City Council Meeting
December 8, 1994
Page 726
At the October 20, 1994, City Council meeting, Resolution #4651
was passed authorizing the Mayor to sign an option contract to
purchase from the Housing Authority the land at the northwest
corner of 4th Street and I-27 for $314,925. As part of this original
option, the Housing Authority granted the City an exclusive six-
month option. This option would have expired on April 20, 1995.
Oscar Sharpe, Director of the Housing Authority, verbally agreed
to accept this contract, and the City turned it over to him for his
signature. However, several weeks later, staff received it back
from Mr. Sharpe unsigned, with two changes written on the
contract. Mr. Sharpe then told the Right -of -Way Department that
he had presented it to the Housing Authority Board and was asked
to change the expiration date on the option contract to January 31,
1995, with an opportunity to renegotiate the option for 90 days.
If the voters vote on January 21, 1995, for an economic
development tax increase, the Housing Authority will negotiate
with the City for an additional 90-day option. According to Oscar
Sharpe, the sales option amount will remain the same ($314,925),
but the Housing Authority will want the City to pay the interest on
this borrowed money for the 90-day period past January 31, 1995,
amounting to a maximum of $9,000.
This revised option contract replaces the original option contract
and memorandum of option approved at the October 20, 1994,
Council meeting. Our original payment of $250 for this option
will be honored by the Housing Authority for this revised contract.
The Right -of -Way Department recommended the approval of this
revised option contract and memorandum of option.
Motion was made by Councilmember Sitton, seconded by
Councilmember Ince to authorize Resolution #4671 as
recommended by staff. Motion carried: 6 Yeas; 0 Nays.

During February through July 1994 numerous negotiation sessions
were conducted with the airline property committee. The airport
presented proposed rates of $.60 in 1994, $.65 in 1995, $.70 in
1996, and $.75 in 1997. The airlines offered to increase the rates to
$.55 in 1994, $.60 in 1995, and $.65 in 1997. During this time,
American Airlines announced its plans to discontinue jet service at
Lubbock, and the air service issue became paramount. After
several attempts to modify the airline proposal to $.55-$.60-.$65-
$.70, the administration, senior management and airport staff
concurred that staff should accept the airline's offer which has the
net effect of raising the rates by $0.15 over the next three years.
The new landing fee rates will produce approximately $50,000 in
additional annual income for the airport.
The documents were approved and recommended to the Council
by the Airport Board at their November 16, 1994, regular meeting.
The staff recommended that the Council uphold the Airport Board.

A copy of the Agreement is filed with Resolution No. 4679.
Jim Bertram, Managing Director of Strategic Planning, presented
staff comments. On October 14, 1993, the City Council passed
Resolution #4297 committing the City of Lubbock to provide local
match (20 percent) for the costs associated with the Broadway
Streetscape project. The Broadway Streetscape was submitted for
consideration as part of the Statewide Transportation Enhancement
Program.
The project was approved for funding in April 1994 by the Texas
Transportation Commission. According to the proposed contract,
the City of Lubbock will receive $1,625,704 in federal funds for
the Broadway Streetscape and will provide $406,426 in local
matching funds.
The initial submission of the project requested $2,688,000 in
federal funds and provided $672,000 in local match from the City
and the South Plains Fair Association. However, in the review
process, the simulated antique lights were deemed ineligible,
leaving the balance in the contract.
It has been determined through discussions with TxDOT that the
extra local match in the amount of $265,574 could be used for
lighting on the project at the City's discretion. Once the contract is
executed, the City will prepare a Request for Proposals for the
preparation of the design plans, specifications and estimates. The
TxDOT is scheduled to bid the project in the spring of 1996 and
TxDOT will oversee the construction until the project is
completed. The expected completion date is fall of 1997.
Staff recommended approval of the contract.

City Council Meeting
December 8, 1994
Page 740
Betty Johnson, City Secretary, presented staff comments. In
reviewing the procedures for election of officers for the 26
standing City advisory boards, it became apparent that there is
significant inconsistency in the number of officers elected to each
board or commission, the length and number of terms of officers,
and the process for electing officers.
In order to ensure greater consistency, staff recommended that the
City Council adopt a new policy entitled "Boards and
Commissions --Election of Officers" to be included in Volume I of
the City of Lubbock Policies and Procedures Manual.
The new policy would consist of the following items:
1. The board or commission shall appoint a nominating
committee to provide a slate of officers for Chair, Vice -
Chair, and any other offices.
2. The Chair and Vice -Chair will be elected by voting board
and commission members. The board or commission, may,
at its option, elect an office of secretary.
3. Election of officers shall be held in the same month every
year (annually). The election date should be based on
individual board's calendar. If, for any reason, the Chair or
Vice -Chair vacates his/her seat, a special election should be
held to fill the unexpired term.
4. The Chair and Vice -Chair shall not serve more than two (2)
consecutive one-year terms. The Council shall reserve the
right, as deemed necessary in individual instances, to allow
more than two (2) consecutive one-year terms.
5. In the event the board or commission does not have an
office of secretary, the staff liaison, designated by the City
Manager, shall serve as the official Secretary to the board
or commission to ensure that records are maintained in
accordance with requirements of the City Secretary's
office.
6. The Mayor shall appoint the Chair of the Community
Development Advisory Committee.
7. The Council shall reserve the right, as deemed necessary in
individual instances, to appoint the Chair and Vice -Chair
for any special issue or temporary advisory committees. If
Council chooses not to make the appointment of Chair and
Vice -Chair, then the procedure outlined in this policy will
apply.
Staff recommended adoption of this policy.

for a zoning change from A-1 and R-1 to C-3 Specific Use on a
portion of Section 27, Block E-2 which includes a portion of

Mayor Langston opened the public hearing at 10:30 a.m.
Bernie Gradel, Jr., appeared on behalf of Seitz Group, Inc., to
present this request for zone change from A-1 and R-1 to C-3
Specific Use.
No one appeared in opposition. Mayor Langston closed the hearing
at 10:32 a.m.
Randy Henson, Senior Planner, presented staff comments. More
than ten years ago, the staff developed a sketch site plan for
development alternatives and has shown it to dozens of developers,
builders, and adjacent residents. The objective was to avoid a
number of disjointed separate uses. This proposal meets that
objective.
Mr. Henson gave the adjacent land uses:
North - commercial
South - proposed 69th Street and a 30-foot buffer of
City property
East - commercial
West - 69th Street connection to 66th and a vacant
area of A 1
The request is a minor change to the Comprehensive Land Use
Plan but one that has been discussed and expected for years. The
request is filed as Specific Use for two items related to zoning
policy:
1. Setback on 69th and 68th Streets. The site plan notes a 20-
foot proposed setback on the curve of 69th Street and a 22-
foot setback on 68th Street. With no parking in these areas,
the proposed setbacks present no line of sight problems and
there are no adjacent buildings.
742
City Council Meeting
December 8, 1994
Page 743
2. The item requesting the most flexibility from the Specific
Use Permit is the proposed shopping center sign. The sign
ordinance formula allowance for size, height, and setback is
based on front frontage to a major thoroughfare. The axis
of this large project is 900 off to provide the sign they
request (only a 60 foot "neck" of land will extend out to
Slide Road).
The layout of the project provides curb cuts well placed within this
critical traffic volume area. Only one curb cut is proposed on Slide
Road. The project will have a major impact on traffic in the area,
though not unexpected.
At the South Plains Plaza the developer is installing a very
minimal landscape, as well as installing hose bibs versus an
irrigation system. Previous experience indicates that few shopping
center managers will provide an adequate personnel commitment
to landscape care when hose watering is all that is available.
The proponent submitted a site plan at the Planning Commission
meeting but no detailed landscape or building elevations as
normally considered during Specific Use requests. The lack of
detailed plans at this early stage of development does not represent
a problem, so the Planning Commission recommended the request
to the Council with a condition attached to the C-2 portion:
That a site plan, including building elevations showing
materials, color, texture, a detailed landscape plan and an
irrigation plan, shall be submitted to the Planning and
Zoning Commission for approval prior to the issuance of a
building permit; and the C-3 Specific Use Permit subject to
the following condition:
2. Building elevations showing materials, color, texture, and a
detailed landscape and irrigation plan, shall be submitted to
the Planning and Zoning Commission for approval prior to
the issuance of a building permit.
City staff requested amendment of these conditions to include
installation of a sprinkler system versus the option allowing hose
bibs "immediately available."
Staff supported the recommendation of the Planning & Zoning
Commission and requested consideration of the amended irrigation
requirement.
Motion was made by Councilmember Cooke, seconded by
Councilmember Sitton to pass on first reading Ordinance #9762
with conditions recommended by P&Z and City staff. Motion
carried: 5 Yeas; 0 Nays --Mayor Pro Tern Neugebauer abstained.

zoning change from R-1, A-1, GO and C-2 to R-1, R-1_ Specific

tracts out of the northwest quarter of Section 13, Block E-2.
No one appeared in opposition. Mayor Langston closed the hearing
at 10:48 a.m.
Randy Henson, Senior Planner, presented staff comments.
Although the case is filed on a large land area, the request was
considered by the staff and the Planning and Zoning Commission
as routine. This proposal returns the quarter section to a style that
is more consistent with development policy under the Lubbock
Comprehensive Land Use Plan.
Mr. Henson gave the adjacent land uses:
North - commercial
South - residential
East - residential and commercial
West - residential
The request is consistent with the Comprehensive Land Use Plan.
In addition, the proposal is compatible with zoning policy. During
discussion of the plat, the Planning Commission noted that the
development illustrated the latest standards discussed for "test
subdivisions" and changes to the Subdivision Regulations. The
right-of-way will have a 52-foot width rather than 43 feet (with a
32-foot street). This and a following "clean-up" zone as Specific
Use on the non -garden home residential will permit the reduction
of front setback from the existing 25 foot requirement to 20 feet.
The project will have a dramatic, but not unanticipated, effect on
traffic.
The Planning Commission recommended this request with the
following change reflected in the proposed ordinance:
The non -Garden home R-1 Specific Use land area may
have a front setback of 20 feet.
Staff supported the recommendation of the Planning & Zoning
Commission.

Mayor Langston opened the public hearing at 10:56 a.m.
Roger Schumacher appeared on behalf of Peerless Tyre Company
to present this request for zone change from C-2A to C-3 Specific
Use.
No one appeared in opposition. Mayor Langston closed the hearing
at 10:58 a.m.
Randy Henson, Senior Planner, presented staff comments. Until
several years ago, Peerless operated a store on this site as a non-
conforming use. The Zoning Code definition of non -conforming
includes a time frame of continuous operation. When the business
(or use) is discontinued for one year, the use is prohibited from
returning unless a zone change is made.
The proponent for this request presented a site plan of the former
store and described his method of doing business.
The existing zoning along this strip of 50th Street is C-2A. C-2A
was originally developed for the shallow lots along 50th Street to
provide lighter uses in the commercial buildings.
Mr. Henson gave the adjacent land uses:
North - residential
South - residential
East - commercial
West - residential
745
City Council Meeting
December 8, 1994
Page 746
The request does not include a Comprehensive Land Use Plan
change. Two items are of most importance related to zoning
policy:
A. Whether or not the proposed use of C-3 (limited to a tire
store) is compatible in the C-2A surroundings.
B. The second item discussed at length by the proponent and
the Planning Commission is the reason the case is styled -
Specific Use, that being the method of operation used by
Peerless to change tires.
After a discussion of the tire changing method and a review of the
property site plan, the Planning Commission reasoned that the
outside activity does not violate the intent of the Zoning Code.
With that issue discussed, combined with a desire to place the
parcel back into productive use, the Commission approved the
request. The staff recommended the request be zoned for C-2 or
C-2A permitted uses in addition to the one C-3 requested use. The
project should have little or no effect on traffic.
The Planning Commission recommended approval of this request
subject to the following condition:
Limited to a tire store and all C-2A permitted uses.
Staff supported the recommendation of the Planning & Zoning
Commission.

Councilmember Hernandez to pass on first reading Ordinance

City Council Meeting

Randy Henson, Senior Planner, presented staff comments. The
request is a "down zone" to residential from A-2 limited to a
church. Mr. Henson gave the adjacent land uses as follows:
North - residential
South - church
East - residential
West - residential
The request is consistent with both the Comprehensive Land Use
Plan, which indicates church at present, and zoning policy.
Discussion with the staff since the Planning Commission hearing
resulted in a probable request to reduce the front setback to 12.5
feet from the standard garden home 15-foot requirement. This will
enable the dedication of a 43 foot "test" street. This parcel of
property is a "scrap" and some flexibility is needed to make the
project work. The proposed screen fence on Frankford would
eliminate most of the concern for how a proposed alley which
parallels Frankford would look.
The request should have little or no additional effect on traffic in
the area. The developer requested one change in the proposed
fence, to allow an entrance to the rear access easement away from
69th. The easement intersecting 69th at Frankford would cause
traffic congestion with the rear access proposal.
The Planning Commission recommended approval of this request.
Staff supported the recommendation of the Planning & Zoning
Commission.

inventory Service Center trailer yards. Mr. Henson gave the
adjacent land uses as follows:
North - commercial
South - commercial
East - commercial
West - commercial
The request is consistent with Comprehensive Land Use Plan.
Subject to a limitation of two display units in front of the building
line on each of I-27 and 50th Street, the request is consistent with
zoning policy. The proposal will have no effect on traffic.
The Planning Commission recommended approval of the request
subject to the following conditions:
1. Limited to trailer rental, all IHC permitted uses, and IHC
development standards.
2. No more than two trailers each shall be displayed in front
of the building line on 50th Street and I-27. The remaining
