The City Council of the City of Lubbock, Texas met in regular session on the 12th day of March, 1992 in the City Council Chambers, first floor, City Hall, 1625 13th Street, Lubbock, Texas at 10:00 A.M. Present: Mayor B. C. McMinn, Mayor Pro Tem T. J. Patterson, Councilman Bill Maloy, Councilwoman Joan Baker, Councilwoman Maggie Trejo, Councilman M. J. Aderton, City Manager Larry J. Cunningham, City Attorney John C. Ross, Jr., and City Secretary Ranette Boyd. Mayor McMinn called the meeting to order at 10:00 A.M. { 1.} The Invocation was given by Mark Hindman, Budget & Research Director. { 2.) The Pledge of Allegiance was given in unison by those in the Council Chambers. { 3.) Motion was made by Mayor Pro Tem Patterson, seconded by Councilwoman Trejo to approve the Minutes of the March 12, 1992 Regular City Council meeting as written. Motion carried: 7 Yeas; 0 Nays. 92-51A-167-132 ( 4.) Liz Sisco presented a request for Loudspeaker Permits for April 18, June 6, and August 8, 1992 at 4707 21st Street. The applicant has previously received loudspeaker permits, but Staff requested they again seek approval from residents in an 800' radius of their home. Of the 24 residents contacted, all approved the loudspeaker request. 12 of the residents were mailed copies of the petition along with self- addressed, stamped envelopes explaining the requests, as the applicant was unable to personally contact them. None of the 12 responded. All three events require a microphone for a pianist, and in view of the unanimous approval of nearby residents and the further fact that the Sisco's hold an event annually without problems, Staff recommended approval. Motion was made by Mayor Pro Tem Patterson, seconded by Councilman Maloy to approve the request of Liz Sisco for Loudspeaker Permits for April 18, June G, and August 8, 1992 events to be held at 4707 21st Street. Motion carried: 6 Yeas; 0 Hays, March 12, 1992 Page 168 92-51A-168-133 ( 5•) Steve Cone, appeared on behalf of the Lubbock Hotel/Motel Association to request Council approval for Hotel/Motel Tax funds to be used as the local match for the acquisition ❑f a trolley. According to Staff memo, members ❑f the Association appeared at the February 26, 1992 Lubbock Transit Advisory Board (TAB) meeting t❑ make this request and TAB approved this recommendation for Council consideration. The State Law specifies five purposes for which funds can be expended from Hotel/Motel Tax revenues: (1) construction/operation ❑f a convention center; (2) furnishings, personnel and registration ❑f delegates at a convention center; (3) advertising and promotional programs t❑ attract visitors and tourists, such as the convention bureau activities; (4) promotion of the arts; and (5) historic restoration and preservation projects, activities or promotional programs to encourage tourists and delegates to visit historic sites ❑r museums. The purchase of a trolley does not clearly fall within the definitions above; however, it can be viewed as a secondary purpose if used predominantly t❑ transport tourists and delegates from hotels to the Civic Center, restaurants, and historic sites such as the Lubbock Lakesite, the Ranching Heritage Center and the Texas Tech Museum. Such usage would place this purchase under both advertising/promotion and activities t❑ encourage tourists to visit historic sites. According to Staff memo, the maximum impact on the Convention and Tourism Capital Projects Fund would be $37,000. Local donations of $5,500 would be subtracted from the $37,000 local funds needed for one trolley. As of January 31, 1992, the Convention and Tourism Capital Projects Fund (#1221) balance was $168,519.51. Projected revenue to this fund for the remainder of FY 91-92 is $35,238.66, and on September 30, 1992, this would leave an ending fund balance of $203,758.17. Approval of this $37,000 funding request will result in a projected balance of $166,758.17 on September 30, 1992. Motion was made by Councilwoman Trejo, seconded by Councilman Aderton to approve recommendation of the Lubbock Hotel/Motel Association for allocation ❑f up to $37,000 from Hotel/Motel Funds to be used for the local match for one trolley. Motion carried: b Yeas; 0 Nays. March 12, 1992 Page 169 92-51A-169-134 ( 6.) 92-51A-169-135 ( 7.) A representative of the Citizens Traffic Commission will appear to present request of the Department of Public Safety for a median cut on Avenue L, south of 4th Street. Alan Hatch, appeared on behalf of the Citizens Traffic Commission to present this two-part request from the Texas Department of Public Safety (DPS). The DPS Region Five office is located at the northwest corner of Avenue L and 6th Street. Avenue L in this area is a divided roadway with a raised concrete median between 4th Street and 6th Street. Inasmuch as the main access to the property for patrol vehicles is from Avenue L, the DPS has requested a median cut to allow their units safer and faster access to the freeway system (I-27 and the future East-West Freeway). Since City of Lubbock Resolution #876 prohibits median cuts except at intersections, the Traffic Engineering Department does not have the authority to grant this request. Therefore, City Staff and the DPS presented the request to the Citizens Traffic Commission (CTC), and in the interest of public safety, the CTC recommended Council approval of the request. The second part ❑f the request is for $1,200 to fund the modification. Resolution #876 also requires that anyone receiving approval for a median modification be obligated to pay the entire cost for such modification. According t❑ DPS correspondence, State Law prohibits expending State funds on streets not maintained by the Texas Department of Transportation. Mayor McMinn stated that if Council approves the request, but problems result from the median cut, that Staff apprise Council so that the issue may be reconsidered. Motion was made by Mayor Pro Tem Patterson, seconded by Councilwoman Baker to approve the request of the Department of Public Safety for a median cut on Avenue L, south of 4th Street and that funding for the modification by paid by the City. According to Staff memo, approval of this grant will continue the current level of service for Fiscal Year 1992-1993 and provide capital assistance from July 1, 1992 through September 30, 1993. The Capital Assistance portion of the grant is 80% Federally funded and 20% local share, except for the expansion vans required to come into compliance with the Americans with Disabilities Act (ADA), which is 9W* Federally funded and 10% local share. A Public Transportation Fund grant in the amount of $8,000 has also been approved for a portion of the local share of the expansion vans. The Capital portion of the grant will be for Fiscal Year 1991-92 and Fiscal Year 1992-93. The following items will be used to maintain the current level of service, t❑ come into compliance with the ADA requirements, and to provide additional services: Total City Share Computers for the $ 8,000 $ 1,500 Downtown Transfer Center Two Rubber Tired Trolleys 370,000 0 Facility Repairs 7,000 1,400 Two Expansion Vans 130,000 5,000 Contg. and Adm. 45,350 9,270 TOTAL $551,350 $17,270 A brief description and justification of each capital item follows: March 12, 1992 Page 178 Computers for Downtown Transfer Center: The construction of the Downtown Transfer Center approved in the FY 1992 grant will be completed in 1993 and the dispatch duties will be relocated to that facility following completion. In FY 1990, Citibus began to utilize a computer aided Paratransit Passenger Scheduling System. The purchase of two computers will allow connection to the Local Area Network (LAN) installed at Citibus as a part of the FY 1991 grant. One computer will be in the Citibus administrative offices, connected to the LAN, and will have a dedicated telephone line for communication via modem; the second computer will be in the Downtown Transfer Center. This will allow the dispatcher at the facility to be on the network to utilize present multi-user application software and communicate directly with other network users. Two Trolleys: Private support for the trolleys included donations from a local supermarket, the Lubbock Hotel/Motel Association, and other private companies and is sufficient to provide the local share for the purchase of two trolleys. The trolleys will be utilized on current fixed routes 5-5 days per week with priority given to servicing convention delegates at the Civic Center, hotels and local attractions. initially, the routes will be determined based on ridership with lower ridership routes being targeted for promotion. The trolleys will eventually travel on all routes. The City of Lubbock has included in its long and short range goals a commitment to the revitalization of the downtown area and included in this effort is the support and commitment to the construction of the Downtown Transfer Center. Future plans include a route to connect the downtown area (with the transfer center being the turn -around location) with the Texas Tech University campus. This would allow students and businesses along the route access to the downtown area. It will also allow current public parking not located in the downtown area to be included on the route to access downtown businesses and therefore assist the City of Lubbock by eliminating some future downtown parking development needs. The trolleys will also be utilized for special events and the promotion of mass transit in the Lubbock area. Facility Repair: Heavy bus traffic entering and exiting the maintenance facility onto Texas Avenue, at the west side of the facility, has damaged the concrete driveways, causing some buses to drag exhaust pipes when exiting the facility. If the problem is not corrected immediately, it will cause damage to the bus engine. March 12, 1992 Page 179 Two Expansion Vans: During the public participation process of the preparation of the Americans with Disabilities Act (ADA) Compliance Plan, estimates for the ADA eligible demand for paratransit service were identified and in order to meet the demand, additional hours of service and vehicles are necessary. Two additional vans approved for purchase in FY 1993 will be utilized for expansion of the paratransit service. The Technical Studies portion of the grant is required for the planning necessary to maintain eligibility for capital and operating assistance. This portion of the grant is 80%* Federally funded and 20% local share. The Federal Government will fund $100,000 of the $125,000 grant, and the City of Lubbock will fund the remaining $25,000 for Fiscal Year 1992-1993. The Operating Assistance portion of the grant is funded with 50% Federal share and 50% local match. The operating portion of the Fiscal Year 1992-1993 grant, as submitted, will include a local share of $1,300,000, of which $650,000 will be provided by the City of Lubbock, $390,000 by Texas Tech University Student Fees, $20,000 by route guarantees, and $240,000 by the State Public Transportation Funds. The final Citibus budget for FY 1993 will be subject to approval by the City Council. At their February 24, 1992 meeting, the Lubbock Public Transit Advisory Board recommended that the City submit this application to the Federal Transit Administration. Staff also recommended approval. March 12, 1992 Page 181 92-51A-181-145 (18.) According to Staff memo, over the last seven months a Golf Development Committee has closely examined the maintenance, construction, design, and operations of Meadowbrook Golf Course in an effort to develop recommendations to improve the playability and ultimately upgrade the overall quality of the Meadowbrook Golf Course. The Committee's recommendations included three categories: I. Enhanced Maintenance -- Those activities, in addition to the current level of activities, needed to increase the turf and playability of the course. I1. Course Improvements -- Those activities outside of typical ongoing maintenance activities such as irrigation improvements that are one-time activities which would also increase playability. III. Course Amenities -- These are capital improvement items not necessarily related to the playability of the course but which provide the amenities at a golf course desired by players and which increase the overall satisfaction and golfing experience, such as putting greens, driving ranges, clubhouse renovations, and water hazard improvements. The 13-member committee, with the assistance of George Manuel, U. S. Golf Association Agronomist, and the Golf Course staff, identified basic objectives, reviewed the course needs, prioritized those needs, and developed recommendations for implementation. A major part of the recommendation is associated with the funding of these improvements and after considerable discussion it was recommended that the improvements be paid with fee increases. The initial fee increases are recommended to begin April 1, 1992, the cart fees increases would begin in October, 1992, and the membership fees will increase in January, 1993. Staff recommended that improvements be phased in over a six -year period. The Plan was reviewed and approved by the Park Board on February 18, 1992. Staff recommended approval. Council heard an extensive presentation by Committee Members Joe May and Bob Nash, and by Steve Shields, Golf Supt. and Pro.
