They also presented each with a school T-shirt. 79-38-203 -370 Representatives from John Knox Village were present to discuss with (6) Council recent changes in tax exem t bond financing for retirement villages. Appearances: Mark Carnahan, Executive Director Dr. Kenneth Berg, Founder Representatives from John Knox Village, referenced above, appeared before the Council to discuss changes in tax-exempt bond financing for retirement villages, and to invite the City to participate in this financing schedule with them. The recent IRS ruling allows a nonprofit organization, such as John Knox Village, to issue revenue bonds on behalf of a state or political subdivision. Then the political subdivision or city would obtain full legal title to the property financed by the bonds issued by the corporation upon retirement of the bonds. The information presented to the City has been referred to First Southwest Company, the City's financial advisors, and to Mr. Elbert Moro, The City's bond attorney, to determine what affect such bonding 204 PR 12 1979 79-38-204-371 (7) might have on the City's credit rating. The City is also securing information as to the effect defaults in the retirement of the bonds would have, i.e., whether or not the City would be responsible for paying those bonds and maintaining the facilities. Mr. Carnahan gave a brief description of the purpose of the Christian Service Organization, which established the John Knox Village in 1975; that it is housing provided for retired people; that it also provides additional services, such as health care nursing, and related services; that such an institution is constantly in search of long term financing; that the 63/20 bond issue, which is a federal program, initiated in 1963, is designed primarily for hospitals and retirement home installations. Dr. Berg, the founder of John Knox Village, supported Mr. Carnahan's statements as to the type of financing presented to the City for their consideration; that the 63/20 issue is primarily for hospitals and retirement village installations; that only one governmental entity is allowed to participate in such a financing plan. Following the presentation Mayor West indicated to them the matter had been referred to the above referenced officials representing the City's financial interest, and they would respond at the appropriate time. Representatives of the Citizens Traffic Commission appeared to recommend a traffic signal at the intersection of 13th Street and Slide Road. Appearance: Mike King The MacKenzie Junior High PTA requested that a traffic signal be installed at 13th and Slide Road, because of the congestion caused by school -related traffic and the inability to enter Slide Road. At the March meeting the Citizens Traffic Commission received the preliminary reports and determined that traffic volumne did not meet the warrants of a traffic signal there. The Commission recommended that curb parking on 13th Street be removed from a distance of 150 ft. on the east and west sides of Slide Road; it was also recommended that the Council authorize installation of a fully actuated traffic signal with pedestrian push buttons and walk -wait signals; that the existing flashing school lights be removed. The estimated cost of the traffic signal is $28,000.00, and could be considered in Revenue Sharing Funds for Entitlement XI. Following discussion, the motion was made by Councilman Aderton, seconded by Councilwoman Jordan to uphold the Commission's recommendations with the understanding that funding will be projected from Revenue Sharing Funds Entitlement XI. Motion carried: Mayor West, Mayor Pro Tem Henry, Councilwoman Jordan, Councilman Aderton and McAlister voting Yea; none voting Nay. 9:50 a.m. Mayor West announced that Executive Session will be held for the purpose of considering land acquisition in accordance with Article 6252-17, Section 2 V.A.T.S. 79-38-204-372 Lonnie Hollingsworth, Chairman of Electric Utilities Board appeared to (8) discuss feasibility study for future gener.ation needs for LP&L and to discuss ossibilities of making contracts for an interconnect agree ent. Mayor Pro Tem Henry presiding. Appearance: Lonnie Hollingsworth, Chairman of Electric Utilities Board At a recent meeting, the Electric Utilities Board recommended that a feasibility study be made for future generation and load growth needs for Lubbock Power & Light. This study could be paid for out of the funds set aside for reserve for system improvements authorized in the current budget. Because of the lead time in building additional generation facilities to handle LP&L's immediate needs, the Board also requested that the Council consider authorizing negotiations for an interconnect agreement as soon as possible. Mr. Hollingsworth, on behalf of the Board, requested the Council's authorization to proceed on these two items. With respect to the feasibility study, Mr. Hollingsworth indicated that it would take I II 205. APR 12 1979 F F -0 f R r F eight to ten months to get the feasibility study completed, and there would be a three to five year lead time to get the plant into operation. He therefore, requested permission to contact consultants for the purpose of doing a feasibility study. In response to Council query as to a possible conflict with the study committee, recently created, Mr. Hollingsworth responded that the feasibility study would not be in conflict; that the Board's positive action in this regard resulted from the study committee's recommendation not only for a feasibility study, but for the needed interconnect agreement. The feasibility study would coincide with the report of the committee. He also indicated that a new generating plant for LP&L could be completed approximately in 1982. There being no further discussion, the motion was made by Councilwoman Jordan, seconded by Councilman McAlister to accept the recommendations of the Board. Motion carried: Mayor Pro Tem Henry, Councilwoman Jordan, Councilmen Aderton and McAlister voting Yea; none voting Nay; Mayor West abstaining. 79-38-205-373 Lubbock County Hospital District re resentatives appeared to discuss the (9) following: 1. Rate change for ambulance service; 2. Use of City fire stations for EMS operations; Appearances: Gerald Bosworth, Executive Director, LCHD Jack Strong, President of LCHD Board Mr. Gerald Bosworth appeared before the Council to ask for proposed rate changes for ambulance service for EMS operations. Section 31-40 of Article 31 of the Lubbock Code of Ordinances provides that any changes in the approved rates charges and/or fees for emergency or transfer ambulance services shall be submitted to the City Council for approval. The following changes are requested: Item Present Rates Proposed Rates No transportation Charge $25.00 $25.00 Base Charge 45.00 60.00 Oxygen Charge 7.50 8.00 Night Charge 6.00 10.00 County Charge 6.00 7.00 Incubator Charge 25.00 30.00 Mr. Jack Strong, President of the LCHD Board, appeared before the Council to request their consideration of the EMS operations using, or possible use of the 30th and Ave. H fire station soon to be vacated by the Fire Department when the new station is ready for operation. Mr. Stong indicated that they were willing to lease or rent for a moderate sum, if the City did not have any other plans for the building's use. With respect to the building at 30th and Ave. H, City Manager Larry Cunningham indicated that they surveyed the various City departments and had received two (2) requests for the use of the building at 30th and H - one from the Fire Department on a temporary basis to use for storage of their reserve equipment until the fire station at 79th and Slide Road is completed, and the other from the Park and Recreation Department, who would like to use the 30th and Ave. H building for the Golden Gloves Program. The Golden Gloves Program is being required to relocate from its present building on Erskine Avenue since it does not meet the guidelines of the Bureau of Outdoor Recreation. The 30th and Avenue H Fire Station would provide a large enough area for a boxing ring, have access to showers which are presently at the site; however, the building is in need of some repair. With respect to housing of EMS vehicles and personnel at other fire stations, particularly the one located at 50th and Utica, Mayor West asked Fire Chief Tom Foster to address this subject. Chief Foster indicated that all personnel., equipment, and operations at their respective stations are under the control of the Fire Chief; that by allowing EMS personnel and vehicles to become a part of any fire station, the immediate problem is one of control or command, that is, that the personnel and equipment, vehicle, etc. of EMS would not be under the control of the Fire Chief, and that two separate operations under the same roof would be very ineffective and there would be a tendency to develop various disciplinary problems. Additionally, the fire stations are designed for a specific purpose, to house specific number of personnel, to contain specific types of equipment and the related facilities, and the two operations are not compatible in this area as well. Chief Foster complimented the EMS operations for the very I 1PR 1 2 1979 206 79--38-206-374 (11) 79-38-206-375 (12) 79-38-206-376 (13) 79-38-206-377 (14) effective work that they do, for a great service that they perform, and he appreciates their friendship and dedicated service and would like to keep this relationship in tact as it now exists. Subsequent discussion reflected that part of the LCHD's EMS operational problems results from very poor collections, particularily in the emergency runs - 36% of their gross runs are collected, according to Mr. Bosworth. Also he indicated that inflation and failure to recover costs have prompted the request rate change. Discussion also reflected that should EMS secure a possible portable building or temporary housing facilities, a mobile home, possibly it could be located on City -owned property, if said property is in the vicinity that would be benificial to the Southwest Lubbock operations. Following all discussion by all parties present, the motion was made by Councilwoman Jordan, seconded by Mayor Pro Tem Henry to negotiate with the Lubbock County Hospital District Board as to the rental or lease of the Fire Station located at 30th and Avenue H, for a reason- able sum, after the premises are vacated by the Fire Department, and to approve the proposed rate changes as reflected above. PUBLIC HEARINGS 79-38-214-397 Held a Public Hearing to discuss amending the franchise of Pioneer (34) Natural Gas Com any as of Lubbock. contained in Ordinance No. 5215 of the City 1 I I, t5 APR 1 2 1979 r r r r In accordance with notice published in the Lubbock Avalanche Journal on March 15, March 22 and March 29, 1979, a public hearing on the above referenced manner was held. Mayor Pro Tem Henry presiding. At the March 8, 1979 City Council Meeting, the Council considered the request to Pioneer Natural Gas to extend its gas mains, said request requiring an amendment to the existing franchise. Therefore, a public hearing, referenced above, was held to allow for the building trade and related areas to express their comments and viewpoints. Copies of the ordinance were sent to the following: Brownie Brownlee, Executive Director, Lubbock Board of Realtors Darryl Berry, President, Lubbock Board of Realtors Sam Reyes, President, West Texas Homebuilders Association M. B. Smith, Executive Director, West Texas Homebuilders Association H. R. Bundock Cecil Jennings Ken Flagg Grey Lewis, (Assistant Manager, Lubbock Chamber of Commerce) The Board of Realtors responded to the effect that they would make their report at the public hearing. Mr. Bundock, a general contractor, indicated that the referenced matter affected general contractors very little and they had no objection. Appearances: Mr. M. D. LaGrone, Vice President Pioneer Natural Gas Cecil Jennings, West Texas Homebuilders Association Mr. LaGrone appeared indicating that the proposed extension of 75 feet of gas mains, particularily in new subdivisions, resulted as a compromise from the previous 150 foot extension, and requested the Council's approval of this amendment. Mr. Jennings appeared on behalf of the West Texas Homebuilders Association to object to the 75 foot extension, reflecting that it would work a hardship on the developer in that the developer had to absorb the initial deposit required for having a new subdivision piped; that the developer was penalized should a prospective new customer not tie onto the main line as a result of purchasing an all electric home, thus eliminating the developer from receiving a refund from the gas company; that the developer was charged on the basis of the front footage of each lot, rather than the linear footage of the line located in the alley at the rear of each lot, thus working an additional financial hardship on the developer. Additional discussion ensued as to the meaning of Mr. Jennings' comments, reflecting a lack of understanding amoung the personnel of Pioneer Natural Gas, as well as Council members. Motion was made by Councilman McAlister, seconded by Councilwoman Jordan that the hearing be recessed to allow members of Pioneer Natural Gas and Mr. Jennings to meet and discuss the matter of front footage vs. linear footage on which each refund is based, and to reconvene at 1:15 p.m. Motion carried: Mayor Pro Tem Henry, Councilwoman Jordan, Councilmen Aderton and McAlister voting Yea; none voting Nay; Mayor West abstaining. At 11:55 a.m., the Pioneer Natural Gas delegation and Mr. Jennings reappeared in Council Chambers and indicated that they were willing to continue with the hearing. The motion was made by Councilwoman Jordan, seconded by Councilman McAlister to remove the matter from the "tabled" status. Motion carried: Mayor Pro Tem Henry, Councilwoman Jordan, Councilmen Aderton and McAlister voting Yea; none voting Nay; Mayor West abstaining. Mr. Jennings indicated that the discrepancy was a matter of interpre- tation between the two parties; that Pioneer management members were unaware of the change of procedures which took place about two years ago; and that both parties are now in agreement with the appropriate interpretation placed upon the developer, and on behalf of the Association he would withdraw his objection; that Pioneer management had agreed to base the developer's refund on the linear footage, instead of the front footage. There being no further discussion, Mayor Pro Tem Henry declared the hearing closed. Consider Ordim Pioneer Natura. The motion died for lack of second. Apparently there was still some confusion on the part of some of the Council members as to the location of the main lines, the matter of 75 foot extension, the matter of the means by which the individual customer ties onto the main line, and related items. Following clarification of these points by Mr. Larry Shortes, Vice President of Operations, Pioneer Natural Gas, and there being no further discussion, the motion was again made by Councilman Aderton, seconded by Councilman McAlister to pass said ordinance on second and final reading. Motion carried: Mayor Pro Tem Henry, Councilwoman Jordan, Councilmen Aderton and McAlister voting Yea; none voting Nay; Mayor West abstaining. 79-38-216-398 Hold a 2ublic hearing on the 1979 Paving Assessment Program. (35) In accordance with Notice published in the Lubbock Avalanche -Journal on March 18, March 25, and April 1, 1979, a public hearing was held on the above matter. 10' Wide alley (a) A-460-68 - E-W Alley between 59th & 60th Sts. Appearances: Mr. Darrell Phillips, 2802 - 60th Richard Duncan, 2826 - 60th James L. Bromley, 2818 - 60th Richard E. Hollingshead, 2822 - 60th Derry Harding, President, Parsons PTA The discussion initiated by the property owners, referenced above, reflected that they, of which there are 13, are bearing the financial brunt for something they do not want; that the alley in question is a speedway surfaced with caliche, which means they "eat" dust everyday; that traffic is excessive and congested, all of which is school related, or playground related (soccer, football, etc.); that there has been a vehicle count by the property owners of as many as 300 vehicles using that alley in one day's time; that the purpose of an alley is for access to the dumpsters and for maintenance/ service calls, but that it is not extremely hazardous due to the traffic; that the issue is between the School system and the City, as they are the ones who have designated its use; that there is no other choice now but to declare it a street, and therefore it should be properly paved with curb and gutter; that it should be designated one way, preferably West -to - East; that there whould be a stop sign on the East end (Canton) to provide safety for children on foot crossing the alley; that there should be a school crossing guard at the West end of the alley to provide safety for children on foot, inasmuch as the entering traffic is extremely heavy. Mr. Harding indicated that the PTA and the School were desirous of paving the alley; that there was need for additional parking and expanded loading -unloading zone to alleviate the congestion; that the PTA did not have any funds to absorb any of the paving costs, inasmuch as they were committed to an indebtedness for air conditioning. At one point in the discussion, Mr. Richard Duncan indicated that in a private conversation with Mr. Charles Waters, President of the LISD Board, Mr. Waters stated the School would be willing to pay one-half of the paving costs. After careful investigation of this statement, the motion was made by Mayor Pro Tem Henry, seconded by Councilman Aderton to hold any further discussion and decision until contact could be made with Mr. Waters by phone, on this day, to determine the validity of his statement. Motion carried. In response to the City Manager's inquiry, Mr. Waters indicated that the School, would be willing to pay the other half of the paving costs, to -wit: The City pay one-half, the School pay one-half, thus deleting any assessment to the property owners. Motion was then made by Mayor Pro Tem Henry, seconded by Councilman Aderton to approve the referenced item for the 1979 Paving Project, with the School to pay one-half of the paving costs, and the City to pay one-half of the paving costs, thus deleting any assessment to the property owners. Motion carried: Mayor West, Mayor Pro Tem Henry, Councilwoman Jordan, Councilman Aderton and McAlister voting Yea; none voting Nay. F11 I [1 I 21 APR 12 1979 G r r r Mayor Pro Tem Henry also requested the matter of a stop sign being installed at the East end, and the alley being designated one-way be placed on the agenda April 26, 1979 for consideration. (b) A-460-69 - E-W Alley between 49th & 50th Appearances: Donald Neuman, 4009 - 49th 0. V. Scott, Attorney, on behalf of commercial property owners Discussion by the parties listed above reflected that neither the residents nor the commercial property owners wished to have this alley paved; that at the time the petition was signed in the Fall of 1978, the residents were under the impression that the City was to pay for all costs; that only when they received their assessment letters did they realize otherwise. In response to Council query, W. Watson, City Engineer, responded that petitions were circulated under the old policy which was that when residential property backed -up to commercial property, Property owners (residential) were not required to absorb any of the costs; that subsequent to the petitions circulating, the Council changed the policy which provided for 90% to be paid by commercial property, and 10% by the City. Under the new policy, the commercial property owners pay 90% of their half, the City paying 10% of that same portion; that the residential property owners pay 50% of their half and the City paying 50% of the residential half. Following discussion, the motion was made by Council woman Jordan, seconded by Councilman McAlister to delete this item from the paving program. Motion carried: Mayor West, Mayor Pro Tem Henry, Councilwoman Jordan, Councilman Aderton and McAlister voting Yea; none voting Nay. (c) A-460-70 - E-W Alley between 74th & 75th Appearances: Clyde Kelsey, Jr., 3307-A - 74th St. Elliott Owen, 3306 - 75th St. Wayne Davis, on behalf of Bob Hughes, 3302 - 75th Mr. Kelsey indicated he owned two duplexes (4 units) at the corner of Indiana and Hartford, the alley in question; that the alley is surfaced with a clay -substance; that during torrential rains, it is literally impassible, the residents being required to park in the street, as they are unable to enter their drive and/or garage, all of which have rear entrances; and he was very much in favor of the paving. Mr. Owen indicated that the paving of the alley would not be beneficial to the property owners on 75th Street, and opposed the paving project. Mr. Davis appeared on behalf of Bob Hughes, who expressed his opposition in a letter addressed to the Council, read by Mr. Davis. Following discussion, the motion was made by Councilman McAlister, seconded by Councilwoman Jordan to delete the referenced item from the 1979 Paving Program. Motion carried: Mayor West, Mayor Pro Tem Henry, Councilwoman Jordan, Councilmen Aderton and McAlister voting Yea; none voting Nay. Mr. Kelsey again requested to speak, making inquiry as to what alternatives are available to him for the remedy of his problem, to which the response was that he would need to confer with the Engineering Department to see.if the alley could be cut and graded to allow for better drainage. Members of the Engineering staff present at the hearing indicated their willingness to work with Mr. Kelsey. (d) A-460-71 - N-SOE -W AlleX between Joliet and Indiana Dr. Appearance: Mr. Merlin Warren, 7911 Joilet This item was filed last year, but was turned down, and Mr. Warren indicated the property owners had changed their mind about having it paved, inasmuch as the cost policy has been changed. Additionally, it was indicated that the only one to benefit from the paving was the apartment complex located at 7906 Indiana Place (Coachlight of Lubbock). Motion was made by Mayor Pro Tem Henry, seconded by Councilman Aderton to delete this item from the 1979 Paving Program. Motion carried: Mayor West, Mayor Pro Tem Henry, Councilwoman Jordan, Councilmen Aderton and McAlister voting Yea; none voting Nay. wi8 4?R i % 1979 (e) A-460 - 72 - E-W Alley between 42nd & 43rd Appearance: James G. Baker, 3307 -- 42nd Mr. Baker indicated that the consensus of all property owners was favorable to the paving program, with the exception of Dude Buster, 3312 - 43rd, was was unavailable for comment, but had indicated in the past his concurrence to the program. Motion was made by Councilman Aderton, seconded by Councilman McAlister to approve referenced item for the 1979 Paving Program. Motion carried: Mayor West, Councilwoman Jordan, Councilman Aderton and McAlister voting Yea; none voting Nay; Mayor Pro Tem Henry abstaining. :I (f) A-460-73 - N-S-E-W Alley between Norwood & Norfolk Appearance: Ken Williams, 6606 Norfolk Mr. Williams did not express any opposition to the paving program, but did indicate he had a unique problem, in that his property had frontage on two sides (a pie -shaped lot), and requested any relief on the assessment amounts, if possible. Willie Watson, City Engineer, indicated to the Council that it had been the Council's policy in the past that where there were specific instances of hardship, the Council used their prerogative and determined a lesser amount of footage; he therefore recommended that the Council consider reducing Mr. William's footage to 120'. Motion was made by Councilwoman Jordan, seconded by Councilman McAlister to approve the referenced item for the 1979 Paving Program, granting the appropriate relief to the property owner at 6606 Norfolk, as recommended by the City Engineer. Motion carried: Mayor West, Mayor Pro Tem Henry, Councilwoman Jordan, Councilmen Aderton and McAlister voting Yea; none voting Nay. 36' Wide Street (g) #2234-80 - Wayne Avenue from 58th to 59th Sts. City Engineer Watson called to the Council's attention that the items under this category reflected a "front rate" and a "side rate"; that the side rate was too high as determined by the appraiser, and therefore recommended implementing the side rate be only the curb and gutter rate, ($4.90). Motion was made by Mayor Pro Tem Henry, seconded by Councilwoman Jordan to approve referenced item for the 1979 Paving Program, implementing the side rate are recommended by the City Engineer. There being no strong indication of support from any of the property owners, the motion was made by Mayor Pro Tem Henry, seconded by Councilman Aderton to delete this item from the 1979 Paving Program. He Requested (1) that this matter be delayed pending dispositon of the water well, or in the alternative (2) some action taken with respect to averting the removal of the water well from the right-of-way portion. Mr. Watson, City Engineer, indicated that the well was located in the parkway area, and would not be involved in the needed right-of-way, to install curb and gutter and paving, but area of well should be retained by owner. Appearance: Bill Cowson, Pastor, Lakeridge Methodist Church 4701 - 82nd Mr. Cowson indicated that the church was newly organized and very deficient in funds; that their frontage was based on commercial rate, and requested some relief in the reappriasal of the property to allow for the lower residential rate, plus the curb and gutter costs.
