A copy of the Special Warranty Deed by and between the City of Lubbock and Ron
Betenbough and Rick Betenbough is filed with Resolution No. 5105.
According to staff memo, when the right-of-way was acquired for
the widening of Milwaukee Avenue in 1990, several whole lots
were purchased. Only a portion of these lots were used for the
actual road construction, and unusable remnants remained. The
remainder of Lot 98, West Side Addition is considered one of these
remnants and can be sold to the abutting property owner. This
remnant is located at the northeast corner of Milwaukee Avenue
and 33rd Street, contains approximately 5,246.50 square feet, and
has an average frontage of approximately 40 feet. The City paid
$3,750 for this entire lot which originally had 75 feet of frontage.
This equates to a residential front foot price of $50.00 per front

foot. Using this $50 per front foot times the remaining 40 feet of
frontage, staff calculated a value of $2,000 for this remnant. Ron

have agreed to this price.

According to staff memo, this water line easement is located along
the south side of 98th Street, adjacent to the east side of Quaker
Avenue, and runs approximately 970 feet east to west in length.
This easement is composed of two parts, a permanent 10-foot
wide easement located along the south right-of-way of 98th Street
and a 40-foot wide working easement located 10-feet south of the
south right-of-way line of 98th Street. This easement is needed for
the installation of a 54-inch water line running westward from
Memphis Avenue to Quaker Avenue. This 54-inch water line is a
part of the Water Utilities Master Plan. The line will help
eliminate chronic low pressure in southwest Lubbock. Current
growth trends will only worsen the low pressure problems. This
water line easement was appraised by Ralph Mabry, M.A.I., who
valued the permanent easement at $9,695 and the working
easement at $405, for a total valuation of $10,100 as offered to H.
A. Sessions.

This capital project was also approved by the City Council on May

CHANGES: ZONE CASE NO.2767; A ZONING CHANGE FROM C-3 TO C-4
ZONING ON LOT 16, HOWARD GARLINGTON ADDITION, LUBBOCK, TEXAS;
SUBJECT TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS

Mayor Langston opened the public hearing at 10:34 a.m. Kirk
Whitworth appeared on behalf of Clear-Vu Auto's to present this
request for zone change from C-3 to C-4. No one appeared in
opposition. Mayor Langston closed the hearing at 10:35 a.m.
Randy Henson, Senior Planner, presented staff comments. At the
corner of 34th and Slide, approximately one-half of the parcel is
already zoned C-4. This request will accommodate the use of the
service station for used vehicle sales and continue the existing C-
3 zoning. The proponent indicates that the structure will be
remodeled. Mr. Henson gave the adjacent land use relationships as
follows:
North - commercial
South - commercial
East - commercial
West - commercial and residential
According to staff memo, the request is not a deviation from the
Comprehensive Land Use Plan. Slide Road is a designated Farm
to Market and this parcel will be adjacent to the future east -west
freeway right-of-way. The request complies with zoning policies
and should create no traffic related issues.
The Planning and Zoning Commission recommended the request
with one condition:
Limited to used vehicles sales and all unconditionally
permitted C-3 uses.
Staff recommended approval of the first reading of this ordinance.

Mayor Langston opened the public hearing at 10:37 a.m. Joe
Stettheimer appeared on behalf of Heritage Home to present this
request for zone change from A-2 to R-1 Specific Use. No one
appeared in opposition. Mayor Langston closed the hearing at
10:39 a.m.
Randy Henson, Senior Planner, presented staff comments. The
existing vacant parcel is zoned A-2 from a project of town homes
and apartments that was never completed. The town home
portions were built and surround the parcel on the north, south and
east. Mr. Henson gave the adjacent land use relationships as
follows:
North - townhomes
South - townhomes
East - townhomes
West - single family
According to staff memo, the request is compatible with the
Comprehensive Land Use Plan. The proposal meets zoning
policies and has little or no effect on the thoroughfare system. The
project will contain 16 homes versus a possible 70f unit apartment
complex allowed by the existing zoning.
Staff recommended approval of the first reading of this ordinance.

Mayor Langston opened the public hearing at 10:40 a.m. Pete
Stone appeared on behalf of Stone's Tire and Auto Center to
present this request for zone change from C-3 to C-4. No one
appeared in opposition. Mayor Langston closed the hearing at
10:42 a.m.
Randy Henson, Senior Planner, presented staff comments. The
parcel is a C-3 remnant between IHC zoning to both the east and
west. The proponent is being displaced from a location at 66th and
University which was zoned to accommodate a business similar to
the proposal of this request. One adjacent owner submitted and
later withdrew opposition. Mr. Henson gave the adjacent land use
relationships as follows:
North - single family
South - single family
East - commercial
West - commercial
The request should have no effect on traffic. The Planning and
Zoning Commission approved the request with two conditions:
Limited to a public repair garage, utility vehicle rental and
all unconditionally permitted C-3 uses.
The display of utility rental vehicles shall be limited to one
vehicle between the building line and 50th Street. All other
storage shall be behind the building or between the building
and Avenue L.
Staff recommended the approval of the first reading of this

Petree appeared on behalf of Dennis Kirk to present this request for
zone change from R-1 to C-4. No one appeared in opposition
Mayor Langston closed the hearing at 10:45 a.m.
Randy Henson, Senior Planner, presented staff comments. The
proponent proposes a business that involves a wholesale
warehouse, sales office and vehicular storage. Mr. Henson gave
the adjacent land use relationships as follows:
North - Reese AFB
South - semi -industrial, site of an old gin
East - non -conforming heavy commercial
West - trailer park
The request is consistent with the Comprehensive Land Use Plan.
Zone cases on 19th Street outside Loop 289 have traditionally

FOR PUBLICATION.
Mayor Langston opened the public hearing at 10:48 a.m. Randy
Henson appeared on behalf of the City of Lubbock to present this
request for zone change from R-1 to C-4. No one appeared in
opposition. Mayor Langston closed the hearing at 10:50 a.m.
Randy Henson, Senior Planner, presented staff comments. The
City of Lubbock is the owner of this parcel as a portion of the
effluent application farm. The property has been leased to the
Plains Co-op Oil Mill for a new facility. Mr. Henson gave the
adjacent land use relationships as follows:
North - City property
South - industrial
East - Loop 289
West - industrial
The request is consistent with the Comprehensive Land Use Plan
and all zoning policies. The property south of 50th Street at this
location is zoned M-2. The project will have no negative effect on
the thoroughfare system. The Planning and Zoning Commission
recommended the request to the City Council for approval.

Betenbough & Company for a zoning change from R-2 to R-1
Specific Use (garden homes with a 20 foot minimum front
setback) on a tract out of Section 37, Block AK, and to consider

ORDINANCE #9886
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING
CHANGES: ZONE CASE NO. 2011-B; A ZONING CHANGE FROM R-2 TO R-1
SPECIFIC USE ZONING FOR GARDEN HOMES ON A TRACT OUT OF SECTION
37, BLOCK A-K, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING A
PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR
PUBLICATION.
Mayor Langston opened the public hearing at 10:51 a.m. Rick
Betenbough appeared on behalf of Betenbough & Company to
present this request for zone change from R-2 to R-1 Specific Use.
No one appeared in opposition. Mayor Langston closed the hearing
at 10:52 a.m.
Randy Henson, Senior Planner, presented staff comments. The
proponent is allowed to develop garden homes in the existing R-2
District. The purpose of this case is to require all garden homes
within the development and not allow a duplex to be built by a
future lot owner. Mr. Henson gave the adjacent land use
relationships as follows:
North - residential
South - industrial with conditions
East - mobile home park
West - residential
The proponent requested a condition for a 20-foot minimum front
setback. In the town/garden home specific use section of the
Zoning Code, the minimum setback is 15 feet for non -garage
portions of the homes. The proposed condition is more restrictive
than allowed by the existing R-2 zoning.
The request is consistent with both Comprehensive Land Plan and
zoning policies. The proposal should have little effect on traffic.
The Planning and Zoning Commission recommended the request
to the City Council with one condition:
The front setback shall be a minimum of 20 feet.
Staff recommended the approval of the first reading of this
ordinance.

A copy of the Grant Amendment for federal assistance for the Lubbock/Reese
Redevelopment Committee is filed with Resolution No. 5114.
Jim Bertram, Director of Strategic Planning, presented staff
comments. On July 22, 1995, the City Council approved a grant
application to the Office of Economic Adjustment (OEA) in the
amount of $175,000. This grant requires a 25 percent local match,
of which 10 percent must be in cash. These funds were originally
established to support the Lubbock Reese Redevelopment Plan as
well as office staff, travel and related costs.

Staff was aware that an amendment would be required to fund the
contract for a land use consultant. This new amendment would
increase the total grant award to $607,172. OEA's portion would
increase to $455,379, up $324,129 from $131,250. This will
require a local match of $151,793. Lubbock County has approved
$10,000 toward the match. This amendment will allow the City to
fund the costs to complete a Comprehensive Reuse Plan for Reese
AFB.

A copy of the Services Agreement by and between the City of Lubbock and Pathfinders
is filed with Resolution No. 5115.
Jim Bertram, Director of Strategic Planning, presented staff
comments. The Lubbock/Reese Redevelopment Committee
(LRRC) is the primary entity overseeing the redevelopment of
Reese Air Force Base, which is due to close in September 1997.
The next step in the process will be to hire a land use consultant to
develop a Comprehensive Reuse Plan for Reese AFB.
Funding for this project will be from a combination of the Office
of Economic Adjustment (OEA), which is a federal agency within
the Department of Defense, the City of Lubbock, and Lubbock
County. The OEA will provide up to 75 percent of the project
costs and the local match will be 25 percent, of which 15 percent
can be in -kind. Thus far, the City of Lubbock has been awarded
$131,250 in planning grant money from the OEA. This contract
will require a request for additional OEA grant funds, which has
been discussed with OEA.
In response to this grant award, the Purchasing Department issued
a Request for Proposal (RFP) for a Comprehensive Reuse Plan for
Reese Air Force Base. A selection committee was appointed by the
LRRC to review the proposals and make recommendations to the
LRRC on the top three qualified firms. The review committee
consisted of four members of the LRRC and each of the chairs of
the various subcommittees appointed by the LRRC.
The criteria used for selection of the top three firms was described
in the RFP and included:
Technical content of proposal, methodology, and
appropriateness to project.
Qualifications and experience of personnel and the amount
of time of the specific persons committed to perform the
requested services.
Prior experience in similar projects.
Verified reputation of work quality.
Committee members reviewed and rated the proposals and
determined the top three firms. On January 4, 1996, the top three
qualified firms appeared before the LRRC for individual
interviews. The three firms selected to make presentations were
Arthur Andersen, BRW, and The Pathfinders. After further
discussion of each firm's qualifications and follow-up reference
checks, the LRRC recommended to City Council that they be
allowed to negotiate a contract with The Pathfinders.
During the presentation to the LRRC, The Pathfinders provided
numerous examples of previous work which is consistent with the
mission and goals of the LRRC for Reese redevelopment and also
showed strong capabilities in marketing and implementation.

The current OEA grant provides $131,250 in Federal funds for
personal services, supplies, and professional services. The City
has $300,000 budgeted for Reese reuse, with $43,750 committed to
the current OEA grant. Lubbock County has agreed to provide
$10,000 as part of our local match.
If the City executes this agreement with The Pathfinders, it will
increase the Federal OEA grant funds to $455,379; increase the
City's cash match to $141,793; with the county providing $10,000.
This will require an OEA grant amendment for an additional
$327,129. The LRRC reviewed and recommended approval of this
contract on February 15, 1996, pending OEA's final review.
The LRRC and City staff recommended approval, subject to the
OEA requirements for up to $285,367 for Phase I and for up to
$216,602 for Phase II. However, OEA's review could result in
lowering these amounts. The City cannot execute this contract
until written confirmation of OEA's approval of our grant
amendment.

Councilmember Patterson to authorize Resolution #5115 as
recommended by staff. Motion carried: 4 Yeas; 0 Nays.
