10:00 A.M.
The City Council of the City of Lubbock, Texas, met in regular session on the 25th
day of January 1996 in the City Council Chambers, first floor, City Hall, 1625
13th Street, Lubbock, Texas, at 10:00 A.M.

Mayor Langston called the meeting to order at 10:10 A.M.
( 1.) The Invocation was given by Bobby McMillan, Pastor of St.
John's United Methodist Church.
( 2.) Pledge of Allegiance was given in unison by those in the
Council Chambers.
( 3.) Board Appointments.
There were no board appointments to be made.
( 4.) Mr. Monico Carbajal and Mr. Rudy Reyes appeared to
receive commendations for their involvement in rescuing and
rendering aid to fire victims. Mrs. Lisa Velasquez, who was
also involved, was unable to be present.
Greg Lee, District Chief, explained that on the evening of
December 17, 1995, at about 7:38 p.m., a fire occurred in the
home of Mrs. Frances Tellez at 3219 1st Street. When the fire
was discovered, the family exited, but didn't realize that two
small children were left inside the burning house. Mrs. Tellez
went next door to request that the neighbors call 911. At this
time Lisa Velasquez began rendering aid to the children who had
exited with Mrs. Tellez.
At about that time Mr. Rudy Reyes, who lives across the street,
became aware of the house fire. Mr. Reyes ran to the burning
house and began breaking windows in an attempt to locate the
missing children. When he located one of the children, he pulled
him from the burning house through the window, suffering a
laceration to his forearm in the process.
Mr. Monico Carbajal, another neighbor, went outside and saw
that Mr. Reyes had removed a child from the house; something
told him he needed to check further. On approaching the broken
window, he could hear a child crying. Mr. Carbajal called out
and the child came to his voice. Mr. Carbajal then pulled
Antonio from the house.

A copy of the Grant Application for the South Plains Regional Narcotics Task Force is
filed with Resolution No. 5079.
According to staff memo, this grant application is being made in
conjunction with the Governor's Anti -Drug Abuse Program. The
52 law enforcement agencies represented in the South Plains
region cover some 10,000 square miles with a population of
approximately 340,000 people located in 11 counties.
The citizens of the 11 county region, including the City of
Lubbock, will benefit from this program. By identifying
transient narcotic dealers and coordinating efforts to monitor
their activities, the program will have an effective impact on the
narcotic problem in the 11 county region.
The Task Force will maintain a communications network with
local jurisdictions concerning criminal violator activity. This
approach will be promoted by coordination of enforcement
priorities and a violator apprehension program working closely
with the Drug Enforcement Administration, Department of Public
Safety, County and City law enforcement agencies. The unit
would also lend investigative support to location jurisdictions.
The total request for funding is $495,963; the City's 25 percent
match is $123,991, which will come from seized asset funds and
will have no impact on the City's General Fund budget.
To assure compliance with the requirements of the program, each
participating agency must sign an interagency agreement with the
City.
Staff recommended approval of this resolution.
Motion was made by Councilmember Patterson, seconded by
Councilmember Hernandez to authorize Resolution #5079 as
recommended by staff. Motion carried: 7 Yeas; 0 Nays.

outdated mail -in payment processing system. The contract price
is $109,500 and the budgeted amount is $120,000. LP&L
processes approximately 50,000 checks per month with this
system. This is an electronic system that endorses checks with
the City of Lubbock endorsement as well as the bank
endorsement. It also encodes the check for the proper dollar
amount. This system also allows LP&L to create batch headers for each deposit and eliminates the need for the bank to run a
proof operation on LP&L's monies, thereby reducing processing
costs.

According to staff memo, the Comprehensive Annual Financial
Report for FY1994-95 revealed General Fund revenues exceeded —
expenditure by $2,908,483. Following the presentation of the
annual report and year-end audit at the January 11 Council
meeting, staff recommended funding several projects with the
year end surplus. Over the past two years, staff has used surplus
funds at the year end to fund major projects which would most
likely impact future budgets or require the issuance of debt.
Following are the recommendations:
1. Bike Routes $40,000
During the public hearing for the FY1995-96 budget, a local
cycling group appeared to request the City's support for the
development of bike riding routes in the City of Lubbock. The
City is eligible to compete for $200,000 in grant funds with this
$40,000 match.
2. Technology Upgrades $300,000

A copy of the Agreement for tax abatement by and between the City of Lubbock and
United Supermarkets, Inc. #501, is filed with Resolution No. 5082.
According to staff memo, each tax abatement agreement must go
before the City Council twice due to the requirements of the state
tax code. The first time is a resolution giving notice of intent to
enter into a tax abatement agreement which must be sent to the
other affected taxing jurisdictions no later than seven days before
the municipality enters into the agreement. The second time is a
resolution authorizing the Mayor to execute the tax abatement
agreement.
Staff received a request from United Supermarkets, Inc. for
commercial tax abatement in the North Enterprise Zone. United
plans to build a new 40,000 square foot store at Parkway Drive
and Zenith Avenue to replace the store at East 4th Street and
Idalou Road. They plan to invest a total of $4.1 million in the
new facility. The breakdown will be $2.3 million for the new

building, the remaining $1.8 million for machinery and
equipment. The annual amount of tax abatement will be

the North Enterprise Zone and will result in the employment of
123 persons.

Supermarket Inc. #501 as an Enterprise Zone Project, which
qualifies them to be eligible for State incentives.

The FYI 995-96 agreement with SPAG provides for recreation in
the place of advocacy and physical fitness. The current
reimbursement rates from SPAG for FY1995-96 year's
components are the following:
Meals--$1.13, hot meal five days a week at all six sites.
Transportation--$0.695, provided at the three full-time
sites.
Recreation-40.41, At all six sites, includes games,
activities, etc.
The proposed contract with SPAG has not changed regarding the
pass -through funds from the USDA, remaining at $0.58 per meal
served limited to 88,300 meals. The agreement utilizing the
TDOA portion is currently funded at $37,333, a reduction
compared to the previous year due to SPAG operating under a
continuing resolution passed by the Federal Government.
Assuming a new Federal budget is passed, SPAG will be notified
regarding the amount of funding available and will contact the City
with an amendment.
Should no additional funding be made available, the City would
have the option to reduce the scope or terminate the programs
funded through SPAG. If a decision to terminate the programs due
to lack of funding is made, carryover funds from the previous
SPAG grants could be utilized to phase out the SPAG programs
over a three- to five -month period.
The cost to operate the senior program is estimated at $19,210.
This in -kind contribution is used as our match for the grant funds.

to be installed at the intersection of 34th Street and

ORDINANCE #9877
AN ORDINANCE AUTHORIZING A NEW TRAFFIC SIGNAL AT
MILWAUKEE AVENUE AND 34TH STREET; AND PROVIDING FOR
PUBLICATION.
Jere Hart, City Traffic Engineer, presented staff comments. The
opening of a new Frenship I.S.D. school at the corner of 43rd
Street and Milwaukee Avenue has significantly increased the
traffic at the intersection of 34th Street and Milwaukee Avenue.
Working closely with the Frenship I.S.D. the Traffic Engineering
Department did a signal warrant study in accordance with the
Texas Manual on Uniform Traffic Control Devices in
mid -December 1995, after school had been in session for
approximately a week. This study indicated that a traffic signal
was warranted. Because the paving at this intersection has not

been fully developed, the Traffic Engineering Department
recommended that a signal installation using span wires and
power poles be utilized until a future street project completes the
entire intersection. Funds for this project are available through
capital projects.

ordinance.
