ORDINANCE #9234 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1542-M; AMEND ORDINANCE NO. 7814 BY REPLACING THE SITE PLAN AND CONDITIONS WITH A NEW SITE ON ALL OF BLOCK 2, FURR-WOLF ADDITION, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. No one appeared either for or against this request. Mayor McMinn closed the hearing at 9:31 a.m. Assistant City Manager Jim Bertram stated that Zone Case #1542-E previously established a Site Plan for the area bounded by 11st Street, 14th Street, Quaker Avenue and Raleigh Avenue. Development since that time has remained consistent with the Site Plan, and the remaining lots will be better served by deleting the original condition for having a Site Plan. Mr. Bertram gave the adjacent land uses as follows: North - Commercial South - Residential East - Commercial West - Commercial The request does not involve the Comprehensive Land Use Plan as an amendment request. The Site Plan was approved in 1979 when concern existed about what was going to develop in this area and since that time, a majority of the area has been built as a quality commercial subdivision. The Planning Department requested the zone case to clear the slate for remaining lots along Quaker Avenue as the balance of the projects are complete. The standard "site plan review prior to a construction permit" for lots adjacent to Quaker Avenue was requested. The Planning and Zoning Commission requested deletion of the Site Plan condition of Ordinance #9191 and recommended approval with the following condition: October 27, 1988 Page 704 1. A site plan, including building elevations showing materials, color and texture, shall be submitted and approved by the Planning and Zoning Commission on all remaining lots adjacent to Quaker Avenue prior to the issuance of a building permit. Staff and the Planning and Zoning Commission recommended approval of Zone Case #1542-M. Motion was made by Councilman Patterson, seconded by Councilman Phillips to pass on first reading Ordinance #9234 as recommended by Staff. Motion carried: 7 Yeas; O Nays. 88-47B-704-632 ( 9.) No one spoke in opposition. Mayor closed the Public Hearing at 9:33 a.m. Latrelle Joy of Astor Management Group, Inc. for Guesthouse Inn appeared to request a zoning change from AM to AM Specific Use. Assistant City Manager Jim Bertram stated that the land area within this request had been zoned previously as AM for a guest house, and the Proponents wish to return the zoning to AM Specific Use. Mr. Bertram gave the adjacent land use relationships as follows: North - Medical South - Medical East - Medical West - Medical A guest house or motel is an allowed use of the AM District in the Specific Use Section. The structure in question has been leased as a substance abuse treatment center, therefore, the AM zone request was approved to accommodate the use. Conversion to a guesthouse requires a Specific Use Permit. Staff recommended approval of Zone Case #2468-B. ORDINANCE #9236--Zone Case_#1968-D located at the Southeast corner of 4th Street and Raleigh Avenue) --Hold a Public Hearing on .request of Lloyd Croslin Jr. for Whis erwood Bank for zoning change from C-3 to C-3 Specific Use on Tract B-1, Rushland Park Addition. ORDINANCE #9236 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 1968-D; A ZONING CHANGE FROM C-3 TO C-3 SPECIFIC USE PERMIT FOR A BANK ON TRACT B-1, RUSHLAND PARK ADDITION, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. Mr. Lloyd Croslin, Jr., on behalf of Whisperwood Bank, appeared to request zoning change from C-3 to C-3 Specific Use. Mr. Croslin pointed out that a similar request was approved by Council in two previous zone cases at King's Gate North and King's Gate South and requested that Council look at changing the policy to allow staff review of these issues. No one appeared in opposition. Mayor McMinn closed the Public Hearing at 9:40 a.m. Assistant City Manager Jim Bertram gave the adjacent land uses as follows: North - Texas Tech property South - Commercial/office zoning East - Commercial zoning West - Playa lake Mr. Bertram stated that the Building Board of Appeals has been very cautious about allowing waivers for the past five years, and a request for waiver by the proponents of this case was denied by the Board of Appeals prior to sub- mission of the zone case. The Board of Appeals guidelines for variances require that a hardship other than economic be demonstrated. For a period of ten years between 1973-1983, the Board of Appeals was very lenient regarding waivers, and, as a result, large areas of town are now developed without sidewalks, both residential and commercial. Mr. Bertram advised further that the Planning Department outlined opposition to the request because sidewalks are an important element of pedestrian safety adjacent to all streets. The proponent set forth two major items to justify the request: October 27, 1988 Page 706 88-47B-706-634 (11.) 1. An increase in aesthetics on the tract by landscaping the entire parkway; and 2. The adjacent land uses should produce few pedestrians, and those that come by can walk in the parking lot. At their recent meeting, the Planning and Zoning Commission discussed the merits of sidewalks at length, and several Commission members expressed concern that the Code requires sidewalk installation by private interests and virtually no sidewalks exist in areas that are developed as parks in conjunction with playas. That absence was explained by the fact that sidewalks are an improvement required during a construction permit. Construction permits are seldom required for park developments, and the omission of walks is not intentional. Mr. Bertram stated his opinion is that the Planning Department staff present alternatives for staff review and approval on requests of this nature. The Planning and Zoning Commission and Staff recommended approval of Zone Case #1968-D. Motion was made by Councilman Carpenter, seconded by Mayor Pro Tem Baker to pass on first reading Ordinance #9236 as recommended by Staff. Motion carried: 7 Yeas; 0 Nays. Section 14. _Block E-2. ORDINANCE #9237 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES: ZONE CASE NO. 2269-L; A ZONING CHANGE FROM AM SPECIFIC USE TO GO ZONING ON A TRACT OF LAND OUT OF SECTION 14, BLOCK E-2, LUBBOCK, TEXAS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION. No one appeared either for or against this request. Mayor McMinn closed the Public Hearing at 9:43 a.m. The area in question is currently zoned AM Specific Use for professional offices, and the Planning Department supported the request to move this land area into the more appropriate Garden Office District. Assistant City Manager Jim Bertram gave the adjacent land uses as follows: October 27, 1988 Page 707 88-47B-707-635 (24.) 88-47B-707-636 (25.) 88-47B-707-637 (26.) North - Commercial and playa lake South - Single-family East - Duplex zoning West - Commercial The Comprehensive Land Use Plan encourages all commercial land uses be separate from residential by a buffer and this strip meets that guideline. Prior to development of the Garden Office District, the AM Specific Use District was "misused" in areas such as this by limiting the uses to professional offices. The GO District is designed specifically for office development and offers a more practical parking ratio (1:200 v. 1:150), more efficient rear and side yard setback (0' v. 5' when not adjacent to residential), the same 10% landscape requirements, and a more clearly understood name.
