A copy of Change Order No. 2 by and between the City of Lubbock and R. E. Monks
Construction is filed with Resolution No. 5061.
According to staff memo, R.E. Monk Construction Company
presently has a contract for the closure of Landfill Cells I and IIA
at a cost of $1,060,090. Cell III was scheduled to be closed later
this year and $482,476 was budgeted for this project. However,
because R.E. Monk already has personnel and equipment on site
and will complete the contracted project ahead of schedule, staff
was able to negotiate a price of $156,000 for the closure of Cell
III. Acceptance of this price will save the City $326,476.
Staff did not include the closure of Cell III with the present
project as additional work was being done on this cell and staff
did not anticipate completing it until later in the year. This work
was also completed ahead of schedule and staff is now in a
position to take advantage of the contractor being on site and thus
reduce costs.
A previous change order of $18,822.36 for a water well and
pump to serve the closure of Cells I and IIA was
administratively approved. Together with this proposed change
order the contract cost of $1,060,090 will increase by
$174, 822.36 or 16.49 percent.
Staff recommended approval of the change order.
Motion was made by Councilmember Patterson, seconded by
Councilmember Ince to authorize Resolution #5061 as
recommended by staff. Motion carried: 7 Yeas; 0 Nays.

A copy of the Agreement by and between the City of Lubbock and Joe D. McKay AIA
Architects is filed with Resolution No. 5062.
According to staff memo, as part of the Bond Election held in
May 1993, a capital project was approved to replace the roof of
the coliseum. A capital project for repairs or replacement of the
auditorium roof had also been approved during the FY1993-94
budget, but lacked the assignment of a project architect. The
similarities of both projects were such that staff felt it
advantageous to combine the efforts of assigning a project
architect. This effort resulted in the advertisement of a request
for proposal for architectural services required for the Municipal
Auditorium/Coliseum roofing projects. Six architectural firms
submitted proposals and a review committee was created to
analyze the proposals.
0
City Council Minutes

Page 5
The firms were rated on their personnel qualifications,
experience of architectural firm, methodology, and utilization of
roofing consultants. Results of the ratings were provided to the
Mayor and City Council members for their review. The
committee's recommendation for the best firm to develop
drawings and written specifications was Joe D. McKay
Architects.
Negotiations with McKay Architects resulted in a fee proposal of
6 percent of the allocated funding for construction which equals
$101,220.
In order to properly evaluate the different types of roofing
systems available in today's market, the assignment of an
architect is essential to proceed with these projects. Staff
recommended that the City Council authorize the Mayor to
execute an agreement on behalf of the City for professional
services with the firm of Joe D. McKay Architects to provide the
required project documents needed to perform the Municipal
Auditorium/Coliseum roofing projects.

According to staff memo, on January 12, 1995, the City of
Lubbock entered into an interlocal agreement with Texas Tech
University (TTU) for the performance of professional services
regarding the land application of sewage sludge. This project
was substantially completed prior to December 31, 1995, with
remaining tasks including analysis of samples and preparation of
a final report. Since the period for performance and payment
was scheduled to expire on December 31, 1995, TTU requested
an extension of time to complete the remaining items of work in
accordance with the original agreement. This amendment will
allow for completion of the work and final payment of $23,937 to
TTU prior to December 31, 1996.
The permitting process for Lubbock's wastewater treatment plant
is now expected to run well into 1996. Extending the time frame
for this work, as requested by TTU, will be advantageous to the
City of Lubbock in that TTU will continue to provide
professional support during this permit renewal process. Also, a
time extension will allow TTU to provide additional sample
analyses.
Staff recommended approval of this item.
Motion was made by Councilmember Patterson, seconded by
Councilmember Ince to authorize Resolution #5063 as
recommended by staff. Motion carried: 7 Yeas; 0 Nays.

A copy of Change Order No. 2 by and between the City of Lubbock and TMI Coating,
Inc., is filed with Resolution No. 5064.
According to staff memo, the City Council considered Bid No.
13330 (repainting elevated and ground storage tanks) and
awarded a contract to TMI Coating, Inc., in the amount of
$710,000. This project includes the rehabilitation and repainting
of three water storage tanks, including the 400,000 gallon
Canyon Lakes storage reservoir located near the Southeast Water
Reclamation Plant.
The specifications pertaining to the Canyon Lakes storage
reservoir were based on an inspection and evaluation of that
facility approximately one year ago. A recent re-evaluation of
this reservoir revealed some unforeseen problems which might
substantially alter the work which must be done. It has recently
been determined that the sand which has accumulated in this tank
contains a concentration of lead high enough to require that this
City Council Minutes

Page 9
material be disposed of in accordance with hazardous materials
procedures. Also, it has recently been determined that the lead
content on the inside wall of the tank is substantially higher than
was established in the prior evaluation. Also, the size of this
tank was misprinted in the specifications for Bid No. 13330.
In view of the changing scope of work involved, it is
recommended that the Canyon Lakes storage tank be deleted
from the current contract with TMI. This would reduce the
contract by $53,900 and would enable the staff to make necessary
revisions to the plans and specifications for this particular
reservoir. The rehabilitation and painting of this tank would then
be included with the 74th Street and Genoa repainting project
which is scheduled to go out for bid later in January. TMI has
agreed to this deletion, and the staff believes that the reduction in
the contract amount accurately reflects the value of the work
attributable to the Canyon Lakes storage reservoir.
Staff recommended approval of this change order.
Motion was made by Councilmember Patterson, seconded by
Councilmember Ince to authorize Resolution #5064 as
recommended by staff. Motion carried: 7 Yeas; 0 Nays.

A copy of the Contract by and between the City of Lubbock and Technical Services
Consulting and Training Group is filed with Resolution No. 5065.
According to staff memo, the LP&L Electric Production and
Distribution departments for many years have had a problem in
not having specific trades classifications. Promotions were based
on length of service and recommendation from supervisors. This
resulted in an inconsistency of knowledge and ability of different
individuals in the same classification. The current system leaves
LP&L without a means to measure knowledge and verifiability to
adequately perform at an acceptable level. Consequently, pay
has been inconsistent with ability and work performed. Some
employees have not been motivated to retain the training they
received and to work diligently to improve their skills and
production.
In keeping with the City's policies and procedures for review and
evaluation of proposals submitted on major projects for the City
of Lubbock, a review committee was formed. This committee
independently reviewed the proposals and rated them according
to the following criteria: firm qualifications and experience with
similar projects and utilities (25 percent); qualifications and
experience of proposed staff (30 percent); proposed time frame
for project development, implementation and completion (25
percent); estimated fees and/or fee structure (20 percent).
The top three companies were interviewed and again
independently rated. The rating from the interviews were
unanimous for Technical Services and Training Group.
10
City Council Minutes
January 11, 1996

The estimated cost of establishing trade classifications for six
categories is $30,000 plus expenses while reviewing current
training information. Holding training classes is approximately
$100 per day, per employee, on an as needed basis upon
knowledge verification.
Staff recommended the approval of this resolution.

According to staff memo, the City Council authorized $319,799
from the 1994 Community Development Block Grant for
construction and renovation of the Rodgers Community Center
and Arnett Benson Senior Center. The primary purpose of the
project is to connect two existing facilities to expand the types of
services and programs that will be offered. In August 1995, a
selection committee was appointed by the City Manager to
analyze the proposals for professional services for this project.
In October 1995, the selection committee recommended that the
architectural firm of SLS Partnership (SLS) be used to provide
the necessary services, and the City Council authorized the Park
staff to negotiate a contract with SLS. The results of that
negotiation are as follows: SLS Partnership will provide
schematic design, design development, construction documents,
bidding/negotiating phase, and construction administration for a
fixed fee of $20,500, which is 6.4 percent of the construction
budget.
The pricing negotiated with SLS for their services is within the
standards which the City of Lubbock sets for
architectural/engineering services.

A copy of the Second Amendment to the Convention and Tourism Service Agreement
is filed with Resolution No. 5067.
According to staff memo, in October 1995, the Lubbock City
Council created Marketing, Entertainment, Travel, Tourism,
Sports, Inc. (METTS), a non-profit corporation responsible for
creating, operating and promoting a cooperative and cohesive
marketing effort on behalf of Lubbock.
The current agreement with the City delegates to METTS the
management and supervision of convention and tourism programs
and activities funded with revenues from hotel/motel occupancy
tax. The proposed amendment to the agreement with the City
and METTS expands the duties and responsibilities to "the
creation, management and operation of programs and activities
for the purpose of visiting participatory and spectator sports
marketing." These expanded duties will be funded with
designated revenues of $187,000 from hotel/motel occupancy tax.

A copy of the Contract for engineering services by and between the City of Lubbock
and Schrickel, Rollins and Associates, Inc., is filed with Resolution No. 5068.
According to staff memo, the Broadway Streetscape project has a
primary purpose of reinforcing Broadway as a major visual
corridor for Lubbock. The project will link the Central Business
District with Texas Tech University on the west and the Canyon
Lakes and Dr. Martin Luther King, Jr. Boulevard on the east.
Funding for this project is a result of the participation from the
City of Lubbock, the Texas Department of Transportation
(TxDOT), the Federal Highway Administration, and the South
Plains Fair Association. Through the Intermodal Surface
Transportation Efficiency Act of 1991 (ISTEA), $1,625,704 of
federal funds were authorized for this project. Local matching
funds of $50,000 have been received from the South Plains Fair
Association, along with the City of Lubbock's commitment of an
additional $622,000, resulting in a total of $2,297,704. The
14

Page 15
ISTEA program provides for an 80/20 match of funds, with the
Federal Highway Administration providing 80 percent of the cost
associated with the project and a local match the remaining 20
percent.
In December 1994, the Mayor was authorized to execute on
behalf of the City an agreement with the State of Texas, acting
through TxDOT. Based on this agreement the State will secure
the federal cost share, let the construction contract, provide the
construction inspection, and provide other items as required.
The City will provide funding, prepare the design documentation,
acquire necessary right-of-way, and accomplish utility
adjustments.
In July 1995, a selection committee was appointed to analyze
proposals for professional services for this project. The selection
committee received and evaluated proposals from the following
six firms: SLS Partnership, Inc.; Shrickel, Rollins and
Associates, Inc.; Carter & Burgess, Inc.; Parkhill, Smith &
Cooper, Inc.; McLarty Baker Associates, Inc.; and Hugo Reed
and Associates, Inc. Proposals were rated on criteria including
personnel qualifications, record of performance, overall
responsiveness to the request for proposal/methodology, and
timeliness of proposed work schedule. After an initial rating, the
top three firms were interviewed, their references checked, and
finally ranked by the committee in the order of which firm is best
suited to provide the services requested. SRA received the
highest ranking, Carter & Burgess, Inc. was ranked second
highest, and Parkhill, Smith & Cooper, Inc. was ranked the third
highest.
In August 1995, the selection committee recommended that the
engineering/design firm of SRA be used to provide the necessary
services, and staff was authorized to negotiate a contract with
SRA. The results of that negotiation are as follows: SRA will
provide basic design services including contract documents for
the streetscape and antique lighting design for $114,500, which is
approximately 5 percent of the budget. Basic services include
engineering/landscape design, production of drawings and
specifications necessary to carry out City priorities of work to be
performed on Broadway. Other services which are considered
non -basic, but will be provided by SRA at a not -to -exceed
negotiated cost, include topographic survey/base sheet
preparation for $40,200, geotechnical investigations for $10,800,
and development of a master plan for $25,500. The topographic
survey/base sheet preparation, and the geotechnical investigations
are functions which provide necessary background information
for the development of a safe and efficient design. The
development of a master plan will provide a basis for future
enhancements along the Broadway corridor. The total amount
paid to SRA, including reimbursable expenses, is not to exceed
$193,000, which is approximately 8.4 percent of the total
project budget.

In accordance with the procedures for selecting and contracting
with professional service providers for federal enhancement
projects, this proposed contract has been pre -approved by
representatives form the TxDOT District office prior to being
submitted to the City Council for final execution.
The pricing negotiated with SRA for basic services is within the
standards which the City of Lubbock sets for engineering/design
services, and the total price negotiated for basic and non -basic
services has been pre -approved by TxDOT representatives as
being within the standard.

CHANGES: ZONE CASE NO. 1235-G; A ZONING CHANGE FROM AM
SPECIFIC USE TO AM SPECIFIC USE ZONING FOR A RADIO TOWER ON A

Mayor Langston opened the public hearing at 10:48 a.m. Ray L
McKim III appeared on behalf of KETS Partnership to present
this request for zone change from AM Specific Use to AM
Specific Use (for a radio tower). No one appeared in opposition.
Mayor Langston closed the hearing at 10:50 a.m.
Randy Henson, Senior Planner, presented staff comments. Mr.
Henson gave the adjacent land use relationships as follows:
North - Texas Tech
South - Carillon
East - Brownfield Highway and Texas Tech
West - Carillon
The property owners where the tower is proposed have approved
a lease; otherwise, no other private property owners are affected.
No adjacent owners appeared at the Planning and Zoning
Commission meeting. The proposal does not violate any zoning
policies. The project should have no effect on traffic. The
Planning and Zoning Commission recommended the request for
approval.

(28.) Consider Ordinance #9874 prohibiting pedestrian crossing of
freeways.
ORDINANCE #9874
AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE OF
ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, WITH REGARD TO THE
PROHIBITION OF PEDESTRIAN CROSSINGS ON FREEWAYS; PROVIDING
FOR THE ERECTION OF SIGNS; PROVIDING A PENALTY; AND PROVIDING
FOR PUBLICATION.
Jere Hart, City Traffic Engineer, presented staff comments. In
the past few years numerous pedestrians have been involved in
serious accidents while crossing freeway vehicular traffic lanes
within the city of Lubbock. As the volume of traffic has
increased, there are no longer sufficient gaps on the city's
freeways (I-27 & Loop 289) to allow pedestrians sufficient time
to make a safe crossing.
The Police Department and the Texas Department of
Transportation both support this ordinance. The signage required
will be the responsibility of the State per the City's maintenance
agreement with the State.
The Traffic Engineering Department recommended approval of
the first reading of this ordinance.
Motion was made by Councilmember Hernandez, seconded by
Councilmember Patterson to pass on first reading Ordinance
#9874 as recommended by staff. Motion carried: 7 Yeas; 0
Nays.
(29.) Consider Ordinance #9875 amending the prima facie speed
limits on various streets and highways within the corporate
limits of the City of Lubbock and conforming Chapter 16 to
the new State Transportation Code.
ORDINANCE #9875
AN ORDINANCE AMENDING CHAPTER 16 OF THE CODE OF
ORDINANCES OF THE CITY OF LUBBOCK, TEXAS, TO CONFORM TO THE
NEW STATE TRANSPORTATION CODE; AND WITH REGARD TO ALTERING
THE PRIMA FACIE SPEED LIMITS UPON CERTAIN PORTIONS OF CERTAIN
STREETS WITHIN THE CITY OF LUBBOCK; PROVIDING AN EFFECTIVE
DATE; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND
PROVIDING FOR PUBLICATION.
Jere Hart, City Traffic Engineer, presented staff comments. The
recent federal legislation returning the power to the State to
control the maximum speed limits within the states and the state's
desire to work with the local cities has caused a need to address
the speed limits on all state highways within the city that were
greater than 55 mph prior to the federal law that took place in
1973. In addition, there have been several other streets and
highways on which the speed limit needs to be changed due to the
growth of the city or safety concerns identified by citizens, the
Police Department and the Traffic Engineering Department.
29
City Council Minutes
January 11, 1996
Page 30
State law allows the City to set speed limits up to 60 mph without
State Transportation Board approval. State guidelines and the
City's Maintenance Agreement with the State require that speed
limit changes be documented by engineering studies. The State
has agreed that a 60 mph speed limit on the Interstate 27 and
Loop 289 will not require a detailed study, but anything less than
that would require a study. On the other major highways
entering the City, the accident data over the last three years
justifies keeping the maximum speed limit at the currently posted
speed limit of 55 mph.
The lowering of the speed limits on Indiana Avenue, University
Avenue, 4th Street (FM 2255), and 82nd Street are due to the
accident data in these areas and concerns expressed by the Police
Department and numerous citizens. The recommended changes
meet the State's guidelines for changing speed limits based on
safety concerns.
The Police Department and the Texas Department of
Transportation both support this ordinance. Staff recommended
approval of the first reading of this ordinance.
Motion was made by Councilmember Ince, seconded by
Councilmember Hernandez to pass on first reading Ordinance
#9875 as recommended by staff. Motion carried: 7 Yeas; 0
Nays.
(30.) Consider Resolution #5075 changing Lubbock Power & Light
infrastructure incentive fund criteria to include some tourism
and convention related projects.
RESOLUTION #5075
WHEREAS, the City Council of the City of Lubbock finds that it would be in the
best interest of the citizens of the City of Lubbock to make changes to the Lubbock
Power and Light Infrastructure Fund created by Resolution No. 2679, enacted November
12, 1987; and
WHEREAS, the purpose of the fund established by Resolution No. 2679 and

determining eligibility for Lubbock Power & Light economic development funds in
accordance with Section 3:
areas:
1. Disbursement of these funds shall be limited to the following targeted
Broadway Corridor. Those properties fronting on Broadway from University
Avenue to Martin Luther King Boulevard.
Central Business. Those properties fronting on Avenue Q from 4th Street to
Broadway.
Depot District. Those properties located within the Depot District, which is
described as follows:

maximum of $25,000.
3. Infrastructure funding is subject to proof of project completion.

Robert Massengale, Director of Electric Utilities, presented staff
comments. In 1987 the City Council approved and implemented a
program for Lubbock Power and Light (LP&L) that would assist
in economic development. This program offers up to $150,000
for a business that would create new jobs in the city of Lubbock.
These available funds are applied to infrastructure that support a
prospective business project. Generally, these funds have been
spent on water and sewer extensions and paving and curb and
gutter extensions.
To date, staff have committed $2,201,000; the actual expense to
date is $1,168,098.

Page 34
In the "Goals for Lubbock, A Vision Into the 21st Century,"
there are three goals that address tourism and conventions as
economic development. LP&L is proposing to expand its
incentive program to include support for these goals. LP&L
proposes expanding the infrastructure program to include new
and expanding businesses in the Depot District, the Broadway
Corridor and the Central Business District.
The new section 3 programs will provide up to $25,000 for
curbs, gutters, sidewalks, fronts, and facades for businesses in
these specified areas. The incentive will be based on $250 per
linear front foot. Staff believes the LP&L Infrastructure
Incentive Fund has been a successful program and that the
additional section 3 program would be equally successful in
supporting the tourism and convention industry in Lubbock.
Staff recommended the approval of this resolution.
Motion was made by Councilmember Hernandez, seconded by
Councilmember Patterson to authorize Resolution #5075 as
recommended by staff. Motion carried: 7 Yeas; 0 Nays.

which are being built in the North Zone. United plans to build a
new 40,000 square foot store at Parkway Drive and Zenith
Avenue to replace the store at E. 4th Street and Idalou Road.
United plans to invest a total of $4.1 million in the new facility.
The breakdown will be $2.3 million for the new building, the
remaining $1.8 million for machinery and equipment. The

amount of tax abatement over the life of the contract will be
approximately $216,197.

Supermarket #501 an Enterprise Zone Project. This qualifies

the North Enterprise Zone and will result in the employment of
123 persons.
