The City Council of the City of Lubbock, Texas, met in regular session on the 11th day of April 1996 in the City Council Chambers, first floor, City Hall, 1625 13th Street, Lubbock, Texas, at 8:00 A.M. Present: Mayor David R. Langston, Mayor Pro Tem Randy Neugebauer, Councilmember Victor Hernandez, Councilmember T. J. Patterson, Councilmember Windy Sitton, Councilmember Max L. Ince, Councilmember Alex Cooke, City Manager Bob Cass, City Attorney Anita Burgess, and City Secretary Betty M. Johnson. Mayor Langston called the meeting to order at 8:03 A.M. The City Council recessed into executive session at 8:04 A.M. The City Council reconvened at 10:20 A.M. (1.) The Invocation was given by Renae Phillips, Pastor of Metropolitan Community Church. ( 2.) Pledge of Allegiance was given in unison by those in the Council Chambers. (3.) Board Appointments ( 4.) Presentation of Special Recognition for "Odyssey of the Mind Day" in Lubbock and special recognition certificates to the "Odyssey of the Mind" teams representing Lubbock in state competition. According to staff memo, each year Lubbock schools compete in the Odyssey of the Mind School Program, a program that fosters creative and problem -solving skills among participating students from kindergarten through college. Lubbock schools have established a history of successful competition and have competed in the World finals. Mayor Langston presented the special recognition certificates. (5.) Request of Burl Masters for Mike Thoma to consider a zone case condition for a tract west of Frankford and north of 3rd Street in Shadow Hills. Randy Henson, Senior Planner, presented staff comments. Zone Case No. 1893-R contains a condition stating "that a street right- of-way from 3rd Street to 4th Street be established, dedicated, and proposed for improvement prior to or in conjunction with a construction permit. If acquiring the right-of-way becomes impossible, an item shall be placed on the City Council agenda as City Council Minutes April 11, 1996 Page 218 other business for review and resolution of the issue." The new owner/developer of the tract in question has a preliminary plat approved for single-family on the parcel. He indicates having trouble meeting the requirement. The staff s position during the zone case was that adding 50 lots to an area with only one access street (3rd Street) to Frankford Avenue does not create a safe traffic environment. The condition is flexible as to where the new street would be located, but does require the cooperation of adjacent owners and perhaps a greater expense than normal for a parcel this size. The staff continues to believe that the additional street is essential to traffic safety in the area. However, because of the temporary stalemate, the staff supports the request of Mr. Masters in hopes that the drive will be forthcoming in the next year. Motion was made by Councilmember Cooke, seconded by Mayor Pro Tern Neugebauer to approve the request to remove the condition from the zone case. Motion carried: 5 Yeas; 2 Nays-- Councilmember Hernandez and Councilmember Ince. ( 6.) Motion was made by Councilmember Patterson, seconded by Councilmember Hernandez to approve the minutes of the March 28, 1996, Regular City Council Meeting as written. Motion carried: 7 Yeas; 0 Nays. (7.) Ordinance #9890--Abandoning and closing a transformer pad easement located in Lot 10-A, Executive Garden Home Addition (5702 81st Street). In Lubbock's approved Office of Economic Adjustment (OEA) grant, $131,250 in federal grant money has been approved for initial personnel and administrative project costs. The Lubbock/Reese Redevelopment Committee (LRRC) began advertising in late 1995 for an Executive Director. A review committee and interview panel were established by the LRRC, and on February 19, 1996, five finalists were interviewed. Of those interviewed, Lewis "Eddie" McBride was selected by the LRRC as their Executive Director. The LRRC reviewed and approved the conditions of employment for Eddie McBride. This position will not be an employee of the City of Lubbock, but a position under contract for professional services. The base pay for this position will be $60,000 annually and work related local travel will be reimbursed at $0.31 per mile. The contract also provides for medical insurance, dental insurance, life insurance, long-term disability insurance, sick leave, and vacation. The director will not be eligible for the City's retirement plan and the individual will have to pay his own FICA withholding. The term of this contract is for one year, subject to additional OEA grant funds being made available. This item was removed from the consent agenda. 222 City Council Minutes April 11, 1996 Page 223 Doug Goodman, Managing Director of Health and Community Services, presented staff comments. In 1994 the Community Development Department implemented stronger fiscal controls over federal grant funds as follows: Controlling project budgets to 5 percent or $10,000 overage Keeping projects on a 12-month schedule Reallocating contingency funds on a timely basis and/or if the fund exceeded $100,000 The results of implementation of the first two items have increased the contingency funds from $142,663 to $387,693. Contingency funds must be used for CDBG eligible activities and must fall within the applicable spending caps for the overall program. The staff looks particularly at projects which are currently underway, projects which may have been put forth during the latest request for proposals (but did not receive funding), and new or special interest projects. HOUSING: Relocation (current project) $ 30,000 East-West Freeway Rehab (new project) $189,000 ADMIN/DIRECT DELIVERY: Neighborhood Coordinator (current project)$ 25,000 CD Attorney (current project) $ 35,000 PLANNING/ADMIN: Fair Housing Assessment (new project) $ 15,000 PUBLIC SERVICE: LUNA (current project) $ 10,000 Graffiti Removal (current) $ 25,000 Youth Development Program (new) $ 18,625 Total $347,625 The staff recommended that all listed projects be funded and added to the 1995-96 CDBG action plan. The funding of all of these projects will not exceed spending caps and must meet the Department of Housing and Urban Development guidelines before they can be implemented. Ms. Margie Jefferson addressed the City Council regarding her concern that the City Council and City staff are not utilizing the funds in the best way to ensure that the people who really need the funds benefit from them. Mayor Pro Tern Neugebauer mentioned that Lubbock citizens serve on the committee that makes the recommendations regarding use of CDBG funds. 223 City Council Minutes April 11, 1996 Page 224 Motion was made by Councilmember Hernandez, seconded by Councilmember Patterson to leave $189,000 for the east -west freeway rehab project and $18,625 for the youth development program in contingency and authorize the other allocations as recommended by staff. Johnson, City Secretary APPROVED AS TO CONTENT: /s/ John Hindman John Hindman, Farm Manager APPROVED AS TO FORM: /s/ Donald G. Vandiver Donald G. Vandiver, First Assistant City Attorney A copy of the Interlocal Agreement by and between the City of Lubbock and the Texas Agricultural Experiment Station is filed with Resolution No. 5161. Terry Ellerbrook, Managing Director of Water Utilities, presented staff comments. Because of the limited underground water supply at its Agricultural Experiment Station located north of the Lubbock airport, Texas A&M University (TAMU) has sought to obtain the use of farm land with sufficient available water to continue its agricultural experimentation work on irrigated crops. Without suitable land with an adequate water supply, TAMU will have to move some of their projects to other regions of the state or cut back 231 City Council Minutes April 11, 1996 Page 232 on the number of projects altogether. It is possible that some existing projects would have to be moved to the TAW facility near the Halfway community in Hale County if arrangements for suitable land in Lubbock cannot be made. To accommodate TAW's needs, it is proposed that the City of Lubbock grant TAW the use of approximately 80 acres of land situated near the terminal storage reservoir at the land application R site. This land has been used for year-round cattle grazing. If the use of the City land is authorized, the existing agricultural experiment station would continue to be operated as a dry land testing facility. The proposed agreement provides that TAW would use approximately 30 acres for corn and sorghum research and about 50 acres for cotton research. Approximately 26 acres of corn would be used in a study whereby Banks grass mites would be released on a very small portion of the acreage, along with beneficial insects, to determine the ability of these insects to control the mites. About two acres of corn and two acres of sorghum would be used for a weed control study, using various herbicides. Finally, approximately 30 acres would be planted in cotton for various performance tests, and an additional 20 acres would be planted in cotton to be given to the City of Lubbock as a consideration for entering into this agreement. The agreement also provides that only a small percentage of the corn and sorghum would be harvested for TAW needs, the remainder will be left for the City to use for grazing or other purposes. Water will be provided to the farm plots from existing wells. TAW would be responsible for the supply of all herbicides, fertilizer, seed, insecticides, and all labor associated with the operation. The term of the agreement would be for one year from the date of execution by the parties to the agreement. It could be renewed annually for additional one-year terms by mutual written agreement of the parties. The direct economic benefit of the Texas A&M Agricultural Experiment Station to Lubbock's economy is substantial. The number of employees (including full and part-time) ranges from 100 full-time employees year round to as many as 250 total employees during the peak summer months. If, as an alternative, some of the Lubbock projects were moved to the Halfway community, it is likely that upwards of one-third of the 100 permanent employees would choose to move to Plainview in order to be nearer their work. In view of the positive economic impact on the Lubbock economy, the anticipated revenue to the City of Lubbock, and the potential benefit of agricultural research to all farmers, the staff recommended approval of this item. 232 City Council Minutes April 11, 1996 Page 233 Motion was made by Mayor Pro Tem Neugebauer, seconded by Councilmember Hernandez to authorize Resolution #5161 as recommended by staff.
