson, seconded by Councilmember Sitton to pass on first reading Ordinance #9898 with conditions as recommended by P&Z and City staff. Motion carried: 6 Yeas; 0 Nays. (25.) Zone Case No. 1826-D (southwest corner of 49th Street and Indiana Avenue) --Hold a public hearing to consider request of Rod Warren (for Sonic Drive -In) for a zoning change from C-3 to C-4 Specific Use (drive-in and all unconditionally permitted C-3 uses) on Lot 1-C, Fry Addition, and to consider ordinance. Mayor Langston opened the public hearing at 11:28 a.m. Dave Fleming and Rodney Warren appeared on behalf of Sonic Drive -In to present this request for zone change from C-3 to C-4 Specific Use. Ed Montgomery, 3509 48th Street, appeared in opposition. Mayor Langston closed the hearing at 11:48 a.m. Randy Henson, Senior Planner, presented staff comments. The request of this proponent is a Sonic drive-in restaurant. Mr. Henson gave the adjacent land use relationships as follows: North - across 49th Street - duplex homes South - self-service gasoline station and convenience store East - Monterey High School West - apartments and a photography studio 257 City Council Minutes April 18, 1996 Page 258 The parcel is currently zoned C-3 and the parcel is noted as commercial on the Comprehensive Land Use Plan. Zoning policy is an issue discussed by adjacent neighbors. Several owners of the duplex units to the south expressed concerns for additional traffic in this area and on Indiana Avenue. The site plan indicates the existing screen wall will remain on 49th Street with no curb cuts. The site plan indicates a style of drive with a landscape buffer on the west that will prevent vehicles from entering the alley as is now a habit on the undeveloped lot. The property is properly zoned for a sit-down fast food restaurant with outdoor patio and accessory drive through. The approval by the Planning Commission was based on the fact that the fast food competition of the Sonic Drive -In could locate on the lot under the current zoning. Traffic issues on Indiana Avenue were discussed at the Planning and Zoning Commission hearing. Indiana Avenue is being constructed as a seven -lane thoroughfare, our largest street, and will be able to handle additional traffic. There is no doubt that congestion will occur at times. The staff is not aware of any operational complaints for the existing Sonic Drive -In stores. The Planning Commission recommended the zone change to the City Council subject to the following condition: Limited to a drive-in restaurant and all unconditionally permitted C-3 uses. Staff supported the request as recommended by the Planning and Zoning Commission. Motion was made by Councilmember Cooke to approve the first reading of this ordinance. Motion died due to the lack of a second. Motion was made by Councilmember Sitton to continue this zone case until the May 9, 1996, Regular City Council Meeting, and that staff report back on mediation between Mr. Montgomery and Mr. Warren, seconded by Councilmember Patterson. Motion carried: 5 Yeas; 1 Nay --Mayor Langston. At the May 9, 1996, Regular City Council Meeting, the Mayor will reopen the public hearing and ask for additional response. 258 City Council Minutes April 18, 1996 Page 259 (25A.) Zone Case No. 2151-A (708 SE Loop 289)--Hold a public hearing to consider request of Ken Kelsay (for Martin Marine) for a zoning change from R-1 to C-4 on Lots 1-6, Del Prado Addition, and to consider ordinance. ORDINANCE #9899 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2151-A; A ZONING CHANGE FROM R-1 TO C-4 ZONING ON LOTS 1-6, DEL PRADO ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. Mayor Langston opened the public hearing at 12:03 p.m. Ken Kelsay appeared on behalf of Martin Marine to present this request for zone change from R-1 to C-4. No one appeared in opposition. Mayor Langston closed the hearing at 12:05 p.m. Mr. Henson, Senior Planner, presented staff comments. The request is to accommodate a boat sales and marine shop. Mr. Henson gave the adjacent land use relationships as follows: North - Loop 289 South - residential East - residential and industrial West - industrial The north three lots are designated as IDP on the Comprehensive Land Use Plan. With proper screening, the proposal should be as compatible as possible with the existing neighborhood. The residential lot next door (east) is already adjacent to industrial. The occupant of a new home south of 74th Street withdrew opposition at the Planning Commission hearing. His home faces north directly across from the back of the boat storage lot. The proponent requests to use chain link with slats as the screening fence. Chain link provides a greater level of security than picket fences and the plastic slats used now are much more durable than the venetian blind metal slats used in the past. The proposal will have little or no effect on traffic. The parcel fronts on Loop 289. The Planning and Zoning recommended the request tied to the site plan. Staff supported the request as recommended by the Planning and Zoning Commission. Motion was made by Councilmember Ince, seconded by Councilmember Patterson to pass on first reading Ordinance #9899 as recommended by P&Z and City staff.
