Donald G. Vandiver, First Assistant

Joe Gilbreath, representing the Electric
Utilities Board, appeared to present
recommendations regarding this Amendment.
The City of Lubbock is currently purchasing fuel
for generation at the Holly Avenue Generation
Plant under a Contract that has been in effect
for approximately four years with Power -Tex Joint
Venture. The Contract has been re -negotiated to
reduce the price of the gas and other
considerations several times during the first
four years of the Contract. The current price
for the gas is $2.60, and the new proposal
provides that the price for the gas will be
$2.45.
In consideration of the price reduction, the City
has extended the take or pay amounts and agreed
to pay the Power -Tex Joint Venture 20t per mcf
for gas to be purchased through a gas line to be
constructed by Power -Tex Joint Venture down the
railroad track along the Brownfield Highway to
the Tech Cogeneration Plant.
The price reduction for the fuel at Holly Avenue
Generation Plant will save approximately $65,000
per month during the rest of the current calendar
year and then beginning in January, 1989, the
savings will be approximately $45,000 per month.
The Agreement for the line to serve the Tech
Cogeneration Plant is for transportation only and
plans are to use City -owned gas to be transported
through that line to serve the Tech facility.
The overall Contract is to end on December 31,
1996.
This Amendment to the Fuel Contract for the Holly
Avenue Plan' )s consistent with the overall Plan
for the ;h Cogeneration Plant and will provide
fuel acc+sss for that plant. Staff will still
have the option to purchase gas from Energas at
that location at any time they should bring their
system up to adequate pressure.

The amount of the Weatherization Grants for the
year just ended was $45,075. Last year, this
Grant enabled the City to install weather-
stripping, caulking, insulation and, in some
cases, storm windows in 29 homes.
Eligible families must awn their homes and meet
income guidelines and priority is given to
elderly and handicapped homeowners.

State Law provides that Charter Amendments
approved by the voters do not take effect until
after such time as the governing body of a
municipality enters an Order in the records of
the municipality declaring that the Amendment is
adopted (Local Government Code, Sect. 9.005). In
order to meet this requirement of State Law, the
City Attorney prepared a formal resolution
adopting the approved City Charter Amendments
from the May 7, 1988, Special City Charter
Election.
As requested by the Justice Department, the City
Attorney will prepare a submission of the
approved Charter Amendments for pre -clearance as
to effects upon voting in the City of Lubbock.
Staff does not anticipate any problems with pre-
clearance by the Justice Department as most of
the Amendments affecting voting are based on the
judgment in Jones v. City of Lubbock or in State
statutes.
374
May 26, 1988
Following action by the City Council, the City
Attorney will prepare a Certificate of Charter
Amendment for the Mayor to certify to the
Secretary of State an authenticated copy of the
Charter Amendments under the municipality's seal
showing the approval of the voters as required by
Sec. 9.007 of the Local Government Code. Since
this is a mandatory provision of State Law, no
Council action is necessary to authorize the
action.
Staff recommended approval of this Resolution.

Sometime ago City Council asked that Staff
prepare some ideas about various ways to
recognize special visitors to the community and
to try to distinguish a recog-nition of some sort
between heads of State and other types of digni-
taries. Staff developed some suggestions which
were previously forwarded to Council for review
and comment.
One addition, made by a Council member, has been
incorporated into the suggested policy for
Council consideration under Other Considerations.
It basically establishes a review committee for
situations in which there is a question as to
whether or not one level of recognition should be
given over another that would not clearly fall
within the guidelines, or if there is some
specific controversial situation.
Having a general policy of this nature will
ensure consistency in official visitor
appreciation and recognition.

ORDINANCE #9206
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES:
TONE CASE NO. 1542-L; A ZONING CHANGE FROM AM AND C-2A TO C-2 ZONING
ON TRACTS A, E, AND F, SOUTH PARK ADDITION, LUBBOCK, TEXAS; SUBJECT
TO CONDITIONS; PROVIDING A PENALTY; PROVIDING A SAVINGS CLAUSE AND
PROVIDING FOR PUBLICATION.
Wayne Robins appeared on behalf of Summit Health
to request that the main property where Southpark
Hospital is located and the offices to the west
be rezoned to C-2. Mr. Robins indicated that
future plans include renovation of some of the
buildings, and that C-2 zoning will allow greater
flexibility for marketing the office spaces.
Assistant City Manager Jim Bertram reported that
this land is currently zoned AM (apartment -
medical) and
C-2A and gave the adjacent land use relationships
as follows:
379
May 25, 1988
88-47A-379-358
(14.)
North - AM, developed as medical offices
South - Loop 289 and C-3, developed as
commercial
East - C2A and AM Specific Use, developed
as
offices and the Godeke Library
West - AM and GO, vacant or developed as
offices
Mr. Bertram stated that the land area at the
corner of Loop 289 and Quaker is within the 5-10
acre Comprehensive Plan policy area adjacent to
major thoroughfares. With GO and AM remaining to
the north and west as a buffer, he said the
Commercial request is compatible with the Plan
and also appropriate according to Zoning Policy.
The change should not affect the street system at
any greater rate than the current development.
The request generated very little discussion from
the Planning and Zoning Commission; however,
Staff did requested the standard Site Plan review
requirement be attached. The Planning and Zoning
Commission should review any exterior renovation
or "significant" redevelopment plans prior to
issuance of a Building Permit. "Significant"
remains to be interpreted by the Staff in the
motion by the Planning and Zoning Commission.
The Planning and Zoning Commission approved this
request subject to the following condition:
1. Any significant exterior
renovation or redevelopment to the
overall development tract be sub-
ject to a Site Plan, including
building elevations showing
materials, color and texture being
submitted and approved by the
Planning and Zoning Commission
prior to the issuance of a Build-
ing Permit.
The Planning Department recommended that the City
Council uphold the Planning and Zoning
Commission.
There was no opposition to this request. Mayor
McMinn closed the hearing.

Ordinance #9205 as recommended by Staff. Motion

May 26, 1988
ORDINANCE #9207
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 7084 AND THE
OFFICIAL MAP OF THE CITY OF LUBBOCK MAKING THE FOLLOWING CHANGES:
ZONE CASE NO. 2616; A ZONING CHANGE FROM IHI AND M-1 TO IHI SPECIFIC
USE AND M-1 SPECIFIC USE PERMIT LIMITED TO THE OPERATION OF HOMELESS
SHELTER AND MOTEL ON LOT 11 AND A PORTION OF LOT 10, SOASH-WHITE
INDUSTRIAL ADDITION, LUBBOCK, TEXAS; SUBJECT TO CONDITIONS; PROVIDING
A PENALTY; PROVIDING A SAVINGS CLAUSE AND PROVIDING FOR PUBLICATION.
Richard Lopez, of Guadalupe Economic Services
Corporation, appeared to request this zone
change.
The proponent is considering purchase of the
Circus Inn and using some of the rooms for
shelter for the homeless, specifically targeting
physically handicapped homeless persons at this
facility. However, it would not be limited to
that population.
Although no formal request was made, the Corpora-
tion asked that the Council waive the filing fee
for this zone case. Such a waiver would require
either changing the Ordinance to provide for
waiver of fees or City Council instructing Staff
to pay out of City funds for this application.
This would have to be a separate action from the
zone case if proponents pursue this waiver
request.
Assistant City Manager Jim Bertram reported that
in late 1987, the Zoning Code was amended placing
"Rescue missions, shelters for the homeless, and
other types of transient housing" in the Specific
Use Section of the Code. That action requires a
zone case hearing at any location proposed for
one of the uses, regardless of the existing
zoning. The proponents requested a letter from
the Zoning Specialist to verify zoning at the
Circus Inn related to a Federal Grant
Application. Since the Amendment, "shelters for
the homeless" are not a permitted use in any
district. Mr. Valentini and Mr. Lopez of
Guadalupe Economic Services Corporation were
advised that a zone case must be filed and to
Staff's knowledge, the Grant Application was
submitted with "zoning pending." At the date of
the Planning and Zoning Commission hearing,
Guadalupe Economic Services was not the owner of
the property, but apparently is in Contract.
Mr. 0. V. Scott represented Mr. Raymond Tapp and
the new owners of the Coca Cola Bottling Company
at the P&Z hearing. After negotiation of a
private Contract dealing with a maximum number of
rooms and a target population, Mr. Scott
indicated that his clients were in support of the
zone change. In discussion with the Staff, the
Planning and Zoning Commission was advised that
the zoning function using City personnel should
not be used to enforce any of the details of the
Contract regarding maximum number of rooms used
for homeless or the "type" of homeless persons
eh+ei t-ered et the property a"d the fig Gemissien
agreed.
Mr. Bertram gave the adjacent land uses
relationships as follows:
381
May 26, 1988
North - M-1, developed as mini -warehouses
South - Slaton Highway and the State
Department of
Highways and Public Transportation
East - M-1, developed as retail
West - IHI, developed as offices
The request is consistent with
Commercial/Industrial Comprehensive Plan policy
noted at this location. Location of transient
housing has created different opinions regarding
the need for the service, versus compatibility
with adjacent land uses. The Public Hearing for
the Specific Use Permit is specifically intended
to address the appropriateness of the proposed
use.
At the Hearing before P&Z, Mr. Scott indicated
that his clients have concerns about a lack of
public transportation to the Circus Inn, limited
medical facilities adjacent to the property,
limited retail services in the area, and also
about the homeless persons being "captive" at the
location. Also, both Mr. Tapp and Coca Cola have
large office staffs coming and going at off hours
and security in the area remains a concern. A
private Agreement between Mr. Scott's clients and
Guadalupe has resulted in support for the pro-
posed zone change.
Staff comments were limited to a history of the
Ordinance change, a comment that the "base"
zoning district is consistent with the Code (M-1
and IHI) and that the public forum should provide
the primary basis of a decision. The Staff
supported one request made by Mr. Scott, that the
Specific Use Permit be tied to the duration of
ownership by the Guadalupe Economic Services
Corporation. Should the property sell, without
another zone change request, the land will revert
to the existing M-1 and IHI as zoned.
Since no negative comments were made during the
hearing, Staff supported recommendation of the
Planning and Zoning Commission for City Council
approval, subject to the following conditions:
1. That it be limited t❑ the
operation of a homeless shelter
and motel under the ownership of
Guadalupe Economic Services
Corporation.
2. That if the ownership changes, the
Specific Use Permit will expire.
Staff recommended approval.
0. V. Scott, representing Raymond Tapp and Coca
Cola Bottling Co., appeared to speak in favor of
this request at the Hearing before City Council.
There was n❑ ❑pposition to this request. Mayor
McMinn closed the hearing.
