A representative of First National Bank will appear to request installation of a traffic signal at Broadway and Avenue 0. Bill Barnett, Chairman ❑f the Board of Directors at First National Bank appeared to present this request. Although it was determined in 1985 that the traffic signal at Broadway and Avenue 0 did not meet the traffic and pedestrian volume requirements as stated in the Texas Manual on Uniform Traffic Control Devices (TMUTCD), First National Bank objected to the removal of the signal. Following passage by City Council of the ordinance on second reading January 9, 1986, the signal was removed January 27, 1986. 0n November 9, 1987, First National Bank asked for the intersection to be re-evaluated. Results of traffic and pedestrian counts showed that the intersection did not meet the warrants during any hour of the day. In addition, the TMUTCD requires that 150 pedestrians per hour for an eight -hour period should exist before a signal should be considered due to pedestrians only and the traffic count showed 25 pedestrians crossing Broadway at Avenue 0 during the highest one hour period of the day, from noon until 1:00 p.m. Bank officials appeared before the Citizens Traffic Commission on April 5 to appeal that decision and on a vote of 7-1, the CTC recommended installation of a semi -actuated signal at Broadway and Avenue 0. In making his request on behalf of First National Bank, Mr. Buddy Forbess made the following points: 1. Broadway has become a very fast street; 2. People cross block because faster, thus condition; in the middle of the they feel it is creating an unsafe 3. It has not been possible to get bank customers and building tenants to use the tunnel beneath Broadway from the parking building to the bank building; 4. First National downtown bank signals at any adjacent t❑ th 5. The bank would participate in installing the Bank is the only without traffic intersection e bank. be willing to the cost of signal. At the CTC meeting, David Woosley, Traffic Engineer, said traffic volumes on side streets are different at First National Bank than at other banks in the Central Business District, and each intersection should be evaluated 257 April 14, 1988 other banks in the Central Business District, and each intersection should be evaluated independently. Mr. Woosley also said the cost of installation of the signal is estimated at $15,000 to $20,000. CTC member Harold Chatman noted the efforts underway to revitalize the Central Business District and said special consideration should be given to the request to better serve one of the major buildings in the downtown area. CTC members decided that in order to maintain the integrity of the downtown area, the CTC should recommend installation of the signal even though it does not meet the traffic warrants. Mr. Woosley stated that if a signal is to be installed, it should be semi -actuated with detectors in the street and a pedestrian button. In this way, the traffic on Broadway will be stopped only when a car on Avenue 0 approaches the intersection or a pedestrian goes to the corner and pushes the button to activate the signal cycle. CTC members amended the motion to recommend a semi -actuated signal and the vote was 7-1 in favor of that recommendation. In written communication to City Council, Staff recommended that if Council approves this signal installation, that it should be noted that this decision was made to aid stabilization and improvement in the Central Business District and that the record reflect this overriding basis for approval, since warrants were not met. Staff further recommended that the cost be paid by First National Sank since this does not meet traffic warrants and that is the justification for traffic signals and public expenditures. Motion was made by Mayor Pro Tem Baker, seconded by Councilman Patterson to authorize installation of a semi -actuated traffic signal at Broadway and Avenue 0 at cost of Sank. Councilman Phillips stated his opinion that the Bank should not be responsible for 100% of the signal installation cost. Motion was made by Councilman Phillips, seconded by Councilman Nash to amend the above motion to split cost 50% for City and 50% for the Bank. Motion to amend carried: 7 Yeas; 0 Nays. Mayor Pro Tem Baker replied that because the warrants are not met, the Bank should bear the cost. Councilman Nash voiced his concern about setting precedent by installing this signal without its meeting the warrants. Mr. Barnett requested that a "regular" signal rather than a semi -actuated signal be installed. Councilman Carpenter requested Staff police "jaywalking" problem, if light is installed. 258 April 14, 1988 Motion was made by Councilman Phillips, seconded by Councilman Patterson to further amend original motion to stipulate installation of the signal on a fixed cycle. In 1983, representatives of the Lubbock Independent School District contacted the Parks and Recreation Department to advise of LISD's interest in providing the meals for this Program. City Staff was interested in working out an 271 April 14, 1988 88--47A-271-246 (28.) agreement with LISD, primarily because of potential savings in the cost of meals and the City Council subsequently approved Food Service Contracts with LISD, which provided meal costs of $1.75 in 1984, $1.80 in 1985, and $1.85 in 1986 and 1987. Lubbock Independent School District has again agreed to provide meals for the Title III program in 1988 at a cost of $1.85 per meal, the same cost as the prior two years. The Agreement contains exactly the same provisions as the 1987 Agreement whereas the City of Lubbock will have the right to inspect food preparations, approve menus and recipes, and to inspect food storage facilities. The City will continue to be responsible for providing transportation of the meals to the various sites and reserved the right to cancel the Agreement should the program not be funded. Current funding for the Title III Nutrition Program is provided by the State through September 30, 1988 and should the Grant not be renewed, Staff could cancel the Agreement with LISD. The Agreement with LISD would be effective through December 31, 1988. Motion was made by Councilman Patterson, seconded by Mayor Pro Tem Baker to authorize Resolution #2806 as recommended by Staff. McMINN, MAYOR ATTEST: /s/ Ranette Boyd Ranette Boyd, City Secretary APPROVED AS TO CONTENT: /s/ Rita P. Harmon Rita P. Harmon, Assistant City Manager APPROVED AS TO FORM: LsZ' Harold Willard Harold Willard, Assistant City Attorney The current Capital Budget includes a Project to engage the services of a Mechanical Engineering Firm for the purpose of examining the Civic Center HVAC System, developing RFP's for the maintenance of this equipment, and assisting with the evaluation of responses by maintenance firms. Last fall, the Staff prepared an RFP soliciting proposals from mechanical engineering firms. On October 29, two RFP's were received, and after a Staff Committee reviewed the proposals and concluded that the qualifications of the two firms were very comparable, it was decided that Staff should negotiate a Contract with the local firm, Fanning, Fanning and Associates. On January 27, Staff met with Jack Roberts of Fanning, Fanning and Associates to discuss the scope of the Project and the performance level expected. Mr. Roberts was advised that the City of Lubbock would expect an excellent performance level on the Civic Center HVAC Project. The meeting concluded with Staff requesting Mr. Roberts to prepare a proposed Contract. The proposed Contract provides that the Engineer will examine the heating and air conditioning equipment in the Civic Center and in the heating/cooling plant and a review of all available equipment data will be done. The Engineer will attempt to obtain from the equipment manufacturers data which the City does not possess and a report of findings will then be prepared. The Engineer will next prepare the manufacturers' recommended maintenance procedures and frequencies for each major piece of equipment. From this information, he will develop preliminary RFP's for equipment maintenance for review and approval. The Engineer will next complete the technical portion of the RFP's which will then be advertised. Following receipt of proposals from maintenance firms, the Engineer will provide assistance in evaluating the proposals and will provide recommendations. April 14, 1988 273 The Contract provides for compensation rates of $60 per hour for the principal Engineer, $50 for registered Engineers, $40 for Graduate Engineers, and $30/hour for support personnel and are within current market. The Contract states that it is estimated that total cost of work outlined will not exceed $12,500 and General Permanent Capital Maintenance funding is available for this Project. Consider Change Order #1 for Transformer reclassification and Disposal Bid #9545. The original Bid #9545 was to reclassify several existing PCB contaminated transformers to a non - PCB status. The work covered by the original hid involved removing and storing the PCB contaminated fluids and replacing these fluids with approved transformer oils. Texas Tech University was to take the stored fluids and destroy these fluids in a proposed research instal-lation in a manner which would he acceptable to the State of Texas and the Environmental Protection Agency. Since that time, Texas Tech has been unable to fund the research installation and consequently is unable to take any fluids. The original bidder will have the required equipment on site to transport the PCB contaminated fluids to the nearest destruction facility. 1f the Change Order #1 is approved, substantial savings will be possible due to allowing the transportation and destruction to be combined with the original hid. Staff estimated the savings to he approximately 30% under the recommended change order compared to the cost if the destruction of these fluids had to be rebid. The value of this Change Order is $21,504 and Staff recommended approval. Motion was made by Councilman Patterson, seconded by Councilman Phillips to approve Change Order #1 for Transformer reclassification and Disposal Bid #9545. Motion carried: 7 Yeas; 0 Nays. 274 April 14, 1988 88-41A-214-249 (31.) Consider Ordinance #9194 granting to Energas Company a franchise for street and alley use privileges. ORDINANCE #9194 ORDINANCE #9194 ORDINANCE OF THE CITY OF LUBBOCK, TEXAS GRANTING TO ENERGAS COMPANY, A TEXAS CORPORATION, WITH ITS PRINCIPAL OFFICE IN THE CITY OF DALLAS, DALLAS COUNTY, TEXAS, THE RIGHT TO CONDUCT IN SAID CITY OF LUBBOCK THE BUSINESS OF ACQUIRING, MAINTAINING, INSTALLING AND OPERATING A GAS PIPELINE SYSTEM FOR THE TRANSMISSION AND OISTRI8UTION OF NATURAL GAS TO RESIDENTIAL AND COMMERCIAL CUSTOMERS IN THE CITY OF LUBBOCK FOR LIGHT, HEAT, POWER AND OTHER PURPOSES, AND THE RIGHT TO USE THE STREETS, ALLEYS AND OTHER PUBLIC WAYS IN SAID CITY FOR SAID PURPOSES; PRESCRIBING THE CONOITIONS, LIMITATIONS AND RESTRICTIONS UNDER WHICH SAID PRIVILEGES MAY BE EXERCISED; AND PRESCRIBING A TERM OF FIFTEEN (15) YEARS FOR SAID FRANCHISE RIGHTS. In order for a utility to operate on the streets and alleys of the City of Lubbock, it is necessary for the City Council to give approval and for the franchise to compensate the City for the use of streets and alleys. The Ordinance granting that right to Energas Company expired in Oecember, 1987. The City Staff has been working with Energas for some time to negotiate the new Agreement and the Ordinance proposed at this time is basically the same as the old Ordinance except for the term. The old Ordinance was for 20 years and the proposed Ordinance is for 15 years. The fee for the use of the streets and alleys to be paid to the City is 3% of the gross receipts of Energas Company derived from doing business within the city limits of the City of Lubbock. The Ordinance also allows renegotiation of any item in the Ordinance except for the term upon 30 days notice by either party. The Mayor received two letters, one from the West Texas Home Builders Association and one from Roy Middleton, requesting that the City Council include a provision in the Street and Alley Use Ordinance that would require Energas to offer a 10-year pro-rata Contract on extensions for gas service in new developments. Until recently, the Contract offered by the Energas Company was for five years before the money paid for the extension was forfeited. Energas has recently extended those Contracts for two years and the new Contracts are written originally for seven years. City Attorney John Ross advised that this typically is not an item to be included in the Street and Alley Use Agreement because changing economic situations cause the need for changes in that Contract and if it is fixed in the 15- year Ordinance, an ordinance change would be required each time the Contract needed to be changed. Energas agreed to meet with the home builders and work out a solution to this request. Council decided not to include this fixed time period in the Ordinance. 275 April 14, 1988 Staff recommended the Ordinance as proposed is appropriate and in the best interest of the citizens of Lubbock and therefore recommended approval of the Ordinance.
