appropriate action.
WAM Corporation, d/b/a Royal Cab, requested approval
of the application for a taxicab permit. The
management of WAM Corporation is the same as Royal
Transportation, Inc., the firm that applied for and
was denied a taxicab permit July 8, 1993.
The applicant, Ms. Gail Smallin, requested approval
for a total of ten vehicles. She has submitted a
letter from Cecil Dunn Insurance Agency indicating
that the appropriate insurance and bond coverage
will be provided at the election of Royal Cab. All
other documents requested in the application were
submitted.
In determining whether public convenience and
necessity require the approval of the application
and subsequent granting of a permit for a taxicab
f service, the City Council shall consider the
following:
L" 1. Whether the demands of public
convenience and necessity require
such proposed or such additional
taxicab service within the City.
To assist the Council in this determination
the staff has surveyed the availability of
taxicabs in various Texas cities. Currently
the City of Lubbock is served by one taxicab
company, Sexton Enterprises, doing business as
Yellow Cabs, and is permitted to operate
twenty taxicabs in the city.
In comparison to the Texas cities which were
surveyed, based on the City of Lubbock
population of 190,000, this provides one
taxicab for every 9,500 in population.
Excluding other forms of transportation such
as buses which operate on fixed routes, this
would indicate that in order to provide
citizens of Lubbock with an enhanced access to
taxi service as an additional means of public
transportation, there continues to be
considerable room for improvement in the City
of Lubbock. However, in the final analysis
the market will determine the level of demand
for additional taxicab service.
December 16, 1993
Page 1060
2. Financial responsibility of
applicant.
The financial history submitted by Ms. Gail
Smallin is contained in the application.
Since WAM Corporation is a new entity, there
is no specific financial statement for this
corporation. However, since it is under the
same management as Royal Transportation, Inc.,
Ms. Smallin has submitted the financial
statements of Royal Transportation, Inc. for
Council review. Ms. Smallin also currently
operates Royal Transportation, Inc. which has
been providing limousine service in the City
of Lubbock for over a year.
3. Number, kind, and type of equipment
and color scheme to be used by the
applicant.
The applicant has asked to be permitted for
ten Lincoln Towncars which will be white with
black lettering.
4. The number of taxicabs already in
operation in the City.
At the present time Sexton Enterprises, doing
business as Yellow Cabs, is permitted to
operate twenty taxicabs in the City of
Lubbock. The color scheme is a yellow vehicle
with black lettering.
5. Whether existing transportation is
adequate to meet the public demand.
At the present time, the other sources of
public transportation available to citizens
within the City of Lubbock include Citibus,
with fixed routes serving the residents of
Lubbock and two routes serving Texas Tech
students. In addition to the service provided
by Citibus, Sexton Enterprises is permitted to
operate twenty taxicabs and one limousine.
Other limousine services within the City of
Lubbock which are permitted as vehicles -for -
hire include Classic Limousine, which operates
one vehicle; White Knights Limousine, which
operates two vehicles; and Royal Coach,
operated by Ms. Smallin, which is permitted to
operate ten vehicles but at the present time
currently only has six vehicles in operation.
6. Probable effect of increased service
on local traffic conditions.
See below.
December 16, 1993
Page 1061
7. Whether the safeness of the streets
of the City of Lubbock will be
endangered unduly by granting of the
proposed additional taxicab permit.
The City Transportation Department does not
feel that there would be a significant impact
on local traffic conditions with the
permitting of an additional ten cabs, nor do
they feel that the safeness of the City
streets will be endangered unduly by granting
a permit for an additional taxicab service.
8. The character, experience and
responsibility of the applicant.
Staff provided Council with a personal history
submitted by the applicant with a resume and
previous work experience. In conducting
routine reference and background checks, staff
uncovered nothing that would reflect
unfavorably on the character of the applicant.
As to experience pertaining directly to the
transportation business, Ms. Smallin's
involvement has been limited to her operation
of Royal Towncar Service for the past year.
The concern the staff has in this area
pertains primarily to the responsibility of
the applicant.
Although staff can debate whether the
provisions of the Vehicle for Hire Ordinance
and the requirements outlined for those
wishing to provide this kind of transportation
for the City of Lubbock are "right" for the
current environment, the fact remains that
when an individual is permitted to operate
under the Vehicle for Hire Ordinance, the
permittee agrees to abide by the provisions of
the ordinance as it exists. At the last
public hearing on this issue, the applicant
was directed by Council that it was the
applicant's responsibility to ensure that they
adhere to the provisions of the ordinance and
that they were in no way to represent or
operate their limousine business as a taxicab
service. A compliance survey conducted by
staff indicated that, of three checks that
were done, in two of the three instances the
rates which were quoted were not in compliance
with the provisions of the ordinance. In
addition, the applicant was very specifically
made aware of the need to not advertise her
service as a taxicab service. The applicant
was very aware of their infractions to the
ordinance with their advertisement in last
year's Fiest Areawide Directory in which they
had listed their limousine company under
taxicab services. This was a clear infraction
to the ordinance and they had indicated that
this situation would be corrected in the
coming year and that they would not allow this
to happen again. However, it was brought to
staff's attention and in this year's
Southwestern Bell Yellow Pages the applicant
has very clearly advertised their business as
Royal Cab under taxicab services and has in
fact listed a permit number. The applicant
had indicated that she was permitted to
December 16, 1993
Page 1062
operate a taxicab service in Idalou; however
she made no provisions to ensure that there
was no confusion by some type of disclaimer
indicating that the permit was a City of
Idalou permit only.
Given this continual disregard for the
provisions of the permit regarding advertising
and the types of rates that should be charged
for a limousine service, it is difficult to
have a reasonable expectation that the
applicant will perform according to the
provisions as outlined for the taxicab permit.
Although there continues to be ongoing
friction between Royal Coach and Yellow Cab,
and there have been some confrontations at the
airport which have been addressed by the
Aviation Department, there has been general
improvement since the last public hearing.
However, although staff have not received any
complaints from customers regarding Ms.
Smallin's service, staff do continue to
receive periodic complaints from Mr. Jim
Sexton regarding the various infractions on
the part of Royal Transportation Limousine
that he has either witnessed and/or documented
on videotape.
9. Whether the applicant is fit, able,
and willing to provide public
transportation by taxicab.
Ms. Smallin indicates a willingness to provide
this service by submitting her application.
She has been operating a limousine service in
the City of Lubbock for approximately one
year.
Although it has been the staff's position that
citizens benefit by increased competition and that.
ultimately the marketplace and the operator's
business skill will determine the success or failure
of a business enterprise such as this, it is also
the staff's position that those people who are
permitted and by virtue of that permitting agree to
abide by the provisions as outlined in the ordinance
that regulates their business should comply with
those provisions. The ordinance is straightforward
as it pertains to rates and advertising for
limousines and taxicabs. The staff has made every
effort to provide consistent interpretation to Ms.
Smallin on any questions that arose regarding
specific provisions of the ordinance. In spite of
all this, she continues to proceed with business as
usual in terms of not complying with rate structures
and advertising of her service. The rates are set
by each individual operator and are merely approved
as part of the renewal and/or application process,
so it is not without merit to expect that an
operator would be able to adhere to the rates which
they themselves set for their business. Based on
the preceding information, staff recommended denial
of this application.
Motion was made by Councilmember Patterson, seconded
by Councilmember Ince to deny a taxicab permit for
WAM Corporation d/b/a Royal Cab. Motion carried: 5
Yeas; 1 Nay--Councilmember Hernandez.

As part of the submission of the FY 1994-1998
Comprehensive Housing Affordability Strategy (CHAS),
the regulations require that jurisdictions must
certify that they will affirmatively further fair
housing, and that they are in compliance with a
residential anti -displacement and relocation
assistance plan.
In accordance with the requirements of the Cranston -
Gonzalez National Affordable Housing Act of 1990,
the Community Development Department of the City of
Lubbock, Texas has prepared a draft of the
Comprehensive Housing Affordability Strategy (CHAS)
for approval by the City Council prior to its
submission to the U.S. Department of Housing and
Urban Development on December 31, 1993. The CHAS is
a comprehensive planning document that identifies
Lubbock's overall housing needs for affordable and
supportive housing and outlines a strategy to
address those needs. Three public hearings were
conducted at different times and locations to allow
citizen involvement in the development of the CHAS.

Brady Dairy Queen, Inc. has made application for
commercial tax abatement on a food service facility
in the South Enterprise Zone, located at the
southwest corner of I-27 and 50th Street. The
facility will require an investment of $260,000 and
will employ 30 persons at its opening. The
long-term employment at the facility will be 25
persons.
The application has been reviewed by the County of
Lubbock and the Lubbock Independent School District
and both bodies have been consulted concerning the
term and amount of abatement. The County has agreed
to a term of five years and an amount of 100
percent; the School District has responded that they
will not agree to any abatement.
If approved by the Council, this abatement, at 100
percent of improvements and five years in term,
would abate approximately $1,600 in City tax revenue
per year. This would amount to a total of
approximately $8,000 abated over the five-year
period.
