. On January 14, 1993, the City Council approved an agreement to pay the
Lubbock Arts Alliance, Inc. $113,896.70 for the encouragement,
promotion, and improvement of all forms of art in the community. The
$113.896.70 represents that amount collected from the 1/2 cent of the
hotel/motel tax during the fiscal year that ended on September 30, 1992.
The agreement provides that a review committee of the Lubbock Arts
Alliance, Inc. will receive and evaluate applications for grants and make
recommendations to the City Council for awarding of these grants. On
July 8, 1993, the Council approved recommendations for the Lubbock Arts
Alliance, Inc. for the awarding of $50,275 in grants for the first half of
1993. The Council was asked to consider the approval of $43,245 in grant
awards for the second and final grant period of 1993.
The $43,245 in grant awards now recommended, plus the $50,275 in
grants approved this past July, equals a total of $93,520. After deduction
of an administrative fee of 5 percent plus audit costs, the remaining balance
will be carried over for next year's funding cycle.
A listing of the recommendations of the Lubbock Arts Alliance, Inc.
Review Committee was provided. This past year, the Lubbock Arts
Alliance, Inc. provided workshops to those interested in submitting grant
applications. As a result of the continued outreach efforts, the grants
received and approved represent widespread diversity.

A copy of the Agreement between the City of Lubbock and the Lubbock Arts Alliance,
Inc., is filed with Resolution No. 4350.
For each of the past 14 years, the City Council has approved an agreement
with the Lubbock Arts Alliance, Inc. (formerly the Lubbock Cultural
Affairs Council) whereby the City designated a portion of the revenues
collected from the hotel/motel tax for the encouragement, promotion, and
improvement of all forms of art in the community. The agreement with the
Lubbock Arts Alliance, Inc. is for the administration and distribution of
those funds.
The 1994 agreement provides for a total sum of $117,643.62, which is 1/2
cent of the 7 cent hotel/motel tax collected during the fiscal year ended
September 30, 1993. This represents an increase of $3,746.92 over the
allocation for 1993, which was $113,896.70. The agreement provided that
a review committee of the Lubbock Arts Alliance, Inc. would receive and
evaluate applications for art grants and make recommendations to the City
Council for awarding of these grants. Approved grants are then paid by
the Lubbock Arts Alliance, Inc. out of funds received from the city.
Lubbock Arts Alliance, Inc. recommended that a new agreement be
approved so that this program may continue through 1994. The 1994

At the Citizens Traffic Commission meeting on December 14, 1993, Traffic

additional requested devices be rejected and that the students be
encouraged to cross at the existing signal at Auburn Street which was
believed to be within a "practical" distance in accord with the "School
Crossing Control Policy" of the City of Lubbock. The estimated cost of
the requested action is $3,000. The project would be funded out of the
fund balance ($84,821) of the Traffic Control System Capital Projects
Fund.
The Commission unanimously voted to recommend an additional crosswalk,
and reduced speed zone.
The speed zone on University Avenue will be reduced from 35 MPH to 30

A copy of the Easement Conveyance and Assignment is filed with Resolution No. 4358.
The City of Lubbock's Agreement of May 3, 1989 with the Brazos River
Authority provides that all easements be either granted or assigned to the
Authority for construction, operation, and maintenance of the Lake Alan
Henry Project. This easement conveyance concerns fourteen previously
acquired properties in the reservoir and comprises the remainder of the
construction area at the dam site and the majority of the remaining lake
areas.
JANUARY 13, 1994
PAGE 19
This instrument will grant, transfer and convey such easements to the
Brazos River Authority for the construction, operation, and maintenance of
the Lake Alan Henry Dam and Reservoir, and grant the Brazos River
Authority the right to permanently or temporarily flood and inundate all
portions of the fourteen tracts of land specified in the instrument located
upstream and immediately downstream of the dam. This easement
conveyance will remain in effect as long as the Brazos River Authority
operates and maintains Lake Alan Henry under the terms and conditions of
the Water Supply Agreement.
This is the second of such easements conveyances. On January 10, 1991,
the City conveyed seven properties in the dam construction area and
recreation area to the Brazos River Authority.

A copy of the Administrative Change Order No. 1 approved by the City of Lubbock and
Gilbert Texas Construction Co., Contractor, is filed with Resolution No. 4359.
This change order provides for the adjustment of quantities and extension
of electrical ducts to close out the contract with Gilbert Texas
Construction for the Runway 17R-35L Paved Shoulder Project.
JANUARY 13, 1994
PAGE 20
This change order provides for a net reduction of $32,720.38 in the
original contract amount by deleting $69,025.38 in asphaltic pavement not
required and adding $35,175 for extension of underground electrical duct
for FAA circuits and $1,130 for wiring and circuit modifications in the
Airport electric vault to provide step-up intensity controls for taxiway
lights.
The reduction in costs over the original estimated asphaltic pavement
quantities was made possible by accepting an alternative mix design
included in the bid and accepting two deductive alternates that reduced the
amount of the project to match available grant funds for the project.
The additional costs were required for items not included in the original
listing of units.
The original contract did not include the type of duct needed for the FAA
cable. This change order adds the required type of duct. The contract
provided for on -off control of taxiway lights as a direct replacement of
older equipment. However, new taxiway circuits have step-up controls
allowing the tower to control light intensity in addition to on -off control.
For the benefit of uniformity and efficiency the airport requested the step-
up controls be added to the circuits involved in this project.

Councilmember Aderton to authorize Resolution #4359 as recommended

A copy of the License for Use of Real Property between the City of Lubbock and The
United State of America (U.S. Dept. of Commerce, NOAA) is filed with Resolution No.
4360.
This license will allow the National Oceanic and Atmospheric
Administration (NOAA) to construct and operate a new "Automated
Surface Observing System" (ASOS) which includes but is not limited to all
field sensor groups, controls, communications, antenna(s), power cables,
signals, and other peripheral equipment on airport property.
The term of the license is for 15 years and the effective date is June 14,
1993. The new license replaces the original license approved for this
facility dated April 25, 1991. The effective date of June 14, 1993, is the
date of the pre -construction conference where the need to modify the site
location was established. The Federal Aviation Administration (FAA) has
ruled that the effective date of the license should be June 14, 1993. The
replacement is required due to the fact that NOAA moved the facility 65
feet north of the original location which required re -approvals through the
U.S. Department of Transportation and FAA and requires an execution of
a new license.
rWm This project is jointly sponsored by the Departments of Commerce,
Transportation, and Defense. It will replace manual collection of surface
weather data at some locations and will provide 24 hour per day
operations. The City will grant this license at no cost to NOAA. Staff
recommended that this license be granted.

Aderton to authorize Resolution #4360 as recommended by staff. Motion

WHEREAS, the City Council of the City of Lubbock deems it necessary to make a

In 1986, the Texas Department of Health requested that local health
departments charge fees for the services that they provided. By 1988, local
health departments were eligible to become Medicaid providers, and be
reimbursed for selected clinical services. The City of Lubbock now
routinely submits claims to Medicaid for prenatal care, family planning,
case management, children's health screening, and laboratory work.
As a recipient of both Medicaid and Texas Department of Health funding,
the Lubbock Health Department must expend funds equal to, or exceeding,
the federal matching share of Medicaid revenue. To accurately account for
this match, a separate "Fees" budget was established.
The revenue generated by the Health Department helps provide programs
and services that might not otherwise be funded, such as a part-time
dentist, temporary help in times of increased clinic demands, critical
supplies for both Personal Health Services and the Laboratory, computer
software and equipment, and continuing education for staff to fulfill
licensure requirements. The General Fund is not affected by this budget,
and expenditures will be made only if sufficient fees are generated.
The proposed resolution will enable the Health Department to continue to
provide needed services, and to collect reimbursement through Medicaid
billing and fees -for -services. The Health Department staff recommended
approval of this resolution.
Motion was made by Councilmember Patterson, seconded by Mayor Pro
Tem Neugebauer to authorize Resolution #4361 as recommended by staff.
